REVIEW OF PLANNING BOARD MINUTES OF NOVEMBER 12 , 1990 The first order of business was to review the Planning Board Minutes of November 12 , 1990 . Page 3 , Bottom of Page Confussion as to what motion Carol Kammen seconded , ( suggested eliminate paragraph bottom of page ) . Frances Ramin moved to table discussion of November 12 , 1990 minutes until they check with Barbara Evans . VOTE : ; 'ALL IN FAVOR MOTION CARRIED UNANIMOUSLY * * * * * * * Al White stated that before we leave tonight we should have a Nominating Committee . Frances Ramin questioned the dates on each subject in the minutes . George explained that he does that so when he puts copies in each folder the date will be with it . LOT 4# 4 HORIZONS Linda Hirvonen asked about the letter from Barney , Grossman , Roth and Dubow , Attornies at Law concering Lot # 4 in the Horizons . It was explained that when the original was passed , it was done with only the lots being accepted and approved by the Health Department at that time . Now the Health Department has approved Lot # 4 on November 08 , 1990 . Carol Kammen moved , seconded by Larry Sharpsteen that the Planning Board go on record also approving Lot # 4 . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY * * * * * * * Roger Hagin stated that he has had some dialog with members of the Village Planning Board about a joint meeting . Agenda possibly on boundary lines , roads and areas of general interest . Tentative date was set for the 2nd meeting in February 1991 . Viola Miller asked about the status of the Site Plan Review process and when is Tom Neiderkorn coming back . Al White stated that Tom Neiderkorn was working on it and would let us know when he is ready . * * * * 7 : 45 p . m . JOHN HEFFRON , SUBDIVISION ON BUCK ROAD , TAX MAP # 27 . - 1- 14 . Chairman White introduced John Heffron who lives on Buck Road and is contemplating on selling his property . He presented a sketch plan of dividing off approximately 3 acres with a 60 ' road frontage and on the remaining 90 approximately 100 ' road frontage . The Planning Board agreed that if this plan was presented as a 2 lot subdivision that they would have NO problem with this . * * * * * * * 8 : 00 p . m . MARC LEATHERS - TWO LOT SUBDIVISION LOCATED AT 29 LANSINGVILLE ROAD , TAX MAP # 27 . - 1- 21 . PUBLIC HEARING Chairman White read Public Notice and asked if anyone had any comments as to this proposed Subdivision . Mike Sweazey spoke on the distance between his well and one of the proposed septic systems . Bob Leathers stated that they have Health Department approval up to this point . He stated that the Health Department took Mike ' s well into consideration . Mr . Leathers stated that after they found the exact location of Mr . Sweazey ' s well then it was agreed to move the septic system over . Mr . Sweazey and Mr . Leathers went over details with the Board . Mike Sweazey stated that his well was 50 ' from the line and is only 30 ' deep and 13 ' from swale , that is usually wet . They are waiting for Health Department permit for the change in the second lot . There was much discussion as to relocating the swale . It was generally decided that it would be best to leave the direction ( flow ) of the swale alone . Linda Hirvonen asked how could you have a sand filter on less than 2 acres ? Mr . Leathers explained that 2 acres only applies to larger Subdivisions and the County determination . Steve Wilson questioned as to the location of the driveway being so close to his backyard . Mr . Wilson would like to know if there is a stipulation on driveways . ( NO ) . Bob Leathers stated that they would keep the driveway in the center of right -of -way , ( 50 ' ) there by moving it farther away from Mr . Wilson . At 8 : 25 p . m Chairman White asked for motion to close the Public Hearing . Viola Miller moved to close the Public Hearing , seconded by Larry Sharpsteen . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY 2 8 : 25 p . m . THEODORE KEENEY - . 3 LOT SUBDIVISION AT 49 BACON ROAD , TAX MAP # 19 . - 1- 15 . PUBLIC HEARING Chairman White read Public Notice and asked for comments from the public . No one from the public was here to speak . Preliminary approval was given in August . Viola Miller moved to close the Public Hearing at 8 : 29 p . m . , seconded by Larry Sharpsteen . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY * * * * * * * 8 : 30 p . m . SAMUEL MYERS - 2 LOT SUBDIVISION AT 21 CONLON ROAD , TAX MAP # 31 . - 1-8 . 2 . PUBLIC HEARING Chairman White read Public Notice and asked for comments from the public . Francis Vallely commented he just received his notice tonight at 5 : 30 p . m . , although it was postmarked December 3rd . It was determined that the Post Office held it up because it didn ' t have his P . O . Box # on it . He also asked if 75 ' of road frontage is enough and what is a minor subdivision ? Al White explained that it is less than 4 lots . Craig Kranz asked if the Health Department is involved . Mr . Vallely also inquired ® about the driveway . It was stated that it would be separate drives . Viola Miller asked if it is in an Agricultural District and it is . Al White asked for any other comments concerning this Subdivision . Carol Kammen moved to close the Public Hearing at 8 : 39 p . m . , seconded by Linda Hirvonen . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY Chairman White explained that action would be taken at a later time . * * * * * * * 8 : 40 p . m . PETE BARRON - 2 LOT SUBDIVISION AT CORNER OF DATES AND JERRY SMITH ROADS , TAX MAP # 9 . - 1- 21 . 8 . ' Al White asked if lots 1 , 2 & 3 were previously subdivided ? It was stated that they were large enough and with enough road frontage and acreage and did not need approval . Al White stated that we have to do a SEQR . It is in an Agricultural District . Carol Kammen went through SEQR step by step and there was no significant area found to be positive so a Negative Declaration was declared . ® Carol Kammen asked how many acres in 4b - 3 acres , 4a - 3 . 94 acres . It was determined that because the other lots have already been sold that this now becomes a Major . Therefore a Public Hearing will have to be held . 3 Mr . Barron stated that he would talk to the potential buyer and have it put in the deed that no home could be put within the 65 ' strip . Al White felt it should be treated as a 2 lot Subdivision . Viola Miller stated that after a certain number of lots are sold , then regardless of the size then it becomes a Major . Frances Ramin said a history should be stated as to what has been and is happening to the other lots from this parcel of land . Carol Kammen stated she thought it should be totally surveyed and which lots have been sold and the dates and what lots are for sale and showing 4a and 4b as discrete lots . Pete Barron stated that the line between 1 & 2 is not solid . It was only put there arbitrarily and they are not being advertised . Carol Kammen moved that we have Pete Barron submit 4b plans for Public Hearing on January 14 , 1990 . If Mr . Barron wants to sell more lots out of this same parcel then he will have to come back to the Planning Board for a Major . Seconded by Larry Sharpsteen . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY Larry Sharpsteen stated the reason for requesting a Public Hearing was the 65 ' road frontage and we just held 2 Public Hearings on 2 separate - 2 lot Sudvisions with less than 100 ' frontage . Linda Hirvonen moved to let the minutes show that it is Article 5 , Design Standard , Section 500 lots ( a ) each lot must have access to a public street , such access must consist of at least 100 feet of frontage to right - of -way line of said public street unless zoning restrictions are less restrictive . Seconded by Roger Hagin . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY Pete Barron asked if the Public Hearing is to be on the variance of 65 ' frontage ? Linda Hirvonen stated that we can hold a Public Hearing regardless . It will be stated in the usual matter in the paper . * * * * * * * Viola Miller asked when the Subdivisions are going to be approved by the Town Board . It was stated that the Town Board will be holding a Public Hearing on December 27 , 1990 and then they will act . Dave Herrick explained briefly what the Town is doing in line for future sewer hook-ups . Viola Miller asked is we should be looking into smaller lots in those arear that are acceptable to better enhance affordable housing . 4 Dave Herrick explained that the Town is meeting with the Towns of Ithaca , Dryden , Villages of Cayuga Heights and Lansing . Right now Cayuga Heights has a moritoruim on . He will bring us up to date as more progress is made . He feels that without sewer in the southern portion of Town the development will be slowed down . MARC LEATHERS - TWO LOT SUBDIVISION LOCATED AT 29 LANSINGVILLE ROAD , TAX MAP # 27 . - 1- 21 . Carol Kammen moved to accept the Marc Leathers Subdivision with consideration to adopt a new location of the septic system to protect the well . Larry Sharpsteen thought we ought to see a new map before Final Approval . Carol Kammen moved that we table the discussion on the Marc Leathers Subdivision , seconded by Frances Ramin until a new map is submitted showing the exact location of the swale , topo and septic system -to have a drawing of the new configuration . VOTE • ALL IN FAVOR MOTION CARRIED UNANIMOUSLY Carol Kammen stated we were pleased that Mr . Leathers was willing to relocate . * * * * * * * THEODORE KEENEY - 3 LOT SUBDIVISION AT 49 BACON ROAD , TAX MAP # 19 . - 1 - 15 . Larry Sharpsteen moved we accept the 3 lot Subdivision on Bacon Road , seconded 411 by Roger Hagin . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY * * * * * * * SAMUEL MYERS - 2 LOT SUBDIVISION AT 21 CONLON ROAD , TAX MAP # 31 . - 1- 8 . 2 . Francis Ramin moved that being no negative feelings expressed during the Public Hearing and therefore we reaffirm our decision to pass the Subdivision . Seconded by Carol Kammen . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY * * * * * * * Al White said last order of business is to elect officers . Election is to be in January and effective in January . Carol Kammen volunteered to be on the Nominating Committee with Linda Hirvonen and she accepted . Al White asked if anyone else would like to be on the Committee . Carol Kammen thought maybe because this Board is static that maybe we should have a new member and that she would be happy to resign . Roger Hagin stated that he has the feeling that the Town Board is supportive of 411 our members attending seminars to further our knowledge . Larry Tvaroha reaffirmed Rogers statement . Larry also mentioned the New York Association of Towns meeting in February and thought it would be a good idea if someone from the Board to attend . 5 Viola Miller and Larry Sharpsteen brought up the question of the eighth member 410 which comes from the Agricultural Community . Larry Sharpsteen moved to adjourn the meeting at 9 : 46 p . m . Seconded by Carol Kammen . CARRIED Respectfully submitted , /4-0-vr-caci). ffte George L .
