Mr. Ronsvalle did 26 send a formal response stating that he intends to comply with most of our requests, however not all of them. The 27 Planning Board has 30 days ( June 22nd ) to take action . Mr. Travis states The Planning Board can put conditions 28 to it if they so wish. The final decision will be made by the Town Board. If a negative vote is made, then the 29 Town Board must provide the developer with a detailed letter of the denial . Mr. Travis opened the meeting up for 30 discussion from The Planning Board members . 31 Lin Davidson : I don ' t it see working with the spirits of the PDA 32 Gregg Travis : We suggested varied 2-3 units, or mixing. Something like Horizons. 33 Lin Davidson : Not just an apartment complex. 34 Nancy Loncto: I agree with that. My reading of the intent to comply from Mr. Ronsvalle is that number 1 , 2 & 3 35 of our recommendation he does not intend to comply with . 36 Gregg Travis : In his letter of intent, he did not intend to comply. 37 Nancy Loncto: In our recommendation letter we clearly stated paved sidewalks or paths are required for 38 pedestrians . In Mr. Ronsvalle ' s letter he does not state paved sidewalks or paths, only a walkway to the bus stop. 39 Gregg Travis : We need to compile a " Non Compliance Items List" • 1 . Character of neighborhood — change number of buildings 41 2 . Driveways built to town specifications to hold emergency vehicles . Width is a must. 42 3 . ( 1 ) The need is there. 4 Lin Davidson: Our intent was for the building to be different, some single family, and some duplexes . 5 Viola Miller: Wider roads are wasted space . The Village doesn ' t require that. 6 Lin Davidson: All private roads in the Town now are required to meet town specs . • 7 Bud Shattuck: Private roads and private driveway with multiple dwellings are now being built to town specs. It 8 does not mean 32 feet wide . It' s talking about the construction underneath. I don ' t think there was anything in 9 the list that you sent to Mr. Ronsvalle that said anything about 32 feet wide . Should those roads ever become 10 town roads, the homeowner would incur less cost. Subdivisions have the same rules . 11 Lin Davidson: #6 they have no intent to go forward with paths or walkways . 12 Nancy Loncto : As for #6, I ' m in favor for pedestrians (children, elderly) more than bicycles . 13 Gregg Travis : Read the Town specs . 14 Viola Miller: I object to this . 32 feet it' s too much ! 15 Nancy Loncto: 160 vehicular trips per day that concerns me . 16 Gregg Travis : Our recommendation to the Town Board would be to approve or disapprove . Does the Town Board 17 have the authority to do other than we recommend? 18 Bud Shattuck: We do. 19 Gregg Travis : Whatever we send on to you, then we need to send our reasons why. If we choose to disapprove, 20 does it still go to the Town Board? • Nancy Loncto : Yes, either way. 22 Lin Davidson : I would make a motion if needed . 23 Nancy Loncto: If we vote either way, we are responsible for answering the following, 706 . 6 . 1 through 706 . 6 . 5 . 24 Bud Shattuck: Mr. Chairman it might behoove you to see if the representative for the developer has any comments 25 that he would like to make before you move along here . 26 Gregg Travis : You ' ve heard the discussion . 27 George Frantz: In terms of the structure, it complies with the town specification . Our concerns are with the width. 28 Bud Shattuck: I would note along with the road pieces that the Town has not meant that to be a punitive measure. 29 It' s meant for the structure of the road is sound for the future . 30 Lin Davidson: I ' m not in the legal profession, but those are conditions of approval . If this board moves to 31 disapprove and say there was not sufficient intent to comply, the request for the PDA thus following don ' t look to 32 me to be addressed. 33 Nancy Loncto: Read section 706 . 5 2"d paragraph. 34 Lin Davidson: Moved to disapprove . The intent to comply has not been suitable to what the board asked for in • 35 their letter to developer. 36 Nancy Loncto : Seconded the motion. 37 Gregg Travis : I just wanted to let you know I spoke with Brad and his opinion was that density is the main issue 38 and the developer must comply. • Lin Davidson: It ' s still twice the legal density. 40 Nancy Loncto : I think those 24 units were with these stipulations attached. (Whole) 2 ..b. 3 Town of Lansing Planning Board, June 10, 2002 1 Viola Miller: It seems to be that rather then make that decision in the matter in which it was made, we have 2further time on this, and before we report to the Town Board we would give the developer an opportunity to tell us whether he can comply. 4 Gregg Travis : We have 30 days . 5 Viola Miller: I appreciate that we have a quorum, but I think we should hold off and have the other board 6 members here to vote. They have worked very hard on this . 7 Gregg Travis : I personally want more members here . 8 Lin Davidson : While the motion is open, the discussion has been I can withdraw the motion and we can discuss 9 this at a later meeting. 10 Nancy Loncto : Open for yet another response is inappropriate . I believe that we need to consider what is on the 11 table at the next meeting. 12 Lin Davidson : If we want to consider this particular response in front of the full board, I withdraw my motion 13 until the next meeting. 14 Viola Miller: I would like the minutes to carry the motion that you made here that we are not happy at this time 15 with the lack of compliance . We feel very strongly that consideration should be given by the full board . 16 Lin Davidson : I propose that we postpone this discussion until Monday, 6/17/02 at 7 : 30PM . 17 Lin Davidson: Motioned to postpone . Viola seconded . VOTE : ALL IN FAVOR. MOTION CARRIED 18 UNANIMOUSLY. 19 20 Kirby Subdivision-Sketch Plan Submission — Goodman Road, Parcel # P/O 20. 1-1 -8.2 21 This parcel was a total of 8 lots. 3 lots were previously subdivided. 5 lots are left that they would like to I, subdivide. We will accept as sketch plan under subdivision rules & regulations . They must come to us again with the requirements for a Major Subdivision . They will need to provide us with a preliminary Plat submission . 24 25 Christina Turek — Special Permit — Ice Cream Stand, 104 Auburn Road, Parcel #31 -1 - 18 26 Mr. Platt explained that Ms .Turek would like to open an Ice Cream Stand up near the old town barns. This type of 27 Business is permitted in that area, however, it is required to have a special permit. Last year when she opened her 28 market, we asked that the DOT come to inspect the driveway. At that time they requested that she restrict the 29 center driveway and block off the other two . They have done that. Mr. Platt spoke to the Town Supervisor and he 30 would like the board to allow her to operate due to the time element. 31 Bud Shattuck: Is there water to this stand? 32 Richard Platt: Yes, the town brought it in . 33 Lin Davidson: As far as buffers, do we want to look at this? Once we approve the site plan, it' s there forever. I 34 think an adequate review of time to go through this is needed. 35 Viola Miller: What size lot is this on? 36 Lin Davidson : There is no real sketch of the lot here . Can we do a conditional type thing so she can get in 37 operation? 38 Richard Platt: Sure, we really need a map . I can also bring photographs. If you 're going to consider it, I would 39 suggest that the board members take a drive up there and check out the site line. 40Lin Davidson : I make a motion that we approve this special permit for the ice cream stand for 1 season, with a • view at this time with the map that was given to us that we can not adequately do a real site plan review. 42 Bud Shattuck: I don ' t think you can do a special permit without a public hearing. We might want 4 to make some recommendations if they are going to be there awhile . 5 Gregg Travis : Mr.Platt please put that on the agenda for 6/24/02 . We will ask for more details, elevations, detailed 6 map . 7 Lin Davidson: Motioned to conditionally approve . Nancy Loncto seconded. VOTE : ALL IN FAVOR.
