I y ^' _ Review of Minutes for May 24, 1993 Viola Miller corrected the spelling of Cynthia Fraser to Frazier. Viola Miller made a motion to accept the minutes as corrected; Lin Davidson seconded. VOTE: ALL IN FAVOR; a MOTION CARRIED UNANIMOUSLY Review of Minutes for May 10, 1993 4, ' r, George Totman pointed out that the June 7 date identified for the public hearing for Melvin Brown should instead be June 14. E General Business Y ' Linda Hirvonen made a motion to acknowledge Cynthia Frazier's outstanding efforts on the - newsletter; Robert Todd seconded. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY. George Totman indicated that he will prepare a memo to Cynthia conveying the appreciation from the Planning Board. t Lansing Day $ 44 Viola Miller commented that there was a good deal of people through the booths and tables of the advisory groups. Sharpsteen read the public notice, opened the public hearing at 8 :00 p.m., and invited • any, questions from the. public present. ba riny Starner• questioned what the plans are for this development. Chip Landry, the developer;; stated that the lots will be sold as . is with the possibility of being built on by the person (s) buying the lot(s): He stated that there will be a deed restriction prohibiting single- :wide mobile homes and no further subdivision. ;; Mit Starner questioned how he would be affected as a farmer by new development coming 'iintoi thearea. George .Totman informed Mr. Starner that the New York State Agriculture Law ;protects farmers by requiring developers to notify potential purchasers that they will be I • buying; land in an agricultural district. ; 1-•11 a .Hirvonen . made :a_ motion to close the public hearing at 8 :05 p.m. subject to reopening if. , any, member of the public appears •with. questions; Al White seconded. VOTE: ALL IN " " ' _: i ' FAVOR; MOTION CARRIED UNANIMOUSLY Al White commented that he is an adjacent property owner and will abstain from this decision, but has no comments positive or negative. Larry Sharpsteen commented that as well as having farming uses surrounding this • subdivision, there is an airstrip. The use of the airstrip should not be compromised by : development in the area. Al . White commented that none of the lots are in the flight path . it �- Vola Miller made a motion to accept this as a final plat; Lin Davidson seconded. VOTE: ALL IN FAVOR (One Abstention - Al White); MOTION CARRIED UNANIMOUSLY • i . , v . Review of Lots for Septic, Alex Cirna, Horizon Estates Alex Cirna appeared before the Planning Board to request final subdivision approval of lots in Horizon Estates that weren' t approved because of there was no percolation and no sewer. He explainedthat they couldn't get Health Department approval for these lots. • Linda Hirvonen briefly explained to Robert Todd that Mr. Cima had originally developed the first part of his project and had fully intended to develop the Estate section under the assumption that he would have municipal sewer available. While in the process of • development, the Village of Cayuga Heights withdrew the access to sewer for this project, but by then Mr. Cima already had all the sewer pipes installed. Because of this incident, Mr. Cima had to resort to putting in septic systems for each lot. Al White pointed out that this Planning Board has already approved this subdivision subject to approval by the Health Department. • Viola ; Miller questioned Alex Cima as to why the Health Department is permitting the fill. that .is being brought in on this development project, when previously the Planning Department wasnot able to approve a similar development that had fill brought in. Mr.: T ; a Circa explained that many of the local highway departments and contractors are bringing in ' •: their fill and he has not had any concerns expressed to him by the Health Department. Mr. Cima's appearance before', the Planning Board is ' ; basically to explain that the lots that weren' t approved before are' now. going to be ' approved because there is sewer available, and that the only, reason that, they• . werent ,approved' .; } originally was because sewer wasn' t available. Al White noted for the record that Alex Cima appeared before the Planning Board to , riotiffy them that he has received permits for sewers that will allow him to complete development • that was originally approved by this board, subject to Health Department approval. • _ t _ , ,1 , , Proposed Subdivision, Chuck and Candyce Bartosch; Cherry Road• •and North Trpiammer Road, Tax Map #44.-1-33.2 .s` , . , Randy Marcus appeared before the Planning Board 'to present a proposed subdivision forthe property belonging to the Bartosch's in the Town and Village of Lansing. He thanked the board for their previous input as to the configuration of the subdivision. He explained that there will be three lots in the Town of Lansing, and two lots in the Village of Lansing. The Bartosch's will be appearing before the Village of Lansing Planning Board on June 29 to i . present the identical proposal for their review. 6 . .,' ia).410 Larry Sharpsteen questioned the amount of the remaining acreage in - the Village of Lansing for lot #5. Candyce Bartosch felt that it was approximately one acre. Larry Sharpsteen questioned whether lot #5 will be allowed further subdivision. Chuck Bartosch stated that , lot #5 will be for their own home and will not be further subdivided. - Chuck Bartosch didn' t believe that there is an easement for the water line that runs through lot #5, but that he doesn't have the abstract yet. , ' Larry Sharpsteen extended his appreciation for the cooperation of the Bartosch's for working with the Planning Board to straighten the lines up for this subdivision. The Planning Board reviewed the SEQR and received a negative declaration. - ; . . Al White made a motion concerning the portion in the Town of Lansing, stating, that it • appears to meet all the subdivision rules and regulations, therefore, to accept this as a - =" preliminary plat and to schedule a public hearing on July 12, 1993, at 8:00 p.m.; Lin f,; Davidson seconded. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY , ' . ') ;; " Viola Miller clarified that the driveway for lot #5 will be from Cherry Road. Linda Hirvonen commented that the Town has not lost sight of the original comment made i to Mrs. Olsfeski in that the Town is concerned about future development of that entire parcel going from Cherry Road to Peruville Road and all the development in between; however, ::.;;;., ` 0 . this subdivision meets all the requirements and there is no reason not to permit it.
