Review of Summary from September 25, 1995 Meeting
Lin Davidson felt it was important to clarify that the concerns surrounding mobile homes
and home businesses are in the General Business and Industrial-Research Districts . Jackie
Baker clarified that the town tour that they took was conducted on September 30 and not
411 October 8. Lin Davidson made a motion to approve the summary as corrected; Robert Todd
seconded . VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY
Walmart in South Lansing
Since there was a representative from the Ithaca Journal present, Viola Miller questioned the
article that mentioned South Lansing as possible site for the Walmart store. She commented
that there is nothing in South Lansing that is not zoned residential . Ms . Bartlett responded
that she could not respond to anything stated in that article.
Flaglots
Viola Miller commented that it has not been her intention that flaglots be used in
subdivisions; they were intended to be used for land that was not reachable in some other
way. Robert Todd responded that it has been his experience on this Board that it is possible
to alleviate flaglots when a parcel is first being subdivided because potential problems, such
as a need for flaglots, can be more visible at the onset. Larry Sharpsteen stated that the
flaglots that the Planning Board has been working on recently have been strictly isolated
pieces of property that have had no other access. This is the reason for the existence of the
possibility of flaglots in the subdivision regulations.
Town Tour
Viola Miller commented that the town tour conducted by Pete Larson was worthwhile. She
found everything in fair condition. Larry Sharpsteen felt they were able to gain a sense of
the things they have been working on such as the potential road changes and also perhaps
had a sense of some direction they could take with some of the other problems that they
have been discussing.

NOVALANE, East Shore Drive •
William Albern appeared before the Planning Board representing the Novalane subdivision.
He stated that the last time he was here, the Planning Board approved thesketch plan
contingent upon three items: (1) a rework of the turnaround; (2) drainage information; and
(3) lot dimensions. Mr. Albern's objective for this meeting is to request preliminary plat
approval of a four-lot subdivision (lots 15, 16, 17, and the remainder of the property), to be
called Phase I. In addressing the three conditions set at the last meeting: the turnaround has
been revised to conform to the Town Highway specifications; lot dimensions are indicated on
the plan; a complete drainage study for the property has been completed; and the Town
Engineer, David Herrick, has walked the property. Mr. Albern presented a revised sketch
plan dated October 6. After further consideration and revision by the owners, the number of
lots in this proposed subdivision has been reduced to 31 from 37.
Larry Sharpsteen stated that considering the lay of the property with the substantial slope
from north to south across the property, the drainage along the north side of this property
will not substantially contribute to the runoff on the Lake Watch subdivision. Any drainage
from this property should be to the south and to the west. Mr. Albern stated that he has met
with and walked the property with Mr. Herrick, but was unable to meet again with Mr.
Herrick and provide him with the drainage numbers. George . Totman stated thathe has
talked with Mr. Herrick regarding this subdivision, who stated that he is working with Mr.
Albern as he does with every other developer and will monitor it to make sure that it meets
all town specifications. Mr. Herrick has not yet seen the numbers, but told George that he is
in agreement with what he has seen so to date.

Mr. Albern stated that there is presently a drainage ditch on the north side of Novalane.
When Lake Watch was constructed, another drainage ditch was constructed farther north
leaving the first ditch without much activity. On the north side of the East Lake
development (south side of Novalane), there is an old farm drainage ditch. The drainage
from the north side of Novalane comes across Novalane and dumps into the East Lake Road
drainage ditch just above the stairs and then flows into the gorge . Presently, all of that water
from Novalane, including the north half of the East Lake development, goes through that 36"
culvert and then into the lake. Novalane is proposing to put a new drainage path along the
north side of the road as detailed in the drawing. The north half of the drainage from
Novalane will be diverted to the new drainage, leaving the south half of the drainage from
Novalane to continue to the East Lake drainage. From the calculations conducted, this
proposal will reduce the amount of drainage going to the 36" culvert presently, because the
whole north side of the Novalane development will be going to a separate drainage system.
Larry Sharpsteen asked George Totman to check with Dave Herrick as to his opinions of the
drainage proposal.
Robert Todd commented that he appreciates Mr. Albern's efforts to answer the concerns
expressed by the Planning Board, and also the indication on the sketch plan that the Town of
Lansing will not be responsible for maintenance of the drainage ditch on these lots (15, 16,
and 17). Mr. Albern stated that that drainage restriction will also be included on lots 14 and
18. Larry Sharpsteen commented that he is pleased that the dimensions of some of the lots
are now substantially larger than as originally proposed. Mr. Albern stated that the average
lot size of these lots is now just above that of the Lake Watch parcels.

Cheryl Nickel introduced Hank Dullea, who will be an adjoining property owner. She
questioned Mr. Albern as to whether or not the developers have developed any covenants or

restrictions for the property, such as preserving views, etc. Mr. Albern stated that right now
they have only discussed the maintenance of the drainage ditch, but that other restrictions
could be addressed now. Cheryl offered to share the covenants from the East Lake
development with Novalane for consideration. Mr. Albern stated that Novalane would
certainly consider those covenants.
The Planning Board members agreed that the concerns raised from the last meeting have
been adequately addressed at this meeting. Viola Miller questioned the request for a Phase I
approval . She was concerned that Novalane was requesting approval of a four-lot
subdivision essentially without a road into the development. Typically, she stated, a
development starts with a road and the phase development comes off that road. Mr. Albern
stated that there is the road from the East Lake development which would provide the access
to these first three lots. Robert Todd questioned the reason for this first phase, to which Mr.
Albern responded that it basically comes down to money and taxes at this point. Mr. Albern
stated that the intent of the developers for coming in for sketch plan approval and request
for approval of Phase I is to let the Planning Board know what the. future intent of the
development is and to provide drainage information. Viola Miller questioned the regulation
that requires a certain percentage of a development be included for phase development. Mr.
Albern responded that he believes it to be a minimum of 10 percent is required. This
proposed development has 31 lots, and this request is for Phase I is for four lots, which
would meet the requirement.
Viola Miller questioned Novalane's intent to provide a north/ south access road. Mr. Albern
® stated that it is the developer's intent to eventually connect to the roadway access provided
by the East Lake development. The Lake Watch development, due to some type of oversight,
was not required to provide that same type of access as was the East Lake development and
now the Novalane development. In a conversation with Mr. Leathers of the East Lake
development approximately one year ago, Mr. Albern was informed that it was the intent of
the East Lake development to provide an access and allow the north / south access to East
Lake Road .
Robert Todd questioned the possibility of an extended time period between requests for
phase approval. Specifically, Robert questioned the drainage plan and whether or not it
would be binding on the remaining large parcel if, for example, it were sold to another
developer before it received Phase II approval. Mr. Albern stated that the drainage
covenants would be in the deeds of lots 14, 15, 16, 17, and 18. The remaining parcel(s)
would also be bound by the deed restrictions if it approved as a whole. The proposals
would need to be presented to the Planning Board again for any proposed changes.
Cheryl Nickel questioned the roadway to the three lake front lots . Mr. Albern stated that
according to his understanding of the law, these lots must have 20 foot access to the public
road. George stated that this access can be called a private road instead of flaglots, but the
deeds will show the lots owning 20 feet out to the public road. Mr. Albern expects that the
developer will commit themselves to building this private road. Cheryl questioned whether
it was possible for the property owners to, at some point, each consider their access a 20-foot
wide driveway instead of a private road. Mr. Albern responded that it is certainly possible,
but it wouldn't affect the Town.
It was agreed to treat this as a three-lot subdivision and accept the October 6 drawings. The
preliminary plat will show the proposed three-lot subdivision and the remaining large parcel.
For the public hearing scheduled, Mr. Albern stated that he will bring the preliminary plat

and a sketch plan showing potential future development of the remaining parcel. Larry
Sharpsteen strongly suggested that Mr. Albern also bring a copy of the covenants proposed
for this development to the public hearing.
Larry Sharpsteen stated that the Planning Board will review the SEQR for the proposed
three-lot subdivision at the October 23 meeting, then vote on preliminary plat approval. This
will allow Mr. Albern to resubmit the revised SEQR form for consideration.
A public hearing has been scheduled for November 13, 1995, at 8:00 p.m. for final plat
approval of this three-lot subdivision.
Site Plan Review
Larry Sharpsteen encouraged the board members to continue reviewing the Site Plan Review,
and come prepared for discussion to the next meeting.
Lin Davidson made a motion to adjourn this meeting; Robert Todd seconded . VOTE: ALL
IN FAVOR; MOTION CARRIED UNANIMOUSLY
