Butler : RESOLVED , that the Lansing Town Board adopts the following P rocurement Policy . TOWN OF LANSING PROCUREMENT POLICY P olicy Statement • The purpose of the Town of Lansing ' s Procurement Policy is to e nsure the prudent and economical use of public moneys and to facilitate the acquisition of facilities and commodities of maximum q uality at the lowest possible cost under the circumstances , and to g uard against favoritism , improvidence , extravagance , fraud and corruption . With respect to the implementation of the Procurement Policy , Town of Lansing Officials are required to conduct their affairs w ith the highest moral , legal and ethical standards . Employees and o fficers of the Town must refrain engaging in personal activities which injure or take advantage of the town . Employees , officials and affiliated persons also may not make personal profits from their Town positions when to do so would be a conflict of interest . The Town of Lansing ' s Procurement policy is intended to fully comply with all federal and state purchasing requirements . Whenever possible , the Town of Lansing will seek to engage in a P rocurement Policy which supports business and industry with New York and otherwise supports jobs within the State . S tatement of Noncollusion E very bid or proposal made to the Town where competitive bidding is • required by statute , rule , regulation or local law , for work or services performed or to be performed , shall contain a noncollusion statement in the form required by law . P olicy All contracts for public work including an amount of more than $ 20 , 000 . 00 and all purchase contracts involving an expenditure of more than $ 10 , 000 . 00 shall be awarded to the lowest responsible bidder furnishing the required security after advertisement for sealed bids as required by law . If such bids appear to be unsatisfactory , the Town of Lansing may in its discretion , reject all bids and re - advertise for new sealed bids as required by law . All Town bid applications and advertisements should state that the Town of Lansing reserves the right to reject any and all bids and quotes and waives the right to waive any of all formalities if it be deemed in the best interest of the Town . A rejections may be based in part on products or services which do not meet Town specifications , inferior products or services , a history of poor or late deliveries , or lack of compatibility to existing products or services . Wherever possible , practicable and feasible and consistent w ith open competitive bidding , the Town of Lansing may use stock time specifications of manufacturers , producers and / or assemblers located in New York in developing specifications for items to be let for bid in its purchasing contracts . Notwithstanding the above , the Town of Lansing may make purchases , when available through Tompkins County subject to the state rules therein , provided that the Town accepts responsibility for any payment due therein . The Town may not make any purchase through the County when bids have been received for such purchase , unless the purchase can be made upon the same terms , conditions and L, 181 January 06 , 1993 , continued specifications at a lower price through the County . N otwithstanding the provisions above , in the case of an emergency involving an accident or other unforeseen occurrence or condition whereby circumstances involving public buildings , public property , or the life , health and safety or property of the ✓ esidents of the Town of Lansing require immediate action which cannot await competitive bidding , contracts for public work or purchase of suppliers , material or equipment may be let by the 4 \ Town . U pon adoption by three - fifths of the Town Board of a ✓ esolution stating that , for reasons of efficiency or economy , there is a need for standardization of purchase contracts for a particular type or line of equipment , material or supplies of more than $ 10 , 000 . 00 , such contracts may be awarded by the Town to the lowest responsible bidder furnished the required security after advertisement for sealed bids as required by statute . The Board ' s resolution must clearly state the reasons for its adoption . Surplus and secondhand supplies , materials and equipment may be purchased without competitive bidding from the federal government , State of New York or other political subdivision . N otwithstanding the above , the Town of Lansing may make purchases of materials , equipment or supplies ( other than printed material ) through the Office of General Services provided such purchase exceeds $ 500 . 00 and the Town accepts sole responsibility for any payment due the vendor . To the extent feasible , the Town of Lansing may procure goods and services from qualified charitable non - profit making agencies for the blind or by any qualified charitable non - profit making agencies for the severely handicapped as provided in Sections 175 - a ® and 175 - b of the State Finance Law . The Town of Lansing may also procure goods from State correctional institutions and penitentiaries as provided by Section 184 of the Correction Law . When purchasing products with and without significant recycled content , the Town of Lansing may whenever the price is reasonably competitive and quality adequate for the purpose intended , purchase the recycled product . The Town of Lansing may enter into cooperative bidding for the performance of certain municipal cooperative activities as provided in Section 119 - o of the General Municipal Law . Procurement Procedures B efore undertaking the purchase of any new or used goods or services , Town officials should determine first whether competitive bidding is required . ( As noted above , competitive bidders are ✓ equired where the purchase of goods or services exceeds $ 10 , 000 . 00 and for public work projects where the amount exceeds $ 20 , 000 . 00 ) Records should be maintained documenting the basis for any determination that competitive bidding is not required . Whenever possible , when the services or procurement of goods are less than $ 10 , 000 . 00 and procurement of public work projects are less than $ 20 , 000 . 00 , there shall be solicitation of price q uotations as follows : ( Public Work Projects ) $ 19 , 999 - $ 5 , 000 - Three written price quotes $ 5 , 000 - $ 1 , 000 - Three oral quotes U nder $ 1 , 000 - Inquire and compare pricing ( Goods and Services ) $ 9 , 999 - $ 2 , 500 - Three written price quotes $ 3 , 500 - $ 500 - Three oral quotes Under $ 500 - Inquire and compare pricing 182 January 06 , 1993 , continued ( Equipment ) All purchases of equipment require Town Board approval . ( Building Repair and Maintenance ) All building repairs and maintenance projects exceeding $ 1 , 000 . 00 require specific Town Board approval . The Town Board reserves the right to require bids on any purchases • if circumstances and market conditions warrant . Adequate documentation should be maintained to verify actions and provide written documentation why a contract award was issued . Justification and documentation will be required of any contract awarded to other than the lowest responsible dollar o fferor . Documentation providing such justification shall be included with any invoice submitted for audit . In an event of an emergency or other unforeseen circumstances which require immediate action , the circumstances of such need or emergency shall be d ocumented ( on a voucher ) . P rohibition No board member , officer or employee of the Town of Lansing shall have an interest in any contract with the municipalities of w hich he is an officer or employee , when such officer has the power o r duty to ( a ) negotiate , prepare , authorize or approve the contract or authorize or approve payment thereunder , ( b ) audit bills or claims under the contract or ( c ) appoint any officer or employee who has any of the above - noted powers . In addition , no fiscal officer , treasurer or his employees shall have an interest in a bank or trust company designated as a depository , paying agent , registration agent or for investment of funds of the municipality in which he is an officer or employee . * * * The above - noted procurement policies and procedures shall be reviewed by the Town on an annual basis . ( Aye ) Jeannine Kirby , Councilman Sharon Bowman addressed the Board concerning errors that were made in regards to water accounts on 1993 Town & County Tax Bills . Concerning the Thaler & Warren bills the units were calculated w rong . The full tax bill will be paid and then the owners will be ✓ eimbursed by voucher . In regards to Mr . Horky , he sold 30 acres to Preston and this w as not picked up at the Assessment Department . Therefore Mr . Horky ' s bill reflected a 5 . 4 units charge on his bill that should have been billed to Mr . Preston . Mr . Horky has paid his bill in full and will be reimbursed the $ 1 , 296 . 00 for the unit charge . It was the consensus of the Board to have Sharon Bowman send a letter stating that the Assessment Department did not make the land transaction along with a calculated bill to Mr . Preston for the 5 . 4 water unit charge . RESOLUTION offered by Mr . Cleveland who moved its adoption , seconded by Mr . Butler : RESOLVED , that the Town Board authorizes Bolton Point to recalculate Mary Frances Steinhart ' s water bill of October 1992 reducing the water surcharge from 45 % to 30o and removing the penalty charges resulting from this water problem . BE IT FURTHER RESOLVED , that the bill has been reduced from $ 427 . 49 to $ 383 . 27 . ( Aye ) Jeannine Kirby , Supervisor It was the consensus of the Town Board to close the Town Annex ( Community Building ) until further notice due to construction on the building and for the safety of the residents . The Town will hire professional cleaners to come in and clean • the building before reopening . Mrs . Kirby informed the Board that the State Department of Transportation per the Town Boards request has lowered the speed limit on Atwater Road , between Asbury Road and Route 34 to 45 MPH . Mr . Thaler informed the Board that the deed has been recorded o n the State land that was purchased on the Auburn Road . Mr . Tvaroha updated the Board on the Solid Waste fee for property owners . Mr . Tvaroha has been pursuing an audit of sales tax figures at the point of origin . . He has had discussions with Scott Heyman , County Administrator in regards to this subject . He will get back to the Board at a later date in regards to the Town passing a ✓ esolution supporting this . Mr .
