VOTE : ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY Review of Minutes from Meeting held September 9, 1996 Al White made a motion to approve the minutes as submitted; Viola Miller seconded . VOTE ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY Review of Minutes from Meeting held September 23, 1996 Brad Griffin made a motion to approve the minutes as submitted ; Lin Davidson seconded . VOTE : ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY GENERAL BUSINESS Pat Conlon was present at tonight ' s meeting on behalf of the Lansing Forum ' s facilitating committee . The Lansing Forum felt in order to have any intelligent and informative programs, they needed to know what was going on in certain areas . Pat was elected to sit in on tonight ' s meeting to see at what point the Lansing Planning Board was in adopting the new Zoning Ordinance . Town of Lansing Planning Board Monday, October 14, 1996 Page 2 ZONING ORDINANCE REVIEW B rad Griffin questioned if Bert Hilliard ' s property was directly across the road from Rl or B1 District in reference to the Zoning Map? George Totman responded Hilliard ' s property was across from R1 . Al White stated that the property was surrounded by the Town ' s property and B 1 District. Lin Davidson stated according to the minutes of September 23 , 1996, All Saints Church is in R2 District but thought the Zoning Map showed it in 31 . Robert Todd and Al White clarified that the Lansing United Methodist Church is in the B1 District but All Saints Catholic Church is in the R2 District . Everyone agreed that was correct. Viola Miller pointed out that the new draft of the Zoning Map did not include all of the Town. of Lansing, particularly the Southern portion of the Town . George Totman stated the map presented by Tom Niederkorn is not the official map . Tom did not want to spend the time and money on a map until the Planning Board was done with all their changes . Al White stated that the Southern area was definitely in error on the map, the Industrial Research Park had never been taken out of Residential . Al understood this map was just an in between map for the Planning Board to see where the lines are approximately drawn, Tom was working on a large map that will be detailed and accurate, but felt this map was wrong and misleading. Viola Miller agreed, there was way too much in the Industrial area. Viola stated everything East of Bush Lane was Residential , when Morse Chain went in, the County bought and took over land all of which was Residential . A very large berm was put in, and it remained Residential . Al explained he and Viola served on the Airport Committee and it was the Town Board ' s concern with the Committee in changing the zoning in that area, but the Town Board ' s position was not to touch the rezoning of that area for Residential until after the rest of the Town is zoned. Al continued that at a later date, the Airport Committee will propose to go back and rezone that area off the end of the runway. Robert Todd suggested that George check the official map in his office and go over it with Tom Niederkorn. He didn' t feel the Planning Board should make any changes at this point. Al White stated the Planning Board needed to iron out the wrinkles and get it to the Town Board, otherwise they were just going to be continuously arguing back and forth. Cheryl Nickel stated she would like to voice her opinion about the changes made during the road tour on Monday, September 23 , 1996 . Cheryl felt she understood some of the reasoning behind changing the strip along Route 34B down to the Schools from R1 to B1 but didn' t think it was appropriate to have strip development next to the Schools . Viola pointed out B1 was commercial mixed use and apartments along with business could go in there, and it was the Planning Board' s intent with site plan review to have an access road set back to eliminate driveways along the main road . Cheryl stated that if the intent was to have an access road, it should be written in for future Planning Board ' s to follow. Al White showed Cheryl that it wasn' t that much of an area that was changed from R1 to B 1 , only a small section above Brickyard Road to the Fire Station Town of Lansing Planning Board Monday, October 14, 1996 Page 3 and by leaving the schools as R1 was incompatible with its uses . Robert Todd agreed that it wasn' t that much and Viola added that the Planning Board was trying to eliminate spot zoning. Cheryl still felt it was inappropriate to have a lot of businesses around a school and would rather see residential . Robert Todd read 701 . 5 (Standards for Site Plan review in Districts other than Rural Agricultural) and the definition of 402 . 4 (Commercial Mixed Use (B 1 ) District) . Everyone agreed as it read, the Planning Board could enforce control of traffic access to primary roads with site planning. Lin Davidson suggested that the Town Lawyers check and make sure that was appropriate . Jackie Baker asked Cheryl if she was withdrawing her concern about the changes made. Cheryl responded yes she guessed so , but still has some hesitation especially if sewer went down that road. Pat Conlon asked Al White to elaborate on his statement that the Town Board didn' t want to make any changes in the Airport area until the whole ordinance was done? Pat wondered if he understood that correctly? Al answered basically yes and explained that there has been an ® Airport Planning Commission that he and Viola have served on for about two years . The Commission was to cover a time frame from 1995 -2015 , a twenty-year span that would include getting rid old buildings and hangers . The Commission had asked in the first five years to rezone the section of Lansing that is right off the end of the runway that is Residential . A public hearing was held and turned down. Al White and Viola Miller representing the Town of Lansing at the Airport Planning Commission meetings stated they would propose by the year 2000 to rezone that area. Pat Conlon remarked when the statement was made that the Town Board doesn ' t want to do anything until the rest of the ordinance was done, he couldn ' t understand why they wouldn ' t tackle it all at once, but he had a little better understanding of why now after Al White explained some of the history behind the Airport area. Brad Griffin raised a question with the block of land within VanOstrand Road and Buck Road known as Watchtower. Brad wondered if R1 was the most appropriate designation regarding high density . Robert Todd responded that the Watchtower project itself was only to cover a certain amount of property, the rest would be agricultural . George and Al stated they thought it was about five or six hundred acres the project would be on. Viola stated that meant there would be about sixteen hundred people over six hundred acres . Al reminded everyone they discussed this before and if it was to be zoned R1 now, the Town Board can go back and request a zoning change later. George stated that Watchtower had been reassured by the Town Board and the Town Attorneys that when they begin this project, even if the zoning was changed in that area, they would be able to continue . Brad felt that the majority of the land acreage would correctly be described as R1 and found that defensible. Cheryl Nickel felt the land along the lake was treated like land anywhere else as far as what was Town of Lansing Planning Board 410 Monday, October 14, 1996 Page 4 allowed there and how it ' s dealt with. Cheryl proposed with the restrictions on lake property such as poor soil and being adjacent to the lake and problems that arise from it, that at least site plan review be required or something. Robert Todd felt that since most of it was designated as Rural Agricultural areas, the Planning Board made it R1 to keep the housing density lower, and felt that was sufficient enough. Al White asked that they go back to the initial intent, if the Planning Board starts adding special conditions to everything at this point in time, the Ordinance will never get it approved. Cheryl stated she needed to descent on that issue . Jacoba Baker remarked that those concerns were answered at June 24, 1996 meeting with the Town Engineer, Dave Herrick and John Anderson from the Tompkins County Health Department. Robert Todd agreed and it was resolved that problems begin further up, not at the edges of the lake . 701 . 5 .2 Lin Davidson pointed out the definition of Erosion Control should include the word highly. Everyone agreed that should be changed. Erosion Control . Development on highly erodible soils, or on slopes greater than 10 percent, shall include an erosion control plan designed to minimize erosion during construction and after construction has been completed. 701 . 6.2 Lin Davidson also stated that (h) should have the critical natural areas listed, Lin recalls at the meeting held on September 8 , 1996 , it was discussed that the Planning Board list was is or is not, it should not be an arbitrary decision. Robert Todd questioned what exactly were critical natural areas? Brad Griffin responded that there is some validity in the recognition of an area whose botanical growth or geologic form or some other unique physical biological character of that area, that makes it desirable for retention or recognized for some impediment to development. Brad gave a couple of examples and thought it was important to know that if such things occur, it can be pointed out and if someone develops on it, it is at there own risk. Brad continued that is was not unusual since he ' s been on the Planning Board, that someone has come in and the Board has pointed out various problems such as water or Engineering issues . Brad stated the County had published a document on identifications of natural areas, but he and George have not located it yet. Lin Davidson suggested having a defined list to go by . It was agreed by the Planning Board that Lin Davidson and Brad Griffin will work on a new definition for (h) - critical natural areas . 704 . 0 Lin Davidson questioned the wording and definition of 704 .4 A turnaround suitable for emergency vehicles has been provided if such private road is a dead- end serving more than four (4) parcels . George explained he couldn' t give a building permit until the Town Attorney has the Town Supervisor sign and the Town Board approve a private road . Town of Lansing Planning Board Monday, October 14, 1996 Page 5 Cheryl Nickel made a motion to delete 704 .2, 704 .3 and 704.4 . And add 704.2 All private roads must be approved by the Lansing Town Board . Al White seconded . VOTE; ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY Pat Conlon remarked the Town has a town road that is less than four or five years old that doesn' t have a turnaround, East Meadow Drive . The Planning Board stated they would have to look into it and asked George to take a ride and look at it. Viola Miller made a motion that the Town of Lansing Planning Board give the Lansing Town Board the Proposed Zoning Amendments as corrected. Al White seconded. VOTE; ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY George stated a separate piece of paper with the corrections will be typed up and given to the Town Board along with the Proposed Zoning Amendments . Al White made a motion to adjourn this meeting . Lin Davidson seconded . VOTE; ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY This meeting was adjourned at 9 : 01pm . ARTICLE III 410 Members 1 . The membership of the Lansing Planning Board shall Consist of seven ( 7 ) residents of the Town of Lansing .i , pointed by the Lansing Town Board .
