3 Gregg Travis opened the meeting at 7 : 05 PM .

26 Ms . Brock presented to the Planning Board her recommendations regarding the Draft of the Proposed
27 Zoning Amendments , Junk Storage Ordinance and Adult Entertainment Ordinance .
28 We began with the Site Plan Review for different districts . The presence of two procedures is
29 confusing. The recommendation was that we have just one section setting out the procedure, with any
30 differences in procedures for the RA district be spelled out . Additional information regarding Site Plan
31 Review should be specific to the maximum extent possible in order for processing under the Planning
32 Board .
33 Violation and Penalties the recommendation was to add a provision stating civil penalties . The
34 advantage to adding this makes it much easier for the Town to collect in the actions , as well as
35 enhancing the penalties . The suggestion was to use the wording directly from the Town Law.
36 The Town Board must establish how many members are on the Zoning Board of Appeals , their
37 procedure for removal of members, and alternate members if a conflict of interest exists . The Planning
38 Board is not mentioned at all , which they need to have the same . Rich John will research/confirm this .
39 Agricultural data statement, Town Law §283-a should be integrated into the ordinance .
40 There are a number of discrepancies between Schedule I and the ordinance . Names of districts and when
41 Special Conditions/Special Permits are required . Ms . Brock will go back over the ordinance and
• Schedule Ito locate all the discrepancies .
43 Junk Storage Ordinance is inconsistent with our Ordinance . Section 10 of the Municipal Home Rule
44 Law talks about when you can vary from Town Law by enacting a local law . We have § 130 ( 15) of

1 Town Law which we may want to check with Rich John to see why that was enacted under that
2authority. Under Junk Vehicles old and secondhand should be scratched . It was suggested that we
•�i change Two (2) junk vehicles to read One ( 1 ) or more . In Junkyard Regulations we mention Junk
4 Storage, what we really are talking about is Junkyard. In screening of the Junkyard it states a fence
5 needs to be put up , but then it also says screening can be permitted by planting. The procedure for
6 renewal of a Junkyard Permit should be listed . Ms . Brock will check to see if there is a State Statue on
7 the surround of a Junkyard and get back to the Board . Penalties should be made the same as our main
8 ordinance.
9 Adult Entertainment number (4) the word regularly should be inserted after the word is. Number (7),
10 conflicts with number (2) . Number (7) definition should be changed , delete films and tailor more for
11 videos . The word sold should be changed to rented .
12 Specified Anatomical Areas should be 1 or 2 , not and .
13 Restrictions as far as boundaries should be reviewed . Wording such as adult use and defined herein is
14 not defined . Under Location In Rural Agricultural District, E-3 & 4 the word premises needs to be
15 interjected in another location and scratched from where it is .
16 In the large ordinance Ms . Brock spoke about certain items that she thought were important.
17 Under Exceptions we need to think about regulating heights on certain things . Obstruction of Vision
18 should have Structures constructed after the date this provision becomes effective . The time frame
19 for planting (30 days) is ok, however more time is needed to move larger items like, fences, houses etc .
20 Rubbish needs a definition . Ms . Brock will provide the Board with a copy of the City ' s Exterior
21 Property Maintenance Ordinance that has a lot of definitions that the Planning Board can use. Under
22 Intent the language needs to be changed to include all other purposes of the Comprehensive Plan .
The Standards for Site Plan Review seems limited . If we reference other sections which spell out what
we we ' re trying to do will give more guidance . Applicability 701 .4. 1 should be taken out. Ms . Brock
25 will check with other ordinances to see how they worked in their landscaping and buffering and provide
26 copies to the Board . 704 . 2 & 704.3 should be deleted as we have a new Town Law. We may want to
27 have Special Conditions apply to Drive Thrus , they apply to Restaurants and Taverns . Dumpster or
28 container may be added to 802 . 13 a. We need a definition for Vehicle Wrecking and Yard . It was
29 recommended that we add a # c to 802 . 19 stating, No airbag propellant shall be stored anywhere in
30 the salvage area site in the Town of Lansing. Under Protest we need to add notes from the Town
31 Law . § 281 of Article 16 of Town Law does not make sense in the paragraph under Approval of Plats :
32 Modifications of Zoning Regulations . We should review the definitions for Dwelling, Townhouse and
33 Dwelling, Two-Family.
34 Nancy Loncto motioned to adjourn this meeting at 9 : 45 . Lin Davidson seconded. VOTE : ALL IN
35 FAVOR. MOTION CARRIED UNANIMOUSLY .

Draft Changes for R3 District
402 . 5 Residential Mixed Use Transitional (R- 3 ) District
The intent of the R3 District is to designate areas where the use of the land will
change from the most traditional uses of the community to the most dense
residential development depending on introduction of water and sewerage.
Regulations and standards in the R3 District are intended to guide density and
establish the criteria and conditions for development of the land driven by the
reality of land values .
