Al White, Chairman, called the Planning Board Meeting to order at 7:30 p.m.
• Public Hearing - Berkshire County Development Trust, Searles Road, Tax Map #28-01 -
28.1
Al White read the Notice of Public Hearing at 7:30 p.m. as published in the Ithaca Journal on
August 15, 1991.
Chip Landry, representative for Berkshire County Development Trust, was not present at 7:30
p.m. when the Public Hearing was opened. Al White asked the public for any questions they had.
Scott McMillen (59 Searles Road; #5 on the map from Berkshire County Development Trust)
questioned regarding the water supply and whether any testing had been done yet. Mr. McMillen
also voiced his concern for the traffic that would be brought into the area, since he appreciates the
privacy that is currently available on Searles Road. Al White indicated that there is a deed
restriction on the lots stating that no further subdivisions are allowed as well as no mobile homes
on the lots. Chip Landry arrived at 7 :35 p.m. Mr. Landry stated that no water testing or drilling
has been done at this time.
George Totman questioned Chip Landry as to whether Berkshire County Development Trust was
registered in New York State, as they are based in Lee, Massachusetts. Chip Landry said they
were registered in New York State and would have the attorney for the company certify that in
writing to George Totman .
Mr. Landry went on to explain that the Health Department would be brought out to the site to do
testing. The Berkshire County Development Trust will be paying for this testing and will pass on
the information obtained regarding the septic systems and soils to the new owners of the property.
There being no further questions the Public Hearing was closed at 7 :45 p.m. Chairman White
informed Chip Landry that the Planning Board will act on this matter at a later date.

• Due to the fact that all of the credentials of Berkshire County Development Trust have not been
presented, the Town Planning Board deferred approval or disapproval action until the September 9
meeting.
Questions were raised between the Planning Board members. Robert Todd questioned whether a
person needs to get approval for a subdivision before owning the property. This is sometimes in
the purchase offer contingent upon approval. If a person sells three lots in a minor subdivision
and then another three lots at another time, this is considered a major subdivision. The person
owning the property doesn't have to present the proposal, but each subdivision must be counted
against the land (tax parcel).
FURTHER BUSINESS
Marshall Volbrecht, Drake Road, Tax Map #37. 1-7-3.2
George Totman stated that Marshall Volbrecht informed him that the Health Department had not
made a decision yet because the variance was only three feet. They want to see a survey map
before they decide.
Discussion with Tom Niederkorn
Tom Niederkorn was in attendance to discuss what services the Planning Board wanted from him.
Tom referred to his letter dated August 7, in which he outlined several ways in which he could
assist the Planning Board. He questioned the Board as to how he could be useful to them? How
can they work together? The first possibility he suggested was to be a substitute staff on an as
• needed basis in which he could give advice on items presented to the Board. A second possibility
was to start a specific project, three of which he mentioned: a) zoning; b) master plan update; and
c) site plan review.
Al White commented that another area of concern was transportation arteries. Viola Miller
Mullane felt that the Planning Board needs someone to coordinate what has been done and what
has been going on (e.g. Searles Road), then look to planning and zoning. George Totman stated
that he often gets questions on what is the plan for Lansing. He feels that a good place to start is
by updating the master plan. Frances Ramin questioned Tom Niederkorn as to what he felt the
priorities should be for the Planning Board. Tom indicated the need to update the zoning
ordinances and felt the ability to coordinate the update of the master plan at the same time.
Frances Ramin feels that the Planning Board has a mission to help the Town Board. Perhaps the
Town Board should tell Planning Board what they want done. Frances asked Tom how he saw
working with the Planning Board. Tom Niederkorn said we need to see what we've got first then
see how the current development patterns are affecting the township. Roger Hagin brought up the
idea of starting with a base map and adding overlays of the water and fire districts, topography,
and roads. George Totman commented that he would look through maps that he has and will
consult with Tom Niederkorn and Al White as to their appropriateness to this project.
Viola Miller Mullane stated that it would be beneficial to see what was projected for the Town 20
years ago and 10 years ago and compare them to now. This information along with the base maps
will be a good start.

. A statement of intent was clarified for the money to be requested from the Town Board. The
statement is as follows: Buying professional services for $ 10,000 plus $ 1,500 for special services,
which include printing and clerical services, to work on zoning ordinances, master plan, town map
with overlays, and study of land use from 20 and 10 years ago. Viola Miller Mullane also
suggested the need to put money in for professional seminars for the Board members.
There being no further business, the Planning Board Meeting was adjourned at 9:30 p.m.
