I p Page 1 1 e ; 1 T 0 own o f L 3 Monday, March 13 , 2000 ; 7 : 30 PM PLANNING BOARD 4 PLANNING BOARD MEMBERS 5 (*Denotes present) 6 Brad Griffin, Chair * Jacoba Baker 7 Larry Sharpsteen Lin Davidson 8 * Viola Miller David Hatfield 9 * Gregg Travis 10 11 * Bud Shattuck, Town Councilman 12 * George Totman, Zoning and Code Enforcement Officer 13 14 GENERAL BUSINESS 15 Viola Miller called the meeting to order at 7 : 39 PM . 16 Discussion of Minutes of 2/14/00- Viola Miller stated that they could not approve the minutes because they did 17 not have a quorum. Viola added that both she and Jackie were not at this meeting. Everyone agreed to wait until 18 the next meeting to discuss . IBud Shattuck stated that everyone thought the joint meeting of the Town Board and Planning Board was worthwhile . Viola Miller stated that she knew Meg Overstrom is working on a committee for the Town Center and 21 Viola was wondering if she would care for input from the Planning Board , Bud Shattuck stated that he can not 22 speak specifically for Meg, but explained what Meg has done and that she is contacting the people that served on 23 the 2010 Committee. 24 Request for Zoning Change - George Tolman explained that the Town Board had received this request for zoning 25 changes from Walt Sweazey & Mike Sweazey for their properties on Ridge Road. Bud Shattuck stated that it came - 26 through the Town Board and that the Town Board is now giving -it toAhe Planning Board for their recommendation . 27 They discussed the request. Viola Miller stated that it is clearly not a case of hardship and it would not be bettering 28 the community . They decided that they should not recommend the change. Viola Miller stated that with the 29 recommendation for no change, they can still go to the Zoning Board of Appeals . 30 Discussion on Snyder Hill- Viola Miller stated that she received a report on the progress on Snyder Hill . Viola 31 stated that Cornell is keeping everyone apprized of the situation . Gregg Travis stated that he heard something 32 about someone being over an aquifer. George Totman responded . Matt Shulman stated that he did an article on it 33 about six months ago. Matt stated that if it would be helpful, he would get them a copy of it. Bud Shattuck asked 34 Matt if he would send copies to the Planning Board and to the Town Board . Matt replied that he would do so . 35 Rick Paae, Subdivision Request- George Tatman explained the subdivision as requested. George stated that Mr. 36 Page is out of town and could not be here tonight. George stated that he, Steve Farkas, and Rich John had all 37 spoken with Harry Willis from the State and were told that there is no law limiting the number of houses on a 38 private road . George Tatman stated that Mr. Page is going to come to the next meeting, but he wanted the Planning 39 Board to look at it and talk it over. George stated that Mr. Page will take suggestions from the Planning Board • meeting . The board reviewed the request. DISCUSSION ON LAND USE ORDINANCE 42 Articles I-III — No changes suggested 2 Town of Lansing Planning Board, February 14, 1999 1 Article IV 2 Sec 401 . 1 .- Gregg Travis stated that to his understanding the Town Board did not want the boundary lines to follow • 3 center lines of streets . Everyone agreed they should discuss this section at the next meeting . 4 Sec 402 . 7 . — Gregg Travis stated that this refers to nearby neighborhoods (line 7), yet there is no definition for a 5 neighborhood . Gregg stated that he thinks they need to be consistent here. 6 Article V 7 Sec. 503 . Schedule 1- Viola Miller stated that there seems to be a lot of SC 802 . 0 . and she thinks this is not clear as 8 to what it means . George Totman stated that it is sort of a safety check to make sure all conditions are met, but it is 9 allowed in the area . Viola Miller stated that it is very confusing and it is something that was brought up by both 10 Tom Nioderkorn and Susan Brock . George Totman explained that the Town Board ' s feeling at that time was that 11 they allow some things in certain district, as long as they meet all the conditions, why should they have to have a 12 public hearing? Viola Miller asked why they don 't just say it is permitted then . George Totman replied that what 13 they want to do is make sure people come just to make sure they don 't go off half beat somewhere . George stated 14 that they make sure they have the right setbacks and yard frontage and that sort of thing . Viola Miller responded 15 that as the Code Enforcement Officer, those are things that are just natural with any building . Viola Miller stated 16 that she just felt it should be brought up again . Viola asked Gregg Travis what his feeling was on it. Gregg replied 17 that they should bring it up again for discussion . Gregg stated that all the things they are discussing tonight will 18 have to be brought tip again . 19 Page V-5 , Items 26 & 28 - Viola Miller stated there should be asterisks indicating that Site Plan Review is required . 20 Page V-7, Item # 6 - Viola Miller stated that it has Special Conditions , but no site plan for Commercial excavation 21 of rock, sand, gravel, salt and similar products . Viola stated that she would think that would take a spa ial pennit. 22 George Totman explained that they would also have to get approval from the DEC . Viola Miller stated that it does 23 not say that in here and said that George may know that but most people would not . • 24 Page V-7. Items #i 6 & 7 — Gregg Travis wondered what the difference between the two is . Gregg stated that it 25 looks as though means they are just looking. Gregg stated that he was curious as to why the exploration is allowed 26 under special conditions, but if you look above the excavation is not allowed . Gregg stated that they can look for it, 27 but if they find gold they would not be able to make a commercial operation out of it. Gregg stated that it seems 28 there are inconsistencies there. 29 Viola Miller stated that it took her awhile to realize that an "SC" means that it is permitted, although it does not say 30 permitted . Viola Miller stated that she has come to the conclusion that all "SC's are permitted . Viola Miller stated 31 that the ones that are not going to be permitted are going to have to be "SP"s . 32 Pave V-9, Sec . 504 , Schedule Il — Viola Miller stated that in RA, they used 20 feetas minimum road frontage 33 because that is a flag lot, but they do not need to consider that. Viola explained that flag lots are special and carry 34 their own dimensions if they are permitted . Viola stated that they are not permitted in the zoning, they are only 35 permitted through the Subdivision Regulations . Viola stated that this should state the minimum that they want, riot 36 the 20 feet. Viola Miller asked what they would like the minimum road frontage to be in the rural area in order for 37 it not to look like snip development.. They discussed cul-de-sacs . Viola asked why they don 't put something in here 38 that relates to cul-de-sacs . Gregg stated that they could footnote it. Gregg Travis stated they should be consistent 39 with Health Department. minimums . They suggested 150 feet minimum road frontage in RA . 40 Gregg Travis stated that he does not understand what is meant by 20/75 in the B1 district for Non-residential or 41 Mixed Development for minimum road frontage with or without public sewer or water. George Totman stated he 42 knows what it means . George stated that if it is 20 feet for a flag lot, otherwise it is 75 feet. Gregg Travis stated 43 that it needs to be clarified . George stated that it has note #5 and if you look at the next page tinder number 5 it 44 talks about flag lots . 41111) 45 Viola Miller stated that she needs a new sheet for Pages V-9 & V- 10 . 46 3 Town of Lansing Planning Board, February 14, 1999 1 OTHER BUSINESS alBud Shattuck stated that he has a couple things he would like to say. Bud stated that he thinks the Town Board was hoping they would be an active Planning Board and that during their meetings, or their subcommittees, they 4 would be starting to move forward and starting this planning phase. Bud stated that he is not casting any 5 judgement. Bud stated that when he conies back from one of these meetings to a Town Board meeting, they will 6 ask him where the Planning Board is in starting the plan for how to discuss sewer coming out to this area . Viola 7 Miller stated that it is something new to them . Bud stated that he understood . Jackie Baker asked if they would 8 give the Planning Board a list of priorities that the Town Board would like to have the Planning Board work on . 9 Bud stated that he will have the priority list for the next meeting . 1.0 Bud Shattuck stated that he read this article on the measure of success in zoning. He suggested it might be good 11 reading for the members of the Planning Board as well . They discussed the article. Viola Miller stated that this 12 goes back to the original Comprehensive Plan . Viola explained that they were not aware of the fact that the water 13 was going as far as it did or they might have had different ideas on it. 14 15 Viola Miller suggested they hold the second meeting in March .
