Gregg Travis opened the meeting at 7 : 45 PM
Frank Rogan Public Hearing, 4 Lot Subdivision , Collins Road Parcel #38.- 1 -7. 152.
Mr. Platt distributed a new map with contours, along with a pamphlet that Gary Wood provided
for Mr. Rogan . On the 4t1 page of the pamphlet there seems to be a problem with the driveway
width, they should be all 20 ' , also, page 5 under miscellaneous (5 . 3 ) it should read that it is in an
agricultural district, however, it is not receiving agricultural exemption . The Planning Board is
requesting to have a copy of the deed restrictions, specifically the restrictions for subdividing.
Since two maps with different information have been provided to us, Mr. Wood has requested
that we combine the information and use them, instead of having a 3r`' map made up . On the TG
Miller map they have 2 "C " parcels . One parcel needs to be listed a "D" as shown on Mr.
Wood ' s drawings .
Mr. Travis read the notice listed in the Ithaca Journal regarding the Rogan Public Hearing. The
Public Hearing was opened at 7 : 57 PM .
Rod Kearl : May I take a look at the plans?
Gregg Travis : Mr. Kearl do you have a direct interest in this that you would like for us to wait for
you to review that and then give us comments , or is this just for your information?
Rod Kearl : Just for my information .
• No comments from the Public or Board Members . The Public hearing was left open .

Porous Materials , Inc . Dutch Mill Road, Parcel # 39- 1 -50 .3 Site Plan
Review
Jason Demarest from Tallman & Demarest Architects presented the proposed plan for
Porous Materials , Inc . to the Board . Porous Materials have a 2- 1/2 acre lot zoned for the
use that is proposed . The building will be 17 ,400 SF that will hold
office/research/manufacturing facility for scientific measuring devices . There are
currently 25 employees with a 40 space parking area . That is intended for the occasional
visitor, also potential growth . Currently they have parking at the front that transitions to
gravel access driveway in the back . The front facade will be made of acrylic stucco,
metal frame building, metal roof system and aluminum frame window units across the
front. Landscaping will consist of trees , some ground plantings as well probably around
the sign and in front of the building . That budget is a little limited , the project budget is
fairly tight so we ' re trying to get everything in . We talking about increasing the current
drainage swale that is at the front of the property by making it a little larger as a retention
basin . All the parking will basically sheet flow into that basin and hopefully that will
filter anything before it heads on down the line . The actual size is twice as big as it
should be, but it will be fairly shallow . What we are hoping to do is take away some of
the existing material and create a burm to hide the parking from the road .
Gregg Travis : Can you explain to us about the sewage disposal .
Jason Demarest : There will be a septic system . The location has not been finalized yet .
Obviously we can ' t put it anywhere without the Health Department approval .
• Viola Miller: How do you plan to take care of the retention basin so that there isn ' t
standing water in it?
Jason Demarest : The idea is to have standing water. A significant amount of water would
occur only if we had a very large storm .
Viola Miller: Is something that you ' re going to keep mowed, or how are you going to
have it looking?
Jason Demarest : Most of the time they will mow right through it.
Bud Shattuck : It says that there are 25 employees and the projection shows some growth .
You ' ve got 38 parking spots , no public transportation, visitors and sales people coming
in, do you think 38 spots will be enough ?
Jason Demarest : If we need to add more parking, additional gravel spaces would be
available in the back .
Gregg Travis : I ' m going to go back to the sewage dispose system , you do have it noted
that it will be according to the Health Department guideline . For the number of employee
have, and the area left you made be hard pressed given the required set- backs . You may
want to check on that before you go too much further. You also need to have 2x the area
to replace a septic system .
Jason Demarest : I really don ' t see an issue, we have plenty of space .
• Gregg Travis : Is the water line now in the road ? Is it included in the utility easement?

Jason Demarest : I believe the water service hydrants are on the far side .
• Gregg Travis : Looking at your roof scape it doesn ' t show any equipment found on top or
exhausts . Will there be exhaust from this buildings operation?
Rick Holt : Probably 2 .
Jason Demarest : 2 exhaust vents that you would see, then obviously bathroom vents .
Most of the equipment will be hung from the ceiling.
Rick Holt : There may be one leaning on the roadside, probably concealed from the road .
Gregg Travis : What kind of exhausts are they that we ' re talking about?
Rick Holt : They are totally filtered . I think there will be 3 or 4 the same size as plumbing.
Our intention is to keep all of them on the backside .
Gregg Travis : Will the deliveries to building be often ?
Rick Holt : The owner indicated to me that he gets about 1 tractor- trailer load every 2 -3
weeks . Most of their deliveries are Fed-Ex , UPS etc .
Nancy Lontco : Can you tell us about lighting.
Jason Demarest : 2 poles, 1 at each end of the parking lot .
Larry Sharpsteen : We would prefer not to have any light going off site .
Jason Demarest: I can get you a spec of the lights .
• Bud Shattuck : Are you planning on putting a buffer between yourself and UPS ?
Jason Demarest : I would say, if the budget allows that might be something they might
add .
Larry Sharpsteen : With Site Plan review we ' re suppose to keep in touch with them as
they go along . There are some things that we ' re suppose to see .
Richard Platt : I can do a #239 . I don ' t think we ' ll get much comment from the County.
Viola Miller : What kind of signs ?
Lin Davidson : It would have to be in compliance with the Town Sign Ordinance. It ' s not
in the Site Plan . From the plans one is on the building and a small one out front . I move
to approve it as presented with the contingency that we are provided with the appropriate
species selection for planting, the specifications on the land, a copy of the Spedie Permit
and follow up inspections with the Code Office .
Viola Miller: Seconded the motion . VOTE : ALL IN FAVOR. MOTION CARRIED
UNANMOUSLY .
Kirby, One Lot Subdivision , Buck Road — Parcel # 29 . - 1 -37 .6
Mr. Platt explained to the Board that Mrs . Kirby came into the Code Enforcement Office
last week to make sure everything was clear on this parcel so that she may sell it .
Approximately 2 -3 years ago the Code Enforcement Officer had the authority to do the
necessary 1 lot subdivisions . After researching our records and the County maps it is not
• showing to be legally approved .

Gregg Travis : Would it be fair to say that probably in the future you will also sell off
• other chunks ?
Jeannine Kirby: We Probably will , just because of the situation that we ' re in . We know
we have to go for a Major Subdivision .
Bud Shattuck : Are you not comfortable at this point separating the rest of that lot out?
Jeannine Kirby : No . This was suppose to have been done, we were under the impression
that it had been . We have had this land for sale for 3 years .
Larry Sharpsteen : Correct me if I ' m wrong, what we ' re doing right now, presumably this
was approved as a one lot subdivision back in 1999 but never stamped . All we are trying
to do is clean up what was already done . I so move to accept .
Dave Hatfield : Seconded . VOTE : ALL IN FAVOR. MOTION CARRIED

Sun Path
Bud Shattuck read a letter Boris Simkin sent to residents of Sun Path regarding sharing
the cost for municipal water and gas . Mr. Platt also shared a couple of letters he had
received from residents regarding Mr. Simkin ' s letter.
Larry Sharpsteen : There was a regulation at one time that stated if no action was taken on
the subdivision within a certain period of time, then it dies .
Lin Davidson : If it ' s subdivided and it ' s gone to the County and your paying taxes on
subdivided lots, I would presume it ' s going to stay that way.

Larry Sharpsteen : My own personal take on these again, the Town has no place
• dispersing itself between the current residents and the developer. The current residents
had the same opportunity to buy the property that the developer did .
B ud Shattuck : I don ' t think the current residents are against that, their just concerned that
he is proposing water and sewer down there and thinking that is their only option .
Larry Sharpsteen : We have made developers put in dry lines and made the developers
pay the cost of putting in the water lines . Seems to me if the developer puts in the water
lines to Town specifications , we don ' t have anything to say about that . Whether or not
we let them hook up, we do have say. I think the resident is more concerned that the
developer is going to make a profit .
Lin Davidson : If somebody is cooking the books and makes it cost more then it should,
that is the concern that I ' m hearing from the letter.
B ud Shattuck : They can ' t get water without Town Board approval , they can put all the
water lines in they want. It ' s going to be a water district, which it will go through our
Engineer. The Engineer will survey all the homes and determine who wants it and who
doesn ' t .
Viola Miller: We ' ve had so many different things that were not right in that area
Bud Shattuck : This proposal was made and the reason it was brought to this board was
because it ' s up to this Board to talk more about the proposed subdivision and the question
came up was there already a subdivision done on those lots . Although we only had a
• preliminary talk with Mr. Simkin , we advised him to contact his neighbors and see if they
have any interest in stuff I don ' t think there is any bias on either side, all Mr. Platt
wanted to do was to show that the proposal is being made . We need to research our
records a little further.
Horizon-Guest Suites
Lin Davidson : What about this guesthouse up at Horizons? Viola seems to remember a
lot of discussion about this 60 ' right of way that was suppose to go someplace .
Viola Miller : It ' s in the minutes and on the map .
Richard Platt : It looks like it ' s showing like a road on the county ' s current map . We ' re
going to have to talk to Rich John about this .
Larry Sharpsteen : It was purely a right of way, never intended for a road .
✓ iola Miller: It ' s still there as a potential right of way unless we do something about it .
We ' ve got to look at minutes .
Larry Sharpsteen : This map clearly shows it as a Town road .
Richard Platt : Alessandro Drive (West End) the Town deeded that back over to the
Cima' s . This map is not showing it yet ; maybe the Town deeded the other back to the
Cima ' s .
Richard Platt : Will check with Assessment Office to see whom owns/ is paying tax on it .

Lin Davidson : I think before we get too glad handed we need to look at this Eastern right
• of way off Cherry to make sure it ' s big enough for a U shape affair in case John Young
wants to go forward .
The Board agreed to hold off on the Public Hearing until this research has been done .
Richard Platt had a question on the Schedule II, the rear set back in R2 non residential for
building type C . Why was it changed from 30 to 20/6 rear and front 30/60?
Viola Miller : The Town made the change .
Bud Shattuck : the Town Attorney and the Town Board would have changed that .
Richard Platt : A person (Kevin Dorn) on Emmons Road is interested in purchasing a lot
and would like to built a house and small Pole Barn to house 2 - 3 buses as he does tours . I
couldn ' t find a classification for that . I advised him that I didn ' t see a problem with that .
The Board didn ' t seem to have a problem with that .
