Al White commented that since Brad's relationship is with the engineer it doesn' t cause a conflict since the Planning Board will not be discussing the engineering. Site Plan Review - The parking lot will not be increased. The septic systems is still going to be adequate for the number of people projected to be there. The project is still within the target amount that the original design was for. The expansion isn' t going to effect any of the existing trees. No review of the SEQR was needed since there is no change to the SEQR that was conducted previously. There are no negative effects from this proposed expansion. Al White questioned if any complaints have been received about this business. George Totman indicated that he has not received any complaints. Al White made a motion to approve the proposed expansion as presented; Lin Davidson seconded. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY SUBDIVISION, Robert Walpole, Luce Road, Tax Map #20-1-8.2 Robert Walpole appeared before the Planning Board as an agent proposing a three-lot subdivision of property on Luce Road. The width of the access to the rear lot between lots #1 and #2 is 40 feet. Larry Sharpsteen pointed out that if the owner ever decides to try to develop that rear lot, the proposed access isn't adequate for a road. Robert Walpole pointed 8 out that there is additional access to that rear lot off of Goodman Road that the owner could use, but that at this point the owner intends to continue farming the rear lot. Town of Lansing Planning Board Page 2 Monday, April 10, 1995 l • Al White pointed out that the northwest corner of- lot #2 is very wet. This is the second two- lot subdivision on the same tax map number in the last few months. Any further subdivision will come under a separate set of regulations. The Planning Board reviewed the SEQR and received a negative declaration. Al White made a motion to approve the subdivision as proposed noting that it grades off to wet conditions at the north boundary of lot #2 but it is not a wetland. The Planning Board acknowledges and waives the usual road frontage of 150 feet for lot #2 and will treat it under the same section of subdivision laws as a flaglot. A public hearing was recommended . Brad Griffin seconded . VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY A public hearing was scheduled for May 8, 1995, at 8 p. m. SUBDIVISION, Paul Ridley, Buck Road, Tax Map #31.-1-1.4 George Totman explained that Paul Ridley is proposing a one-lot subdivision of his property on Buck Road which he intends to sell. The lot has 150 feet of road frontage with public water available. The Planning Board reviewed the SEQR and received a negative declaration. As this proposal meets all subdivision rules and regulations, Al White made a motion to approve the subdivision as presented . The public hearing was waived. Lin Davidson seconded . VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY SUBDIVISION, Tom O'Reilly, Triphammer Terrace, Tax Map #40-3-14.2 Tom O'Reilly appeared before the Planning Board to request a four-lot subdivision of his property on the west side of Triphammer Terrace. He indicated that the drainage easement from the Lakeview Subdivision will be coming through Lot C. Each lot will be slightly bigger than two acres. It is his intention to live on the largest parcel. He will be dismantling the existing barn and rebuilding it farther back on the property. Two of lots will be sold for single-family homes; a duplex will be built on the third lot. The interim housing refers to people building homes in the Lakeview development. Mr. O' Reilly felt that there are usually people coming in from out of town that need a place to stay for short-term. This will not turn into a rental community. A public hearing was scheduled for May 8, 1995, at 8: 15 p.m. The Planning Board will review the short-form SEQR at 7:30 p. m. on May 8, 1995. Larry Sharpsteen commented that the lots are deep for their proposed road frontage. The Planning Board is concerned that deep lots have the potential for future subdivision. Tom O'Reilly indicated that he has no intention to further subdivide these lots. Review of Minutes from March 13, 1995 Al White made a motion to approve the minutes as presented; Brad Griffin seconded. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY Town of Lansing Planning Board Page 3 Monday, April 10, 1995 Review of Summary from March 27, 1995 Brad Griffin made a motion to approve the summary as presented; Jackie Baker seconded. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY Comments from Ron Parks Regarding Lakeview Subdivision Ron Parks appeared before the Planning Board to ask for an opportunity to follow up to public hearing held on March 13 for the Lakeview Subdivision, which he was unable to attend. From tonight's meeting regarding the O'Reilly subdivision, Mr. Parks questioned whether there is anything in the subdivision regulations requiring that a subdivision must be in keeping with the surrounding neighborhood, specifically in regards to the proposed duplex. Larry Sharpsteen indicated that a duplex is currently allowed in that density. George Totman indicated that there are already two-family houses in that area . Larry Sharpsteen stated that the Planning Board is not allowed to consider what is intended for a particular piece of property; the Planning Board can only consider the subdivision of the land. The use of the property comes into play when the owner applies for a building permit. Larry Sharpsteen began a point-by-point review of Mr. Parks' letter, which was addressed at the March 13 meeting. The drainage solution would be among the first items undertaken by the developers. The Planning Board was assured by the developer that the drainage swale would be worked on at the same time that the heavy equipment was on the property constructing the roads . Larry Tvaroha commented that when any construction of roads has begun, the town engineer is on site to verify that the road is being constructed according to codes. Larry Sharpsteen clarified that at the public hearing it was agreed that the swale would be constructed consecutively with the construction of the roads to protect the neighboring properties. The swale would continue as far as necessary, but not necessarily all the way to the boundary line. The deed restrictions are being written so that swale can' t be plugged by any of the property owners. George Totman was concerned about the Planning Board trying to require that certain deed restrictions be included. Larry Sharpsteen indicated that the Planning Board will not require the deed restrictions, instead it will be agreed upon within the negotiations between the Planning Board and the developer. Larry Tvaroha questioned if it would be sufficient for Mr. O'Reilly to provide a letter to the Planning Board indicating his intention to include that deed restriction. Larry Sharpsteen felt that a letter of intent would satisfy the Planning Board. It was made clear to Mr. Parks that only when Mr. O'Reilly sells the property (and not when the property is sold from Mr. Horky to Mr. O'Reilly) that the deed restrictions will come into effect. Mr. Parks was concerned that because this is such an ambitious project and that for some reason may not be fully developed, he wanted some way to file his concerns about the drainage problem coming from that property. Larry Tvaroha recommended that he seek advice from the town attorney. Town of Lansing Planning Board Page 4 Monday, April 10, 1995 REVISIONS TO ZONING ORDINANCE Tom Neiderkorn indicated that from discussions at the last meeting, another district was created to encompass an area approximately 500 feet on each side along Route 34 from the town center area to the county line. This new district actually splits that agricultural district into two parts . The Planning Board then began an item by item review of allowable uses in the particular district. Some were concerned about making that district too restrictive, while others were concerned about not having enough restrictions to protect that strip of land. The Planning Board will be meeting again on April 24 to continue their review of another district . Lin Davidson made a motion to adjourn the meeting; Brad Griffin seconded.
