M . with Supervisor Kirby presiding . ROLL CALL Jeannine Kirby Supervisor Present H erbert Beckwith Councilman Present P aul Butler Councilman Present Jeffrey Cleveland Councilman Present L arry Tvaroha Councilman Present B onita Boles Town Clerk Present Richard John Town Attorney Present 1111 VISITORS : Randy Swearingen , George Totman , Pete Larson , Dave H errick and Jeff Sweazey . Randy Swearingen asked the Board for their approval for him to continue with the Water District extension for his property on W ater Wagon Road in the Town of Lansing . Mr . Cleveland stated that there were not enough Water Board Members present at their last meeting to give Mr . Swearingen authorization . After the Town Attorney and the Town Engineer went over Mr . Swearingen ' s proposal with the Board members , the following Resolution was adopted : RESOLUTION offered by Mr . Cleveland and seconded by Mr . Tvaroha : RESOLVED that the Town Board does hereby authorize the Town Attorney to draw up the necessary paper work for Mr . ( Aye ) Jeannine Kirby , Supervisor After the Board explained the costs involved in a water district extension , Mr . Swearingen decided to go back and discuss it with his neighbor and get back to the Board . ® Jeff Sweazey of Ludlow Road in the Town of Lansing stated that he was informed by Mr . Totman that he should approach the Board in regard to storing cement slabs at his home on Ludlow Road . The slabs were acquired from McGuire & Bennett Construction . Mr . S weazey stated that he would like to use these for his personal use but did not know there was a law against this . The Board felt this w as recycled building material and would be put to good use . The B oard Members asked Mr . Sweazey to put into writing , his intended w se of this material and give it to the Town Clerk to be filed . Mr . Larson , Highway Superintendent , reported the following to the Board : 1 . He will start placing an ownership sign on the back of all road signs stating the month and year the sign was put into place so they can better identify them . 2 . Mr . Larson has a copy of a hold harmless agreement that he w ill start using for Town use instead of letters from individuals w hen the Town needs to go onto private property . 3 . Lansing maintains 4 . 6 miles of the Genoa / Lansing Townline Road and Genoa maintains 1 . 8 miles of this road . Mr . Larson asked for the Board ' s approval to approach the Town of Genoa in regard to making this more equal as far as the maintenance of said road . ( 3 . 5 miles equally ) . Mr . Tvaroha was concerned about the maintenance that the Town of Genoa might provide to Town of Lansing residents . It was the consensus of the Board to allow Mr . Larson to further investigate this situation and to get back to the Board w ith his findings . 4 . The new fuel tank arrived today and should be put into place within the next month or so . 5 . Mr . Tvaroha stated his concern with the old fish hatchery located on the north side of Salmon Creek in Myers . He felt this was a safety hazard and would like Mr . Larson to proceed with filling this in as goon as possible . One Lansing resident had 1) 0 continued January 15 , 1992 complained but the Board felt this was one persons feelings and that Mr . Larson should continue with his completion of this project . 6 . The bid price of $ 18 . 099 . 94 on the culvert pipe for Bill G eorge Road is still in effect and Mr . Larson would like to order this within the next month or so . Mr . Herrick stated that he has people asking him for information from his files and he was not sure if this should be g iven out . The Town Board felt an individual will have to put into writing exactly what information they would like to obtain before Mr . Herrick gives it out . RESOLUTION offered by Mr . Beckwith and seconded by Mr . III Cleveland : RESOLVED that the Regular Meeting be adjourned to go into E xecutive Session at 8 : 55 P . M . Carried . RESOLUTION offered by Mr . Beckwith and seconded by Mr . Cleveland : RESOLVED that the Executive Session be terminated at 9 : 18 P . M . and the Regular Meeting be reconvened . Carried . The Town Board suggested that a letter be written to Bolton P oint Water Commission stating that they should NOT DO ANY INSPECTION ON THE GIRLS SCHOOL . Mr . Herrick stated that he has received a letter from Pilon Construction in regard to the uncompleted work in the Bean Hill area . Mr . Herrick will respond to Pilon ' s letter as he feels there h as been misrepresentation and errors made . RESOLUTION offered by Mr . Butler and seconded by Mr . Beckwith : RESOLVED that the Town Board does hereby authorize Dave • H errick , the Town Engineer to release requested information to Donald Swearingen after Mr . ( Aye ) Jeannine Kirby , Supervisor After discussion of the proposed legislation to establish a county equalization rate for the Ithaca City School District which w ould result in an increase of approximately One Dollar and 45 / 100 ( $ 1 . 45 ) per One Thousand ( 1 , 000 ) of assessed value to Town of L ansing residents living within the Ithaca City School District , the following resolution was duly made by Mr . Beckwith and seconded by Mr . Cleveland : WHEREAS , the Town Board of the Town of Lansing , having been informed of the request by the City of Ithaca for State legislation d ealing with the Ithaca City School District equalization rate ; and WHEREAS , a similar proposal was passed on by the County Board o f Representatives by Resolution No . 173 on May 15 , 1990 which ✓ equested Senator James Seward and Assemblyman Martin Luster to present special legislation amending Section 1315 of the Real P roperty law ; and WHEREAS , the Board has had brought to its attention that a proposed bill to amend Section 1202 of the Real Property Tax Law h as been drafted but has not been acted upon by either the County B oard of Representatives of Tompkins County nor by Senator Seward o r Assemblyman Martin Luster ; and WHEREAS , representatives of the Town have met with representatives of the Village of Lansing concerning this matter and both the Village of Lansing and the Town are opposed to continued January 15 , 1992 legislation under the present state of facts governing the reassessment within the proposed area for the equalization change . NOW THEREFORE , BE IT RESOLVED , that the Town Board of the Town of Lansing requests its representatives in the Board of Representatives in the County of Tompkins , its State Senator and its State Assemblyman oppose the adoption of the proposed amendment to Section 1202 of the Real Property Tax Law . This opposition is based upon the inequities which will result from adoption of said change at this time . BE IT FURTHER RESOLVED , that the Supervisor is hereby authorized to send a copy of this resolution to Thomas Todd , Mary 010 Call , Senator James Seward , Assemblyman Martin Luster and to the Supervisors of the Towns of Caroline , Enfield , Ulysses and the Mayor of the Village of Lansing . ✓ ote of Town Board . . . Richard Cook from the Lake Ridge area has informed Mr . Totman that a lot of junk will be removed by the end of January . 2 . So far this year the Town is 6 permits and $ 357, 000 . 00 ahead of 1991 . 3 . Mr . Totman stated that he had written a letter to the New York State Electric and Gas stating that their building permit application states that the total amount of the proposed construction will be 90 million dollars and he has understood it to be a 160 million dollar project . He also stated that N . Y . S . E . & G . would like to do their project in phases spread across a four year period . Mr . Totman felt this to be a fair procedure . Mr . Totman stated that he has been informed by N . Y . S . E . & G . ® that the construction part of the project will be 90 million and the inside finish work will bring the project to a total of 160 million dollars . RESOLUTION , offered by Mr . Kirby informed the Board that a copy of the Village of L ansing Impact Analysis is available for them to read if they wish to do so . After discussion by the members of the Town Board concerning Judge Floyd Ferris ' long and devoted service to the Town and to the justice system , the following Resolution was duly made by Mr . Cleveland and seconded by Mr . Tvaroha and unanimously passed with the instruction to the Clerk to spread it upon the minutes of the 1 ,3 . continued January 15 , 1992 meeting and send a copy of it to Judge Ferris . BE IT RESOLVED , that this Town Board representing the people of the Town of Lansing , hereby salute Judge Floyd Ferris upon the completion by him of thirty - two ( 32 ) years of active , dedicated and excellent service as Town Justice for the Town of Lansing . Judge Ferris exemplified the dedication and judicial temperament which made the Town of Lansing Court a model for all justice courts in this part of the State . Judge Ferris dedicated himself to the performance of a Judge and his dealings with the public brought credit not only upon the court system but upon Judge Ferris 1110 himself . The Town Board , on behalf of the Town residents , wish to thank Judge Ferris and his family for the countless hours that he spent dispensing justice as opposed to being with his family . His service brought credit and enhanced the reputation of not only himself but of the Town of Lansing in the way he dispensed justice in our Town . ✓ ote of Town Board . . . ( Aye ) Jeannine Kirby , Supervisor Mr . Cleveland stated that Anne Colt has resigned from the Lansing Water Board . Mrs . Kirby stated that there has been an addition to the agriculture district that has to do with the fire insurance a farmer has to carry . There is a new law that allows a Town to offer a farmer a lesser fire premium if they were in an agriculture district . The Town Board will review the law and take further action after this has been done . On motion , meeting adjourned at the call of the Supervisor at 10 : 34 P . M .
