20 Brad Grif 'in opened the meeting at 7 : 30 PM.
• Approve Minutes of 10/9/00 - Viola Miller corrected . _ . . an asterisk should be inserted by her name as she
22 was in attendance. Iain Davidson moved to accept the minutes as corrected . Jackie Baker seconded. VOTE:
23 ALL IN FAVOR MOTION CARRIED UNANIMOUSLY.
24 John Young Subdivision , Tax Map # 44.- 1 -35 - The members reviewed the application . Gregg Travis
25 asked about the tax map numbers of some of the parcels. Mr. Young explained that the survey was originally
26 done before he bought the property. Mr. Young stated that he went through the subdivision process with the
27 Planning Board when he sold the other parcels previously. Mr. Young stated that he got a call from the
28 neighbor who lives in the village and they wanted to buy an additional acre next to their property. George
29 Totman stated that because the other property is in the Village of Lansing, it could not be done as a boundary
30 change like it would if it were in the Town.
31 Gregg Travis stated that because the other lots had already been divided this would make it a major
32 subdivision. Mr. Young stated that George Totman told him that might be the case. Brad Griffin asked who
33 has the easement through there , Mr. Young replied that it is the Water Authority and showed them the parcel
34 on which the tank sits . Brad Griffin stated that the regulations require that it be classified as a major
35 subdivision and there needed to be a public hearing.
36 They discussed the topography . it was decided that the U . S . G . S . information would be sufficient for the
37 property, therefore would not require that a surveyor do the topography. Brad stated that their view would be
38 that, in terms of previous information that he has presented , the relationship of its topography to the adjoining
39 area, the U . S . G. S . would be enough to show a reasonable person what that topography is .

• The Board reviewed the SEQR. Lin Davidson moved to declare a negative declaration . Gregg Travis
42 seconded . VOTE ALL IN FAVOR. MOTION CARRIED .

John Young stated that for the meeting in December he should bring in the maps with the elevation lines
2 sketched in. George Tatman stated that he usually asks that they submit 10 copies . Mr. Young asked how ;4a
3 much the fee was going to be. George Totman replied that the initial application is $ 25 , then $ 50 per lot for a
4 major subdivision.
5 Ron Ronsvalle Subdivision Request Tax Map ti P/O 39 .44 — Mr. Ronsvalle introduced his Desigm
6 Consultant, Dan Signore. Mr. Signore explained that Mr. Ronsvalle purchased the property, and subdivided it
7 into 2 lots . Mr. Signore stated that what he would like to do is divide one of the remaining lots into 3 lots ,
8 making it a total of 4 lots. Mr. Signore explained that there would be one curb cut for all four lots . Mr.
9 Ronsvalle explained that they would be turning Lot B into Lots B , C and D.
10 Jackie Baker asked if these were going to be houses. Mr. Signore replied that they were going to be duplexes.
1 Jackie asked if they were going to be one story. Mr. Signore stated that they would have a one car attached
12 garage for each unit and there would be a common parking area. Viola Miller stated that there would be two
13 families in each building. George Totman reminded them that this was a subdivision request. Viola Miller
14 replied that she knew that, but they needed to look at it for drainage and such . •
1. 5 Mr. Ronsvalle explained the things he had gone through up to this point with the UFPO, the health department,
16 Spuds Excavating, and Garth McMillen Electric, the plumbing contractor, and many others. Mr. Ronsvalle
17 explained that they are trying to plan for the future for telephone and the underground electric and cable. Brad
Is Grifnn asked if this would require an extension of water. Mr. Ronsvalle replied that it would not.
19 Gregg Travis asked if they are requesting a sketch plan approval of preliminary approval. Mr. Signore
20 responded that they are requesting preliminary approval .
21 Gregg Travis asked how long ago the one lot subdivision took place. George Totman replied that it was 2
22 months ago . Mr. Ronsvalle asked why that would be relevant. Gregg .Travis replied that they need to know
23 that information to determine whether they are looking at a major or a minor subdivision. Viola Miller asked
24 why he would want to subdivide them anyway because it would make the assessment more. Mr. Ronsvalle
25 replied that they were under a moratorium right now preventing multi-family residences from being built. Bud
26 Shattuck explained that you could not put 3 duplexes on one lot without it being considered multi -family. Mr.
27 Signore stated that it is the best use of the land, that the septic systems are approved by the health department
2S and meet all the requirements.
29 Ron Ronsvalle stated that he is requesting that parcel B be divided into 3 lots and that is not a major
30 subdivision . Lin Davidson stated that is why they needed to determine the time frame, and using that time
31 frame, Lot A is included. Mr. Ronsvalle disagreed. He stated that it is a separate lot with it' s own tax parcel
32 number. Gregg Travis stated it all came from one parent parcel .
33 Brad Griffin stated that they would poll the board as to whether they thought this would be a minor or a major

39 Brad Griffin stated that they are all in agreement that it is a major subdivision.
.tu Ron Ronsvalle asked if they would read him that section of the Subdivision Rules and Regulations , Brad
41 Griffin read it aloud. Mr. Ronsvalle asked if it mentioned a time line in there. George Tatman replied that is
42 was the same thing as the previous subdivision. Mr. Ronsvalle asked how much time would have to lapse
43 before it would be considered 3 lots . Lin Davidson stated that 3 years has been the standard . George Totman W
44 explained that basically, the only difference is that they would have to have a public hearing.
45 Gregg Travis stated that the only part of the map that is missing is the topography . Mr. Signore stated that he
-16 gave it to George Tatman , so they should have it already, but if they do not he could drop it off in the morning.

1 Brad Griffin stated there were only 2 adjoining owners listed on the application . Brad asked about the owners
2 across the road, to the north and to the west. George Totman replied that if it goes to public hearing, his office
,t takes the tax map and determines all the adjoining owners . George explained that they take the applicant' s list
4 as a guideline, but would be remiss if they just used the list given.
5 The public hearing was set for Monday, December 11 , 2000, at 8 : 00 PM .
6 The Board reviewed the SEQR. David Hatfield moved to declare a negative declaration. Lin Davidson

8 Gregg Travis stated that in order to go to the public hearing, they should have new maps with the contours and
9 utilities and such . Ron Ronsvalle asked if the Planning Board votes on this the night of the public hearing and
10 when the approval would come about. Brad Griffin stated that they try to make that timely.
11 Ron Ronsvalle stated that he appreciated their consideration.
12 OTHER BUSINESS
13 Brad Griffin stated that Tom Niederkom submitted a summary with the Planning Board ' s recommendation to
14 the Town Board. Brad Griffin stated that he hoped that the Town Board would regard Torn Niederkorn as not
15 only the Planning Board 's consultant, but the Town' s consultant.
16 Brad Griffin stated that he called the Department of State recently. Brad stated that with regard to letters they
17 received questioning the right of the Planning Board to delegate responsibility of single lot subdivisions , he
18 spoke with Harry Willis. Brad Griffin said that they spoke for quite some time, but that the punch line is that
19 within Town Law, the Planning Board does not have the authority to delegate anything , the Town Board may
20 delegate. George Totman replied that is what happened in this case, the Planning Board made a
21 recommendation to the Town Board and the Town Board passed a resolution .
3 Brad Griffin read Jackie Baker ' s resignation letter. Brad stated that they will miss Jackie Baker, but that is
23 would not be too early to think of candidates to recommend to the Town Board. Viola Miller suggested that
24 they look for someone from south of Asbury Rd. Viola stated that with Jackie leaving , the board is getting very
25 unbalanced and it would be nice it the replacement would be a woman . Bud Shattuck stated that recommend
26 Nancy Lonate.
27 Bud Shattuck stated that when he got the packet from Tom Niederkorn , he distributed it to the other members
28 of the Town Board . And at the same time, he made sure they were aware of the time needed to do the public
29 hearing, turning it over to the County, etc. Bud stated that when they got the packets and because of the
30 amount of changes, it was apparent that they could not get everything done by December 31 , 2000 . Bud stated
31 that they will be extending the moratorium, probably 60 days, at the next Town Board meeting. Bud stated
32 that they will be sending out letters to the residents explaining the changes and then have an informational
33 meeting.
34 Bud Shattuck stated that the Tome Board would like to have a joint meeting with the Planning Board . The
35 meeting is set for Monday, November 20, 2000.
36 Treasurer' s Report — Jackie Baker stated that they have $ 1486 left for the year. They have spent $62 for the
37 Ithaca Journal, $ 78 for supplies, $ 1390 for TG Miller, $212 for legal fees , and 51347 for consulting fees and a
38 few otter smaller items. Viola Miller moved to approve the Treasurer ' s Report. Lin Davidson seconded .
39 VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY .
40 Lin Davidson motioned to adjourn at 9 : 1013M. David Hatfield seconded . VOTE : ALL IN FAVOR .
