PLANNING BOARD *Denotes Present Grace Haney Larry Sharpsteen * Linda Hirvonen Robert Todd * Viola Miller Mullane Al White * Cheryl Nickel * George Totman, Planning , Zoning , and Code Administration Larry Tvaroha, Town Councilman PUBLIC PRESENT Larry Fabroni Scott Pinney Gary Lamont Tim Terpening Flo Pinney Jeff Uotila Rick Pinney Chairperson Linda Hirvonen called the meeting to order at 7:30 p. m . • GENERAL BUSINESS SEQR for new industrial zone. Linda explained that in the subcommittee meetings with Tom Neiderkorn , the SEQR was preliminarily reviewed and received as negative . Linda asked that if that decision was agreeable to the Planning Board members, she would entertain a motion. Larry Sharpsteen moved to accept the SEQR for the new industrial zone ; Viola Miller seconded. VOTE: ALL IN FAVOR ; MOTION CARRIED UNANIMOUSLY Linda explained that this must now go to the county before the town can act on it. The county has 30 days, which means that it will not be enacted until the first of the year. She went on to explain that when the Planning Board has determined that the amendment is the way they want it, they need to make a resolution referring it to the Town Board with a recommendation that it be adopted after a public hearing . In this case, the Town Board will be the lead agency for SEQR. The Planning Board resolution should also include a recommendation that based a long-form environmental assessment made by the Planning Board , a negative declaration be filed (no significant environmental impact because of the amendment) . The amendment will have to be sent to the County Planning Board for 239-1 L&M review before the Town Board can act. The County Planning has 30 days to respond . The negative declaration of SEQR should be filed by the Town as follows: Thomas Darling , Commissioner, New York State Department of Environmental Conservation ; New York State Department of Environmental Conservation ; and Ted Wicksham , Mayor of the Village of Lansing . Larry Sharpsteen moved to recommend that the amendment to the zoning ordinance for the industrial • zone (see attached) be submitted to the Town Board for their approval ; Grace Haney seconded . VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY Town of Lansing Planning Board Page 2 Monday, November 2, 1992 • Review of Planning Board Minutes from September 14, 1992, September 28, 1992, and October 12, 1992 Cheryl Nickel moved to accept the minutes as presented ; Grace Haney seconded. VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY ONE-LOT SUBDIVISION, Gary and Pamela Lamont, Triphammer Terrace, Tax Map #41 :1 -2 This proposal from Gary and Pamela Lamont is for a one-lot subdivision on the corner of Hillcrest Road and Triphammer Terrace. The size of the lot to be created is 1 .093 acres, leaving a parcel of 1 . 934 acres. Both parcels have adequate road frontage. The new parcel would have 165.95 feet of road frontage on Triphammer Terrace as well as 255 feet on Hillcrest Road . The existing parcel as reduced would have 235.55 feet of road frontage on Triphammer Terrace . There would be no new utilities or roads . The size of the lot meets health department regulations for septic. Cheryl Nickel stated that for traffic safety purposes , the driveway or any access to the new lot should come off of Triphammer Terrace rather than Hillcrest Road . Viola asked that consideration be given that any possible structures or shrubbery, etc. , be far enough away from corners so that you can see around them . George Totman clarified that this is currently in the building codes and the road right-of-way comes back so far from each road. • Larry Sharpsteen moved to accept the one-lot subdivision at the corner of Hillcrest Road and Triphammer Terrace by Gary and Pamela Lamont with the understanding that any access will be off Triphammer Terrace and that curb cuts will no closer than 50 feet from the intersection of Triphammer Terrace and Hillcrest Road, and further waive the requirement for a public hearing ; Viola Miller seconded . VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY The Planning Board reviewed the SEQR and received a negative declaration . FIVE-LOT SUBDIVISION , Jeff Uotila , Algerine Road , Tax Map #12.•1 .23.21 Jeff Uotila and Tim Terpening appeared before the Planning Board with further questions as to where the north/south paper road should be placed . Mr. Uotila is proposing that since the access to Algerine Road is already existing on the main entrance driveway to his proposed subdivision , that that be considered as the location of where he would grant some type of easement or right-of-way across that to become a future highway connecting to some properties to the north and directly with Algerine Road . Mr. Uotila as to how he is to get the fire department to work with him . He stated that he has tried to make connection with the Fire Chief who has flatly refused to be involved in the designation of a road that could be accessible for the fire trucks and emergency vehicles. Mr. Uotila questioned the Planning Board as to if there was another agency or person that he should be contacting. George Totman explained that the Fire Commissioners have informed the Fire Chiefs that they are not to • have anything to do with designating roads, because they don't want to be liable. It says in the State Law book that any road, like the one proposed by Mr. Uotila, or long driveway or private road that it has to be accessible to fire, police, and emergency vehicles. George stated that there is no way that anyone will be Town of Lansing Planning Board Page 3 Monday, November & 1992 • able to determine whether a fire truck will be able to get down that road unless you actually take a fire truck down the road and try it. George Totman stated that he has informed the Town Board of the stand by the Fire Commissioners, and the Town Attorney has informed him that he is to continue referring people to the fire department. If it creates a problem , the Town Attorney will have to contact the Attorney for the fire district and work this out. George Totman suggested that a representative from the Planning Board appear before the Town Board and discuss this problem , and ask if the Town Attorney can solve it. Another issue that still needs to be resolved is paper roads. Larry Sharpsteen suggested looping the long , dead-end road abutting to Ruth Adams's property. Since the paper road may not be able to be placed anywhere other than where the old road was placed, it was suggested to Mr. Uotila to look at topography maps of the area. Linda stated that the Planning Board is sympathetic to Mr. Uotila's situation , and will work with the Town Board and Town Engineer as to what would be acceptable. The Planning Board encouraged Mr. Uotila to send a letter to the Town Board asking their assistance in what their next direction should be with this subdivision proposal. SIX-LOT SUBDIVISION, Richard and Flo Pinney, Ridge Road, Tax Map #25:1 -7.5 • The Planning Board reviewed the long form of the Environmental Assessment Form and declared a negative impact as proposed. George Totman questioned as to whether the Pinney's had decided on a name for the new road yet, which they have not. Viola Miller moved to accept the preliminary plat for this six-lot subdivision ; Larry Sharpsteen seconded . Contingent upon Mr. and/or Mrs. Pinney providing the required information to George Totman prior to the scheduling of public hearings for the next regular meeting of the Planning Board , a public hearing will be scheduled for this subdivision on December 14 , 1992. VOTE : ALL IN FAVOR ; MOTION CARRIED UNANIMOUSLY FIVE-LOT SUBDIVISION, Stephen Lucente, Village Circle, Tax Map #39.1 -38 through 39.-1 -38.18 Larry Fabroni appeared before the Planning Board representing Rocco and Steve Lucente requesting approval of a five-lot subdivision of their property on Village Circle. The Lucente's are now developing this parcel , where in the past they were prevented because they were all on private wells. Public water is available and the Health Dept is now in a position to accept the system that will be developed for each individual lot. The new developments would contain ten , one-bedroom apartments. The Planning Board stated that if they get a letter from John Anderson stating that he approves of the septic systems for each lot, that would be sufficient information regarding the septics. • The concern of this proposal is that the area is zoned for low density not for multiple occupancy. These units were built in the late 1960's before zoning was introduced into that area. The lots are already in existence, therefore, this is not a subdivision. Town of Lansing Planning Board Page 4 Monday, November 2, 1992 • George Totman believes that this issue should go before the Zoning Board of Appeals, and that the Planning Board should provide them with something in writing . This is a non-conforming use of the land . Viola Miller believes that the Zoning Board of Appeals only deals with variances for use and area and only the Town Board can change a zoning district, and that this must go before the Town Board. The recommendation is that this is within a multiple housing district and is non-conforming , but that this board would recommend that they allow it. George Totman said that the Planning Board then is asking that the Town Board write a letter to the Zoning Board of Appeals if they decide to hold a public hearing with that recommendation. Linda Hirvonen questioned whether any open space was being designated . Linda clarified that the Planning Board does not need to take any action since the Planning Board has determined that this is outside their domain. FURTHER BUSINESS George Totman explained the project that Alan Cima is working on in the Horizon area. He explained that Mr. Cima is considering converting on of the buildings that has two house in it and making it so that it would house up to 16 people, as well as one resident care person . It would • house older people that can still get around on their own , but do require some amount of supervision . He has contacted the Department of State, the lawyers for the state, and the Health Department, who have been guiding him as to what he needs to do. This house would have one major kitchen and living room , with the remainder being rooms for the individuals. This would be an alternative for a nursing home. Once the residents can't take care of themselves, they would not be able to stay there. He is in the planning process. According to the Health Department for the state, with the square footage that Mr. Cima has got, he could house up to 16 people. The Town Board passed the resolution that any new members to the Planning Board are required to attend a training session or be removed from their position . George Totman passed out a handout entitled, "What Does the Planning Board Do?", and "What Are My Responsibilities as a Planning Board Member?". Discussion turned to the need for a replacement for Roger Hagin , and that they would like to be able to choose from more than just one person. There being no further business, the meeting was adjourned at 9 :50 p. m . • The next Planning Board meeting is scheduled for November 23, 1992, at 7:30 p. m. Submitted by Michelle Eastman
