at 7 : 34 p . m .
REVIEW OF PLANNING BOARD MINUTES OF OCTOBER 8 , 1990
The first order of business was to review the Planning Board
Minutes of October 8 , 1990 .
Page 3 . Site Plan Review and Approval . Roger Hagin stated that
in paragraph 2 , Mr . Neiderkorn ' s statement that " since there are
no zoning ordinances in the Town of Lansing , Site Plan Review and
Approval would have to become a local law " should be revised to
read " that in the areas in the Town of Lansing that are not zoned
in the Town of Lansing , Site Plan Review and Approval would have
to become a local law .
Roger Hagin moved that the October 8 , 1990 Planning Board minutes
be accepted , as corrected ; Linda Hirvonen seconded the motion .

NYPF MEETING
L inda Hirvonen and Roger Hagin shared a brief overview of the NYPF
seminar they had attended . Roger Hagin stated that he had a lot
of ideas that he wanted to share with the Planning Board .. Roger
Hagin stated that the Planning Board should be working on a general
plan and then organize the zoning ordinances and site plan review
to tie in with the general plan . Roger Hagin suggested that the
P lanning Board meet twice a month and that the first Planning Board
meeting of the month should be strictly for subdivision review and
approvals and that the second Planning Board meeting of the month
should be strictly for planning purposes . Roger Hagin also
suggested having a joint meeting between the Planning Boards of the
Town of Lansing and the Village of Lansing before thefirst of the
year .
FRED AND BETTY CAMPBELL and BRENDA HAMMOND , ONE LOT SUBDIVISION
LOCATED AT 374 ASBURY- ROAD , TAX MAP NO . 38 . - 1 - 34 . 2 .
® Mr . and Mrs . Fred Campbell. and Ms . Brenda . Hammond appeared before
the Planning Board seeking final approval for a one lot subdivision
located at 374 Asbury Road , Tax Map No . 38 . - 1 - 34 . 2 .
George Totman stated that at the October 10 , 1990 meeting Mr . and
Mrs . Campbell and Ms . Hammond were informed that they would need
t o obtain variance approval from the Health Department and stated
that the Tompkins County Health Department issued approval of their
request for a variance on October 1.2 , 1990 .
Roger Hagin stated that there should have been a variance requested
on zoning because the lands are in a zoned area and that rural
residential property requires 150 foot frontage per housing unit
and that zoning was never addressed .
L inda Hirvonen read Article V § 500 . 10 of the Zoning Regulations
" When a lot is divided by a district boundary , the regulations and
requirements of the least restrictive district may be extended for
a distance of 50 feet into the more restrictive district . "
Chairman White stated that a zoning variance needed to be issued .
Larry Sharpsteen stated that the Planning Board has made sure that
the requirements for subdivision approval were met but that the
Zoning Board of Appeals would have to take action regarding the
zoning variance .
Linda Hirvonen then read Article IX , § 904 noting the requirement

for a Public Hearing . Chairman White suggested that the Planning
Board waive the new requirement for a public hearing as previously
waived due to the fact the extreme hardship had been established .
Larry Sharpsteen stated that it could be made clear that thiswas
by no means an established precedent of the Planning Board .
Chairman White moved that the Planning Board has become aware since
preliminary approval of this one lot subdivision , that the lot in
question is in a zoned area and a public hearing is required .
However , since elapsed time is now causing real hardship , based. on
the. foregoing and in the essence of saving time , waive the
✓ equirement for a public hearing noting that the Planning Board is
not setting a precedent , but merely reacting to extreme hardship ;
Carol Kammen second the motion .
VOTE : ALL IN FAVOR
MOTION CARRIED UNANIMOUSLY
L inda Hirvonen noted that there were a lot of members of the public
in attendance at the Planning Board meeting and asked if Chairman
White would open the floor to the public . Mary Lou Miller stated
that she was opposed to the approval of this subdivision noting
the impact of two new septic systems and water and drainage in the
area . Craig Kramer stated that the Health Department meeting was
scheduled at an inconvenient time and expressed concerns for lands
o f Burley and Buckingham . Jerry Burley also expressed concern
about the impact that two additional houses will have on his septic
system . Deborah Mann stated that the Planning Board is actually
setting a precedent if they went forward with approval of the
Campbell / Hammond subdivision . Craig Kramer stated that if a public
hearing is required by the regulations , that a public hearing
should be held .
L inda Hirvonen , in defense of the Planning Board , stated that the
P lanning Board has tried hard to meet the needs of the people who
appear before it and to be consistent in the interpretation of the
rules and regulations to that end .
L inda Hirvonen further stated that in view of public comments
received , the reading of the regulations and that the Planning
Board would , in fact , be setting a precedent in this matter , moved
that the Planning Board should have a reading from the Zoning Board
o f Appeals andthat a Public Hearing be scheduled after favorable
action by the Zoning Board of Appeals ; Roger Hagin seconded the
motion .
VOTE : ALL IN FAVOR
MOTION CARRIED UNANIMOUSLY
Carol Kammen stated that Chairman White had previously made a

411 motion before the Planning Board . Chairman White moved that his
motion be withdrawn ; Carol Kammen seconded the motion .
VOTE : ALL IN FAVOR
MOTION CARRIED UNANIMOUSLY
George Totman explained that Mr . and Mrs . Campbell and Ms . Hammond
would have to apply to the Zoning Board of Appeals and contact John
Barney to set up the meeting . Chairman White stated that the
P lanning Board will hold a public hearing , if a zoning variance is
granted , to act on and grant final subdivision approval .

ALFONSO and BONNIE FIORILLE , ONE LOT SUBDIVISION LOCATED AT 388
SALMON CREEK ROAD , TAX MAP NO . 21 . - 1 - 2 .
Mr . Fiorille appeared before the Planning Board seeking approval
for a one lot subdivision located at 388 Salmon Creek Road , Tax Map
No . 21 . - 1 - 2 .
SEQR . The Planning Board members reviewed the short form SEQR as
submitted by Mr . and Mrs . Fiorille and issued negative declaration
noting no adverse environmental impact and that the subdivision
would reduce agricultural land by 1 . 25 acres .
L inda Hirvonen question how far the rear lot line was from Salmon
Creek . Mr . Fiorille stated that the rear lot line was 800 - 1 , 000
feet and that the road frontage is 300 x 175 . Mr . Fiorille stated
that they were going to put in a trench system of drainage and that
there would be no sand filter . Mr . Fiorille stated that the mylar
survey map had been given to George Totman .
L inda Hirvonen moved that the Planning Board approve the proposed
Fiorille one lot subdivision noting that it meets all subdivision
requirements with no negative impact and waived the requirement for
a public hearing ; Larry Sharpsteen seconded the motion .
VOTE : ALL IN FAVOR

GARY L . GIORDANO , ONE LOT SUBDIVISION LOCATED AT 42 SPERRY LANE ,
TAX MAP NO . 25 . - 1 - 15 . 1 .
Gary L . Giordano and Vincent Giordano appeared before the Planning

Board seeking approval of a one lot subdivision located at 42
Sperry Lane , Tax Map No . 25 . - 1 - 15 . 1
Mr . Giordano stated that he would like to subdivide the land at 42
Sperry Lane with total acreage of 2 . 68 acres into 2 lots , each
being 1 . 3 acres . Mr . Giordano stated that the road frontage is
299 . 8 feet and his intention was to build a house and garage on one
of the lots . Mr . Giordano stated that the remaining lot was 300
x 200 feet .
SEQR . The Planning Board members reviewed the short form SEQR as
submitted by Gary L . Giordano and issued negative declaration in
character with the area .
Carol Kammen moved that the Planning Board approve the proposed one
lot subdivision of the Giordano lands for a house and garage ,
waived the requirement . for a public hearing , that the lands are in .
an unzoned area and meet subdivision requirements ; Linda Hirvonen
seconded the motion .
VOTE : ALL IN FAVOR
MOTION CARRIED UNANIMOUSLY
HERB AND JEAN ROBINSON , ONE LOT SUBDIVISION LOCATED AT 450
LANSINGVILLE ROAD , TAX MAP NO . 16 . - 1 - 19 . 2 .
Mr . and Mrs . . Robinson appeared before the Planning Board seeking
approval of a one lot subdivision located at 450 Lansingville Road ,
Tax Map No . 16 . - 1 - 19 . 2 .
Mr . Robinson stated that their intention was to subdivision part
of the property located on the east side of Lansingville Road into
two lots and that except for a residence , the remaining parcels
would be rented for agricultural use .
SEQR . The Planning Board members reviewed the short form SEQR as
submitted by Mr . and Mrs . Robinson and issued negative declaration
noting no adverse environmental impact .
Roger Hagin moved that the Planning Board approve the Robinson one
lot subdivision in that it meets all subdivision requirements and
waived the requirement for a Public Hearing ; Larry Sharpsteen
seconded the. motion .
VOTE : ALL IN FAVOR
MOTION CARRIED UNANIMOUSLY
111 Chairman White informed Mr . and Mrs . Robinson that he would need

• to be provided with the mylar copy of the survey - map for signature
and sealing .

WILLIAM S . MEAL , ONE LOT SUBDIVISION LOCATED OFF SNUSHALL ROAD ,
PART OF TAX MAP NO . 3 - 1 - 14 . 2 .
Mr . Robert Coates appeared before the Planning Board on behalf of
Mr . William S . Meal seeking approval of a one lot subdivision
located off Snushall Road ( on the north side of the road toward
Cayuga County ) , part of Tax Map No . 3 - 1 - 14 . 2 .
Mr . Coates stated that this land is a 14 acre wooded parcel and is
located 1 , 138 feet from the road and that there would be a 30 foot
right of way . Linda Hirvonen stated that she could not support
this proposed subdivision due to the 30 foot right of way . Mr .
Coates asked what the minimum footage for a right of way was .
Carol Kammen stated that 60 feet is required for a right of way .
Carol Kammen stated that the Planning Board could not approve the
proposed subdivision with a 30 foot right of way because it leads
to a 14 acre parcel , that the Planning Board sees this area as
having potential for future development and with this in mind , a
® wider access would be required . Chairman White then advised. Mr .
Coates to have Mr . Meal resubmit the proposed one lot subdivision
with a 60 foot right of way for review by the Planning Board .

SAM MYERS , BOUNDARY ADJUSTMENT and ONE LOT SUBDIVISION LOCATED AT
21 CONLON ROAD , TAX MAP NO . 31 . - 1 - 8 . 2 .
Mr . Sam Myers appeared before the Planning Board seeking a boundary
adjustment and approval of a one lot subdivision located at 21
Conlon Road , Tax Map No . 31 . - 1 - 8 . 2 .
SEQR . The Planning Board members reviewed the short form SEQR as
submitted by Mr . Myers and issued negative declaration noting no
adverse environmental impact .
Mr . Myers stated that his intention was to split the 5 1 / 4 acre
parcel to construct a new home . Mr . Myers stated that there would
be 2. lots . The first lot would be 2 acres with 150 feet of road
frontage and the second lot would be 3 1 / 4 acres with 75 feet of
road frontage . Larry Sharpsteen questioned that since the 75 feet
of road frontage for lot 2 was less than required by the
regulations , should the Planning Board consider this as a variance
from the regulations and schedule a public hearing . The Planning
Board members agreed that a public hearing should be scheduled .

® Carol Kammen moved that the Planning Board accept the Myers
boundary adjustment and the proposed 1 lot subdivision located at
21 Conlon Road , waiving the required road frontage and subject to
a public hearing ; Larry Sharpsteen seconded the motion .
VOTE : ALL IN FAVOR

THEODORE W . KEENEY , PROPOSED 3 LOT MINOR SUBDIVISION LOCATED ON
BACON ROAD , TAX MAP NO . 19 . - 1 - 15 .
George Totman explained that Mr . Keeney had been before the
Planning Board on August 10 , 1990 seeking approval for a 3 lot
minor subdivision located on Bacon Road , Tax Map No . 19 . - 1 - 15 and
that at that time , Mr . Keeney was told that he would need to
provide Chairman White with a final mylar survey map for signing
and sealing . George Totman stated that he now had the Keeney map .
Larry Sharpsteen questioned the distance from VanOstrand Road .
Chairman White stated that the distance was 1 , 199 . 7 feet to the
centerline along Bacon Road .
® Carol Kammen moved that a public hearing for the proposed Keeney
3 lot minor subdivision be scheduled for December 10 , 1990 ; Larry
Sharpsteen seconded the motion .
VOTE : ALL IN FAVOR

GORDON AND SHIRLEY HOAGLIN , ONE LOT SUBDIVISION AND 2 BOUNDARY
CHANGES , 928 SALMON CREEK ROAD , TAX MAP NO . 4 . - 1- 26 . 3 .
Mr . and Mrs . Gordon Hoaglin appeared before the Planning Board
seeking approval for a one lot subdivision and 2 boundary changes
for 928 Salmon Creek Road , Tax Map No . 4 . - 1 - 26 . 3 .
SEQR . The Planning Board members reviewed the short form SEQR as
submitted by Mr . and Mrs . Hoaglin and issued negative declaration
noting no adverse environmental impact , noting the property was
just outside the zoned area .
Mr . Hoaglin explained that their intention was to divide Tax Map
No . 4 . - 1 - 20 . 2 into 2 parcels which are located on the west side of
S almon Creek Road , just north of the French Hill intersection with
t otal acreage of 11 . 99 acres .

George Totman provided the Planning Board members with a copy of
the current survey . Mr . Hoaglin explained the survey to the
P lanning Board members and the past trade of land . Chairman White
stated that the actual first boundary change was the addition of
50 feet . Carol Kammen stated that because of the past trade of
land this would actually already subdivision and that only a
boundary change would be required .
Roger Hagin moved that the Planning Board accept the Hoaglin
application as a boundary change at 928 Salmon Creek Road , noting
negative declaration on SEQR and waived the requirement for a
public hearing ; Larry Sharpsteen seconded the motion .
VOTE : ALL IN FAVOR

MARC LEATHERS , TWO LOT MINOR SUBDIVISION LOCATED ON LANSINGVILLE
ROAD , TAX MAP NO . 27 . - 1 - 21 .
Mr . Marc Leathers. and Mr . Robert Leathers appeared before the
P lanning Board seeking approval of a one lot subdivision located
on Lansingville Road , Tax Map No . 27 . - 1 - 21 .
110 Mr . Robert Leathers reviewed the proposed drawing with the Planning
Board members and explained that Mr . Marc Leathers is in the
process of purchasing 4 acres of land. on Lansingville Road with the
intention of building his home on the lot that is shown on the
right side of the drawing and further that the 3 lots in front
would be retained for possible sale in the future or building of
a. spec house . Mr . Robert Leathers explained . that the lot facing
the road has 150 feet of road frontage and land slopes slightly to
the southwest . Mr . Robert Leathers stated that the Health
Department has been contacted to test the soils and explained that
there is an existing well that is producing amply .
L inda Hirvonen stated that she does not agree with the design for
the addition of 2 driveways entering onto Lansingville Road as this
is a problem area . Mr . Robert Leathers stated that the plan would
be reworked so that there would only be 1 driveway entering onto
Lansingville Road . Larry Sharpsteen questioned whether the
location of the driveway could be adjusted without affecting the
road frontage . Mr . Robert Leathers explained that the well would
be in the center of the road right of way if the driveway were on
the other side . Larry Sharpsteen suggested that Mr . Robert
Leathers explore the possibility of granting a right of way to the
front property that bleeds off without changing the width of staff .
411 SEQR . The Planning Board members reviewed the short form SEQR as

® submitted by Mr . Marc Leathers and issued negative declaration
noting no adverse environmental impact .
Carol Kammen moved that the Planning Board grant preliminary plat
approval for the proposed Marc Leathers two lot minor subdivision
located on Lansingville Road , and , in view of the fact that the
lands are so close to the intersection with Route 34B , will accept
the 2 lot subdivision with the modification of a single curb cut
for the shared driveway , that a public hearing be scheduled for
December 10 , 1990 , subject to receipt of a revised site plan and
Health Department approval ; Larry Sharpsteen seconded the motion .
VOTE : ALL IN FAVOR
MOTION CARRIED UNANIMOUSLY

There being no further business , the Planning Board meeting was
adjourned at 10 : 29 p . m .
