19 Review of Land Use Ordinance

26 Bud Shattuck stated that he was passing around a letter about what was going on at the Cornell site on
27 Snyder Rd .

29 Bud stated that at the last Planning Board meeting, there was a gentleman who was looking to subdivide
30 his properly on Auburn Road . Bud stated that the board gave him a couple options that might be
31 possibilities . Bud stated that the board left it up to the Town Engineer and the Highway Superintendent
32 and Code Enforcement Officer to make that determination as to what a turnaround was . Bud stated that
33 the Town Engineer and the Highway Superintendent decided they did not want anything to do with
34 being deciding factors .

36 Dick Platt stated that the intention is to get a hold of Harry Willis at the Department of State to try to
37 figure out what other towns do with private roads. Bud Shattuck stated that it comes down to private
38 roads and what composition private roads had to be, some definitions on private roads . Bud stated that
39 the Town Board is ill equipped to do that .

41 Lin Davidson stated that they had this discussion before and it seems to be at the will of the Town Board
42 to grant them .
Brad Griffin stated that there are two things that the ordinance speaks to with some clarity. One is that

45 The Town Board must approve natters having to do with roads before the Planning Board can make any
46 approvals . The other is that the Town Engineer is the one that sets the standards for private roads .

1 Dick Platt stated that the Town Board was asking whether they even want to accept private roads
2 anymore. Bud Shattuck stated that Dick was correct. Bud stated that if they accept a private road and
3 they subdivide again and again., and eventually it would be a public road and would have to be brought •
4 up to standard and who then pays the costs . Viola Miller stated that there are areas where it is not
.5 reasonable or feasible to put a public road in and a private road should be allowed . Viola added that
6 there are people who want to live on private roads and are perfectly willing to keep it up . Viola stated
7 she feels that you are doing a disservice to the community if you say there can not be any private roads .
8 Lin Davidson agreed with Viola and stated that there has to be standards for the private roads. Lin
9 stated that it was his understanding that emergency vehicles had to be able to pass each other and that it
10 had to have a certain degree of load bearing capacity. Bud replied that he brought that up at the last
11 Town Board meeting and he did not think the Highway Superintendent or Town Engineer wanted to
12 commit to either the width of the road or the construction of the road .

14 Brad Griffin stated that the ordinance states that these things will only be done with the understanding
15 that they will not be conveyed to the Town . Brad Griffin stated that the whole requirement for having
16 the Town Engineer look at those was to give the Planning Board and the Town Board something in the
17 way of competent credible advice. Brad Griffin read the definition of Private Roads on page 41 of the
18 Subdivision Regulations . The Board discussed Cedar Cove Rd . Lin Davidson stated that there was no
19 way 2 emergency vehicles could pass each other on that road and he thinks there is a great liability for
20 the town in that respect. Brad Griffin replied that there is certainly a liability if they do not obey their
21 own ordinance. All agreed .

23 Bud Shattuck stated Cedar Cove was the test of whether or not a fire truck could go over the culvert and
24 make that. corner. L,in Davidson stated that whatever the laws of this town are have to be followed ,
25 whatever the laws of how they build roads for the public have to he followed hit has more than one •
26 house on it . Bud Shattuck stated that he suggested that at the Town Board meeting and he did not think
27 the Highway Superintendent was in favor of saying anything for grade or construction . Brad Griffin
28 stated that, fortunately, the Town Board is not answerable to the Highway Superintendent. Bud
29 Shattuck stated that he was looking for direction . Brad Griffin stated that the Town Engineer and the
30 Town Attorney are there to give the Board advice .

32 David Hatfield motioned to adjourn at 932 . Lin Davidson seconded . VOTE : ALL IN FAVOR . MOTION
33 CARRIED UNANIMOUSLY .
