Al White made a motion to accept the minutes as corrected; Viola Miller seconded. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY REVIEW of Summary from November 22. 1993 Meeting Page One, Fourth Paragraph - Viola Miller pointed out that the correct spelling of the person's name is Ned Hicky. Page Two, Second Paragraph - Larry Sharpsteen corrected the spelling of John Homa and the Corps of Engineers. Page Two, Third Paragraph - Viola stated that a suggestion had been made from the Historical Resources Committee that a Conservation Council be established. Larry Sharpsteen wanted clarification as to what capacity this council would be dealing with. Viola stated that the Conservation Council would be dealing with natural resources. Page Three, Second Line - Viola also pointed out that the correct date for the party is December 12. Viola Miller made a motion to accept the summary as corrected; Lin Davidson seconded. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY Larry Sharpsteen asked George Totman if he could send a letter over his name inviting John Homa to the January 24 meeting of this board. Town of Lansing Planning Board Page 2 Monday, December 13, 1993 GENERAL BUSINESS11, Conservation Council - Robert Todd questioned Viola Miller about the Conservation Council. Viola stated that as long as it is a council, it is an advisory board that looks into things and works with the Planning Board and Town Board. She felt that a council of this type would. be beneficial to the boards by providing information about natural areas. Their function would be to gather information. Robert was concerned about this type of council becoming a board, an example he cited was the Town of Ithaca Conservation Advisory Council. That council ended up telling the Town of Ithaca Planning Board where development should be placed. Viola stated that this council was developed for that purpose. Robert didn't feel that the Planning Board has made any recent decisions that disrupted the environment because of lack of information to the board. Robert felt that this type of council would meddle and hold things up that didn't need to be held up. Larry Tvaroha agreed with Robert. a GIS Maps - Lin Davidson stated that the GIS work has been started and should be completed by the end of December. The cost of the work will be $750. Larry Sharpsteen questioned whether the software and existing files will be available to the town for its use. Lin responded that the software costs $4000, which the town will not be purchasing, and the data files will work downtown for them to generate maps as needed. These data files will be created from the GIS and the updated maps of new roads that George provided them. Transportation - Viola Miller recommended that there be other members of the Planning Board that will be a part of the MPO, in addition to Lin. Viola commented that MPO is looking to expand throughout the entire county, not just within the Village. • Agriculture Districts - Larry Sharpsteen questioned the status of review by the individual board members of the new ag districts materials. Lin Davidson would like to see the difference between the existing ag districts and the proposed changes. He thought this may just be a change in the composition of the board, but wasn't sure of the original arrangement. Robert wasn't in attendance at the last meeting and hadn't received a copy yet. PUILIC HEARING, Ran dal Tarbell, VanOstrand Road, Tax Map #19-1-6.2 Larry Sharpsteen read the public notice, opened the public hearing at 8:00 p.m., and invited any questions from the public present. Mr. Shaw, representing the Tarbells, briefly described the proposed subdivision identifying the location and the division of the lots. Viola wanted to clarify whether the remainder of the land to the west of this subdivision would have another means of access. George Totman stated that the adjacent parcel does have access off of Newman Road. A question was raised as to how large a development this will be. Mr. Shaw clarified that this subdivision will be sold as five single-family lots, but there will be no deed restrictions to prevent further subdivision of any of the lots. George Totman stated that the wetland area is 3000 feet back from Newman Road and 2000 feet back from VanOstrand Road. Larry Sharpsteen believes that the elevation of that land is higher than the back corner of this proposal. Larry also stated that this entire parcel would drain towards the road. George Totman clarified that he cannot issue a building permit within 10.0 feet of a wetland, but the land can be sold. Viola stated to the public that any of the new property owners wishing to further subdivide their lots would have , to come before the Planning Board with a proposal. Viola also pointed Town of Lansing Planning Board Page 3 Monday, December 13, 1993 out that mobile homes can be placed on these lots, but if there are more than two on a lot, it becomes a park and falls under the jurisdiction of the town. Al White made a motion to close the public hearing; Lin Davidson seconded. The public hearing was closed at 8:16 p.m. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY Al White made a motion to accept the final plat as presented; Viola Miller seconded. VOTE: MOTION CARRIED with One Abstention (Larry Sharpsteen) PUBLIC REARING, Ron Preston, Grandview Drive and Pheasant Way, Tax Map #40.-3-28 Larry Sharpsteen read the public notice, opened the public hearing at 8: 19 p.m., and invited any questions from the public present. A question was raised as to how many lots are proposed. George Totman stated that only one lot can be permitted until that road is built. Lin Davidson questioned whether the road has to be totally completed before more lots cart be divided or whether it can be done piece by piece. George responded that that decision is strictly up to the board. If a proposal comes in for a couple of lots and includes the development of the road to a certain point, that developer can come in for permission from the board. The road would have to meet town road specifications in order to be approved. Larry Tvaroha added that the water lines would also have to be extended to the end of the road. ® Robert Todd questioned the proposed 250 feet on the map versus the 280 feet suggested by the board. Paula Euvard, representing the Prestons, stated that she had presented this recommendation to Mr. Preston and he didn't see the extension as a problem. Al White made a motion to close the public hearing with the option to reopen if any member of the public appears with questions or comments; Lin Davidson seconded. Public hearing closed at 8:24 p.m. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY Robert Todd made a motion to accept this final plat with the understanding that contrary to the finished map, the depth of the subdivision will be 280 feet rather than 200 feet; Lin Davidson seconded. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY SUBDIVISION, James Reeves, Jr., Auburn Road. Tax Map #5:1-8 and 5.-1-63 Mary Decker appeared before the Planning Board on behalf of the Reeves. She explained that the Reeves have accepted a purchase offer on their home. They are owners of record of 5.-1-8 and 5.4-6.3; They are asking for a subdivision of the first parcel and a boundary change of the second. The residence they are selling is located on 5.-1 -8, and is marked by the proposed 1 .62 acre section on map #2. The barn (see map #3), which the potential owners wish to buy, is located on other parcel (5.-1-6.3). The end result is a new parcel which is a little over three acres (see map #4). The Reeves will remain owners of the property around this new lot. Larry Sharpsteen is exempting himself from this action, because he was the structural inspector of the property. Ms. Decker stated that the stakes and the field survey will probably be conducted on December 14 or 15. Town of Lansing Planning Board Page 4 Monday, December 13, 1993 Al White questioned whether the Reeves have subdivided any land in the past for their son. • Ms. Decker wasn't sure, but George thought Al was correct. The Planning Board reviewed the SEQR and received a negative declaration. Al White made a motion to accept the subdivision as presented as a final plat and waive the public hearing; Viola Miller seconded. VOTE: MOTION CARRIED with One Abstention (Larry Sharpsteen) SUBDIVISION. Gail Stockton. Sharon Campbell, and Gary Argetsinger, East Shore Drive, Tax Map #37.1-2-53.2 Cal Warren appeared before the Planning Board to present a proposed subdivision of the Argetsinger land on East Shore Drive. Mr. Warren stated that a purchase offer has been accepted for the purchase of 400 feet of road frontage on East Shore Drive starting at the center line of the utility lines and goes 400 feet south. The southern boundary will be perpendicular to East Shore Drive; the northern boundary will follow the center line of the . utility lines back approximately 380 feet. The back (eastern) line of the property follows the. drainage ditch and hedgerow, but will not be less than 300 feet. The overall size of the parcel is slightly less than •four acres. They will be maintaining the hedgerow and drainage ditch as a buffer to the back land to separate the commercial usage from something thatmay potentially a more dense housing situation. They have also had inquiries as to a type of farmers' market for the larger parcel to the east. Viola was concerned about the number of times a single subdivision of this land has come • before the Planning Board, when each time the Planning Board has asked the owners to prepare some type of long-range plan for their property. She is also concerned about the remaining lot of 53 acres and where the easement is for access. Robert Todd was also concerned about the remaining land, and what will happen when the other two road- frontage lots are sold. Mr. Warren stated that when he had originally come before the board with this proposal approximately two years ago, many different ideas were discussed. Access to the rear parcel is being saved 60 feet to the north of the utility line. There is also access to the back land off of Woodsedge Drive. . Larry Sharpsteen stated that this will be the fourth division of this land in the last six to seven years, which will require it to be considered as a major subdivision. George clarified that this doesn't necessarily make approval any more difficult, it just requires that a public hearing be conducted and that the division be labeled as a major. Al White wanted to go on record stating that the next time there is a proposal for subdivision of this particular parcel, a complete plan for future development must also be submitted. He indicated that provisions must be made for future roads. Robert agreed in part with Al stating that it would be in the best interest of the town to know the plans for that land. Al emphasized that if there is a potential for significant housing in that area, than there will need to be two means of access. : Cal stated that the discussion of roads has taken place with the owners. He stated that there has been a wide diversity of inquiries for this property. For example, expansion of Woodsedge, a year-round farmers' market, and builders for modest housing. Viola strongly encouraged that easements and paper roads be clearly marked on the map for _® this subdivision. Lin questioned whether the access off of East Shore Drive is in the best location. Cal stated that both to the north and south of the currently identified location would not be any better than where it is identified. Town of Lansing Planning Board Page 5 Monday, December 13, 1993 ® Larry Sharpsteen wanted a consensus as to whether this is a subdivision or a major subdivision. Al White felt that a public hearing was necessary. Viola felt that the map should have the easements on it. Larry Sharpsteen stated that the property will drain into the drainage ditch then down past the church and across the state road into existing waterways. George Totman emphasized that the Planning Board is concerned about drainage and the developer/purchaser should know that they are responsible if they do anything to the drainage. They will have to correct it or make provisions so that it doesn't disrupt other people's property. Larry Sharpsteen stated that a buffer will be required between commercial and residential uses, and it will be the responsibility of the commercial to install that buffer. Lin questioned whether the four-acre lot could be divided again. Cal responded yes, but they would need to come before the Planning Board again. Cal stated that the original idea was to maintain the brush/drainage area as a natural buffer. The back line of this proposed lot goes down the center of the drainage, which was done to not put it into control of one side or the other. Larry Sharpsteen questioned whether there will be a deed restriction to leave that vegetation alone; Cal didn't believe there was a restriction at this point. Cal stated that there will be a fairly definitive deed restriction on outside storage. Lin questioned whether the board should consider any type of buffer to the residents across the road. Larry Sharpsteen stated that since Site Plan Review is not currently available to the Planning Board as a tool, the most it can do is make recommendations. Al White made a motion to accept this preliminary plat with a request that an easement to ® the back land be put on from both Woodsedge Drive and East Shore Drive, and to schedule a public hearing. Robert Todd seconded. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY A public hearing was scheduled for Monday, January 10, 1994, at 8:00 p .m . FURTHER BUSINESS Vacant Board Member Positions - Larry Sharpsteen stated that the Town Board has currently taken no action on appointing new members. They are waiting for Mr. Griffen to decide whether to offer his nomination. George Totman stated that Mr. Griffen came in and had a long discussion about the responsibilities of the board and its members. Nominating Committee for Officers for 1994 - Viola stated that since Linda is leaving, she should be a member. Robert and Lin both volunteered to be members of this committee. Larry reminded them that there are three positions to fill: Chair, Alternate, and Secretary/Treasurer. Larry suggested that Linda be chair of the nominating committee. Treasurer's Report - Larry stated to Lin that for a final report, the board should be made aware of actual expenditures compared to budgeted line items.
