Brad stated that only meaningful to As Board in that context. Lin 18 Davidson stated that es the changes are made to the document, the stuffto be deleted will show with a line 19 through it; and the new will be in bold or in a different color so that all the changes will be visible. 20 The Board compared the current ordinance with the proposed ordinance and the following changes runes noted_ 21 601 . 2 , No Lot shall hereafter be reduced or altered so as to result in a lot that does not meet the minimum area or yard requirements prescribed in SCHEDULE• II of this Ordinance, A 5140717 pre- existing lot that does not meet the minimum requirements of this Ordinance at 24 the time it is enacted may be used for a permitted use . 25 26 606 .0. OBSTRUCTION 03 VISION 27 28 'for safety reasons, no structure, fence or planting over 3 feet in height, and no 29 branches less than 10 feet from the ground , shall be permitted within the vision 30 triangle at road intersections . The vision triangle is an area formed by the right- 31 of- way lines of intersecting 32 roads and a diagonal line connecting 33 a point located on each of the 34 right -of way lines nod located a 35 distance of 25 feet from their 36 intersection . INTENT 2 3 The intent of this Article VIi is to protect the public health, safety and general welfare in • 4 the Town of Lansing and to maintain the intent of the Comprehensive Plan . Items 5 already covered by existing Federal, State and Local laws are not included below. This 6 Article intends to : 7 8 700 . 3 . Establish specific design and development guidelines that can be applied to development 9 in the BI Commercial Mixed-Use District & B2 Commercial Town Center as a means 10 of accomplishing objectives of the Comprehensive Plan for this district. 11 12 701 . 1 . Purpose. The intent of this Sec . 701 is to provide for Town Planning Board review and 13 approval of site plans for certain uses in the Town of Lansing for one or more of the 14 following purposes : 15 16 701 , 1 . 3 . Pceseni-ng-and-eenhaneing Conserving property value and visual quality in the Town as 17 development occurs. 18 19 701 . 3 . 2 . New construction of a one or two family dwelling unit., and related accessory 20 structures, as these terms are defined in Appendix Art. HI of this Ordinance . 21 22 (Insert Sec . 701 . 4. , thus changing all the remaining numbers in Sec . 701 ) 23 24 701 . 4. Site Plan Review Procedures for Certain Land Uses in Rural Agricultrual (RA 25 Districts. _ • 26 27 701 .4 . 1 Applicability. In a Rural Agricultural (RA) District site plan review is required 28 only for those communty , business, industrial/research and utility uses listed in 29 SCHEDULE I as requiring site plan review . 30 31 701 .4 . 2 Review Procedure in RA Districts 32 33 a . A plan for the proposed land use shall be presented to the Code Enforcment 34 Officer who shall refer it to the Planning Board for review at the next 35 meeting. 36 37 b. The Planning Board shall make an environmental SEAR determination on 38 the proposed development before proceeding with the site plan review. 39 40 c. The Planning Board may hold a public hearing on the proposal . 41 42 d . Within 45 days from the date of application , or from the date of a public 43 hearing if one is held , a decision to approve, with or without modification , or 44 disapprove the proposal shall be made by the Planning Board . This time 45 fram for decision will be adiusted as necessary to accommodate completion 46 of the SEAR process. 47 48 701 . 5 . Standards for Site Plan Review . AIRPORT HAZARD AREA 7 8 Notwithstanding other provisions of this Ordinance, and particularly SCHEDULE 9 1T, to the contrary, no lot shall be less than one acre in area, with a minimum of 200 10 feet of frontage, and no dwelling, school , nursing home or place of public assembly 11 shall be permitted within the "Land Use Restriction Area " as this may be shown on 12 the Land Use Control Map . In addition, before a building permit is issued for any 13 construction in the said Land Use Restriction Area the Code Enforcement Officer shall 14 inform the applicant in writing of noise and hazard conditions that are possible in the 15 flight path of the Tompkins County Airport . 16 17 706 . 0. COMMERCIAL MIXED USE (B1 & B2 Districts) 18 19 Except for one and two family dwellings , no building permit shall be issued and no 20 development shall occur, in any Commercial Mixed-Use (B1 or B2) District, as 21 delineated on the Land Use Control Map , unless site plan review and approval has 22 been obtained in accordance with applicable provisions of Sec. 701 of this 23 Ordinance. Site plan review shall include consideration of any special performance 24 standards or guidelines that my be established to achieve Comprehensive Plan 25 objectives for development in this district. • 26 27 707.0 . PLANNED DEVELOPMENT AREA (PDA ) 28 29 707 , 2 . 3 . More convenience and flexibility in the location of any nernesidenfial land use 30 activities . 31 32 707 . 2 . 6 . A development pattern in harmony with the objectives of the Comprehensive 33 Plan and complimentary to the character of the surrounding area . 34 35 36 707 . 3 . ions- Preliminary Proposal 37 38 An applicant wishing approval for a Planned Development Area shall submit a 39 request to the Planning Board , with a copy to the Town Board , in the form of a 40 Preliminary Proposal which shall include : 41 424. Unless waived or otherwise modified by 2 Town Board resolution, each site plan for a proposed land use activity shall conform to the general standards listed in this Section 701 . 5 . , as applicable, and to any other 4 concerns specifically related to a particular site, as may be identified and described in 5 writing by the Town Planning Board . 6 7 701 . 5 . 3 . Off- street Parking . Parking areas, if any, shall be determined to be adequate in terms of 8 area, safe access thereto and surface water drainage . The Town Planning Board shall be 9 satisfied that an adequate amount of off-street parking will be provided . (see Section IX) 10 11 701 . 5 . 8 . Additional Information . When the Town Planning Board determines by resolution that 12 special conditions exist that could adversely affect the proposed development, or 13 negatively impact adjacent land, additional information and considerations may be 14 required as part of the site plan review process . 15 16 701 . 6 . Site Plan Review Procedure. 17 18 701 . 6 . 1 . Application . Each application for site plan review and approval , shall be made on 19 forms provided by the Code Enforcement Officer. Such application shall be 20 submitted to the Town Planning Board by the Code Enforcement Officer. 2I 22 701 . 6 , 2 . j . Proposed storm water drainage from the site. Natural drainage ways shall 23 be maintained whenever possible or replaced . 24 701 , 7 . Site Plan Approval Procedure in Districts other than Rural Agricultural . - J 27 701 . 7 . 2 . Hearing. Before a decision is made on an application for site plan approval, the Town 28 Planning Board may hold a public hearing on such application . The hearing shall be 29 held within 45 days from the date a completed application is submitted to the Code 30 Enforcement officer and an environmental determination has been made. 31 32 701 . 7 . 3 . Decision .
