Chairperson Linda Hirvonen called the meeting to order at 7 :37 p . m .
Review of Planning Board Minutes from August, 10, 1992
Roger Hagin moved to accept the minutes as presented ; Viola Miller seconded .
VOTE: ALL IN FAVOR; MOTION CARRIED UNANIMOUSLY
GENERAL BUSINESS
Linda Hirvonen began by discussing the letter she had written to Tom Neiderkorn as a
follow up to the input from the Town Board and a committee meeting held. She asked
the Planning Board members that if any further information need to be included in this
letter to let her know as soon as possible .
Linda went on to discuss Town Law 280A in regard to subdivisions on unimproved
streets , which are private roads that are not built specifically to town specifications or
have not been dedicated to the Town . Linda stated that according to Town Law, there
can only be four lots on an unimproved street, provided there is a 60-foot right of way
to a highway or a town street. The Planning Board can approve a subdivision on an
• unimproved street , but the Town Board will have to pass a resolution after the
Planning Board has approved the subdivision .

TWO- LOT SUBDIVISION, Charles Nedrow, Davis Road, Tax Map #16.-1 -8 . 2 •
Charles Nedrow appeared before the Planning Board to request approval of a two-lot
subdivision of his property on Davis Road . He plans on giving the smaller lot as a
wedding gift to his son . Linda Hirvonen questioned Mr. Nedrow as to if he has
subdivided any of his land in the past . Mr. Nedrow responded that he has not .
The Planning Board reviewed the SEQR and received a negative declaration .
It was recognized that it is the responsibility of the realtors or the person selling the
land that is in the agriculture district , to notify the Town that it is being subdivided .
Viola Miller moved to accept the subdivision as presented and to waive the public
hearing ; Roger Hagin seconded . VOTE: ALL IN FAVOR; MOTION CARRIED

P UBLIC HEARING , Grace Allen , East Shore Drive, Tax Map #48 .- 1 -4
Linda Hirvonen read the public notice published in the Ithaca Journal , opened the
public hearing at 8 :00 p. m . , and invited questions or comments from the public
present . As there were no members of the public with any questions regarding this
subdivision , Roger Hagin moved to close the public hearing at 8 :05 p . m . , subject to •
reopening if anyone appears with questions ; Grace Haney seconded . VOTE: ALL IN
FAVOR; MOTION CARRIED UNANIMOUSLY

P UBLIC HEARING , Viola Miller, Horizon Drive, Tax Map #44 .-1 -43 . 2
Linda Hirvonen read the public notice published in the Ithaca Journal , opened the
public hearing at 8 : 15 p. m . , and invited questions or comments from the public
present.
Carol Devine and Jim Sethra own the property that is identified as "The Learning
Web" on the proposed subdivision map. Their concern is with the drainage ditch that
drains their property , which runs across the proposed subdivision . They are asking
that that ditch stay open , and stated that they have expressed this concern to Viola ,
and just wanted to register this concern with the Planning Board . Viola Miller added
that she has assured them that it will remain open and that anyone buying the lot has
to know that the drainage ditch is there . Mr. Setha expressed his concern that the
drainage ditch frequently fills up , and that he currently goes and shovels the ditch out ,
and is concerned with what the new owners will think of this . Linda Hirvonen stated •

1111 that the new owners will have to deal with the drainage , and not cause any problems
for the Devine/Setha property or any other property.
Grace Haney moved to close the public hearing ; Roger Hagin seconded . VOTE: ALL
IN FAVOR; MOTION CARRIED UNANIMOUSLY - One Abstention (Viola Miller)

PUBLIC HEARING , Douglas Harris , Dandyview Heights , Tax Map #25.-1 -7. 6
Linda Hirvonen read the public notice published in the Ithaca Journal , opened the
public hearing at 8 :30 p. m . , and invited questions or comments from the public
present . As there were no members of the public present with questions regarding
this subdivision , Cheryl Nickel moved to close the public hearing subject to reopening
if anyone appears with questions ; Roger Hagin seconded . VOTE: ALL IN FAVOR;
MOTION CARRIED UNANIMOUSLY
Viola Miller moved to approve this subdivision ; Roger Hagin seconded . VOTE: ALL
IN FAVOR; MOTION CARRIED UNANIMOUSLY
• THREE- LOT SUBDIVISION , Alice Olsefski , Cherry Road , Tax Map #44.-1 -33. 2
Alice Olsefski and Allan Warshawsky , the real estate agent representing Ms . Olsefski ,
appeared before the Planning Board to request approval of a three - lot subdivision of
property belonging to Ms . Olsefski located on Cherry Road .
On Lot One , there is a proposed water line going in , but it will be written into the deed .
Viola Miller questioned Ms. Olsefski as to whether she has plans to further subdivide
the land the remainder of her land behind these three lots in the future. Mr.
Warshawsky responded that Ms. Olsefski 's intentions were to at some point sell the
remaining lot as a whole with the house on it . Roger Hagin clarified that these lots
would be outside of the airport hazard zone .
Roger Hagin questioned the poor drainage on these lots . Linda Hirvonen added that
there is public water available. Viola Miller questioned the width of these lots as
compared to other lots that Ms. Olsefski had sold previously on Cherry Road . Mr.
Warshawsky responded that the other lots were approximately 300 feet wide , where
these are 100 feet wide.
The Planning Board reviewed the SEQR and received a negative declaration . A
public hearing was scheduled for October 12 , 1992 , at 8 :00 p . m . , subject to approval
• of the Planning Board .

Viola Miller commented that she is very concerned that no provision has been made •
for a road going to the back of her property. The Planning Board agreed that since
Ms . Olsefski has in the past subdivided several other lots , they would ask her to put in
a right-of-way to the back boundary of her property to assist the Planning Board with
their master plan and paper roads . The Planning Board is concerned that all of the
land behind this proposed subdivision is being cut off. Linda Hirvonen clarified that if
indeed Ms. Olsefski wishes to subdivide , that it must be considered a major
subdivision .
S KETCH PLAN REVIEW, Elizabeth Biss , Tax Map #44 .-1 -28
G eorge Schlecht appeared before the planning board representing Elizabeth Biss , to
review a sketch plan for a 17- lot subdivision of her property off of Bean Hill Road and
Stormy View Road . This proposed subdivision would require the extension of Bean
H ill Road and Stormy View Road , which are currently dead ends . These new
extension will provide a turnaround area and an area for future road extension . This
area is serviced by public water and the water lines would be extended . The area is
well drained , but of the some of the drainage ditches will need some attention , which
will be given . This entire proposed subdivision is in the airport hazard zone . This is a
medium -density residential zone . Linda Hirvonen commented that this proposed
subdivision fits in well with the plans of the Planning Board . Linda added that she is
pleased to see the turnarounds so that the roads could be continued for any future .
development.
Linda Hirvonen stated to Elizabeth Biss that this proposal will need some more review
and discussion by this Planning Board , since the Planning Board is currently working
on a master plan and new zoning areas. Linda questioned Ms . Biss as to natural
hedgerows or large trees that might be utilized . Mr. Schlecht responded that the
majority of the property is overgrown , thick brush where there are both hedgerows and
trees . The majority of the larger trees are on Lot One .
Mr. Schlecht stated that he would like to hear comments from the Planning Board as
to the sketch plan before he goes any further with completing the plan (e . g . , the
turnarounds) . Grace Haney commented that there is drainage that comes
underground from the Anderson lot onto Lot 14. Linda commented to Mr. Schlecht
that one thing the Planning Board will request is that a drainage plan be developed
and presented to the Planning Board as well as to the Town Engineer prior to
approval of this proposed subdivision .
Larry Tvaroha questioned where the current roads end . It was determined that the
roads currently end approximately 20 feet before the boundary. Larry Tvaroha's
concern was with who will be responsible for the construction of that 20 feet. George
Totman clarified with the Planning Board for Mr. Schlecht ' s benefit , that they generally
accept this sketch plan with the recommendation that Mr. Schlecht go back to the 1111
Town Engineer and Highway Department for their comments about the roads and
drainage .
SKETCH PLAN REVIEW, Peter. Duenkeisbuehler, Aigerine Road , Tax Map #12.-1 -
23 . 2
George Schlecht appeared before the Planning Board to request approval of a five-lot
subdivision . Linda Hirvonen addressed to Mr. Schlecht the Town Law #280A that -
states that there cannot be any more than four lots on an undeveloped/private road ,
without getting into a homeowners association . Linda clarified that this sketch plan is
actually six lots since the remaining land is considered a lot.
Viola questioned how long the private road was , to which Mr. Schlecht responded
approximately 5 ,000 feet. Roger Hagin commented that this sketch plan differs from
the original plan in that it doesn 't have the access to the private road from the lake
frontage road , which would have been used as an emergency access road . George
Totman stated that he has expressed to Mr. Duenkeisbuehler that he should get a
letter from the fire department stating that they won 't have a problem getting to the
houses down the private road .
Roger Hagin suggested putting in a paper across the Adams' property so that in the
future if there were any development , the developers would see what the Planning
• Board has in mind .
George Schlecht asked the Planning Board whether they would consider a four-lot
subdivision on a private road , and that if in the future more development was done ,
the road would be brought up to town specifications and be dedicated ; or whether the
Planning Board would recognize a four- lot subdivision on a public road , which would
be a long dead-end road. Linda Hirvonen didn 't feel that the Planning Board could go
any further without more topography being done . She is concerned with the design of
the road , e . g . the grade. Linda Hirvonen was concerned that Karl Dates , the original
subdivider, had already cut through the road before bringing the subdivision to the
Planning Board . She stated that the Planning Board does have certain design
standards that it can exercise , and if the Planning Board feels that it is not in the best
interest of any future residents of that area, the Planning board can request changes.
George Totman clarified that if Mr. Duenkeisbuehler brings the entire road up to Town
specifications , he can ask for a major subdivision for the rest of his lots because it will
be a public road .
TWO- LOT SUBDIVISION , James and Jean McIntyre, Lakeview Drive, Tax Map
#26 .-4- 11
• Lenore Fleming appeared before the Planning Board representing Mr. and Mrs .
McIntyre to request approval of a two-lot subdivision of their property on Lakeview
J
Drive . This lot was, atone point , two separate lots . Mr. and Mrs. McIntyre are now •
asking that it be divided back into the two separate , original lots .
The Planning Board reviewed the SEQR and received a negative declaration .
Viola Miller moved to accept this proposed two-lot subdivision and to waive the public
hearing ; Roger Hagin seconded . VOTE: ALL IN FAVOR; MOTION CARRIED
UNANIMOUSLY
FURTHER BUSINESS •
Viola Miller commented that the meetings for the State Planning Federation will be at
Niagara Falls during the weekend of November 8 , 9 , and 10 - Sunday , Monday, and
Tuesday. Linda Hirvonen added that the Town has money in its budget for this
meeting , and encouraged anyone that wants to attend to do so .
There being no further business , the Planning Board meeting was adjourned at 10 :30
p . m .
