Munson Al White, Chairman, called the Planning Board Meeting to order at 7 :30 p.m. GENERAL BUSINESS Larry Tvaroha opened the meeting by sharing a handout with information from the county level that identifies some of the water sources, sewer, highway projects, and transportation plans that • are scheduled to be done in the next five years throughout the county. He pointed out that there were very few items referred to in the Town of Lansing. He went on to report that the county is responsible for bridge repair and replacement and that there are presently two bridges over Salmon Creek that are of concern in the Town of Lansing. The first is the Lockerby Hill Road bridge where the weight limits have been lowered and lowered to the point now where even school buses are over the Iimit. The Town Board is trying to get the priority of this bridge moved up on the list. The second bridge and even more of an immediate concern is the one in Myers. This bridge is currently at a three-ton limit and is not expected to maintain that limit for more than a year and a half without some major repair work. The county suggested abandoning this bridge. Larry Tvaroha advised the Planning Board to be aware of any discussion regarding this and to confirm that this bridge needs to be in place to be available to all the car and emergency vehicle traffic. Another topic of discussion by Larry Tvaroha was the possible expansion building on Warren Road by Cornell University. Cornell University came in with a plan for putting in a package plant or a sewage disposal system on a small and limited basis. Larry Tvaroha commented that he didn't believe it was very practical to put in a pilot system or a stand alone plant because you are still going to have huge volumes of water you are going to have to discharge on top of the ground that will be running. down through the Village and may have an impact on the Town somewhere along the line. Larry Tvaroha felt that what the Town of Lansing should be working for is to ask Cornell University to put a 1/2 million dollars into the buy-in into the Ithaca Waste Water Treatment Plant, instead of spending 112 million dollars on a package plant. By meeting about once a week on this project, Larry Tvaroha said that the Town is trying to get some sewer going down to the Ithaca Waste Water Treatment Plant. The biggest problem for the Town of Lansing is that we have a very limited base in order to apply any sewer benefits to. There is very little federal funds, there isn't any state funds, it's more or less a stand alone like the water districts. • Commenting that there isn't any funding, Larry Tvaroha said that we've got to come up with a way to get a buy in and work from there. He feels that all the towns are concerned that they don't . want to get anything started right now, they want to go for a more long-range solution. He expects to see something in six months come out of his meetings. This would bring attention to the south end of the town since there is already water there and by bringing sewage, it would increase development and growth in that area. Comments on the package plant by Larry Sharpsteen were such that he felt a package plant would be the worst thing for the Town of Lansing. He had heard that Owasco Lake in its entirety is beyond the limits set by New York State for water being safe to swim in or draw potable water from, and the source for the pollution has been traced all the way back to the Village of Groton's Sewage Treatment Plant. The entire Owasco inlet from Groton all the way to the lake is dead water. That may not have necessarily been a package plant when it was installed, but it is certainly one step or two better than what is being seen as package plants. He doesn't want to see that happen in the area around the proposed site by Cornell University. Review of Planning Board Minutes for August 12, 1991 Frances Ramin pointed out that the last name of Linda Gross had been misspelled. Page three, first paragraph under Sketch Plan Review . Al White pointed out that the last sentence should read, "This would allow for the installation of sand filters." Roger Hagin made a motion to accept the minutes as amended; Frances Ramin seconded the motion. VOTE: ALL IN FAVOR MOTION CARRIED UNANIMOUSLY • Review of Planning Board Minutes for August 26, 1991 Page three, first paragraph. Viola Mullane wants the minutes to show that the work listed might not be completed within the time frame. Frances Ramin suggested that something be sent in writing to the Town Board. Al White agreed to add another paragraph on page three stating, "The Chairman of the Planning Board will supply the Town Board with a statement of intent to work on the update of the master plan, town maps, zoning ordinances, and land use as discussed with Tom Niederkorn." Roger Hagin emphasized that these things would interact and the Planning Board would not necessarily be able to accomplish all of any one of them, but they will be concurrent. Viola Mullane added that they would take what seemed to be of the most importance to work on first with some help from the Town Board and Tom Niederkorn as far as direction. Frances Ramin made a motion to accept the minutes as amended; Roger Hagin seconded the motion. VOTE: ALL IN FAVOR MOTION CARRIED UNANIMOUSLY HERBERT HOWELL, SEARLES ROAD, TAX MAP #28-1 -21 .1 Herbert Howell appeared before the Planning Board to request approval of a one-lot subdivision of approximately two acres on Searles Road. Sherl Walters wants to buy the lot and build a house on it. Linda Hirvonen commented that Sherl Walters can bring the application through , but the application for subdivision should be in the name of the person who legally owns the property (Herbert Howell). Roger Hagin expressed his agreement. • 2 • SEQR Review. The Planning Board reviewed the SEQR and made a negative declaration. Linda Hirvonen stated to Herbert Howell the position that the Planning Board has taken in the past that strip development is not the best type of development for land. The Planning Board would prefer to see depth develop rather than road frontage developed. Linda Hirvonen then acknowledged that this subdivision meets all requirements and moved to accept this one-lot subdivision and waive the public hearing; Larry Sharpsteen seconded. VOTE: ALL IN FAVOR MOTION CARRIED UNANIMOUSLY Viola Mullane commented on the need of the Planning Board to take a look at that land on Searles Road and how the rest of the land is going to be developed. If major development is planned, the Planning Board should have a very clear picture of what is proposed and what is to be proposed. However, Viola Mullane added, that this has no bearing on this particular subdivision. MUNSON FARMS, ASBURY ROAD, TAX MAP #39.4 -7.2 Glenn P. Munson appeared before the Planning Board to present a proposal on behalf of Munson Farms. Mr. Munson distributed a sketch of the six parcels of land on Asbury Road that are proposed to be auctioned off by Munson Realty. Mr. Munson informed the Planning Board that the property is currently owned by Munson Farms, but the Federal Land Bank of Springfield holds the mortgage, and that Munson Farms was asked to submit a proposal for the auction and sale of this particular property. • The question was raised as to why parcel #5 was longer than # 1 - #4, to which Mr. Munson replied that this would keep them out of realty subdivision regulations with the Health Department. He went on to explain that state regulations say that if you propose to sell five parcels of less than five acres each, you are required to submit detailed drawings plus engineering, do PERC tests, provide detailed drawings of the sanitary septic systems, do water tests for analysis, and provide data on adjoining wells. Linda questioned Mr. Munson as to why there were five small parcels and not four large ones. Mr. Munson replied that a one-acre lot across the road, he heard, had sold for between $ 15,000 and $ 18,000. Mr. Munson stated that before anyone buys the parcels, they are told that the sale is contingent on subdivision approval of the Planning Board. This is also stated in the purchase offer. If the Planning Board doesn't approve the subdivision, the buyers will get their money back. Mr. Munson emphasized that this was just a proposal and the map just indicated proposed parcels and not the actual look of the outcome after the auction. He stated that they are selling auction parcels up until the point where the auction has been completed. Then based on if the person puts a combination of any of the parcels together, they are buying one single unit of land. This combination of parcels purchased will eventually become one subdivision lot. Linda Hirvonen again stated the position of the Planning Board that strip development is not a desirable way of using the land. Robert Todd questioned as to what the alternative is for that land. Referring to the proposed map, a suggestion was made to move parcel #5 into the position of parcel # 1 so there wouldn't be a jagged edge in the large parcel #6. Al White suggested drawing a line towards the back of the property, .for perhaps a large field for farming. 3 • Viola expressed appreciation for being able to look at this proposal and acknowledged that all the Planning Board can do is look at it right now. She went on to say that the Planning Board doesn't like it and they don't know exactly what they are going to see in the future, but they will make sure that everything is done in accordance with the rules and regulations that govern. On behalf of the entire Board, Al White expressed appreciation for Mr. Munson presenting this to the board. FURTHER BUSINESS Replacement for Carol Kammen Al White brought up the issue of naming candidates to replace Carol Kammen's vacant position. Viola Mullane stated that Randy Cox had expressed his interest to her and that she directed him to forward his resume to the Town Board. Larry Tvaroha verified that they had not received Mr. Cox's resume as of yet. Discussing the background of Cheryl Nickel, Linda Hirvonen commented that Cheryl has more knowledge than the average person of development because of the work that she has done and the work that she has been involved in, and is familiar with the work that the Planning Board does. Viola wanted to know if Cheryl was active in ongoing developments. George Totman replied that she was not involved in any that he knew of. Larry Sharpsteen felt that her training and experience would be helpful. However, on the down side, a professional comes in with the preconceived notion of what's right and what's wrong as far as their own training and/or experiences leads them to believe. • Larry Sharpsteen commented on Barney Termina as a candidate. Several years ago, when there was a vacancy on the Planning Board, Barney had expressed his interest in serving on this board to Larry Sharpsteen. Mr. Termina is a general contractor who has worked with Triangle Steel for a number of years and currently works for John C. Lowery. He is experienced as a builder and a contractor in light and heavy construction . He also has the fresh experience of a development of his own. The consensus of the Planning Board was to submit to the Town Board the names of both Cheryl Nickel and Barney Termina as candidates for the vacant position . Larry Tvaroha said that he would like something in writing submitted to the Town Board before their next meeting which is on September 18. Marshall Volbrecht, Drake Road, Tax Map #37. 1-7-3. 2 George Totman informed the Planning Board that Marshall Volbrecht has met with the Health Department regarding the three-foot variance for his property. As required by the Health Department concerning variances, letters were sent to owners of the adjoining properties. One of the neighbors got up a petition against Marshall Volbrecht because he was lacking the three feet from the 150 feet required. The Health Department's determination was that they wanted to see a survey of the property in order to verify the data, since the tax map may be short or long on the measurements. Mr. Volbrecht is now considering whether to do the survey or not since it will cost him between $600-700 to get a survey done. • 4 • Alnoor and Karimah Dossa, Grandview Road, Tax Map #40-4- 14. 2 Kathy Webb, a realtor with Audrey Edelman and Associates, appeared before the Planning Board to present a proposed map of a 22-acre lot subdivision on the Horky property and to find out what else will be required of her to make a formal proposal. Discussion surrounding the proposed road lead Ms. Webb to explain that the proposed road is a continuation of the driveway to the Preston's property. George Totman informed the Planning Board that he would be meeting on Tuesday, September 10, 1991, with Dave Herrick, John Horky, and a realtor to discuss details of this proposed road. He went on to explain that Dave Herrick has been working with the Town Board, Town Attorney, Mr. Horky, and Mr. Preston on the proposed road to get to the proposed water tower. Larry Tvaroha commented that it could be more correctly called a town driveway. It is an access area to go to the water tower which the town will have complete control over and will give limited easement to Preston and possibly one other property owner there. It was said that if Horky developed the land, he would be responsible for upgrading the driveway to a road to meet town specifications. Al White stated that because of the proposed water tower and town driveway, there is going to have to be electricity and telephone service run to the tower. With this access, he didn't see any reason why this subdivision wouldn't be subject to approval. Roger Hagin brought up the discussion of drainage on the other pieces of land next to the proposed subdivision lot. He was concerned that there was no outlet for that land to get any water out of there other than crossing other people's land. Larry Sharpsteen offered that since the proposed 22- acre lot is the high point of the area, the storm drainage would end up along the proposed town driveway. Since the town is putting in the driveway, Dave Herrick will be taking drainage into • mind as he is designing the driveway. Viola addressed a question to Larry Tvaroha as to whether the Planning Board should be working with the Town Board on any thought of a proposed road going on beyond the water tower in the future. Larry Tvaroha agreed especially because Horky really doesn't have a plan for his property. Mr. Horky is just selling lots as people want to buy them. Larry Tvaroha also added that Dave Herrick, in his plans, has the road so it hooks up to Whispering Pines in his next phase. Al White expressed to Kathy Webb that she can feel that the Planning Board will look favorably on this as it meets the requirements. Berkshire County Development Trust, Searles Road, Tax Map #28-01-28. 1 A public hearing was held on August 26, 1991, for the proposed subdivision on Searles Road by Berkshire County Development Trust. As was requested by George Totman, the attorney for Berkshire County Development Trust set a letter to the Town Board regarding their status of being registered in New York Status. Larry Tvaroha said he had received a letter from their attorney, but it didn't indicate a register number or include a copy of the registration. Al White said he had been informed by Jeannine Kirby that Berkshire County Development Trust is not registered in New York State, under that name. The consensus of the Planning Board was to request that the application for the subdivision be resubmitted in the owners' name, and there would not be a requirement for further public hearing. George Totman received clarification from the Planning Board that if someone comes in for a subdivision, unless they are the owner of the property, they must say they are acting as an agent 5 • for the owner. As long as the application is in the name of the owner of the property, an agent for the owner can go through the processes for a subdivision. Comments Roger Hagin brought up the subject of land contract sales in regards to the Munson property. He feels the subdivision regulations should have some kind of amendment to cover land contract deals so they can't slip by as far as the legalities are concerned. Al White questioned as to how you identify land contract deals. Roger Hagin suggested this as something to discuss further. Viola Mullane suggested that if it is a legal question, a question can be written up and sent to the Planning Federation to perhaps get some kind of a rule on.
