19 Gregg Travis opened the meeting at 7 : 35 PM .
20 Mary Decker Subdivision, 760 Van Ostrand 12d, Tax Map # 19.-1 -6.25 — Mary Decker introduced herself
21 Mary explained the subdivision and location of the property. Larry Sharpsteen asked if the owners would continue
Pto subdivide the remaining parcel . Mary replied that the owner has indicated that when they decide to sell the
remaining land, it will be sold as the 10 . 5 acres. The board discussed the subdivision .
24 Lynn Davidson read the SEQR. Larry Sharpsteen moved to declare a negative declaration . Lynn Davidson
25 seconded . VOTE : ALL IN FAVOR . MOTION CARRIED UNANIMOUSLY .
26 Brad Griffin motioned to accept the subdivision as explained pending submittal of the final survey . Lynn
27 Davidson seconded . VOTE: ALL IN FAVOR . MOTION CARRIED UNANIMOUSLY.
28 Mary Decker thanked the board .

30 Questions regarding SEQI( — Gregg Travis stated that he would like a summary of the first couple questions on
31 the SEQR form that they always say no to . Nancy Loneto agreed . Nancy stated that she made herself a note to
32 ask about that. Nancy stated that she needs a SEQR. 101 course. Larry ,Sharpsteen , stated that a lot of the stuff
33 overlaps, but basically what they are doing in the first couple questions are saying that they feel the short form is
34 adequate for these subdivisions, then they go through the rest of the questions. Larry said that the important thing
35 to remember about SEQR is that it is not an instrument to be used to stop development.

37 • Rod Burke Subdivision Request, Tax Map #30.- I -26.26 - The board asked for an explanation of the parcel . •
38 Rod Burke explained that he had recently sold one parcel and would like to sell another parcel , leaving a 20 foot
39 access strip to the remaining land in the back. The board asked when the previous parcel was sold . Rod replied .
40 . that he thought it was in June. Nancy Loneto indicated that the survey map stated the pin was set in June 2001
41 and asked if that was an indication . Rod Burke replied that it was .
Gregg Travis asked about the right-of-way through the NYSEG property . Mr. Burke stated that his lawyer
731. obtained the right-of-way in writing when he originally bought the property. . Mr. Burke stated that he could not
44 build or improve on the NYSEG property, except to put in a driveway for access to the back land. Larry

1 Sharpsteen stated that it would be interesting to see that as Mr. Burke will not be the last one to bring a request
2 like this to the board . Brad Griffin stated that he shared the concern about the access.
ipLarry Sharpsteen stated that they could approve it contingent upon the completion of the SEQR and the board ' s
receipt of the written document the lawyer received from NYSEG giving him permission to cross that land . Mr.
5 Burke asked if he submitted the written document from the lawyer if it would be ready for the closing the
6 following day. Larry Sharpsteen replied that it would depend on how the motion is worded . Larry Sharpsteen
7 stated that this was pretty fast because this should also have a public hearing, but that could be waived. Laity
8 stated that he would not be opposed to that.

14 approval , and the Planning Board will waive the public hearing as there would not appear to be any potential
15 controversy regarding the subdivision . Lynn Davidson seconded . VOTE : ALL IN FAVOR . MOTION CARRIED
16 UNANIMOUSLY .
17 The board discussed construction of new houses and any related subdivision of property on Storni Rd . It was
18 determined that the property in question was over the acreage and road frontage required for a subdivision ,
19 therefore would not conic before the board . The board asked that the Code Enforcement Officer begin to give
20 them a report on the new construction in the Town .

Dennis Tarbell Subdivision , Tax Map # 20.-1 -18.2 - Brad Griffin asked if the public hearing would have to be
26 re-advertised . Robin Cornell replied that it was never advertised .
27 The public hearing was set for Monday, January l4, 2002 .

29 Discussion on Local Regulations Regarding Utilities - Brad Griffin stated that during their deliberations on the
30 Zoning Ordinance they raised the question about Local Regulations that would regulate utilities . Brad stated that
31 it seemed if there are public service laws, Articles 7 & 8, that guide the siting and dimensions of transmission
32 lines and power plants, maybe there wasn ' t very much for the Town to do . Brad sent that question to Flany Willis
33 at the Department of State. Brad stated that it . took a longtime to get a reply, but he finally received it. Brad read:
34 the letter. Brad stated that it may be worthwhile to have some reasonable regulation for those things that are local
35 in nature .
36 Nancy Loncto moved that the letter bej>Zcluded as an appendix to he Land Use Ordinance . Brad Griffin
37 seconded . VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY.

41 Viola Miller stated that they received a copy of the terms of the Planning Board members and that Lynn ' s term .
42 would be up this year and she felt it was the Planning Board ' s pleasure that the Town Board reappoint him Viola
43 Miller motioned to request the Town Board reappoint Lynn Davidson to another term on the Planning Board ,
Larry Sharpsteen seconded . VOTE: ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY.

1 Nancy Loncto stated that Mr. Farkas and Mr. Shattuck came to the last meeting of the 'Town Center Committee
2 and asked them to develop a plan for land use for the old Ottenschott property . Nancy stated that they will be
ipmeeting regarding that tomorrow night .

Dear Mr. Griffin :
This will reply to your letter dated August 28, 2001 . We received this letter in our
Counsel ' s Office on November 81I'. You inquired concerning the extent of authority of the Town of
Lansing over gas and electric utility facilities .
0 " Major utility transmission facilities"-- i . e . , certain large-scale electric and fuel gas
transmission lines- -arc subject to regulation and approval by the Public Service Commission ( PSC) under
Article VII of the Public Service Law ( PSL) . Where such regulation obtains, local governments may not
require permits or approvals . PSL bd30. They may; however, at the discretion of the PSC , apply
reasonable dimensional and impact requirements . PSL §126(1) (1).
Where no PSC jurisdiction exists , local governments may reasonably regulate utility
facilities . In such instances, where utility facilities are a prohibited use, a local zoning board of appeals
may not deny approval of a variance on the basis the applicant has failed to show " unnecessary
hardship" . Rather, the utility transmission lines must be allowed , with appropriate conditions if
applicable , where the utility shows a " public necessity" . Matter of LI. Lighting Co. v. Horn. 23 AD 2d
583, 256 NYS 2d 690 (2"11 Dept. , 1965) .

19 Gregg Travis opened the meeting at 7 : 35 PM.
20 Mary Decker Subdivision, 760 Van Ostrand Rd, Tax Map # 19.- 1 -6.25 — Mary Decker introduced herself. '
21 Mary explained the subdivision and location of the property. Lany Sharpsteen asked if the owners would continue
to subdivide the remaining parcel . Mary replied that the owner has indicated that when they decide to sell the
remaining land, it will be sold as the 10 . 5 acres . The board discussed the subdivision .
24 Lynn Davidson read the SEQR. Lan-y Sharpsteen moved to declare a negative declaration . Lynn Davidson
25 seconded . VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY.
26 Brad Griffin motioned to accept the subdivision as explained pending submittal of the Final survey . Lynn

30 Questions retarding SEAR — Gregg Travis stated that he would like a summary of the first couple questions on
31 the SEQR form that they always say no to. Nancy Loncto agreed . Nancy stated that she made herself a note to
32 ask about that . Nancy stated that she needs a SEQR 101 course . Larry Sharpsteen stated that a lot of the stuff
33 overlaps, but basically what they arc doing in the first couple questions are saying that they fee! the short form is
34 adequate for these subdivisions , then they go through the rest of the questions. Larry said that the important thing
35 to remember about SEQR is that it is not an instrument to be used to stop development.

37 Rod Burke Subdivision Request, Tax Map #30.-I -26.26 - The board asked for an explanation of the parcel .
38 Rod Burke explained that he had recently sold one parcel and would like to sell another parcel , leaving a 20 foot
39 access strip to the remaining land in the back. The board asked when the previous parcel was sold. Rod replied
40 that he thought it was in June . Nancy Loncto indicated that the survey map stated the pin was set in June 2001
41 and asked if that was an indication . Rod Burke replied that it was .
0 Gregg Travis asked about the right-of-way through the NYSEG property. Mr. Burke stated that his lawyer
obtained the right-of-way in writing when he originally bought the property . Mr. Burke stated that he could not
44 build or improve on the NYSEG property, except to put in a driveway for access to the back land . Larry

1 Sharpsteen stated that it would be interesting to see that as Mr. Burke will not be the last one to bring a request
2 like this to the board . Brad Griffin stated that he shared the concern about the access.
3 Larry Sharpsteen stated that they could approve it contingent upon the completion of the SEQR and the board ' s •
4 receipt of the written document the lawyer received from NYSEG giving him permission to cross that land . Mr.
5 Burke asked if he submitted the written document from the lawyer if it would be ready for the closing the
6 following day. Larry Sharpsteen replied that it would depend on how the motion is worded . Larry Sharpsteen
7 stated that this was pretty fast because this should also have a public hearing, but that could be waived . Larry
8 stated that he would not be opposed to that.
9 Mr. Burke thanked the board .

12 Larry Sharpsteen motioned to accept the subdivision contingent upon receipt by the Code Enforcement Officer of
13 the appropriate documentation from the applicant, bearing in mind that the County has 45 days to give their
14 approval, and the Planning Board will waive the public hearing as there would not appear to be any potential
15 controversy regarding the subdivision. Lynn Davidson seconded . VOTE : ALL IN FAVOR. MOTION CARRIED
16 UNANIMOUSLY .
17 The board discussed construction of new houses and any related subdivision of property on Storm Rd . it was
18 determined that the property in question was over the acreage and road frontage required for a subdivision ,
19 therefore would not come before the board . The board asked that the Code Enforcement Officer begin to give
20 them a report on the new construction in the Town .

22 Approval of Munites of 11 /26/01 — Lynn Davidson moved to accept the minutes as submitted , Larry Sharpsteen
23 seconded . VOTE : ALL iN FAVOR, MOTION CARRIED UNANIMOUSLY.

25 Dennis Tarbell Subdivision . Tax Map # 20.4 -18.2 — Brad Griffin asked if the public hearing would have to be
26 re-advertised . Robin Cornell replied that it was never advertised.
27 The public hearing was set for Monday, January 14 , 2002 .

29 Discussion on Local Regulations Regarding Utilities — Brad Griffin stated that during their deliberations on the
30 Zoning Ordinance they raised the question about Local Regulations that would regulate utilities . Brad stated that
31 it seemed if there arc public service laws, Articles 7 & 8, that guide the siting and dimensions of transmission
32 lines and power plants, maybe there wasn ' t very much for the Town to do. Brad sent that question to Harry Willis
33 at the Department of State. Brad stated that it took a long time to get a reply, but he finally received it , Brad read
34 the letter. Brad stated that it may be worthwhile to have some reasonable regulation for those things that arc local
