Farkas 134 Bower Road 27 Paul Butler 105 Hillcrest Rd 28 William Targosh 397 Buck Road 29 Cheryl Nickel 99 East Lake Road 30 Rich John Town Attorney 31 32 33 GENERAL BUSINESS 34 Viola Miller called the meeting to order at 6 : 30 PM . 35 Discussion of Proposed Zone Ordinance- Tom Neiderkorn stated he was quite pleased with the work 36 that the Town Board has put in on this . There are a few things Tom is concerned about and would like 37 to go over. 38 Tom listed the significant changes in the map. The B1 District is extended down Rt. 34 to the Village 39 Line, RA District dropped down to the south side of Peruville Road. Tom stated he was concerned that 40 this may opportunity for strip development. The extension of L1 to Myers Point is probably okay. The d' change of the area west of Ludlowville from R3 to R2 . Tom stated he did not see that would be a 42 problem . Tom stated that the elimination of the B2 district doesn ' t mean significant change.ge. 2 Town of Lansing Planning Board, March 9, 1998 1 Moving on to the regulations, Tom stated that on Schedule I, pages V-6 through V- 8 , where it is listed as 2 permitted with special conditions 802 . 0 . The conditions are not listed in 802 . 0 . Tom stated that it • 3 should be "SC" instead of "P" . Larry Tvaroha stated it would be okay to change . Viola Miller also 4 stated that on page V-7, the numbering needs to be corrected, change to " 10 ." 5 Tom Neiderkorn stated that on page V-2 , the dwelling types have been combined under one category and 6 permitted in every district except IR. Tom stated there is not a problem with that if you do not believe it 7 is inappropriate to have apartment dwellings and multi-family dwellings in Low Density Residential . On 8 Schedule II, page V-9, R- 1 density was changed to 12 ,000 sf minimum. There could be some fairly 9 dense development if there were sewers available . Tom stated that seems to be inconsistent with low 10 density. Tom also stated that what is already zoned low density is the area which will be zoned R2 . The 11 current minimum lot size is 12 ,000 sf and it has been changed to 10,000 . Tom suggested making an 12 adjustment so as not to diminish the minimum lot size in areas where they already have established a 13 minimum lot size . 14 Tom stated that the Town Board is being more strict with farm uses . Other than crops, they are not being 15 allowed in the L1 , R1 , R2, and B1 Districts . Larry Sharpsteen stated that goes against all the public 16 comments they have had. Larry Tvaroha responded that current farming practices can continue . 17 On Schedule II, page V-9, where front yard setback is 30/60, under notes it needs to list #2 in the last 18 column. Also, note #6 needs to be added where the minimum road, frontage is 20/75 . 19 Regarding Site Plan Approval, Tom stated it seems to him that the Town Board kept most of the 20 objectives of Site Plan Approval . Larry Sharpsteen agreed. Lin Davidson stated that they took it off for 21 truck and motor freight terminals . Larry Sharpsteen stated there were very few which required Site Plan 22 Review, and they were very specific uses . The Site Plan Review was designed to protect the 23 neighboring property owners and to enhance the value of the property. Larry stated that was not overly • 24 restrictive, yet it has eliminated. Tom Neiderkorn stated that may be something the Town Board will be 25 willing to discuss with you. Tom stated that there is some inconsistency in the area of Site Plan Review. 26 Where it says "Appropriate Board" it should state which Board. If it is to be the Town Board, it would 27 also need to be changed to say Town Board in all areas . 28 Public Hearing - Ron Seacord Development- Larry Sharpsteen recused himself from the Planning 29 Board. Lin Davidson read the public notice . Viola Miller declared the public hearing open at 7 : 00 PM. 30 Roger VandePoel stated his neighborhood had submitted a plan suggesting ideas for traffic control to the 31 Planning Board. He would like to hear a response from the Board . George Totman stated that after the 32 road is complete and dedicated, the Town Board can look at your request. If they agree with the request 33 they will send it to the State. Town Board agrees with the concept, but they have to get approval from 34 the State . Mr. VandePoel stated they also suggested some sort of natural separation of the existing 35 residences and any new commercial development. They are also concerned with lighting . Larry 36 Sharpsteen, speaking as construction manager for Mr. Seacord, stated covenants require shoebox 37 lighting. The owner of property that has already been developed has been notified of that . Viola Miller 38 stated the Planning Board appreciated Mr. VandePoel ' s letter. Mr. VandePoel gave the Planning Board 39 pictures taken last Fall of traffic around the ball field to demonstrate the problem with traffic congestion. 40 Larry Sharpsteen stated the stop sign was put up voluntarily by developer to control the traffic . Mr. 41 VandePoel also questioned the traffic study that was done, was that done solely on the intersection on 42 East Shore Drive? Larry Sharpsteen state it was required by the state to do traffic study of the new 43 intersection. 44 Michael Matier asked whether the decision making on the roads was on the Town Board. The Planning • 45 Board stated yes that will be a decision of the Town Board. Mr. Matier asked if Town Board is in favor 46 of the suggestions submitted . Larry Tvaroha stated the Town Board supported the suggestions . Roger 3 Town of Lansing Planning Board, March 9, 1998 1 VandePoel stated they had not addressed the issue of an earth berme . Larry Sharpsteen stated that quite 2 often, the bermes do not measure up to intention. W3 Lin Davidson moved to close the Public Hearing at 7 : 18 PM. Al White seconded. VOTE ALL IN 4 FAVOR, ONE ABSTENTION. MOTION CARRIED . 5 Privilege of the Floor- Pat Conlon stated he gave a letter to Supervisor Kirby along with the petition he 6 had originally gave to the Planning Board last August. The petition was to restore the R3 district to the 7 R1 area. 8 Peter DeLorme agreed with Pat Conlon. He stated that what they thought would be primarily residential 9 is now subject to other types of uses . Rather than having it changed back to R1 , they have added even 10 more uses . It is worse rather than better. 11 Susan Miller stated she was disappointed after reading the new proposal . Originally, it was not intended 12 to be a business district, but now there are thirty-some retail businesses that can go in the R3 district. 13 Susan Miller stated it would now appear R3 has become a dumping zone . Susan stated she is 14 disappointed in the lack of attention to the feelings and input of the residences . 15 Steve Farkas stated he is concerned in reading this . Although he is all for the protection of agricultural 16 land, he also believes anyone living in the Town of Lansing should have some protection. If a farmer is 17 farming that is great, but if he sells land for other types of development, then where is my protection? 18 William Targosh stated he was concerned with having his property devaluated because of a $ 70, 000 19 mobile home going on a lot near him. He hopes that the zoning will protect the people so their property 20 will get devaluated . 91 Matt Shulman stated that he would join Pat Conlon ' s petition at this time . He has been reluctant to be 12 more restrictive, but the changes are sufficient enough to change the nature of the area. Matt stated he is 23 not clear why this area was decided to be a transition area. Matt stated that the reason he did not sign the 24 petition last year is because he did not want to systematically eliminating people who could not afford a 25 house, but now with the other uses are now so ambiguous. 26 Viola Miller thanked the public for their concerns . 27 Discussion of Proposed Ordinance Cont. 28 Brad Griffin stated that because the B2 district has been removed, in Sec . 400 . 0 . the number of districts 29 should be changed to 7 Districts . Brad agreed with Tom Neiderkorn that the reduction in size of 30 minimum lot size would not be low density, therefore it is not desirable to call it low density. 31 Brad also noted that on page V- 10, Footnotes to Schedule II, the footnote regarding height limitations do 32 not apply to any agricultural building has been removed. Also footnote #7, Brad is not aware of any 33 D . E . C . regulations on distance from the lake. In several areas the reference to Site Plan Approval 34 should be changed to Site Plan Review. Brad also agreed with Tom Neiderkorn about changing 35 "Appropriate Board" to state the actual board. 36 Larry Sharpsteen stated overall, he agrees with Tom, in some cases the Town Board makes the ordinance 37 more restrictive . Larry feels quite strongly in some of the areas that were removed, they will find are 38 more important to the people who live in those areas than we may realize now. Larry agrees with Lin 39 Davidson in that there should be some Site Plan Review for some uses in the RA areas . Larry says it 40would be appropriate to exercise caution for commercial businesses in Bl , the people in the RA district it deserve the same protection. Larry Sharpsteen stated that his major concerns are the same as the Board has expressed here tonight. If the it is going to be the Town Board doing the Site Plan Review, Larry 43 feels it should be removed from the political arena. 4 Town of Lansing Planning Board, March 9, 1998 1 Viola Miller pointed out the Board members received notice there is a meeting put on by the Planning 2 Federation on Thursday, April 30, at 7 : 30 PM. Site Plan will be discussed at this meeting . • 3 Lin Davidson stated he feels the Town Board should look at Site Plan Review in the RA district. In 4 applying the drainage and lighting issue, the Town Board should look at it for all commercial uses in 5 RA . 6 Viola Miller stated she also feels strongly about Site Plan Review for commercial uses in the Town. 7 Viola feels the people who live in that area deserve protection and consideration. 8 Dave Lippert added that his position is anything in an agricultural district that is not agricultural should 9 have Site Plan Review. In an agricultural zone, agriculture should have predominance and those rights 10 should be protected above all other rights . If it takes Site Plan Review to protect that right it should be 11 there . 12 Joint meeting with Lansing Town Board- Viola Miller welcomed the Town Board to work with the 13 Planning Board. Viola listed a few concerns the Planning Board would like the Town Board to address . 14 Larry Tvaroha stated zoning has to be an educational process, you have to show people how zoning can 15 be a benefit and protection to them. The Town Board wanted to have something in place and perhaps 16 grow with it and work with it. It can be changed based on the needs of the people, it will not be locked 17 in place . 18 Lany Tvaroha explained the reason for extending the B1 district down East Shore Drive . Larry stated 19 there are not any residences being built on East Shore Drive, no one wants to live on the main road. It 20 has been businesses going in. 21 Larry addressed the idea that the Town Board had ignored landscaping. Larry said landscaping is very • 22 general . Larry stated that any commercial developers will want to make their property attractive . Larry 23 Sharpsteen objects to the idea to "get something in place and then change it the way we really want it. 24 Larry Sharpsteen feels that is dishonest and demeans the people of the Town. Larry Tvaroha stated he 25 had not meant it that way. 26 Larry Tvaroha also explained the Town Board ' s position on buffers and barriers . Larry said it did not 27 seem to be fair to insist someone have a barrier. 28 Viola Miller stated the Planning Board wanted an explanation on why they changed the boundaries of 29 the RA and R1 districts on Peruville Road. Larry Tvaroha stated again, it is not the most desirable area 30 to have residences along that road. 31 Larry Sharpsteen explained that the agricultural uses allowed in the other areas for specific purposes 32 were as a result of public input. The Town Board has taken those completely out, and Larry Sharpsteen 33 asked the Town Board for their reasoning for doing so . 34 Lin Davidson stated the minimum road frontage in RA had been changed from 150 ft. to 20 ft. Larry 35 Tvaroha stated that it has to get Health Department approval which would require a 150 ft radius for a 36 septic system. The 20 ft. is for a flag lot. 37 Al White stated he is personally very satisfied with the proposal . There are a few little things that need 38 to be changed, but overall he is satisfied. 39 Jackie Baker stated she feels if Site Plan Review for commercial development is left out of the RA 40 district, you are being unfair to the residents of that district. • 41 Cheryl Nickel stated that Site Plan Review is also a protection for any businesses looking to go in the 42 RA district as well . Businesses want to know what can go in next to them as well . 5 Town of Lansing Planning Board, March 9, 1998 1 Dave Lippert stated that the Town Board will not take the heat in RA. Dave said they will take it in R3 . 2 R3 will have to be revisited almost immediately. Dave Lippert feels if they do not get a handle on it, •3 going to have some serious problems . 4 Jeff Cleveland stated he feels the Planning Board ' s input has been very helpful . Paul Butler stated that 5 in some places, Site Plan Review may be a good idea. Herb Beckwith stated that in regarding Site Plan 6 Review, he was not thinking of it as protection as much as detriment. Jeannine Kirby stated her feeling 7 was to have document that could be recepted by the whole community. She knows there is a need for 8 zoning . 9 Viola Miller read letter from the Lansing Planning Board to the Lansing Town Board . 10 Larry Sharpsteen moved to pass resolution to give the letter to the Town Board. Lin Davidson seconded . 11 VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. 12 Brad Griffin read article in Dryden paper regarding Ottenschot in Varna. Brad asked George what he is 13 doing about it in Lansing. George Totman replied that it has been sent to the State . 14 PROJECTS PENDING 15 Ron Seacord Subdivision- Al White moved to accept the First Phase on the Final Plant. Lin Davidson 16 seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY, WITH ONE 17 ABSTENTION. 18 Lin Davidson motioned to adjourn at 9 : 08 PM. Brad Griffin seconded.
