Review of Minutes from April 10, 1995
Al White made a motion to approve the minutes as presented; Lin Davidson seconded.

Review of Minutes from April 24, 1995
Viola Miller doesn't feel that the Planning Board has a dear understanding of the differences
between special conditions and special permits, and recommends that Tom Neiderkorn
provide written clarification to the Planning Board. Brad Griffin pointed out that the last line
on the bottom of page two, the word should be expect not except. Larry Sharpsteen
reiterated that a clarification from Tom Neiderkorn will need to be developed because the
Board isn't comfortable with the definitions set forth. Brad Griffin made a motion to accept
the minutes as corrected; Viola Miller seconded. VOTE: ALL IN FAVOR; MOTION
CARRIED UNANIMOUSLY
Cornell Water Cooling System
Brad Griffin commented that he has spokento the DEC and will be able to have a
representative come to the Planning:Board and provide an update and answer questions. An
appointment was scheduled for June 12 at 7 p. m.

Public Hearing, O'Reilly, Triphammer Terrace, Tax Map #40.4-14.2
The Planning Board reviewed the SEQR and received a negative declaration. (7:45 p.m.)
8: 15 p.m. Larry Sharpsteen read the public notice, opened the public hearing, and invited
any questions from the public present. What is the cost of the lots ? Approximately $35,000
each. Will drainage from above the hill go all the way to . Triphammer Road? Yes, the drainage
will cross Triphammer Terrace into Lot C where there will be an easement for the drainage
to Triphammer Road. Will you be positioning a new culvert near Triphammer Road ? Mr.
O'Reilly stated that he wasn't sure. The Town Engineer would be able to help provide an
answer. Mr. O'Reilly stated that the overall parcel is 14+ acres, with lots B, C, and D each
being 2. 1 acres. He currently resides in the farm house on lot A. Haw many new homes will be:
constructed ? Each of the three new lots will be subdivided for single family houses, for a
total of three new houses. Are you planning to develop the land closer towards Triphammer Road ?
Possibly, but Mr. O'Reilly doesn't currently own that parcel. He has been thinking about it
and in the future may develop that land with a road and approximately ten lots, but that is
very early in the planning stage. Are you still planning to build a duplex on one of the lots ?
There is potential there, but it is not likely at this point. Therewill not be any mobile homes
allowed on these lots. Mr. O'Reilly is planning to building the homes in the price range of
$180,000 - $200,000. I am pleased to know that the developer is actually going to be living within the
development. Mr. O'Reilly stated that he does have a very vested interest in the property.
Lin Davidson made a motion to close the public hearing (8:28 p.m.) contingent upon any
other members of the public present appearing with questions; Brad Griffin seconded.
VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY
Al White made a motion to accept as final plat this subdivision, in view of the fact that the
SEQR and public hearing have been conducted, and that the proposal meets all subdivision
regulations; Lin Davidson seconded. VOTE: ALL IN FAVOR; MOTION CARRIED
UNANIMOUSLY
Public Hearing, Jeannine Kirby, Luce Road, Tax Map #20.-1-8.2
8:00 p.m. Larry Sharpsteen read the public notice, opened the public hearing, and invited
any questions from the public present. As no members of the public present had any
questions related to this subdivision, Lin Davidson made a motion to dose the public hearing
(8:05 p.m.) contingent upon any members of the public present appearing with questions;
Brad Griffin seconded. VOTE: MOTION CARRIED with One Abstention (Al White)
Al White noted that he is an adjoining property owner and will be abstaining from voting.
Viola felt that it is a mistake for the Planning Board to not require that the small access be 60
feet versus 40 feet, even though there is access from another road. Her concern stems from
the possibility of future development of that large parcel, which now will only have a 40 foot
access from Luce Road. Lin added that the owner is fully informed. Larry restated that the
owner and developer insisted that the 40 foot right-of-way could not be any larger and it was
to be held for farm access only.
Viola Miller made a motion to accept this subdivision with the provisions as so stated in the 111
minutes; Brad Griffin seconded. VOTE: MOTION CARRIED with One Abstention (Al White)

Viola questioned that status of the Comprehensive Plan. George Totman thought that it had
been passed by the Town Board. Larry Sharpsteen wasn't sure because the Planning Board
had made a few last minute revisions. Larry stated that he would question Tom Neiderkorn
about the status.
Boundary Change, Howard Cogan, Ridge Road, Tax Map #10:1-14.2
George Totman explained Jeffrey Miller married Judith Cogan and purchased this piece of
property from Cogan's parents. The Miller's have since separated and are planning to sell
the house with four acres, conveying the balance of the 14.5 acre parcel back to Howard and
Helen Cogan.
Al White made a motion to accept the boundary change as proposed, waived the public
hearing, and noted that review of a SEQR is not required; Lin Davidson seconded. VOTE:
ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY
Two-Lot Subdivision, Thomas Cirafica, Ridge Road, Tax Map #32.4-29.2
George Totman explained that this is the property just across the Salmon Creek bridge after
0 the school. He stated that this ;proposalwas presented to the Planning Board in the past, but
was rejected because it did not meet the subdivision rules and regulations. Mr. Cirafica's
rationale for reapplying is because public water will become available in that area in the near
future, and the Town's rules and regulations will be changing. George stated that this is not
a formal subdivision sinceapplication has not been submitted by the Cirafica's nor has
payment been received.
George clarified that the Town. of Lansing Subdivision Regulations currently read that lot size
can be reduced if public sewer is available; it does not allow lot size reduction for public
water. The Health Department regulations do allow for reduction with public water.
The total frontage of this lot on the road is 504 feet, 300 feet at the back, and 188 feet deep.
Larry clarified that there is approximately 150 feet of road frontage fromthe edge of the lot
to the edge of the bridge. The Planning Board does have the possibility by precedent of
reducing the frontage requirement to 100 feet because a water district is being approved for
that area. That would leave 100 feet of road frontage for one lot and 50 feet for the other lot.
A flaglot could then be considered for the land down the cliff. Larry felt that the Planning
Board would need to get input from the Town Attorney as to how soon they could act on
something like that since they don't know exactly when the water district will be approved.
Viola questioned where the driveway would come out of the flaglot onto the road in relation
to the edge of the bridge. George felt that was an area that needed further clarification from
the Cirafica's. Viola also felt the Planning. Board would have to carefully review the SEQR
since this is in such a fragile area. Al stated that approximately 1 /3 of the parcel is above
the bank with the remaining 2/3 over the bank. Viola was also concerned about putting a
septic system on this parcel. Larry Sharpsteen suggested that each board member take an
opportunity to look at the lot in person.

Viola made a motion to table discussion of this proposal until the Planning Board has had an

opportunity to further review this request, and receive the necessary information; Jackie
Baker seconded. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY
Subdivision, Till Vaughan and Seeley DeKay, North Triphammer Road, Tax Map #40:1-1.1
George Totman explained that the property owners are proposinga one-lot subdivision,
keeping the house and selling the other parcel to Mr. Carpenter. The new lot has 204 feet of
road frontage, 297 feet deep, and is more than one acre with public water available.
Al questioned the marsh symbols on the map in the proposed lot. Mr. DeKay explained that
several years ago while Mr. Horvath was developing his property, the drainage pipe was cut
to divert the drainage. The remainder of the drainage has continued to drain onto the
proposed new parcel. Mr. Carpenter also explained that it is the drainage from the fields
above and the development. It is a natural seasonal drainage, almost a stream.
The Planning Board reviewed the SEQR and received a negative declaration.
Al White noted that this proposed subdivision meets all subdivision rules and regulations of
the Town of Lansing, therefore, made a motion to approve this subdivision as presented and
waive the public hearing; Lin Davidson seconded. VOTE: ALL IN FAVOR; MOTION
CARRIED UNANIMOUSLY
OTHER BUSINESS
Subdivisions - Cheryl Nickel proposed that the Planning Board find an alternative way of
dealing with one-lot subdivisions and boundary changes. George Totman agreed. He stated
that as long as the proposal meets all the requirements, he would be able to administer the
subdivision regulations. George stated that the Planning Board has to agree to this type of
proposal and then send it to the Town Board to hold a public hearing. Larry suggested that
Cheryl draft a recommendation that the Planning Board could submit to the Town Board.
Land Use Ordinance - Tom Neiderkorn brought updated copies of the Land Use Schedule for
consideration at the next meeting. He also brought revisions and comments on
"Administration", and a revised section on "Appeals". Tom had suggested that the Zoning
Board of Appeals receive a copy of this section to be able to provide their feedback and
input. Larry asked George to invite the ZBA members to attend the Planning Board
meetings when these issues are discussed.
Al White made a motion to adjourn the meeting; Lin Davidson seconded. VOTE: ALL IN
FAVOR; MOTION CARRIED UNANIMOUSLY
