BUSINESS 15 Greg Travis opened the meeting at 7 : 00 PM . 16 Approval of Minutes of 8/ 13101. — Brad Griffin moved to accept the minutes as submitted . David Hatfield 17 seconded . VOTE : ALL IN FAVOR , MOTION CARRIED . 18 One Lot Subdivision Resolution 19 The following Resolution was duly made by motion of Dave Hatfield and seconded by Brad Griffin. All 20 members being present except Lin Davidson, the vote was unanimous . Whereas , the following action will help provide consistent application of the existing ordinance with regard to LG flag lots and multiple roadside divisions of property on contiguous or adjoining tax parcels . 23 It is hereby, 24 Resolved, that the Planning Board of the Town of Lansing hereby requests that the Town Board of the Town of 25 Lansing revert responsibility for the review and approval of one lot subdivisions to the Planning Board . � 6 27 Review of the proposed changes to the Land Use Ordinance 28 The Board resumed their review of the Land Use Ordinance with Section VIII . Nancy Loncto will note the 29 proposed changes and submit to the Planning Board . 30 31 Dave Hatfield motioned to adjourn at 9 : 45 PM . Brad Griffin corrected . . . stated that it is only meaningful . . . 17 . . . Viola Miller moved to accept the minutes as amended . David Hatfield seconded . VOTE: ALL IN FAVOR. 18 MOTION CARRIED . 19 Discussion on corrections to the proposed changes to the Land Use Ordinance — 20 Viola Miller stated that for Sec. 701 . 6.2 . (0 she thought they had said retained instead of maintained . The Board i discussed and agreed to the following : 2 701 . 6 , 2 . (j ) Proposed storm water drainage from the site. Natural drainage ways shall be maintained 73 retained whenever possible or replaced and maintained . 24 Viola Miller suggested deleting the word "any" in Sec. 707 .7 . 3 . The board members discussed and agreed to 25 remove. The change would be as follows : 26 707 . 2 . 3 . More convenience and flexibility in the location of auy-nencesidenthtI land use activity. 27 • 28 Subdivision - John Young, Tax Map Parcel it - Dick Platt explained that Mr. Young had originally .. 29 applied for 3 lots, but since the Planning Board already declared it a major subdivision , he decided to 30 change it to 4 lots. 31 32 John Young stated that he did some research on shared driveways. He stated that one positive reason is 33 to reduce pavement . He stated that in areas that are very densely populated that is important . Mr. 34 Young stated that he also assumed there are less curb cuts but did not find that in the literature . Mr. 35 Young stated that on the negative side he found three major problems . Mr. Young stated that the first 36 one is future conflict between neighbors. Mr. Young gave other examples of problems with shared 37 driveways that he found on the internet. M.r_ Young stated that he found in a health journal , that shared 38 driveways were a major contributing factor to the deaths of children in vehicular accidents . Viola Miller 39 stated that , primarily, what they were talking about whim trying to get the driveways off of the main 40 roads, that for big subdivisions they would show where the streets were going to be and the houses 41 would not all be coming out on a main road , but rather a smaller common road . Mr. Young responded 0 that he does not have any plans for a major subdivision so when these lots are sold, they would have to 1; access them by Waterwagon . Mr. Young stated that he spoke with . � • _ jr 2 Town of Lansing Planing Board. August 13, 2001 1 Pete Larson and Pete felt that any new house should have a driveway at least 100 feet from an 2 intersection so the change would be about 200 linear feet . 3 4 Brad Griffin stated that there remains about 100 acres and asked Mr. Young, in concept, what he had 5 planned for that 100 acres. Mr. Young stated that he doesn ' t have any plans, but that his sense is that at 6 some point the community is going to decide where it wants the community to stop and where it wants 7 the greenbelt around the community to begin. Brad Griffin asked what Mr. Young wanted . Mr. Young 8 stated that he enjoys it the way it is . Mr. Young stated that he has several other major parcels of land in 9 the Town of Lansing, and of those, he has only subdivided and sold lots on one of those . 10 11 Brad Griffin stated that it would be in the best interest of Mr. Young, his brother, and the Town if there 12 was a plan . Brad stated that he isn ' t there to force him to make a plan . Brad stated that he may do , more 13 for himself and his brother in some tangible way, as well as aesthetics, by giving it some thought as to 14 what he would like to have happen. Mr. Young stated that if he came up with a plan now, in a couple i 5 years with sewer or something, it may change . Gregg Travis stated that by leaving the area there for a 16 possible road , that is at least a start of a plan so that is good . 17 18 Gregg Travis stated that he does not see a compelling reason for the combined driveways . Gregg stated. 19 that lie personally would not want to share a driveway with someone. Larry Sharpsteen explained that 20 they suggest to developers across the board to minimizt. curb cuts when ever possible. Larry stated that 21 they encourage consideration for shared driveways or double driveways , Mr. Young read the deed 22 restrictions he planned to have regarding driveways . Larry Sharpsteen replied that was reasonable . 23 24 Lin Davidson moved to accept the preliminary plat. Brad Griffin seconded . VOTE : ALL IN FAVOR . 25 MOTION CARRIED UNANIMOUSLY . • 26 27 Public hearing was set for the next regular meeting, Monday, September 10 , 2001 . 28 29 Committee Reports • 30 31 Larry Sharpsteen stated that he had nothing for the Sewer Committee . 32 33 EMC — Larry Sharpsteen stated that the EMC doesn ' t have a meeting in the month of August . Larry 34 stated that the big flack is the drilling in the Heccor National Forest . Larry stated that the next place they 35 are going to be looking at drilling is in the Town of Danby. Lin Davidson asked if the EMC was against 36 it . Larry Sharpsteen replied that they came out in favor of Option 3 , which is that no development with 37 boring sites within the Hector National Forest but leasing of land outside for boring sites outside the 38 forest , 39 40 Sewer — Bud Shattuck stated that on September 6, 2001 , D . E. C . is going to have a meeting here in this 41 building. Bud stated he brought his copy of the overview document . Larry Sharpsteen asked if an 42 agreement had been signed . Bud Shattuck responded that 5 of the 6 municipalities had signed . Bud 43 explained the situation with the sewer. 44 45 Brad Griffin stated that he had sent away to get a copy of a bill purported to reform the general 46 obligations law about recreational trespass on private property. Brad stated that he thinks the legislature 47 has again blown it ' s own horn without great cause . Brad stated that what they had done was recommend 48 a study by the Superintendent of Insurance . 49 ', ' 7. . 3 Toxin ofLtznsing Planning Board, August 13, 2001 1The board discussed the situation with developers being made to designate certain areas for recreational ipland . Lin Davidson and Brad Griffin explained what they understood from the meeting they attended . 4 Gregg Travis stated that they are Lead Agency in the Cayuga Lake Waterfront Revitalization and asked 5 Bud Shattuck who was going to be contacting them . Bud responded that it would be Joan from the 6 Planning Department . Bud stated that she had been on vacation for a couple weeks so he had not talked 7 to her . 8 9 Bud Shattuck stated that he attended a meeting on cell towers. Bud stated that they gave several 10 example of alternatives to having cell towers in towns. Bud stated that the Town has had 2 sets of 1I people approach the Town about building cell towers and they have backed off and will probably back 12 off even farther after this . Bud stated that they have no rights at all to approach towns about building 13 cell towers, only if they have a signed contract with a provider and show cause to be in an area . Bud 14 added that the communities have rights to say that they don ' t want towers and that they only allow them 15 to put them on silos or telephone poles or whatever. Bud stated that the County has agreed that it is 16 going to look at a County Master Plan which the towns will be asked to pay for a portion of. 17 18 Bud Shattuck stated that the Village of Lansing is looking for someone to fill one position on the 19 Planning Board and one position on the Zoning Board of Appeals. 20 21 Viola Miller stated that it is getting very close to the time they need to think about budgets so she will 22 bring a report for the next meeting. 23 Other Business ii 26 Discussion on One- Lot Subdivisions — Gregg Travis stated that the minutes stated they would discuss 27 one- lot subdivisions . Gregg asked for an explanation as to why they should or should not request to 28 have the one- lot subdivisions back . Larry Sharpsteen stated that he thought it was more of an issue of 29 loss of control . Larry stated that there had been a number of incidents where there were members of the 30 board felt they were not being kept abreast of one- lot subdivisions. Viola Miller stated that the person 31 who started it all is no longer on the board and hasn ' t been for some time. Viola stated that at the time, 32 they had so much to do, that sometimes the one- lot subdivisions were taking so much of their time, they 33 could not get to the other stuff. Viola Miller stated that since then they have realized that they really 34 should be looking at this because they do not see what is going on and can ' t relate it to anything else . 35 Brad Griffin stated that given the experience since, he would say that it may be an abdication of the 36 board ' s responsibility and may place an undue burden on the Code Enforcement Officer in the conduct 37 of his duties . Viola agreed . Dick Platt agreed . 38 39 Viola Miller motioned that Larry Sharpsteen write the resolution to the Town Board requesting the 40 responsibility of doing one-lot subdivisions be given back to the Planning Board . Brad Griffin 41 seconded . VOTE : ALL IN FAVOR , MOTION CARRIED UNANIMOUSLY . 42 43 The next meeting is scheduled for August 27 , 2001 at 7 : 00 PM . 44 45Lin Davidson motioned to adjourn .
