November 7, 1994 Page One - Brad corrected the sentence that read "fieldschool house" to Field Schoolhouse, after Mrs. Field who taught there for many years. Page Two, Mine and Quarry Plans - Brad corrected the sentence to read, "submitted estimates of lives of mines," not plans. Brad also stated that from the reports, the mine is long term and the quarry is short term, but thought that everyone agreed not to make any self-fulfilling prophecies . Brad recommended omitting tli& sentence that referred to the limited time of operation for the mine and quarry. Viola Miller made a motion to accept the minutes as corrected; Lin Davidson seconded. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY Review of Draft of Comprehensive Plan The board members began a thorough, page-by-page review of the draft of the comprehensive plan with the comments from the Town Board's review. Section III, Policy Goals and Objectives Brad thought it important that a section be included that covers "Community Services, including Emergency and Medical." George Totman commented that although the Fire Commissioners are handling this issue themselves, the Town Board has been looking into restoring the ambulance service. George felt it would be important even to include a generalstatement about the service in the comprehensive plan in an attempt to gain public support of the plan . Page 19, (F), Environmental Concerns - To avoid any misperceptions of this section, it was recommended that it be eliminated from the comprehensive plan. George pointed out that the Lansing Newsletter was going into the mail the next day, and there was an article about the next town meeting to review the comprehensive plan. Larry l I 1. I 14 1 i ‘ { 98 . } z t x p i}- i • Town of Lansing Planning Board Page 2 Monday, December 12, 1994 Sharpsteen recommended that each of the committee chairpersons receive a copy of the draft to review before the townmeeting in January. Cheryl agreed. Lin was concern that each committee might continue to be focused only on their topic, and not the overall topic. Lin also felt it was important that there be a single spokesperson at the town meeting that could lead the discussions. It was agreed that the forum for the meeting could be discussed further at the next meeting of the Planning Board. PUBLIC HEARING, Kirby Subdivision, Goodman Road, Tax Map #20.-1-8.2 Larry Sharpsteen read the public notice, opened the public hearing at 8:00 p.m., and invited any questions or comments from the public. Mr. and Mrs. Andrew Schultz, who own property directly across the road from this subdivision, wanted to be informed about the subdivision. Robert Walpole, representing the Kirby Subdivision, stated that this will be a two-lot subdivision, residential only. One lot will have 1 .34 acres and the other will have 1 .44 acres. Lin Davidson made a motion to close the public hearing at 8:06 p.m. with the option to reopen if any other members of the public appear with questions regarding this subdivision; Cheryl Nickel seconded. VOTE: MOTION CARRIED (Al White abstained) Lin Davidson recommended officially closing the public hearing. Larry Sharpsteen closed the public hearing at 8: 16 p.m. since there was no further participation from the public present. Viola Miller made a motion to approve the two-lot subdivision as presented; Jackie Baker seconded. VOTE: MOTION CARRIED (Al White abstained) SUBDIVISION, Boris Simkin, Stonehaven Road, Tax Map #39.-1-20.12 George Totman explained that Boris Simkin and two other families are proposing to subdivide a 2.63 acre parcel into three parcels. Mr. Simkin has been in contact with the Health Department and was informed that for lots served by a public water supply, the minimum lot size is . 5 acres with 100 feet of road frontage. Each of the three proposed lots meet these Health Department requirements. In a cover letter provided by Mr. Simkin, he submitted for comparison lots sizes of surrounding parcels. This parcel is in the low-density zoned district. The minimum road frontage required is 100 feet, and the lot size must be at least 12,000 square feet. The Planning Board reviewed the SEQR and received a negative declaration. Since this subdivision appears to meet all the rules and regulations in the Town of Lansing, Al White made a motion to approve this three-lot subdivision as presented, and to schedule a public hearing; Lin Davidson seconded. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY 111 A public hearing was scheduled for January 9, 1995, at 8:00 p.m. • Town of Lansing Planning Board Page 3 Monday, December 12, 1994 SUBDIVISION, Don Worsell, Algerine Road, Tax Map #15.-1-7.2 George Totman explained that Don Worsell has a parcel of land that in the past he has sold off three other parcels. At that time (in the early 80's), Mr. Worsell stated that he wasn't of the need to receive subdivision approval to sell the lots. At this time, Mr. Worsell is intending to sell the back lot with the house and pond on it, while retaining the road r frontage parcel of 9.922 acres. By selling this back lot separate, it becomes a flaglot. The road that services the back lot is 60 feet wide, but is currently a private driveway which also serves the three other lots that Mr. Worsell sold. Access to this driveway is written in the deeds of parcels #7.3, 7.4, and 7.5, but not any ownership of the driveway. Mr. Worsell stated that to his knowledge, in the deeds the road was designated as a future town road. If Mr. Worsell were to make the driveway into a private road, he wouldn't have to have the agreements of the other parcel owners. The maintenance of the driveway to this point has not been in writing; the owner of one of the parcels has taken that responsibility. Mr. Worsell was informed that he will need to make application to have the driveway be approved as a town-designated private road, since there will now be four properties using the access. Viola was concerned about the remaining ten acres and its future development. The board members felt it would be important to require in the deed for the parcel that is being sold, that the future developer of the remaining 10 acres have access onto the private road. George responded that according to how the town attorney interprets the law, only four parcels can have access onto a private road. George didn't think that the Planning Board should consider the remaining 10 acres in this subdivision. It was then agreed that a statement could be put into the deed for the remaining 10 acres that specifies that if that is ever further subdivided, that the private road be upgraded to a town road. This entire subdivision can be contingent upon whether or not the Town accepts this access as a private road. George explained that by going through the approval process for a private road, Mr. Worsell will have to get an agreement from the other three property owners that they will put 15 feet of the private road into their deeds, but if the road is developed into a public road at some point, they will turn that 15 feet over without profit. The Planning Board reviewed the SEQR and received a negative declaration. Al White made a motion to give approval of this four-lot subdivision contingent upon approval from the Town Board of the current driveway turned into a town-designated private road,- and to waive the public hearing; Lin Davidson seconded. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY SUBDIVISION, John Hicks, Waterwagon Road, Tax Map #42-1-1.12 John Hicks appeared before the Planning Board requesting approval of a one-lot subdivision of his property, which he will be conveying to his son. All utilities are currently in place as is the house and driveway. The Planning Board reviewed the SEQR and received a negative declaration. • Town of Lansing Planning Board Page 4 Monday, December 12, 1994 This proposal appears to meet all requirements and regulations in the Town of Lansing. Al White made a motion to accept this one-lot subdivision as presented and to waive the public hearing since there will be no new construction; Lin Davidson seconded. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY BOUNDARY CHANGE, Samuel Myers, Conlon Road, Tax Map #314-8.2 Larry Sharpsteen explained that this request is just to change the boundary line between Mr. Myers' two properties. The road frontages will remain the same. It is the consensus of the Planning Board to recognize this request as a boundary change with no further action required. OTHER BUSINESS Report from the Nominating Committee - Brad reported that the Nominating Committee unanimously recommends the present slate of officers graciously extend their terms of office. All current officers are willing to continue to serve. The vote on these officers will take place at the January meeting. NYS Council on the Arts Grant - Cheryl explained that this grant would be on actually 11/ designing the appearance of the town center. She would like to proceed with developing a town center park, public square space in the location of the current town hall, and call it "Heritage Square." There would have to be feasibility studies as to what the buildings could be used for, but would be the basis for what could eventually be the town center. Since the entire town center won't be created for some time, she would like to see the public square developed right away. It would be a participatory design process. She would like to see the town develop a small road around the "town square" that would make the area attractive to developers. This meeting was adjourned at 9:45 p. m.
