Review of Minutes from Meeting Held March 11 , 1996
Al White made a motion to accept the minutes as presented , which had been tabled at the March 25
meeting ; Jackie Baker seconded . VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY

OTHER BUSINESS
Ron Parks - Al White felt that the minutes should reflect that Mr . Parks ' position is that the geography
of the area should be changed to accommodate him . Any water coming down that hill and onto Mr .
Parks ' property is from a naturally occurring condition . The developers are only responsible for any
additional water that comes as a result of the development not the ambient flow of the water that was
there because of the geography of the land . Larry Sharpsteen added that the land was there long before
Hovarth ever built the house . The Parks were unable to deal with the previous owners of the land in a
manner that would resolve the situation . Currently , it is the opinion of the town attorney that the best
course of action for any member of the board is to judiciously ignore the situation and have any further
communications be through the town attorney . The town attorney has advised that should Mr . Parks
approach any member of the Planning Board , they should pleasantly indicate that any discussions
should be through the town attorney . George Totman stated that Mr . Parks understands this condition .
Site Plan Review, Article VII - 300 . 9 Al White was concerned that an ingress/egress from a farm field
would qualify it under the category of a development . Larry also gave the example of logging the
wood off of a parcel . 300 . 41 Frontage (see lot width) - Al felt that the definitions were too
complicated ; for example , the description of lot width . He suggested just stating that the lot width is
• the road frontage . George added that the definition needs to specify continuous frontage versus just
road frontage . Al felt there was too much duplication throughout the plan . Larry suggested continuing
the reference to lot width , but for lot width use the street right-of-way . Al felt it was too complicated ;
each section seems to refer to another . 300 . 78 removed .

300 . 89 Private Roads - Al suggested that this definition state that the two lots need to be owned be 410
different people . Hefted the example of farmers that own many parcels and provide private access to
those parcels . He was very concerned that this item would cause many problems for farmers . Larry
suggested changing the word " lot " to "dwelling , " but not indicating the need for different owners . This
would require the easement or private road if there were homes on those two or more parcels . Lin
pointed out that there are several examples of shared driveways in the Town of Lansing . George
suggested reviewing this with the town attorney . Larry felt that the town attorney would agree with
Tom ; the more restrictive , the more the town attorney would probably like it . Al White also suggested
adding " in an approved subdivision " to this definition .
Al White stated that he would not support this proposal as is , and one of the reasons is because of
Section 300 . 89 . He stated that he would not support anything that would put any member of the Town
of Lansing in jeopardy because they didn ' t understand the ordinance .
Discussion also turned to whether or not the dwellings should be individually owned or rented . George
stated that many people that get approval for a private road tend to build the road to town specifications
right from the beginning . It is the town attorney ' s interpretation of the State law that there can be no
more than four parcels serviced by a private road . The issue of ownership of the parcel (s) needs to be
addressed .
704 . 1 retained - 701 . 2 , 701 . 3 , and 701 . 4 removed .
300 . 96 Outdoor Advertising and Billboards - Larry felt that this definition should tie in and confirm the
existing Sign Ordinance .
400 . 0 Land Use Control Areas - Al White stated that this section , as written, does not include the Rural
Agriculture District . The wording to be added was suggested as " any project , activity , or action
related to any agricultural activity . "
700 . 1 Restricting Development in Designated Wetlands - Brad suggested being more specific by
• indicating State designated wetlands .
701 . 4 . 7 Frontyard Screening - Brad suggested striking this entire piece .
300 . 53 Landscaping - The wording was suggested to be changed as follows : " or other natural or
decorative features . " Jackie wants to encourage trees and keeping beautiful areas and open space , but
realizes that the Planning Board can ' t demand it . But , it can strongly encourage those ideas . Brad felt
that decorative features could be a windmill or pink flamingo . The definition was then suggested as :
" alteration or finishing of a site by grading , planting , or ornamental rockeries or fencing . "
701 . 4 . 8 Loading and Outside Storage - Larry suggested limiting the screening to trash , but realized that
it might be difficult for some businesses , as far as setup . Al felt that there are certain members of the
Planning Board that are on a power trip ; and that as long as this is going to happen, there is going to be
an argument . He doesn ' t want to see things in the zoning ordinance that are going to be hardships ,
unworkable , or difficult to enforce . He felt that it is important that if something is an allowed use now ,
that it shouldn ' t be restricted in the future . Brad agreed , and felt it was important to keep this
ordinance as simple and non-intrusive as possible . The Board agreed to strike this item from the
proposal . Larry stated that the important part of all of this item is the safety issue , and not whether the
site looks pretty . His example is the Ithaca Journal and its loading dock on the street side . There is a
strong safety concern for trucks parking and backing out into traffic .

® 701 . 4 . 10 New York State Traffic Law - Larry didn ' t feel this item belongs in the Site Plan Review .
701 . 4 . 15 Performance Standards - George stated that the town definitely does not want a sound
ordinance . Al felt the issue also was with odors , from a restaurant , for example . The Board agreed to
strike this entire item .
The Planning Board will continue its review at the next meeting .
Al White made a motion to adjourn ; Lin Davidson seconded . VOTE:• ALL IN FAVOR; MOTION
CARRIED UNANIMOUSLY
This meeting was closed at 9 : 50 p . m .
