General Business
Viola Miller suggested a letter or some response should be given to Donald and Emma Hung.
Viola felt that when a letter or request is sent to the Planning Board, it should be answered and
documents kept on file. Robert Todd agreed that some sort of acknowledgment should be made
when a letter is received. Jacoba Baker thought the Board was remiss in not doing something in
August when Mr. and Mrs. Harper first came to the Board. Larry Sharpsteen stated the reason
they did not change the zoning for them is because the Board had just been accused of changing
. another area in response to one personcoming in and requesting it. Larry reminded the Board
they agreed they were not going to do that again. Jackie responded that the Planning Board is

there to listen to the people and provide an adequate reply. George felt that acknowledgment
should have been sent at the time Mr. and Mrs. Harper were there and the Board would have
considered their request, but he thought it was too late for that now. Viola didn't suggest that
anything be sent out now, only that in the future, this needs to be addressed and felt that this
Board is strong enough to stand up to criticism when someone accuses them of something and do
what they think is right as a Board. Lin Davidson asked if the Board felt they should respond to
Donald Hamer at this point. The Board agreed it was too late to reply to Mr. and Mrs. Hamer.
Viola remarked that she did not want anything like this to happen again. Larry Sharpsteen
agreed that from now on when someone comes to the Board with something in writing, the
Board should respond to it. Larry also added he felt the Board should come to a consensus
before a reply is made.
On behalf of the Town of Lansing Planning Board, Viola Miller welcomed David Lippert to the
Planning Board. David is the Board' s newest member, he replaced Cheryl Nickel and will serve
a term ending December 31 , 2002 .
Lawrence Conlon remarked that it seemed unfair people were complaining about the Zoning
Ordinance before it' s an Ordinance. He didn't feel it should be a problem until the Ordinance is
put in place or a public hearing is set. Brad Griffin felt that it was very important that the people
look at the Ordinance while it is still in a flexible stage. Any plan is subject to change and the •
most important part of what the Board is doing involves people, not lines on a map. Brad also
added that this is all about the people in this town and the fact that the Board can listen to them
and give benefit of the doubt when that exists reflects well on the Board and ability to make fair
judgement.
Sewer Committee
Larry Sharpsteen read the Resolution made by the Town of Lansing Planning Board supporting
the concept of a Waste Water Treatment Plan as documented in Section III of the Comprehensive
Plan of the Town of Lansing, December 1994. The resolution was reviewed by the Board and
accepted. Larry Sharpsteen signed the document and will deliver it to the Lansing Sewer
Committee.
Zoning Ordinance Review
Larry Sharpsteen met with Jeannine Kirby to discuss the Zoning Ordinance and answer
questions ' Jeannie or the Lansing Town Board might have. Jeannine Kirby stated the Lansing
Town Board was not going to act on the Zoning Ordinance until Jeff Cleveland had returned to
the Board after recovering from surgery. Larry stated that the Town Board was concerned that '
the Rural Agricultural area was too heavily restricted and a lot of site plan review, but after
reviewing Schedule One together, found that it was not as complicated or restricted as she

thought. After Larry and Jeannie walked through a few examples and their uses, he felt
everything was right there and she found it very easy to use. Lin Davidson suggested having an
example in the forward would be very useful . Viola Miller agreed . Larry felt it was a very
useful two hours spent with Jeannine . Jeannine requested to Larry that the Town Board would
like to look at it and then have a joint meeting with the Planning Board. Larry is convinced now,
more than ever, there is the need for informational meetings to keep the town informed. Lin
Davidson thanked Larry for taking the time to meet with Jeannie. Brad Griffin asked if the Town
Board had to be at the stage where they approve of the Ordinance before public meetings are
held? George and Larry stated public meetings should be held before the Ordinance is approved .
Larry stated the Planning Board needs to have the commitment from the Town Board that they
are ready to proceed before public hearings are held.
Robert Todd asked how serious is the Town Board' s problem with site plan review? Larry
commented they are afraid that a future Planning Board could yield improper power with the use
of site plan review.

Larry Sharpsteen read the public notice, opened the public hearing at 8 : 00p.m. , and invited any
questions .
Lin Davidson made a motion to adjourn the public hearing pending the arrival of anyone who
wishes to speak until 8 : 15p.m. David Lippert seconded. VOTE : ALL IN FAVOR; MOTION
CARRIED UNANIMOUSLY

Subdivision as presented; David Lippert seconded. VOTE : ALL IN FAVOR; MOTION

AUTUMN RIDGE SUBDIVISION
Larry Fabbroni appeared before the Planning Board with an updated map of Autumn Ridge
subdivision as requested by the Planning Board at their December 9, 1996 meeting. Mr.
Fabbroni stated he presented this map to the Lansing Town Board at their February 20, 1997
meeting. The Lansing Town Board unanimously agreed with the paper roads and the
continuation of the subdivision, sending Mr. Fabbroni back to the Lansing Planning Board to
proceed. Mr. Fabbroni distributed the revised subdivision map with paper roads drawn in. The
first paper road to the North(Butler property), the second to the East (property owned by DePew

University) and the third to the South ( property owned by Frank Paolangeli, the developer, that
fronts Burdick Hill Road) . Larry Fabbroni explained those map shows the right-of-way to
Burdick Hill Road in hopes that someday the Village of Lansing will accept a future road and
curb cut onto Burdick Hill Road. Viola Miller asked if there would be a possibility in doing the
same as what Alex Cima had done with Horizons . Mr. Cima requested two roads accessing
Triphammer Road, the Village refused to allow the second road, but do keep it there for an
emergency exit.
Mr. Fabbroni stated the Village was only interested in keeping that area as a Park, not a road off
of Burdick Hill . Robert Todd asked if the owner of Lot #46 intends to build a house on that
parcel. Larry Fabbroni replied that Frank Paolangeli owns all of that parcel which runs from the
exterior portion of the continued loop on Autumn Ridge Circle to Burdick Hill Road with 60 foot
of that lot reserved for highway purposes. Robert Todd wanted to clarify that if and when the
Village agreed a road could be built, the owner of that parcel would turn over that land. Mr.
Fabbroni agreed and George Totman stated it would be a deed restriction. Larry Sharpsteen
asked if that road right-of-way had just a culvert planted over in grass, could an emergency
vehicle drive across it and get through to Autumn Ridge Circle if they had too. George stated
you would have to get approval from the Village to put in a culvert. Larry Sharpsteen believed if
the Planning Board approached the Village requesting a culvert for an emergency entrance, not a
road, the Village might agree. Larry Fabbroni stated the developers are willing to do anything •
needed in order to proceed in extending Autumn Ridge Circle. Viola stated she would like to see
the Planning Board proceed with this . Larry Sharpsteen claimed the Village wants to cooperate
more and did not feel that this request was unreasonable.
Viola suggested bringing it up with Ned Hickey, the Village of Lansing Planning Board Chair.
Brad Griffin asked Mr. Fabbroni if he had gone before the Village Planning Board. Larry
Fabbroni explained he had talked with the Village Zoning Officer who gave him a run down on
the history and feedback from Ned Hickey. The Village basically told him they would like to see
a park on that property and not even talk about a road off of Burdick Hill . Brad wanted to know
if an application had been made for a curb cut on Burdick Hill Road? Larry Fabbroni responded
that the original subdivision developers did apply.
Larry Sharpsteen stated the primary reason for not allowing the subdivision to continue the circle
and the develop the rest of lots was the second access road. Larry Sharpsteen added that the
Town of Lansing Planning Board could not afford the liability. Viola felt it should be noted that
it was for safety reasons. Larry Sharpsteen stated he was willing to approach the Village ;
Planning Board in asking for a culvert off Burdick Hill Road for an emergency exit. George
Totman stated he had a letter from the Village of Lansing' s Attorney dated March 27, 1989, to
Richard Thaler, the Town of Lansing' s Attorney, explicitly explaining that the Village would not
permit the egress on Burdick Hill Road. Viola responded that was eight years ago. Larry

Sharpsteen felt they were looking for a full road to be built then, not an emergency exit. Lin
Davidson thought it should be pursued. Viola wondered if Larry Sharpsteen should ask to appear

in front of the whole Village Planning Board, not just the Chairperson.
Robert Todd wanted to know what the reason was for denying the road in 1989 ? George stated
the letter from 1989 was for two reasons . First, a house was going to be built on the particular
lot in question. It was requested a driveway and roadway be put on Burdick Hill Road. The
Village did not want any more curb cuts . The second reason was George ' s observation that the
whole project was in the Town along with the whole tax base. Larry Fabbroni added that at the
same time, Sundown Farms was in the process across the street. Larry Sharpsteen stated the
Village had approached the Lansing Town Board at that time and were willing to allow a curb
cut if more of Autumn Ridge and portions of the Town were in the Village . Viola remembered
when that happened and stated it was carried out by the Village Board not the Planning Board.
George suggested having the Village Mayor involved since whatever happened originally came
from the Village Board . Larry Fabbroni asked if he could proceed with the Health Department.
Larry Sharpsteen recalled favorable response from the Planning Board members and opened it up
for discussion. Brad Griffin agreed and felt Larry Fabbroni had come back with acceptable
changes . George Totman claimed the Lansing Town Board approved the paper roads and what
changes to Autumn Ridge that Larry Fabbroni had brought before them. The additional right-of-
way to the East was the answer to some of the original questions raised in 1989 when the size of
the development was limited. Viola felt the developers have attempted in good faith to provide
• what was needed. The Planning Board will follow up on the easement and not restrict them as
they did in the beginning because it has been impossible to carry out.
Robert Todd asked if there could be any legal repercussions? Larry Sharpsteen was concerned
but felt there had been enough changes made to reduce liability. Larry Sharpsteen asked if
George would contact Rich John to reopen the files and make sure the Town is not vulnerable to
any legal action. It was the consensus of the Town of Lansing Planning Board that Larry
Fabbroni could proceed in contacting the Health Department and getting the rest of the
subdivision approved.
County Waterfront Development Study
Viola reported she attended the meeting of the County Waterfront Study on February 21 , 1997 .
Viola stated everything said concerning the restaurant being approved under this grant depends
on economic development. Brad Griffin felt that was a squandering of the public purse. Viola
remarked that any questions of why those kinds of things were being allowed would have to go
back to the grant committees, but they were going forward with the restaurant.
Viola stated the Pinney ' s were developing the Portland Point area. Larry Sharpsteen responded
• that the Pinney ' s wrote letters to the Town Board four different times and did not get any
response. Viola added this was being done through the County Waterfront Study and with the
help of the County, they were able to apply for the grants. As a result of no zoning in that area,

Viola was hoping the County would do a good job in asking how it would be set up and the plans
on it. The Pinney ' s will be asking for a road in the future from their development over to Gulf
Creek. Viola also reported they discussed the scenic byways . The County would designate the
highway but it would be up to the Town in whatever gets done to it.
Tompkins County Planning Federation
Viola stated she attended the Planning Federation meeting and the topic of discussion were
ISTEA and transportation. Viola reported Lansing was one of the Towns that did not have a
representative for the County Transportation Advisory Board. Jeannine asked for a note from the
Planning Board nominating Brad Griffin as Lansing ' s representative. Robert Todd made a
motion to nominate Brad Griffin as representative to the County Transportation Advisory
Council . Lin Davidson seconded. VOTE : ALL IN FAVOR; MOTION CARRIED
UNANIMOUSLY
A copy of the minutes would be sufficient to give to Jeannine nominating Brad Griffin to the
Advisory Board .

The Planning Board is to look over the listing provided by George of the new building permits
issued.
Lin Davidson distributed new copies of the paper road maps . Larry asked that everyone look at
the area bounded by Route 34, Triphammer Road and Triphammer Terrace .
Viola asked that the bylaws of the Planning Board be read over. At a previous meeting, the
decision of secretary was casually changed. Viola felt the bylaws should be followed and the
responsibilities of secretary carried out as such.
Zoning Ordinance
Brad Griffin asked if there was some preset process by which the Town Board would let the
Planning Board know when they are ready to proceed with the Proposed Zoning Ordinance?
Larry responded that the only process is to squeak until the Planning Board gets an answer, then
sit together and have a joint meeting. Larry Sharpsteen felt that part of the reason for delay was
that two Town Board members are up for reelection this year. Robert Todd stated Matthew
Shulman felt under pressure to report this to the public. George responded that the Town
Board ' s feeling on that is since there have not been any public meetings yet, they would like to •
have a chance to study it and have their thoughts put into it before it is tore apart by the public in
the papers. The Town Board would like to see it go to the public through a public meeting rather

than the papers . Larry Sharpsteen stated that Matthew Shulman would like to read through it and
study it so when the time comes, he is able to report on it. Larry didn' t think the town wanted to
be in a position where they make the local paper file a foil to get a public document. Viola
responded it was not a public document yet. Larry stated that it was, any document that it
presented from any public board to another public board for consideration comes under the
freedom of information act. Larry also told Jeannine he didn' t think the Town wanted that kind
of adversarial situation set up and suggested clearing identifying it by stamping each page as
draft copy. Viola felt that by having a public informational meeting would help the Town Board
in making their assessments .
Lansing Forum
Pat Conlon announced there will be a meeting on Thursday, March 27 , 1997, to discuss the
Comprehensive Plan. Tom Neiderkorn will be the guest speaker. Mr. Conlon believed Tom
would be giving the same presentation that he gave to the 2010 Committee. Pat Conlon was
concerned it was the feeling of the Town Board and Planning Board that the Lansing Forum was
trying to "do them in". Mr. Conlon did not feel that was the mission of the Forum as he
understands it, he wasn't sure if they were doing things right, but he didn' t think they were doing
any damage either.

Viola asked if there were extra copies of the Comprehensive Plan, the County Planning Board
was in need of a copy. George stated he always kept a few on hand in the office. Larry
Sharpsteen asked if anyone was willing to attend the Forum ' s meeting on the Comprehensive
Plan? Lin Davidson, Brad Griffin and Robert Todd volunteered to be at the meeting on the 27th
of March.
Lin Davidson made a motion to adjourn this meeting. Jacoba Baker seconded. VOTE; ALL IN
FAVOR; MOTION CARRIED UNANIMOUSLY
