30 Lin Davidson opened the meeting at 7 : 40 PM .

34 Bud Shattuck passed out copies of the information LLR.i) submitted at the Town Board meeting on September
35 6 .
36 Lin Davidson stated that lie spoke with Torn Niederkorn about a timetable for reviewing the ordinance. Lin
37 passed out copies of a timetable to the members of the board. The Board discussed getting together for a work
38 meeting to discuss the ordinance before the next regular meeting .
39 Public Hearing — John Hicks, Subdivision Request, Murfield Drive, Tax Map ft 42 .- 1 - 1 . 12
40 Lin Davidson read the legal notice. Lin opened the public hearing at 7 :47 PM. George Tatman stated that he
ahad a letter from Dave Herrick . George added that Mr. Hicks also received a letter from the D . E. C . regarding
the water issue. Viola Miller asked if they did a SEQR on the subdivision , George Totmam replied that they
43 did a SEQR on the subdivision as a whole when it was originally presented and asked if they really needed to
44 do another one for the additional four parcels . Viola Miller suggested that they discuss it after they close the

public hearing . Viola Miller moved to close the public hearing. David Hatfield seconded. VOTE : ALL ITS'
2 FAVOR . MOTION CARRIED UNANIMOUSLY. •
3 McKane Subdivision, Buck Road , Tax Parcel #27 .4 -27 .22 - George Totman explained that the McKane ' s
4 previously sold a house and a portion of this parcel in about 1993 , then built a house next door to it . George
5 Totman stated that there was a garage across the road from their new house. George stated that about 3 years
6 later they sold another parcel . George Totting' stated that this year they sold their house and a part of the
? parcel . George stated that the parcel was bigger than what would require a subdivision . George explained that
8 he made a mistake in that the garage across the road was originally part of the total parcel , but when they sold
9 their house, they kept the garage. George had been told that the parcel of land where the garage was located
10 would still be part of the remaining parcel . George explained that when he saw the survey of it, he realized
I that the garage parcel was no longer contiguous with the remaining parcel, so therefore would have it' s own
12 tax map number, which made it more than a one lot subdivision . George Totman stated thatbe had Rich John ,
13 Town Attorney, come talk to the McKanes . Goerge stated that all the lots were probably twice the size that
14 would be required for a one lot subdivision , but because the parcel with the garage was not contiguous , it
15 becomes a three lot subdivision. Rich John stated that both he and George met with the Assessment
16 Department to see if the garage parcel would be given a separate tax map number and were told that it would.
17 The Board discussed the map. Gregg Travis asked lithe McKanes had plans to further subdivide. Deborah
IS McKane stated that maybe in the future. Gregg Travis stated that because this was a three lot subdivision, if
19 they go to further subdivide, it would kick it from a minor to a major subdivision. Mark McKane asked if there
211 was a limit on the time before they could subdivide without it being a major subdivision . Rich John stated that
21 the policy has been 3 years . Mr. ivlcKane asked if the size of the lots was a factor. George Totman replied that
22 the subdivision regulations apply to lots less than 3 acres or less than 300 feet of road frontage.
24 Gregg Travis motioned to declare this application as a minor subdivision. David Hatfield seconded . VOTE: IIP
25 ALL EN FAVOR. MOTION CARRIED UNANIMOUSLY.

27 The Board discussed the necessity of holding a public hearing. Gregg Travis asked about Supplement 1 , Page
28 43 of the Subdivision Rules and Regulations , which stated that a. public hearing is required. Rich John
29 reviewed the Subdivision Regulations and stated that it appears that Supplement 1 appears to be what they
30 need to follow. The public hearing was set for 7 : 00PM on September 25 , 2000.

32 Gregg Travis read the SEQR. The Board declared a negative declaration.. Lin Davidson, as acting chairman ,
33 signed the SEQR.

36 Viola Miller motioned to approve the extension of the existing subdivision by four lots . Gregg Travis
37 seconded . VOTE : ALL IN FAVOR . MOTION CARRIED UNANIMOUSLY .

39 Privilege of the Floor
40 Doug Firth stated that an add-on to an initial subdivision is classified as a major subdivision. Lin Davidson
• 41 stated that is was an extension of a major subdivision . Doug Firth stated that it says that it in itself is a major
42 subdivision. Viola Miller disagreed . Viola Miller explained that a few years prior that there had been an
43 original subdivision, that they had reviewed and approved that subdivision, and this was just an extension of
44 that subdivision . Mt Firth asked if they would have to do a SEQR on this extension. The Board discussed it.
45 Lira Davidson stated that they did the SEQR as part of the major subdivision. Mr. Firth stated that he did not

46 see where it says that they can do that. Viola Miller stated that this area was part of the original subdivision.
47 M.r. Firth stated that they had already considered this as part of the subdivision prior to tonight. Viola Miller
48 stated that was correct .

• Pat Conlon asked how much of an area SEQR. does involve when doing they are approving a subdivision . .Lin
Davidson asked if his question was a matter of phasing. Mr. Conlon stated that he did not hear anything about
4 phasing, that he was asking how much of an area is considered in a SEQR review. Lin Davidson stated that
5 they would have to pull the file and take a look at it. Mr. Conlon stated that his question was a blanket
6 question, not directed at this instance, but at any instance.
7 Review of the Land Use Ordinance
8 Viola Miller stated that she has a copy of most of the comments that have come in . Viola Miller stated that
9 some of the comments have come from people that may be even more knowledgeable about it than those that
10 sit on the Board . Viola. also stated that the people that sit on the Board try very hard to do the job they are
11 supposed to do.

13 Viola Miller stated that before she goes into this , everyone should take a hard look at their maps so that it could
14 be more easily understood. Viola stated that density is one of the major areas that need to be addressed. Viola
15 stated that some of the things they need to look at are lot size in RI , the size of the Rl district, do they want to
16 leave it as large as it is presently? Viola also stated that they need to consider PDAs allowed in Rl . Viola
17 stated that Site Plan Review was something else that they needed to take a look at. Viola stated that they have
18 been told that Site Plan should be done by the Planning Board , it should not be political.

20 Lin Davidson passed out copies of the draft ordinance in which Viola had marked the changes that the Town
21 Board had made.

23 Viola Miller stated that the R3 zone was very similar to R I zone. Viola stated that you have to allow mobile
el homes somewhere and you also have to allow apartments somewhere. Viola suggested that they look at
25 possibly extending the R3 zone north ofPeruville Road .

27 Viola stated that when they meet together, obviously they have to put the greatest emphasis on the moratorium .
28 Viola stated that they should read over the draft ordinance and see how much of it fits with what they like and
29 what they want for the future. Viola said to look at the map and think about where sewer and water was going
30 to go .

32 Viola stated that everyone should take a look at the information and comments that they had received. Viola
33 Miller stated that in Schedule 1 of the draft ordinance, conversion of existing structure into three or more
34 dwelling units should be Not Permitted in the low density zone. Viola stated that if someone does not like a
35 decision that was made by the Planning Board or the Code Enforcement they can go to the Zoning Board of
36 Appeals. Viola stated that the only thing that can not be appealed is a decision by the Town Board .

38 Dennis Osika stated that the Zoning Board of Appeals declined to hear their appeal about a ruling by the Code
39 Enforcement Officer. Mr. Osika stated that he did not feel they knew what their responsibility was. Lin
40 Davidson stated that if it was allowed in the ordinance as it was , then there would not be a question about
41 whether it is legal and the Zoning Board of Appeals may feel that it is not their jurisdiction to deal with it,

43 Walter Polland stated that they may also want to take a look at their current definition of an appeal and they
44 may find why people either do not take applications to the ZBA. Nancy Loncto stated that she would
45 encourage them to take Site Plan Review and hold it close to their hearts. Mrs. Loncto stated that the burden
1` for Site Plan Review belongs on the developer, not on the residents that are already there .
48 Lin Davidson motioned to adjourn this meeting at 9 : 54 PM until 1 : 00 PM on Sunday, September 24 , 2000 at
49 the Tea Room. Gregg Travis seconded , VOTE: ALL IN FAVOR. MOTION CARRIED
