Sales are done mainly through the Internet, phone and occasional client in 28 house. Mrs . Keefe clearly indicated this would not cause a problem with traffic . UPS and FedEx come once a 29 day, that' s about it for traffic . 30 Dick Platt referred to Schedule I, #22 PROFESSIONAL OFFICE IN R2 DISTRICT which indicates that a 31 Special permit is required, and the conditions listed under 803 .2 .4 must be met. Dick dictated both 803 .2 .4 (a& b) 32 also 803 .21 SITE PLAN APPROVAL. Mrs . Keefe questioned if a Site Plan review was even necessary because 33 there were no asterisks in Schedule I, PROFESSIONAL OFFICE IN R2 Zone. 34 Nancy Loncto inquired How many employees . Mrs . Keefe stated 3 full time and 2 other part time employees . 35 She does not see that changing. 36 Dick Platt stated in his opinion that the Special Permit would serve for The Keefe' s business only. It would not 37 be transferable if someone else were to purchase their business . Janet Keefe brought up out of curiosity what if a 38 Doctor ' s office originally had it and then sold it to another. Dick Platt stated it wouldn ' t be any different. Lin 39 Davidson mentioned there was no zoning when they started their business. Change of ownership should have to 40 go back to the Town Board for review. at Brad Griffin made a motion regarding this matter stating that the Special Use Permit be referred back to the Town Board with 2 recommendations. 1 .The Town Board waives unnecessary portions of the site review. 2 . 43 Permit issued to the present owner on a non-transferable basis . 2 Town of Lansing Planning Board. March 25. 2002 II 1 Motion seconded by Larry Sharpsteen . Bud Shattuck questioned the increase in traffic . Lin Davidson stated 2 there are rules for traffic. Janet Keefe' s response was that they have 6 spots for parking to include trucks. Lin tipDavidson, our goal is to have an existing business continue not to expand. No complaints have been heard from neighbors. 5 Nancy Loncto inquired about the septic system. Janet Keefe states the system was installed in 1992 with no 6 problems . Dick Platt and Larry Sharpsteen suggested that we check with the Health Dept. regarding the number 7 of gallons used for a business. Larry Sharpsteen states that there is a policy when it comes to owner occupied, 8 and now it' s going to be a business unoccupied by the owner in an R2 district which requires a special permit 9 form the Town Board, which in turn a special permit requires a site plan review. 10 Viola Miller made a motion to send it back to the Town Board. Bud Shattuck seconded the motion. All voted in 11 favor of the motion. Motion passed at 19 :23 12 13 Ron Ronsvalle- PDA Preliminary Proposal-Hillcrest and Triphammer Terrace George Frantz, Site Planner, 14 for Heritage Builders gave a presentation for the proposed plans to construct a 48 dwelling complex. , 12-4 unit 15 structures, on 13 .9 acres of land, to be built in 2 phases. 15` phase will be 6 structures, architectural design will be 16 modern colonial, peak roof, 2-2car garages. ( 1 garage for each unit) . Phase 1 will be on the Eastern side of the 17 property and will be served by on-site septic disposal system, consisting of sand filter and absorption filter which 18 will be located between Phase I and Triphammer Road. This is the area chosen by the project engineer. Phase 2 19 will be contingent upon public sewer. (Western Part) . Upon completion of both phases approx. 6 acres will 20 remain in the existing meadow type vegetation. Meadow is intended to buffer the project from Triphammer road. 21 One feature that is remarkably different from the original proposal is the Northeast corner of the property (approx. 22 3 .2 acres) will be preserved. In addition to that, landscaping in excess of 100 treeswill be planted. A bus stop 23 will be located on Triphammer Road. . Each unit will have a deck or patio, and 80% will have a generous back 24 yard. This is more like a traditional simple family home neighborhood. Also considered in the criteria (Sec . 706) - are the objectives with the Town of Lansing comprehensive plan, supporting growth and development in areas where public water and sewer services can be provided. As for traffic and transportation, they are eliminating curb 27 cuts (objective for County as well as the Town). This plan has been designed to meet town ' s effort to provide full 28 range of housing. (Different ages, family sizes and income levels) . In terms of natural history, they will maintain 29 40% of site with meadows and natural vegetation. Meadows will be mowed approx. every 3 years . 30 Larry Sharpsteen inquired as to what the building footprints were to„ include the garages. 31 George Frantz stated that they were 144ft. end to end, main structure is 32 ft. deep, 48 feet wide (two 24x32 units) 32 with garages(front to back) and the height is about 25 to 27 feet. . 5 - 12 pitch roof. Rears of building on downhill 33 side of street will have walkout basements. 34 Larry Sharpsteen asked what size caliber of trees and what variety. 35 George Frantz states they have not gotten that far in the landscaping details, however, his recommendation for 36 caliber ' s of trees would be 2inches or so . The type of trees probably would be ash, oak, and maple. They will be 37 very careful with their choice of trees for this site due to the wetness . 38 Larry Sharpsteen agreed, very wet. Also with softening, it will take a number of years to produce. Larry 39 Sharpsteen wanted to know about the garage face to face, he did not have a scale . 40 George Frantz, 50 to 70 feet. 41 Larry Sharpsteen asked what type of street Lighting , post lantern at the end of the driveways or . . . 42 George Frantz states they looking at a traditional gas light style street style . The height will probably be 12- 15 43 feet. They will not be higher , lighting is not efficient. oLin Davidson asked how many bedrooms per unit. George Frantz , 2 bedrooms per unit. They are 2 story units . 46 Lin Davidson, As for elder housing theirs no appreciation for an elevator. 2 . Referring to ( Sec.706.3 .2 Permitted Land Use Activies) 3 George Frantz, Enhances neighborhood through an attractive design, providing for a variety of different types of 4 families. 5 GreggTravis, where are the sewer systems goingto be located in the first phase? ggY 6 George Frantz, the systems will be in the area where phase 2 is going. This area has already been approved by the 7 health department. 8 Lin Davidson, Will fill be brought in? 9 George Frantz, No, because of cutouts. They will use the fill . 10 Viola Miller, questioned space for snow removal . 11 George Frantz, Yes . . 12 Larry Sharpsteen brought up the possibility of realignment of Hillcrest Road 11 13 George Frantz, Yes, they will eventually have to sit down with the county staff. 14 Larry Sharpsteen, As for a bus stop, at the last PDA,The County required that a pull off be made for the driveway. 15 The corner of a busy intersection is not the greatest place for a bus stop. 16 George Frantz, Yes, but it also depends on how wide the road will be. 17 Brad Griffin, Have you seen the County ' s design for those intersection? 18 George Frantz, No . However, it ' s in the County right of way so they will have final say. 19 Gregg Travis, Who will maintain the all weather path? George Frantz, the owner. 21 Brad Griffin, What ' s the approx. Sq . footage per living unit? 22 Dan Signore, 24 x 32 , 1500- 1600 square feet plus basement. 23 Bill-Audience, How are you handling storm water? 24 George Frantz, were looking at approx. 3 .7 acres of gravel surface . 25 Paul, What happens when you rent these units to students who have 5 -6 cars . 26 George Frantz, Each structure will have room for at least 4 cars (2 in; 2 out) 27 Nancy Loncto, How can people get to the bus stop? 28 George Frantz, Yes, they will be walking in the streets. 29 Nancy Loncto, So theres no pedistration walks to the bus walk. 30 George Frantz, No, again, in terms of both pedestrian and vehicular traffic these would qualify as low volume 31 streets . It' s not going to be a safety hazard for children or adults 32 Don-Audience, How would you term the classification of these apartments? (A, B, C, and what quality of 33 construction) 34 George Frantz, Class A 35 Don-Audience, Will this be gravel road or will developer put in asphalt? 11* George Frantz, This will be an all weather road. Ron Ronsvalle, If your asking me, my answer is the same answer as George gave you. • 38 Female-Audience, Can we limit these apartments to single family dwellings verses having the responsibility of 39 having 3 -4 people living in the apartment? 3 4 Town of Lansing Planning Board, March 25, 2002 1 George Frantz, That' s a question for the Town, I'm not familiar with the Town ' s definition of a family. Generally that is out of control . 4 Nancy Loncto, Are there any covenants under living arrangement? II 5 George Frantz, No. 6 Paul-Audience, In a past meeting the question of (What is a family?) was brought up and the senses were we 7 could not restrict it. II 8 Dick Platt , Located the definition in (Appendix I, A.44) and read tothe public. 9 Larry Sharpsteen, Clarified that in NYS 50% or more of the exterior, wall of a unit is backfilled is considered a 10 cellar not a basement. You can not have habitable space in a cellar unless you take measures for adequate natural 11 light or adequate alternate egress. The only habitable basement would be on the West Side of the driveway on 12 Phase II. 13 Dick Platt, Yes they would have to meet code . 14 Richard Meagher,Audience,expressed his concerns about the number of children (48- 100) living their and their 15 parents not paying taxes. . 16 Doug Firth- Audience, Wanted clarification from the Board as to if this is a Developer' s conference. 17 Gregg Travis & Dick Platt, made it perfectly clear that this is our first application and not the developer' s 18 conference. This is classified as the Preliminary Proposal and within 45 days a public hearing must be set. 19 Doug Firth-Audience, Inquired as to if they had an idea of what the rate would be for these units . According to 20 Ron Ronsvalle he is currently building a duplex with the same layout up on Warren and Asbury and he is 9receiving about $ 1200-$ 1300 plus utilities . Dough Firth requested clarification on weather the basements would 1 be unfinished. Ron Ronsvalle and George Frantz explained that the basements will be finished (game room, 3 family, No bedrooms) . 24 Cathy Morrell-Audience, Her question had to do with density issue . From her understanding the original proposal 25 was shot down because density issues, this was a high-density issue and you wanted a low-density neighbor. 26 How does this develop differ from the other as far as density? 27 George Frantz, It is not different 28 Cathy Morrell-Audience, Would like this density issue answered. (In 10- 15 yr. is this property going to have the 29 same lovely appeal?) 30 Gregg Travis explained that we are not going to answer the density issue because this is a proposed condition and 31 we haven ' t approved of anything. That' s a question that the developer and we will consider over period of time. 32 The question could be asked at the public hearing. 33 Candis Bailey-Audience, Is this property going to have onsite management? Also what is the trash removal? 34 George Frantz, Each will be up to each resident to take care of, they are not proposing having a dumpster. 35 Richard Meager-Audience, How much lighting? 36 George Frantz, We will use what is needed to make a safe environment for residents. , lights that do not extend up 37 in the sky, and no glare from the property. The final plan will include the type of bulb which we intend to use . 38 Larry Sharpsteen, Builder will come with proposal to answer our concerns during the site plan process. Meetings 39 are always open, and there will be public hearings throughout the process . 40 Nancy Loncto, There seems to be a lot of concerns with the neighbors, will you be working with them? Could • questions or concerns be forwarded to you or the planning board? 42 George Frantz, probably the planning board, however questions related to this he has no problems answering 43 them. (tethered balloons) 6 George Frantz, What buildings are of concern? • 7 Larry Sharpsteen, Phase I, building on North end. Were going to discuss it and if it' s the sense of the board we 8 will make it a formal request. 9 Mark Catone-Audience, Are these apartment buildings higher than the convential style home? 10 Larry Sharpsteen, There is a height ordinance in the Town of Lansing , this is a concern that we deal with on the 11 board. 12 George Frantz, As an alternative to balloons, I can easily figure out the elevations of their homes and the height 13 of the trees, and the height or roof peaks using cross sections . Probably more accurate . 14 Larry Sharpsteen motioned that we accept this as the preliminary proposal with the understanding by no means an 15 approval of the building size or density. This information presented should been enough to move on to the next 16 phase. 17 Dave Hatfield seconded the motion 18 Brad Griffin stated that we must determine if the material presented 'meets the criteria for consideration of a PDA. 19 VOTE: ALL IN FAVOR . MOTION CARRIES. 0 Gregg Travis, 5/6/02 scheduled for Developer' s Conference Charles & Debbie Crandall-Informal Subdivision- Dick Platt explained to the board that the Crandall ' s son 22 would like to built a home on Marion Lane, on the northern portion of parcel 9 . 2 (9 . 7 is Debbie & Charles 23 residence) . The son would need to have access across Debbie & Charles ' s property. Marion Lane is a private 24 road. This lot has previously been subdivided. The board' s advice for the Crandalls was to have the parcel 25 subdivided with a 20 foot access to Marion Lane. The access would go behind Crandall ' s and along side on the 26 south side. 27 Other Business- Dick Platt submitted to the board handouts of inconsistency in the proposed zoning ordinance. 28 According to Lin Davidson strikeouts and changes have been made, each member should go over their notes, add 29 to or make corrections . . Schedule 1 looks ok, but is hard to visualizer Tom Niederkorn will go over this again . 30 Viola Miller has requested that we make changes in Sec. 402 .3 Residential Low Density (RI) District to read as 31 follows: 32 The intent of the R1 District is to designate areas where agriculture has been the historic use of land, 33 where these areas are primarily residential. Such areas often face environmental limitations and potential water 34 supply and sewage disposal problems that restrict the extent of development. Regulations and standards in the 35 R1 district are intended to limit density and, based on soil conditions and land accessibility reduce the number of 36 nonfarm uses that are considered suitable. 37 Gregg Travis requested for the April 3rd meeting that we have a volunteer who worked on the old ordinance give a 38 presentation to the Town Board. Larry and Lin agreed to do a tag team effort. 39 Larry Sharpsteen made the motion to adjourn. David Hatfield seconded. VOTE : ALL IN FAVOR. The property belongs to his grandmother. She would transfer the portion of land, but he would need a right of way across Crandall ' s property. They would like advice from the Planning Board on how to proceed. The minutes from the Planning Board Meeting for the original subdivision are atached. Phase 1 will be on the Eastern side of the 17 property and will be served by on-site septic disposal system, consisting of sand filter and absorption filter which 18 will be located between Phase I and Triphammer Road . This is the area chosen by the project engineer. Phase 2 19 will be contingent upon public sewer. (Western Part) . Upon completion of both phases approx. 6 acres will 20 remain in the existing meadow type vegetation. Meadow is intended to buffer the project from Triphammer road. 21 One feature that is remarkably different from the original proposal is the Northeast corner of the property (approx. 22 3 .2 acres) will be preserved. In addition to that, landscaping in excess of 100 trees will be planted. A bus stop 23 will be located on Triphammer Road. . Each unit will have a deck or patio, and 80% will have a generous back 24 yard. This is more like a traditional simple family home neighborhood. Also considered in the criteria (Sec . 706) 2 are the objectives with the Town of Lansing comprehensive plan, supporting growth and development in areas where public water and sewer services can be provided. As for traffic and transportation, they are eliminating curb 27 cuts (objective for County as well as the Town). This plan has been designed to meet town ' s effort to provide full 28 range of housing. (Different ages, family sizes and income levels) . In terms of natural history, they will maintain 29 40% of site with meadows and natural vegetation . Meadows will be mowed approx. every 3 years . 30 Larry Sharpsteen inquired as to what the building footprints were to include the garages . 31 George Frantz stated that they were 144ft. end to end, main structure is 32 ft. deep, 48 feet wide (two 24x32 units) 32 with garages(front to back) and the height is about 25 to 27 feet. . 5 - 12 pitch roof Rears of building on downhill 33 side of street will have walkout basements . 34 Larry Sharpsteen asked what size caliber of trees and what variety. 35 George Frantz states they have not gotten that far in the landscaping details, however, his recommendation for 36 caliber' s of trees would be 2inches or so. The type of trees probably would be ash, oak, and maple. They will be 37 very careful with their choice of trees for this site due to the wetness . 38 Larry Sharpsteen agreed, very wet. Also with softening, it will take a number of years to produce . You can not have habitable space in a cellar unless you take measures for adequate natural 11 light or adequate alternate egress . According to 20 Ron Ronsvalle he is currently building a duplex with the same layout up on Warren and Asbury and he is 21receiving about $ 1200-$ 1300 plus utilities . The son would need to have access across Debbie & Charles ' s property. Marion Lane is a private 24 road . This lot has previously been subdivided. The board ' s advice for the Crandalls was to have the parcel 25 subdivided with a 20 foot access to Marion Lane . Such areas often face environmental limitations and potential water 34 supply and sewage disposal problems that restrict the extent of development.
