PLANNING BOARD MEMBERS (* Denotes present) * Jackie Baker Cheryl Nickel * Lin Davidson * Larry Sharpsteen, Chair * Brad Griffin * Robert Todd * ' Viola Miller Al White * Larry Tvaroha, Town Councilman * George Totman, Zoning and Code Enforcement Officer PUBLIC PRESENT Tom Niederkorn The Planning Board began discussing the revisions to Articles 4, 12, and 13 presented by Tom Niederkorn. Article 13 - Appeals George Totman indicated that he will distribute copies of this article to the members of the Zoning Board of Appeals (ZBA) to review and provide comments. The difference between a zoning officer and a building inspector was clarified. It was agreed that there should be more than three but not more than five members on the Zoning Board of Appeals. The article as it reads currently states that no member of the town board shall be a member of the ZBA. It was discussed and agreed that members of the planning board should also be restricted from being members of the ZBA. Article 4 - Definitions Discussion followed concerning the inclusion of language regarding landscaping. Should requirements for landscaping be specified which would provide some protection for property owners as well as making the land useful for future landowners? If nothing is specified, then according to the regulations, what is not identified is not allowed. Instead of trying to clearly specify what variety of tree or shrub should be planted, it was thought that a better way would be to set standards, such as the height and density of a buffer. Article 12 Temporary Certificate of Occupancy - In "emergency" situations, temporary certificates could be issued with a limited amount of time for the items out of compliance to be corrected. It was agreed that five business days was sufficient notification time for a requested building inspection. Article 9 - Regulations Governing Special Conditions and Special Permits Home Occupations - It was agreed that this use would be allowed in the rural / agricultural district without special conditions or a special permit. Parking conditions were discussed. Town of Lansing Planning Board Page 2 Monday, May 22, 1995 State law states that a vehicle may not back out onto a state highway. It was agreed that further restrictions on parking would not be specified in this district. Lake Upland Area - Robert Todd felt that there may be too many uses not permitted in this district. There is already an existing owner-occupied business in this district that is proposed to be not permitted. OTHER BUSINESS Homework - Review Schedule 1 and Article 9. Sewage - Larry Tvaroha stated that within the next five years, it is likely that sewage will be available in the town. Dave Herrick actually has a preliminary plan for the areas to be a included. Cornell's Cooling System - At the next meeting (6 / 12/ 95 at 7 p.m.), a representative from the New York State Department of Environmental Conservation will give a presentation on the process to be used by Cornell in the proposed water cooling system utilizing lake water. Comprehensive Plan - At the next meeting, Larry Tvaroha will report on the status of the Town Board's review of the Comprehensive Plan. Revision to Zoning Regulations - Viola questioned how the Planning Board was moving forward with the recommendation made at the last meeting about having the Code Enforcement Officer handle one-lot subdivisions and boundary adjustments if they meet the regulations. Larry Tvaroha stated that the Town Board knows how much time the Planning Board spends on these items, and would be in favor of making this change. The Planning Board will be submitting a recommendation for this policy change to the Town Board. Robert questioned what would happen to reviewing the . SEQR George stated that if the request only involves an administrative decision, and there is no governing body making a decision on the request, then no SEQR is needed. Robert Todd made a motion to adjourn the meeting; Lin Davidson seconded.
