In the matter - of the establishment . of Lansing Water District N o . 17 , Town of Lansing , County of Tompkins , State of New York , pursuant to Article 12 - A of the Town Law . ® . .WHEREAS , a map , plan and report : have been prepared in such manner , and . in such detail as has heretofore been determined, by • : the Town Board of . Lansing , relating to the - establishment of a • proposed w ater district in the Town ; and , • WHEREAS , such map , plan and report dated June 30 , 1993 having been - duly - filed in the Town Clerk ' s Office in said Town on . June 30 , 1993 ; . and , _ : . WHEREAS , said .map , plan and report were prepared by T . G . Miller - & . Associates , P . C . , Engineers and Surveyors- , . Ithaca , New York , duly . licensed by . the State - of New York , . showing the boundaries : of the proposed district , a general plan of . the water system and a . report : of the proposed method of operation ; and , . . , . , WHEREAS , _said map shows the .-. proposed water district , water mains -,. fire - hydrants . and other related and necessary appurtenances ; and , • WHEREAS , the boundaries of the proposed district are described in Exhibit " A " filed in . the Town Clerk ' s Office , and , WHEREAS , - the improvements proposed are as . follows : SERVICE AREA r As show on .the map filed in the - Town Clerk ' s O ffice and described in Exhibit A the proposed water district will include approximately 1040 acres of land , more or less . These presently include five ( 5 ) tax map. parcels owned by New York - State E lectric and Gas which are undeveloped , and approximatelly1103 developed residential living units . • The proposed service area w ould include properties along Ridge Road between the existing ® Water District No . : 7 . boundary and the intersection with the new Milliken Station Road . - POPULATION TO BE SERVED - There are presently 122 consumption units in the District and it is anticipated that there will be an additional 53 consumption units at the time the District had been fully developed .. The number of persons to be , served will be approximately 500 . . . WATER SUPPLY - Treated water requirements , estimated not to exceed an average - of 56 , 8 :75 . gallons per day , will be purchased from the Southern. Cayuga . Lake Intermunicipal. Water Commission , ( Boltoni continued June 30 , 1993 P oint Water Supply ) . The Town of Lansing is one of the municipalities who own the system . The capacity of the Bolton P oint supply is considered more than adequate to supply this d istrict . WATER SYSTEM TO BE CONSTRUCTED - As shown on the map filed w ith the Town Clerk , the facilities to be constructed will u ltimately consist of 28 , 400 linear feet of 12 inch diameter d uctile iron pipe and 7 , 000 linear feet of 8 inch ductile iron pipe ; construction of Pump Station No . 2 and acquisition of 1 / 3 acre of land ; construction of a Pressure Reducing Station . • Construction of Storage Tank No . 4 will include a 150 , 000 gallon elevated water storage tank , a granular pavement access driveway , a Telemetry Building and acquisition of 1 / 2 acre of land . The proposed storage tank will be designated as Town of L ansing Water Storage Tank No . 4 . The source of supply of water is the SCLIWC water system . Storage Tank No . 4 is tentatively located o ff of Ridge Road at a high point north of Beckwith Lane . The o verflow for the tank is proposed at approximately 990 feet U . S . G . S . Due to extremes in topography it will be necessary to provide a Pressure Reducing Station ( PRV ) along Milliken Station Road . The static pressure at the proposed Storage Tank will be 45 - 155 psi . The down range static pressure will be between 25 - 125 psi . There will be the necessity of individual pressure reducing ✓ alves . The Town of Lansing Pump Station No . 2 is proposed to be located along Ludlowville Road slightly within Water District No . 7 boundary . This location of the pumping station will provide suction pressure of approximately 35 psi . A 40 Hp pump , as well as a second sister back - up pump ( for emergencies ) will be necessary to adequately fill the proposed tank . A telemetry system between Storage Tank No . 4 and Pump Station No . 2 will be required to relay signals to initiate pump start - up and shut - down , and will be tied into the Bolton Point Treatment Plant . All of the 8 inch and 12 inch ductile pipe , improvements including hydrants and valves , Pump Station No . 2 , Pressure Reducing Station and Storage Tank No . 4 , plumbing and electric , 1111 concrete vault , : telephones , pumps , telemetry equipment and chlorinator will be dedicated to the Town . a WHEREAS , the method of financing will be as follows : - METHOD OF FINANCING - The cost of construction for relocating the existing water main and installing the new service connection w ill be financed entirely by the issuance of serial bonds to mature in annual installments . The annual installments which include repayment of principal and interest will be assessed as follows : The project cost for Water District No . 17 is planned to be financed by the issuance of serial bonds to mature in annual installments . Under this method , there is to be an Agreement between the Town of Lansing and NYSE & G to pay the cost of the annual payments of $ 200 , 000 . 00 per year over a period of 20 years . 20 Year Serial Bond Assuming the project is financed with 20 year serial bonds at 6 % interest and a minimum principal payment of 80 % , the first year payment is calculated as follows : P rincipal = $ 2 , 000 , 000 . 00 Interest = 6 % Term = 20 years 1st Year Principal Payment = $ 2 , 000 , 000 . 00 / 20 x 80 % = $ 80 , 000 • 1st Year Interest Payment = $ 2 , 000 , 000 . 00 / 20 x 0 . 06 = 120 , 000 $ 200 , 000 And , WHEREAS , the operation will be as follows : METHOD OF OPERATION — The service connection will connect to the existing Town of Lansing Water District 7 distribution system o n Ludlowville Road . WHEREAS , a map , plan and report have been prepared in such manner and in such detail as has heretofore been determined by the Town Board of Lansing , relating to the establishment of a proposed water district in the Town ; and WHEREAS , such map , plan and report dated June 30 , 1993 having been duly filed in the Town Clerk ' s Office in said Town on June 30 , 1993 ; and , WHEREAS , said map , plan and report were prepared by T . G . Miller & Associates , P . C . , Engineers and Surveyors , Ithaca , New York , duly licensed by the State of New York , showing boundaries of the proposed district , a general plan of the water system and a report of the proposed method of operation ; and , WHEREAS , said map shows the proposed water district , water mains , fire hydrants and other related and necessary appurtenances ; and , WHEREAS , the boundaries of the proposed district are described in Exhibit " A " filed in the Town Clerk ' s Office ; and , WHEREAS , the improvements proposed are as follows : S ERVICE AREA - As shown on the map filed in the Town Clerk ' s Office and described in Exhibit A the proposed water district will include approximately 48 acres of land , more or less . There are presently 38 developed parcels and 9 undeveloped parcels , none of w hich are within an agricultural district . P OPULATION TO BE SERVED - There are presently 38 consumption units in the District and it is anticipated that there will be an1111 additional 9 consumption units at the time the District has been fully developed . The number of persons to be served at that time w ill be approximately 141 . W ATER SUPPLY - Treated water requirements , estimated not to e xceed an average of 15 , 275 gallons per day , will be purchased from Southern Cayuga Lake Intermunicipal Water Commission ( Bolton Point Water Supply ) . The Town of Lansing is one of the municipalities w ho own the system . The capacity of the Bolton Point supply is considered more than adequate to supply this district . WATER SYSTEM TO BE CONSTRUCTED - As shown on the map filed w ith the Town Clerk , the facilities to be constructed will u ltimately consist of 4900 linear feet of 8 inch diameter ductile iron pipe . The service connection with Water District 17 will be 3 / 4 inch copper service connections and approximately 950 linear feet of trenching for the service connections . All of the 8 inch ductile iron pipe and improvements including hydrants and valves w ill be dedicated to the Town . WHEREAS , the method of financing will be as follows : METHOD OF FINANCING - The project cost of construction of Water District No . 17 , Extension 1 will be financed entirely by the issuance of serial bonds to mature in annual installments . The annual installments which include repayment of principal and interest will be assessed by the following formula : 1 . Lots With Existing Dwelling ( s ) Fronting on Water Mains a . Parcels 2 acres or less . Assessed one ( 1 ) unit per dwelling and one ( 1 ) unit for the dwelling lot . b . Parcels greater than 2 acres : Assessed one ( 1 ) unit per dwelling and one ( 1 ) unit for initial 2 acres of the dwelling lot . All remaining acreage will be assessed one - fourth ( 1 / 4 ) unit per acre . rl273 continued June 30 , 1993 2 . Vacant Lots / Unimproved Land Fronting on Water Mains a . Existing Subdivision Lots 2 acres or less : Assessed o ne ( 1 ) unit per dwelling lot . b . Existing Subdivided Lots greater than 2 acres : Assessed one ( 1 ) unit for initial 2 acre dwelling lot . All ✓ emaining acreage will be assessed one - fourth ( 1 / 4 ) unit per acre . ® c . Undeveloped Acreage : For the purpose of assessment , n on - subdivided lots will be divided into approximately two acre lots with a minimum of 150 foot frontage and assessed one ( 1 ) unit for each lot . Y . S . Route • 34 . Pressure will be provided by a 150 , 000 gallon capacity w ater tank located off of Ridge Road North of Beckwith Lane . Water is to be ' pumped -to this tank by Town pumps located at or near Ridge Road . The source of supply of water is the SCLIWC water system . The static pressure in the Town distribution system at the proposed service connection is estimated to be approximately 65 - 120 psi . • :. - - And , WHEREAS , the maintenance and operating costs are as follows: - • MAINTENANCE AND OPERATING COSTS - The costs of maintaining and o perating and, system - wide improvement cost are recovered in the per - gallon - price charged to all water users in the Town and it is e stimated at $ 80 . 00 per quarterly billing for - a single family residence . Cleveland : BE IT RESOLVED , that as a result of the public hearing held on June 30 , 1993 and the proof presented by New York State Electric & G as Corporation and the Board having found that the proof showed that there will not be a public nuisance or health hazard created by granting of an exception to New York State Electric & Gas Corporation in their fulfilling a proposed contract with Cornell University for bringing fly ash solid waste from Cornell University to New York State Electric & Gas Corporation ' s fly ash maintenance facility in an amount not to exceed 4 , 000 tons per year , the Board h ereby authorizes the Town ' s Code Enforcement Officer to issue a permit to New York State Electric & Gas Corporation pursuant to its application , upon its payment of the fee of 10 cents per ton , which fee will be paid in advance and adjusted to scale reports submitted by New york State Electric & Gas Corporation to the Code E nforcement Officer . Cleveland : BE IT RESOLVED , that Supervisor Kirby be and hereby is authorized - and directed to execute the Grant Application for Small Cities - Community Development Block Grant - 1993 for improvements for water supply in low to moderate income neighborhoods , in ® particular , extension to the North Myers Road neighborhood . ( Water D istrict •No . " 7 , Extension No . 9 ) on behalf of the Town of Lansing ; and ' be it further RESOLVED , that the Supervisor is authorized and ' directed ' to e xecute any and all other documents and certifications ° that may be ✓ equired in the processing of this Grant application ; and be it further RESOLVED , that it is the intention of the Town of Lansing that g rantFfutids will be used by the Town for the proposed project to maximize -benefits to low to moderate income households and - persons ; and be it further RESOLVED , that the project construction will be primarily along existing highways with no dislocation of families , businesses , or any establishment except in case of emergency in w hich case the town is prepared to provide shelter for dislocated parties for the period of time the need exists ; and be it further RESOLVED , that the Town Board will continue to pursue the policies of the Community Development Plan ( copy on file in the Town Clerk ' s Office ) as a guide and basis for this application ; and be it further RESOLVED , that the Town Board will take the roll of " Lead Agency " in determining whether an Environmental Impact Statement is ✓ equired in connection with the project and based in the information and analysis contained in an Environmental Assessment prepared in accordance with HUD - 399 - CPD requirements and in a SEQR Environmental Assessment Form , it is determined that the proposed project WILL NOT result in any significant adverse Environmental Impact and therefore not require an Environmental Impact Statement . Tvaroha and seconded by Mr . B eckwith : WHEREAS , the Town of Lansing contracts with the Village of Cayuga Heights ( " Cayuga Heights " ) for use of its Sewage Disposal Facility ; and WHEREAS , Cayuga Heights has placed a Moratorium on sewer permits for use of its Sewage Disposal Facility ; and WHEREAS , the Town of Lansing has been allocated a limited number of sewer access permits for use of the Cayuga Heights Sewage Disposal Facility ; and WHEREAS , the extension of the municipal sewage disposal system w ithin the Town of Lansing has significantly increased expenses for o peration and maintenance of the system while the number of available sewer permits because of the Cayuga Heights Moratorium limits the base of ratepayers in the Town of Lansing Sewer D istrict ; and WHEREAS , in anticipation of obtaining sewage disposal access to the Cayuga Heights Sewage Disposal Facility , the Town of Lansing accepted ownership of dry sewer lines originally installed in 1987 27, 6 continued June 30 , 1993 w hich have not been utilized because of the Moratorium and for w hich no operation and maintenance funds - could be obtained ; and WHEREAS , as a result of the non use of said dry sewer lines and lack of operation and maintenance funds in the Sewer District for these dry sewer lines which will now be eligible for permits from the Town of Lansing , the Town of Lansing must imposean access fee in the amount of $ 4 , 000 . 00 per sewer permit ; NOW THEREFORE BE • IT RESOLVED , thatsewer permits shall be issued by the Town of Lansing pursuant to the allocation of sewer permits from Cayuga Heights Sewer Disposal Facility and upon the approval of an application for a Sewer Permit of one of the allocated sewer access permits from Cayuga Heights by the Town of Lansing will issue a sewer permit to the applicant upon the paymentIII of an access fee in the amount of $ 4 , 000 . 00 which will be used to provide sufficient funds to operate and maintain the existing system including the previously un - utilized portion of the Town of Lansing sewer system . ✓ ote of Town Board . . .
