29 Gregg Travis opened the meeting at 7 : 29 PM .

31 Public Hearing, Andrew Boerman —1 Lot Subdivision — Brickyard & Wilson
32 Greg Travis read the legal notice and opened the public hearing . No Public comment .
33 Brad Griffin : Did the Town actually move to accept the property?
34 Richard Platt : Yes , and they will be holding their own public hearing tomorrow night 10/ 16/02 on it.
35 Larry Sharpsteen : Have we received any comment from the County on this ?
36 Richard Platt : No , I have nothing in the file .
37 Lin Davidson motioned to suspend the Public Hearing until 7 : 45 PM for lack of Public comment. Larry
38 Sharpsteen seconded . VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY.
39 Ernest & Helen Armstrong, 4-Lot Subdivision - Parcel #38 . - 1 - 1 . 6 Armstrong Road .
• Mr. Platt explained to the Board that Mrs . Armstrong would like to sub-divide the above parcel into 4
41 additional lots . The Board previously approved a 1 - lot subdivision on this parcel on June 6 , 2002 . They
42 would end up with a 5 lot Major Subdivision . Mr. Platt explained to her that she should at least have a
43 20 ' strip to each lot .

1 Viola Miller : What ' s the land where the turn around is indicated ? Is that more land that could be later
2 developed?
03 Richard Platt : No , that ' s one of the lots . The plans are showing a cul-de-sac , they don ' t want to build a
4 public road . Do we want the 20 ' strip driveways coming out?
5 Gregg Travis : I think the answer is no .
6 Lin Davidson : I think we would have to hear from her proposing a private road to the town . Then
7 building a road to town specs that would handle safety vehicles .
8 Larry Sharpsteen : This neighborhood is entirely different then the nature of the one on Collins Road
9 that has all those flag lots that really none of us are crazy about . This is potential sewer and water, also a
10 road that is a core for more formal subdivision type development with roads cutting all the way through
11 them . If coming with the nature of the neighborhood, 6 flag lots for this location would not be suggested .
12 Gregg Travis : I agree with Larry .
13 Larry Sharpsteen : She can talk to the town about building a private road to town specs .
14 Brad Griffin : Our previous approval of these 20 ' rights of way flag lot situations were truly exceptional , not
15 meant to be standard for the development of the town . The other point that Lin brought up was, whatever kind of
16 road goes in there I think they ' d look for that standard Hammer Head at the end rather than that round turn around
17 at the end of the road .
18 Donald Worsell — 1996 Subdivision , Emmons Road
19 Mr. Platt explained to the Board that Mr. Worsell had his subdivision approved and a Public Hearing
20 was held , however, he neglected to file his map with the County. Mr. Platt advised the Board that he
21 had 60 days from endorsement of the Planning Board to file .
• Larry Sharpsteen : Mr. Worsell can present all the information that was given before so we can review
23 and make sure questions like drainage was handled . We can take it on as a Final Plat and then go from
24 there as to when we will hold our Public Hearing .
25 7 : 58 PM Boerman Public Hearing Reopened
26 Gregg Travis questioned the audience to see if anyone had questions/comments regarding the Boerman
27 Subdivision .
28 Larry Sharpsteen : Motioned to close the Public Hearing for lack of public comment . Brad Griffin
29 seconded . VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY .
30 Brad Griffin : I would move that we approve the subdivision on the basis of the information that was
31 provided to the Planning Board .
32 Larry Sharpsteen seconded . VOTE : ALL 1N FAVOR. MOTION CARRIED UNANIMOUSLY .
33 Porous Materials, Inc . Site Plan Approval
34 Richard Holt presented to the Board the same site plan with a few revisions . The issues that were raised
35 at the last meeting have been addressed and attached to the plans . (Lighting, tree species) . The retention
36 basin has been engineered to retain a lOyear storm in the front swale . The other revision is that we are
37 requesting to move everything closer to the road (approximately 20 ' ) for future growth . Nothing has
38 changed on the project . We also have labeled the actual trees that we ' re going to plant, also, their size .
Lin Davidson : Would there be some kind of hedge in front of the cars?

Rick Holt : They have not planned on that yet. The storm water is actually designed to sheet flow across
41 the parking lot into the swale in the front .

1 Richard Platt : Do you have a copy of the SPDES report?
Rick Holt : I think Jason is going to take care of that . He will submit it with our building drawings , also
IF our approved septic tank design .
4 Gregg Travis : Which way does the 12" culvert drain ?
5 Rick Holt : It drains to the left towards UPS .
6 Brad Griffin : The term "Forest" designates something that ' s there now , or it will be there?
7 Rick Holt : No that is existing. It ' s pretty dense . Also , when we did the lay out of the further expansion
8 they wanted to maintain a wooded buffer in the back and not have to cut the whole place out .
9 Lin Davidson : Motioned to approve Site Plan as submitted . Brad Griffin seconded . VOTE : ALL IN
10 FAVOR. MOTION CARRIED UNANIMOUSLY .

12 Tuddenham - Review of Application for 1 Lot subdivision , Parcel # 36- 1 - 12 . 1 Teeter

14 Larry Sharpsteen : Recused himself from voting.
15 Mr. Platt explained to the Board that the Tuddenham ' s would like to sell the 100-year-old farm home to
16 a developer, who in turn will demolish and build a new home . Mr. Platt presented a preliminary drawing
17 to the Board . The Tuddenham ' s will go ahead and have it surveyed if the Board feels it is an acceptable
18 proposal .
19 Gregg Travis : How much land is it?
• Richard Platt : 3 . 98 acres total . The old house would go with 1 acre.
21 Larry Sharpsteen : The developer is hoping to tear this house down and build before the sewer goes in .
22 They will connect to the existing system and then connect to the sewer when it comes up over the hill .

24 Gregg Travis : The consensus of the Board is that it ' s doable .

26 Andra Benson , Informal Discussion — 1 Lot Subdivision
27 Mr. Platt explained to the Board that Mr. & Mrs . Benson would like to give their son a 2 -acre parcel .
28 The Parcel would be up at the top of the hill for the view . There is a 9 - acre field that they work so I
29 roughly calculated 9 acres would be 517 ' . There is a lane that comes up near that property that they
30 probably will continue to use. For future use of that 9 -acre field Mr. Platt advised Mrs . Benson to leave
31 at least a 20 ' access to that .
32 Mrs . Benson : Woods border the lot .
33 Gregg Travis : Would you want to leave 60 ' instead of 20 ' between the 2 lots . If you leave a 60 ' than
34 you can divide the 9 acres into other lots .
35 Mrs . Benson : Maybe I miss spoke when I talked to Mr. Platt, the whole thing is 9 acres less the 2 acre
36 would be 7 total .
The Board encouraged Mrs . Benson to leave the 60 ' strip for future development .

1 Mr. Fabbroni presented to the Board a new packet containing information from John Andersson at the
2 Tompkins County Health Department stating that 7 of the 8 lots sand filters could be used. The 8th lot
a3 needed to be larger. Without an acceptable pert on that lot, you have to have at least a 250 ' circle in it .
4 The earlier drawing presented their was an 8t1' lot that was under 150 ' wide by 500 ' deep . They now
5 have included the empty acreage between what they called before, lot 19 and 15 . One lot is in access of
6 5 acres . If we can get acceptable fill in the area for a fill system , they might be amenable to splitting that
7 lot into 2 . We are before the Board to consolidate the preliminary submittal, lot 19 with the empty
8 acreage to make one large lot . (8th lot) One other issue with John. Andersson is there is a mapped stream
9 on the tax maps that comes from the existing crossing under the existing road and through that lot . Mr.
10 Fabbronihas shown that drainage way slightly relocated so that it is 100 ' away from any system that
11 might be put in .
12 Larry Sharpsteen : Is that a seasonable stream ?
13 Larry Fabbroni : Yes . Most of the surface drainage comes off of the Bland Field to the West of the
14 project. Because the land is so flat, the intention is to have 3 culverts crossings that are only 15 inches in
15 size . This caries the drainage through the project without redirecting or accumulating it . It will be
16 brought through to Warren Road at the existing Crossing, or North of the lot 27 .
17 Bud Shattuck: Why aren ' t you finishing your road up to the end of that instead of stopping in between?
18 Larry Fabbroni : Mr. Thaler wanted to stay out of that field as much as he could. We will leave the field
19 until Phase V . Someone is farming it on and off.
20 Bud Shattuck : If you finish that road you would only be excluding that top lot, you wouldn ' t necessarily
21 be excluding that field as a matter of fact you wouldn ' t even be dipping into it . You can have your turn
22 at the end where the proposed road is .
iLarry Fabbroni : There ' s other issues which I sort of hint at in the report as far as the water pressure on
24 that upper lot. I have spoke with Dave Herrick and I ' mnot sure how that ' s going to unfold . Part of the
25 intentions was to run a water main down from the tank up to Warren Road at some point . That will not
26 alleviate the water problems on those two lots .
27 Gregg Travis : On lot 19 , what is it that the Health Department would require 'for a larger size?
28 Larry Fabbroni : It all goes back to separation of systems , poor perk .
29 Richard Thaler : I ' ve been approached by Mr. Bland to see if I would buy him out, I probably will . If you
30 remember when we originally brought the plan, I was asked to make sure there was a connection for that
31 road . I would like very much to have water district 9 connected to water district 14, I think that will
32 really help with that water pressure in that whole area. My feeling is that I would really like to do is
33 keep the size of the lots large where the trees are. When we go into the open field is to take them. down
34 to maybe an acre and a half.
35 Bud Shattuck : How much land is in the Bland property?
36 Richard Thaler : He told me that he wanted to keep 8 acres and he wanted to sell me 16 .
37 Brad. Griffin : I want to make sure we clearly understand what remedy you seek from us this evening?
38 Richard Thaler: We ' re looking to change the phase that has the lots that we ' re going to be selling.
39 Viola Miller : I make the motion that we approve it as we see it at this point . Larry Sharpsteen seconded.

• Bud Shattuck : Would your future road as it goes West line up with Pheasant Walk?

I Cherry Road- Lent Property
2 Mr. Platt explained to the Board that the County purchased the Lent property for the airport. The airport
IF should not require a subdivision .
4 Larry Sharpsteen : We strongly suggest due to the proximity of the airport that that not be used for any
5 kind of residential construction .
6 Bud Shattuck : Right, it won ' t be used as residential ; they ' re looking at it as light manufacturing .
7 Larry Sharpsteen : It ' s not zoned that way.
8 Town Barn Road
9 Mr. Platt advised the Board that Town Barn Road is a public road .
10 Cima
11 Mr. Platt checked with Rich John and the Cima ' s do own that 60 ' strip of property that was never
12 dedicated to the town .
13 Lin Davidson : Is that an easement like we ' ve left on other 60 ' strips in other cases? Is the status of that
14 60 ' strip different than the status of the 60 ' strip on Eastlake or Autumn Ridge? Another words we ' ve
15 left these in all these developments .
16 Brad Griffin : I don ' t think we had a question about ownership , unless I misunderstood .
17 Bud Shattuck : Yes it ' s theirs . What it shows is we have an easement and it goes into the other property.
18 The reason for that is to have access and egress out of that other property. What Candy Cima wants to
19 do is build on it . Suggestions of the Planning Board were to move it back to the East off the edge of the
easement .
21 Brad Griffin : Somewhere there ' s got to be some reference to this easement .
22 Lin Davidson : This should show up on the final plat .
23 Gregg Travis : The map we saw it said either proposed road or future road . It did not use the word
24 easement .
25 Viola Miller : I think if we want to redo the PDA and decide that there is no reason for it to be there and
26 change it, we could . I think it should be acted on because it was on the final map .
27 Brad Griffin : What Mrs . Cima is saying is that nothing has changed .
28 Lin Davidson : She came in here asking for a Guest House, that ' s a change .
29 Larry Sharpsteen : In context she ' s asking for a Guest House because as far as their concerned, there
30 was never any easement . The reason she ' s asking is because it ' s a departure from the original PDA .
31 Brad Griffin : I would say we would have to make reference to the original plat, signed map to see
32 whether or not there is anything in the way of an easement filed on that map .
33 Richard Platt : I don ' t believe it shows an easement, it does show the future road .
34 Lin Davidson : I say the best we can do for Candy Cima is to give her a chance to build her Guest
35 Houses out of the way of the road with the idea that that may be a road some day.
36 Viola Miller: I think there ' s a piece of land in there that it might need to go to .
Larry Sharpsteen : It would also be a good record to see how the Village wants to cooperative with the
) a Town . There ' s an alternate place for that road , it could go on the West side of the Water Tower, in the
39 Village connecting to Horizon Drive .

1 Lin Davidson : One option is to go make a deal with the Village; the other option is to move the location
2 of the Guest House so that the future road is open and put the Guest House in the Village .
03 Sun Path
4 Mr. Platt presented the Board Members with a letter from a resident at Sun Path regarding the proposed
5 water hook up .
6 Budd Shattuck : Presented the original map dated 1975 showing the roads going both ways, also ,
7 minutes from 1974 on . Mr . John and Mr. Shattuck researched them all . in 1984 Mr . O ' rear came back
8 in and had removed the road . He was under the assumption that he could do either/or. That is what we
9 are holding him to . Today in a meeting with Mr. Simkin , Mr. O ' rear, Mr. John, Mr. Farkas and myself
10 we advised them that they will now have to build a road even though the other property doesn ' t have
11 any plans right now they are mandated to come down and build that 410 ' to the edge and bring water all
12 the way down to the edge also .
13 Viola Miller : You say "they" who are they?
14 Bud Shattuck : Boris Simkin , that ' s if he still wants to buy the land . Mr. Simkin and Mr. O ' rear now
15 know that this road has to be built, water has to come down and a new junction box has to be installed .
16 They know the Kammen ' s property is land locked , so all this has to be done before any subdivision . Mr.
17 John advised Boris Simkin that he could build 3 lots as long as the excess money came to the Town for
18 the escrow account .

31 Gregg Travis advised the Board Members that Susan Brock would be at our next meeting on October
32 28 , 2002 with the finished product as well as recommendations for the Board . Brad Griffin presented
33 draft changes of the R3 District (definitions) to Gregg Travis for discussion at the next meeting. Rachel
34 will type up and forward copies to all Board Members as well as Susan Brock for review prior to our
35 next meeting.
36 Mr. Platt requested that the County Planning Department provide him with a map of all the Mobile
37 Homes in Lansing. He is concerned that a portion of Scofield Road will be effected if we change the
38district to an R2 . New mobile homes are not allowed there . It was mentioned that the Board discuss this
issue with someone who is familiar with Real Estate Law .
40 Mr. Travis advised the Board Members that out of one of our budgets , of $ 3 , 500 . 00, so far this year we
41 have expended $ 1 , 078 . 00 leaving a balance of $2 ,422 . 00 to spend before the end of the year.
