REVIEW OF PLANNING BOARD MINUTES OF APRIL 8 , 1991 The first order of business was to review the Planning Board minutes of April 8 , 1991 . Page 1 . Frances Ramin pointed out that the motion was carried regarding the March 11 , 1991 Planning Board meeting minutes . Chairman White added that the motion was carried unanimously . Chairman White stated that there were no minutes from the joint meeting between the Village and Town and that his statement in paragraph 2 should be amended to read that " Al White asked if there were any comments of the joint meeting between the Village and All Town " . ® Linda Hirvonen moved to accept the April 8 , 1991 Planning Board meeting minutes as amended ; Frances Ramin seconded the motion . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY GENERAL BUSINESS Larry Tvaroha reported on that Milliken Station Project and encouraged the Planning Board members to keep up on the Project . Mr . Tvaroha further reported that David Herrick and Pete Larsen are working on a plan for the construction of new roads , that the plan has been reviewed and is about ready to be approved , however , depending on the State budget , they do no know what revenue share to expect so , therefore , do not know how to plan for new roads , summer hiring , etc . Chairman White mentioned the article featuring Viola Miller -Mullane which appeared in The County Planner . Linda Hirvonen mentioned that she , Viola Mullane and Carol Kammen had met to discuss Waterwagon and Triphammer Roads and the development spreading out from Pyramid and how they would like find a way to relieve the congestion in this area . Linda Hirvonen mentioned that they had discussed the possibility of internal roads and diversion of traffic from Triphammer and Waterwagon Road and East Shore Drive . Viola Mullane stated that she will present their concerns at the Town Board meeting . * * * * ROBERT WALPOLE ( BECKLEY ESTATE ) , MINOR SUBDIVISION , CORNERS OF LOCKE ROAD AND WEEKS ROAD , TAX MAP 6 . - 1 - 6 . 2 Chairman White read the Notice of Public Hearing at 8 : 00 p . m . as published in the Ithaca Journal May 3 , 1991 . The purpose of the meeting was to receive public comments prior to consideration on the final plat approval for a 3 lot subdivision located at the corners of Locke Road and Weeks Road , Tax Map 6 . - 1 - 6 . 2 . Mr . Walpole briefly stated that he planned to divide the land into three parcels . Frances Ramin moved that the Public Hearing on the Walpole subdivision be closed ; Viola Mullane seconded the motion . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY The Public Hearing was closed at 8 : 07 p . m . Chairman White informed Mr . Walpole that the Planning Board would act on the matter before 2 the Board later in the meeting . * * * * CAYUGA REALTY ASSOCIATION , PROPOSED 3 LOT MAJOR SUBDIVISION LOCATED ON SALMON CREEK ROAD , TAX MAP NO . 4 . - 1 - 22 AND 4 . - 1 - 23 . Chairman White read the Notice of Public Hearing at 8 : 15 p . m . as published in the Ithaca Journal May 3 , 1991 . The purpose of the meeting was to receive public comments prior to consideration on the final plat approval for a 3 lot subdivision located on Salmon Creek Road , Tax Map No . 4 . - 1 - 22 and 4 . - 1 - 23 . Attorney Les Reizes appeared before the Planning Board on behalf of Cayuga Realty Association to answer any questions that the Board or public may have . Attorney Reizes presented a survey map of the proposed subdivision to the public in attendance and explained that there is a deed restriction that no mobile homes could be placed on the land . A member of the public questioned what impact the proposed subdivision would have on property taxes in the area . Chairman White stated there would be no increase in property taxes until the land was improved . A member of the public questioned if apartment buildings were planned for this land . George Totman explained the zoning for the area of the proposed subdivision and stated that if apartments were to be planned , they would have to meet the Building Code . Viola Mullane moved that the Public Hearing on the Cayuga Realty Association subdivision be closed ; Linda Hirvonen seconded the motion . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY The Public Hearing was closed at 8 : 27 p . m . Chairman White informed Attorney Reizes that the Planning Board would act on the matter before the Board later in the meeting . * * * * * HERBERT MILLIMAN , PROPOSED 3 LOT SUBDIVISION LOCATED ON EAST LANSING ROAD , TAX MAP PARCEL 20 . - 1 - 21 . 2 . SEOR . The Planning Board reviewed the SEQR submitted by Mr . Milliman . Mr . Herbert Milliman appeared before the Planning Board seeking approval for a 3 lot subdivision located on East Lansing Road , Tax Map No . 20 . 1 - 21 . 2 . Mr . Milliman explained that the amount of land 411 affected would be 1 . 3 acres and that the plan was to make 2 lots 3 out of a larger parcel , less than 1 acre each . Chairman White stated that the lots are not legal lots as they do not meet the required specifications . Chairman White explained that a lot cannot be created where there is no public water and that the lots as presented were only 2 / 3 of an acre . Frances Ramin suggested the possibility of going east on the land and doing a boundary line change . Viola Mullane asked for clarification of access to the property . Linda Hirvonen suggested moving the line on the survey down to East Lansing Road but then pointed out that the road frontage was not adequate and further stated that the Planning B oard did not have a problem with a lot in back of a lot but the lots must comply with the regulations . Linda Hirvonen recognized that Mr . Milliman should receive assistance regarding the subdivision regulations in order to get the land into compliance . Frances Ramin suggested Mr . Milliman come t o the next Planning Board meeting and Chairman White agreed . * * * * S TEPHEN AND WENDY VARGA , PROPOSED 3 LOT SUBDIVISION LOCATED AT SHARON DRIVE EXTENSION , TAX MAP NO . 37 . 1 - 2 - 24 . 2 . Mr . Stephen Varga appeared before the Planning Board seeking approval of a 3 lot subdivision located at Sharon Drive Extension , Tax Map No . 37 . 1 - 2 - 24 . 2 . Linda Hirvonen asked if he owned the land and what the acreage was . Mr . Varga explained that he did own the land and that it was approximately 4 acres . Mr . Varga further explained that he is proposing a 3 lot subdivision and that he would not build a road unless the Town agrees to take it over . Larry Tvaroha and Frances Ramin were in agreement that Mr . Varga should attend the Town meeting regarding the road and then come back before the Planning B oard . Linda Hirvonen stated that if the Vargas could get the road situation resolved , the Planning Board could move forward with the subdivision request . Larry Sharpsteen stated that the Planning B oard would need a letter from the Town regarding the road . * * * * * MUNSON REALTY , WHEELER DEVELOPMENT OF ITHACA , INC . , PROPOSED SUBDIVISION LOCATED AT 2753 NORTH TRIPHAMMER ROAD , TAX MAP NO . 14 . - 1 - 15 . 1 . Mr . Glenn Munson appeared before the Planning Board and explained that Munson Realty had been contracted to offer at public auction the lands of Wheeler Development of Ithaca , Inc . . The Planning B oard had received a copy of Mr . Munson ' s April 26 , 1991 letter which explained the plan . ® Mr . Munson asked if it would be a better plan if 2 - 1 . 7 acre 4 J parcels were put together . The Planning Board members agreed that it would be better if they were not split at all . Chairman White explained that the Planning Board didn ' t like the proposal but there really was nothing they could do . Larry Sharpsteen suggested that the Wheeler subdivision map be made available to Mr . Munson and stated that the plan on that map fulfilled the lot requirements but didn ' t deal with curb cuts . Chairman White stated if they sell the parcel as proposed the Planning Board will have to deal with it . Mr . Munson said they are working under the order of the Bankruptcy Court and are trying to sell off the lots in order to get money . * * * * * ELEANOR RUZICKA , PROPOSED 1 LOT SUBDIVISION LOCATED AT MILLIKEN ROAD EXTENSION , TAX MAP NO . 14 . 1 - 12 Attorney Roger Sovocool appeared before the Planning Board to present plans on behalf of Eleanor Ruzicka for a proposed 1 lot subdivision located at Milliken Road Extension , Tax Map No . 14 . 1 - 12 . Attorney Sovocool stated that Mrs . Ruzicka owns a number of small lots and that John and Pam Herring , her daughter and son - in - law , would like to consolidate a few parcels into one bigger parcel and that Mrs . Ruzicka would keep that southern 3 . 26 acre parcel . Attorney Sovocool explained that the plan would eliminate three separate septic systems and would be replaced by one septic system . Attorney Sovocool explained the parcels by the use of a map of the land and pointed out that Mrs . Ruzicka owned tax map nos . 12 . 6 - 12 . 15 and that 12 . 3 was owned by John and Pam Herring and that 12 . 16 had been willed to another daughter . He pointed out that there is a private road going onto the property and that Mrs . Ruzicka wants to keep the land in the family . Frances Ramin moved to accept the Eleanor Ruzicka proposed 1 located subdivision located at Milliken Road Extension to incorporate Tax Map Nos . 12 . 8 , 12 . 9 and 12 . 10 into that part of Parcel 12 as earmarked on the map attached hereto , subject to all existing rights - of -way of record ; Viola Mullane seconded the motion . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY 1 ABSTENTION * * * * * ® TOBEY AND YVONNE MOORE , PROPOSED 2 LOT SUBDIVISION LOCATED AT 226 5 BREED ROAD . Mr . Tobey Moore appeared before the Planning Board seeking approval of a 2 lot subdivision located at 226 Breed Road . The Planning Board members reviewed Mr . Moore ' s proposed 2 lot subdivision plan . Frances Ramin asked if the road frontage could be increased to 60 feet . Mr . Moore explained that there was a 40 foot right of way of the back lot . Chairman White stated that if a public road was to be built that a 60 foot right of way would be required to meet Town specifications . S EAR Review . The Planning Board members reviewed the short form S EQR submitted by Mr . Moore and made negative declaration . Linda Hirvonen moved to accept the Moore 2 lot subdivision as presented subject to the inclusion of a right of way to the back lot and waived the requirement for a public hearing ; Larry Sharpsteen seconded the motion . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY * * * * * JOHN HORKY PROPERTY , 1 LOT SUBDIVISION LOCATED AT TRIPHAMMER TERRACE , TAX MAP NO . 40 . - 4 - 14 . 2 . Mary Decker and Ron Preston appeared before the Planning Board seeking approval of a 1 lot subdivision located at Triphammer Terrace , Tax Map No . 40 . - 4 - 14 . 2 . Mr . Preston stated that their intention was to purchase 31 acres o f back lands of the Horky property and with a 60 foot right of way from Grandview past the property and to put in a 15 foot extension road to the house . Mr . Herrick stated that part of the brush land would be utilized for a water tank and that Mr . Preston would benefit from accessing a conduit as the lands are in an ag d istrict . After discussion of the plan presented to the Board , Larry Sharpsteen moved that the Planning Board approve the proposed 31 acre parcel as a subdivision as presented with less than 300 feet o f road frontage as proposed and waived the requirement for a public hearing ; Frances Ramin seconded the motion . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY * * * * * ROBERT WALPOLE ( BECKLEY ESTATE ) . MINOR SUBDIVISION , CORNERS OF 6 P LOCKE ROAD AND WEEKS ROAD , TAX MAP 6 . - 1 - 6 . 2 Viola Mullane moved that the Planning Board approve the Walpole subdivision as presented ; Linda Hirvonen seconded the motion . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY * CAYUGA REALTY ASSOCIATION , PROPOSED 3 LOT MAJOR SUBDIVISION LOCATED ON SALMON CREEK ROAD , TAX MAP NO . 4 . - 1 - 22 AND 4 . - 1 - 23 . Linda Hirvonen moved that the Planning Board approved the Cayuga Realty subdivision as presented ; Larry Sharpsteen seconded the motion .
