Larry 20 Sharpsteen motioned to accept as a preliminary plat, David Hatfield seconded . VOTE: ALL IN FAVOR. 017 MOTION CARRIED UNANIMOUSLY . The public hearing was set for Monday, December 10 , 2001 , at 8 : 00 PM . Sear 23 l � . ' ? 24 Discussion on Debbie McKane letter — The Board discussed the letter from Debbie McKane regarding whether 25 a dog grooming business would be allowed in the old Lansing Liquor building on Ridge Road . The board 26 determined that under Sec . 503 . Schedule I of the Land Use Ordinance, " Kennel ; animal boarding" was not 27 permitted in the B1 zone . The Board read the definition of "Kennel " in Appendix I of the Land Use Ordinance 28 and determined that it included dog grooming. The Board stated that it was not a matter for the Planning Board, 29 but for the Zoning Officer and the Zoning Officer would have to deny such use in the 131 zone . it was also 30 determined that Ms. McKane would have to go to the Zoning Board of Appeals for a variance if she wanted to 31 pursue it. 32 Discussion on One-Lot Subdivisions — Larry Sharpsteen stated that he was not at the last meeting, but would 33 like to know where the issue of one-lot subdivisions stands . Bud Shattuck explained that under the advice of the 34 Town Attorney , the authority for the one-lot subdivision remains with the Code Enforcement Officer. Bud stated 35 that the Town Attorney advised that they make the necessary changes at the same time they change the Land Use 36 Ordinance . Bud stated that Dick Platt has agreed to bring all one-lot subdivisions before the Planning Board 37 before approval . 38 Larry Sharpsteen stated that he disagreed with Rich because the one-lot subdivisions do not have anything to do 39 with zoning . Larry Sharpsteen stated that he was concerned because he could see a lot of lots being lopped off for 40 sale. 41 Brad Griffin stated that 6 or 7 years ago, Cheryl Nichols brought this recommendation to the Planning Board , 4which at the time seemed like a good idea and the board approved it and sent it to the Town Board . Viola Miller 413 stated that it was agreed upon that the Code Enforcement Officer would still inform the Planning Board of those 44 one-lot subdivisions so that they would be aware of what was going on , but that did not happen . 45 Larry stated that he disagrees with the Town Attorney because these are two separate issues, but for now will 46 work with Dick Platt as suggested . Bud Shattuck stated that his interpretation of what Rich said may have been • 2 Town of Lansing Plannink Board, October 15, 2001 I wrong, that Rich may have just been saying that they would hold one public hearing and change both the one-lot 2 subdivisions and the Land Use Ordinance at the same time, rather than holding 2 separate public hearings . Larry 3 stated that that would make sense . 4 Approval of Minutes of 10/29/01 - Larry Sharpsteen moved to accept the minutes as submitted . Brad 5 Griffin seconded . VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY . 6 7 Review of Land Use Ordinance 8 9 The board resumed their review of the ordinance with Appendix 1, continuing from the definition Lot 10 Area through the end the definitions. 11 12 Other business 13 14 The Planning Board discussed Private Roads . Bud Shattuck and Nancy Loneto both stated that they did not have 15 copies of the Subdivision Rules and Regulations and requested that Robin send them a copy. 16 17 Bud Shattuck stated that he and some others were in the process of writing a new Wireless 18 Communication Master Plan for the Town of Lansing . Bud stated that he would make sure this board 19 would be able to review the plan before it is ever acted upon . Brad Griffin asked if it would be a plan , 20 not an ordinance. Bud stated that it would effectively take the place of an ordinance that this board will 21 be able to use for documenting what limits Nevi11he, what types of structures dealing with communication 22 devices . Brad asked if the county would supercede that plan . Bud replied that it would not, and he 23 believed the county would use it as a model . Bud stated that it would not effect. the Cell Tower 24 Ordinance as in the Wireless Communication Master Plan they do not discuss cell towers . O 25 26 Nancy Loncto motioned to adjourn at 9 : 16 . The Board is currently reviewing the Town Land Use Ordinance. One of the land use categories is "Public utility substation or storage yards ; electric or gas transmission line in certain districts." • It is our understanding that the siting of such utility transmission lines is actually decided under State P.S.C. law and proceedings. While the community wishes to assert its aspirations for appropriate land use in this category, we would hope not to erect regulations so unfounded in jurisdiction as to be ineffective. Consequently, we would seek to clearly understand the extent and limits of local authority to regulate the placement of "Public utility substation or storage yards ; electric or gas transmission line." Box r86 Lansing, NY 14882 Dear Mr. Platt: I am considering submitting a purchase offer to the owner of the property on Ridge Road known as the old `Lansing Liquor" property, in order to expand my current dog • grooming business . The purchase offer would , of course , include a contingency for zoning approval for this type of business. I am concerned ,however, because the property line for the old " Cortland Paving" property, which I understand the Town now owns, is so close to the "Lansing Liquor" building. I believe this may be a factor why the property has not previously been sold . ® I would like to inquire about the possible purchase of no less than 15 feet of land for a buffer from the new tenants, future renovations and /or parking.
