Gregg Travis opened the meeting at 7 : 30 PM . 2 23 Kirby Public Hearing, 5 Lot Subdivision — Goodman Road, Parcel # P/O 20.4 -8.22 24 Nancy Loncto : I move that we open a Public Hearing to consider Kirby 5 lot Subdivision, Parcel # P/O 25 20 . - 1 - 8 . 22 . Brad Griffin seconded . VOTE : ALL IN FAVOR. MOTION CARRIED 26 UNANIMOUSLY . 27 Gregg Travis : Do we have any questions from our guests ? 28 Brad Griffin : Is there a final map now? 29 Robert Walpole : Yes, I brought it with me . 30 Brad Griffin : There are not changes in the dimensions from the previous issue? 31 Robert Walpole : No everything is submitted as the Engineer finalized with the contours on . 32 Nancy Loncto : I move to close the Public Hearing. Brad Griffin seconded . VOTE : ALL IN FAVOR. 33 MOTION CARRIED UNANIMOUSLY. 34 Lin Davidson: Completed the SEQR. Lin Davidson will make a motion to say that this will not have 35 any sufficient adverse environmental impacts . Larry Sharpsteen seconded . VOTE : ALL IN FAVOR. 36 MOTION CARRIED UNANIMOUSLY . 37 Brad Griffin : Since the Subdivision meets all dimensional requirements in the Ordinance, I would move di for its approval . MOTION CARRIED UNANIMOUSLY . 8 9 Lisa Warner — One Lot Subdivision , Jerry Smith Road, Parcel # 16.4 - 12 . 3 10 Mr. Platt brought to the Board ' s attention that they had not declared a negative declaration at our last 11 meeting on July 22 , 2002 . 12 Larry Sharpsteen : I so move to declare a negative declaration . Lin Davidson seconded. VOTE : ALL IN 13 FAVOR. MOTION CARRIED UNANIMOUSLY . 14 15 Christoper Muka, Informal Discussion - Special Permit ( Antiques, Crafts, & Flea Market) 16 A short discussion prior to Mr. Muka' s arrival took place, Mr. Shattuck was surprised that Mr. Platt 17 submitted a 239 at this stage of the game. Mr. Platt stated if its going to be for a Special Permit than a 18 239 review, would be needed at some point. Viola Miller requested to know why we are classifying this 19 a Special Permit. Mr.Platt explained that under the Ordinance it is "Retail Sales". Mr. Shattuck imentioned that in the past The Town Board has moved Special Permits to this Board, however, he is guessing that they may exercise and review this one themselves in public, prior to it coming to this 22 Board. Mr. Sharpsteen suggested to the Board that they not take too narrow of a view on this as a 23 situation like this could grow into something that could be sizable. 24 Lin Davidson : How is it going to be set up ? 25 Chris Muka: I ' m trying an open-air flea Market . My concerns are that it be clean and neat . I would run it 26 on the weekend. I have one storage building if vendors want to rent to store their items . 27 Gregg Travis : These would be enclosed buildings, not just like open flea? 28 Chris Muka: The buildings I have permits to build right now are for storage only. They are completely 29 enclosed just like the one is on my property now . 30 Gregg Travis : If you 'rebuilding for storage now, if your going to have the people come for some type of 31 sales you might be required by code to have more exiting. 32 Christ Muka : I' m not going to use those buildings for anything other that storage. This flea market 33 would be open air. 34 Viola Miller: Is it seasonal? 35 Chris Muka: Yes, it probably would be late spring to fall, weather permitting, and only daylight hours . 36 Lin Davidson: You would foresee RV ' s and trucks? 37 Chris Muka, I didn't foresee that sort of thing. There ' s going to have to be parking for vendors . I ' m going to have to put in a fairly nice parking lot. 39 Larry Sharpsteen : Have you approached the State Department of Transportation about curb cuts? 2 3 Town of Lansing Planning Board, August 12, 2002 1 Chris Muka: They said when I need to have a commercial access they would want me to apply for a 2 permit. They didn ' t see a problem, it would need to be a little wider than the driveway I ' ve got. I have plenty of extra flat land, I can easily go across to another section of my 12 acres . I hope it doesn ' t get 4 that big. 5 Brad Griffin : Sanitary facilities on the area, I noticed on the map that it ' s worded for privy! 6 Chris Muka: The Health Department will design for me. 7 Larry Sharpsteen: Are you talking rent a johns or chemical toilets? 8 Chris Muka: No, I want one like the one they have a Buttermilk Falls (Sandbank Road) . 9 Larry Sharpsteen : Are you planning on using a stabilization fabric under the gravel? 10 Chris Muka: No, it ' s a pretty dry spot . 11 Brad Griffin : Is there a particular focus of the sales? 12 Chris Muka: Antiques would be nice . The whole idea with my location is to help the business next door, 13 help my business but I ' m not going to limit it. 14 David Hatfield : Your not looking for another Farmer' s Market? 15 16 Chris Muka: That sounds good, I would love that too . 17 Larry Sharpsteen : You don ' t have the word Windmill in the back of your mind? 18 Chris Muka: No . 1 Nancy Loncto : Do you have people interested? Chris Muka: I know a lot of people who shop where I shop , they all like selling their stuff 21 Lin Davidson : What do you see as signage? 22 Chris Muka: I would put an ad in the newspaper, put flyers out in different places. I don ' t think we ' re 23 going to put a lot of signs . (Triphammer, and Stewart Park) . I definitely would put a permanent sign out 24 in front of my place. 25 Viola Miller: What if people travel, I think they're going to want to stay more than just I day especially 26 if they are antique dealers . 27 Chris Muka: I guess I will have to look into that. I didn ' t want to get involved with supplying water, 28 electric or sewer. Maybe I will have to limit it to one day. 29 Brad Griffin : Have you had the occasion to have the market surveyed? 30 Chris Muka: No I haven 't done any research on this . 31 Gregg Travis : With a Special Permit are we required to do a Site Plan Review? 32 Richard Platt : Yes . 33 Gregg Travis : The intent of our review tonight was to give you feedback on our thoughts. Mr. Platt will 34 provide information to you regarding site plan review . We ' ll expect a more detailed map . 35 • Albert Linderberry — Informal discussion , Used Car 37 Mr. Linderberry called and left message with Mr. Platt that he was unable to make the meeting. 3 4 Town of Lansing Planning Board, August 12, 2002 1 2 Other Business 4103 Mr. Davidson requested that the Board take a day and get the new Ordinance approved. Mr. Platt will 4 obtain the reduced maps for each member and either mail or have them picked up . Rachel & Nancy will 5 get together to complete the editing that needs to be done . Brad Griffin announced that he would be 6 submitting his resignation at the end of this calendar year. A prospective new member that he would 7 recommend to the Board is Tom Ellis . Mr. Ellis is well known in Lansing, he knows a good deal about 8 what ' s happened with the history of Lansing, he ' s involved in the issues that come before this Board 9 regularly and he ' s devoted to fair play. 10 Larry Sharpsteen : We all received copies of the results of the Planning Forum, and I 'm really concerned 11 I think this erodes home rule. Considering the potential abuses by a very small group of people, and the 12 ability to damage lifestyle of an entire region, I just think it ' s a real mistake. I think that traditional 13 centers of local control belong at the local level not at the regional level . 14 Bud Shattuck : From that meeting I would say that it is pretty clear that it is City verses Rural . Growth 15 verses no growth. A number of us let them know that while they move this forward, it has no teeth . The 16 Town Board of Lansing was one of three Towns that did not support it . 17 Dave Hatfield : I make a motion to adjourn this meeting . Larry Sharpsteen seconded.
