at 7 : 30 p . m .
ALAN EUVRARD , PROPOSED 4 LOT MINOR SUBDIVISION ( Located.. on the.
Northeast Side of Hillcrest Road ) , TAX MAP NO . 41 . - 2 - 12 .
Chairman White read the Notice of. Public Hearing as published in
the Ithaca. Journal. . The purpose. of the hearing wasto receive
public comments prior to the consideration of finalplat approval
for a major subdivision that had been. submitted. by Alan. Euvrard
located on the northeast side of Hillcrest Road , Tax Map No . 41 . -
2 - 12 .
Chairman White then called the Public Hearing to order at 7 : 35 p . m .
Chairman White stated thatall members of the. Planning Board were
present except for Larry Sharpsteen who was called out of town .
Attorney Thaler asked. Mr . Schlecht. how they were going to legally
fit a back up septic system on. Lot No . 1 as there didnot seemto
be enough room . Mr . Schlecht explained that the lot was laid out
so as to meet the Health Department and local codes and
® regulations . Chairman_ Whi.te questioned why Lot No . 1 was not moved
down to allow more room . Mr . Schlecht explained . that they had
worked on many designs for Lot No . 1 , however , the plan as
® presented was the only plan that would meet all codes and
regulations .
Mr . James Tucker requested clarification of the changefrom the
plan as presented at the May 7 , 1990 Public Hearing to the plan
being presented tonight . Mr . Schlecht explained to Mr . Tucker that
the revised plan reduced the number of lots from. 6 to 4 and
eliminated the proposed road . Mr . Tucker stated that he felt the
property was not suitable for the proposed 4 lot subdivision and.
that it was only really suitable for 3 1 / 2 lots , not 4 . Mr . Tucker
further stated that a home built on Lot No . 1 would only be about
20 feet from his lot , that every tree on that lot would have to
come down and that it would reduce the value of his home ..
Attorney Thaler stated that it appears that Lot No . 1 is out of
character for the area and is out of proportion with the Whispering
Pines Subdivision and thinks that Lot No . 1 should be dedicated to
the Town of Lansing . Mr .. Schlecht stated that to thebest of his
knowledge , thesubdivision and sizes of the lots as presented meet.
the requirements as set forth in the Town regulations .
Linda Hirvonen stated that thereason for the two acre lots was to
accommodate the septic system . Viola Mullane statedthat there are
some members on the . Planning Board who do not particularly like
large lots and that the lots in the proposed. Euvrard subdivision
411 -meet the Town. regulations . Linda Hirvonen questioned why the
smaller lot could. not be moved to theother end of the. subdivision .
Mr . Schlecht explained that it would be almost impossible because
of the lay of the land .
Attorney Thaler explained to the Planning Board that they should
think about the overall area when making these decisions and that
he had to sacrifice a lot of land to the Town when he was putting
in the. Whispering Pines Subdivision .. Attorney Thaler stated to.
Viola Mullane that he felt the Planning Board should consider the
adjacent land owners when reviewing projects .
Mr . Tucker questioned why or what the differences of the septic
systems were and the proposed flow of drainage . Mr . Schlecht
stated that because of the slope of the land the. drainage would.
flow away from the Tucker. property . Town Engineer Herrick agreed
with Mr . Schlecht .
Mr . Tucker questioned whether the fact that the proposed .
subdivision was locatedin the airport. hazardzone hadbeen. taken
into consideration .. Chairman . White stated that this had already
been addressed and wasnoted on the plans .
Linda Hirvonen moved that the Public Hearing. regarding . the . proposed.
Euvrard subdivision be closed ; Carol Kammen seconded the motion .

MOTION CARRIED UNANIMOUSLY.
Chairman White closing the Public Hearing regarding. the proposed
Euvrard subdivision at 8 : 00 p . m. . Chairman White statedthat the
Planning Board will take action on the Euvrard subdivision at a.
later date .

TOWN OF LANSING , PROPOSED CHANGES IN SUBDIVISION RULES AND
REGULATIONS .
Chairman White read the Notice of Public Hearing as published in
the Ithaca Journal . The purposeof the hearing was to receive
public comments on proposed amendments to the Town of Lansing
subdivision rules and. regulations .
Chairman White then called the Public Hearing to order at 8 : 02 p . m .
Viola Mullane reportedthat she had reviewed the proposed changes
with Mr . Herrick andsubmitted. them: to Mr . Niederkorn . Carol
Kammen reported that Larry Sharpsteen had called and agreedwith
the proposed changes in the rules and regulations and that the
® changes met with his approval ..
Chairman White stated that the Planning. Board hadalready reviewed
the proposed changes to the subdivision rules and regulations in
detail and that since no one from the Public was in attendance , he
would entertain a motion to close the Public Hearing .
Carol Kammen moved that the Public Hearing regarding the proposed
changes in the_ Town of Lansing subdivision rules and regulations
be closed ;. Roger Hagin seconded the motion .
VOTE : ALL IN FAVOR
MOTION CARRIED UNANIMOUSLY
Chairman White closed the Public. Hearing: at 8 : 10 p . m .
Viola Mullane then moved that the Planning Board recommend thenew
regulations to the Town Board for their approval ; Linda Hirvonen
seconded the motion ..
VOTE : ALL IN FAVOR
MOTION CARRIED UNANIMOUSLY
Carol Kammen stated that since. the Planning Board has now finished.
their work on the subdivision rules and regulations , that the

Manning Board should look forward and start studying some sort of
zoning for the rest of the Town . Larry Tvaroha agreedthat
something shouldbe done and that after hearing from the new County
planner , suggested that a site planreview process may be a quicker
solution .
Linda Hirvonen stated . that she presented a proposed budget. from- Mr .
Niederkorn to the Town Board for $ 22. , 000 . 00 over a. 2 year period.
with siteplan review plans first. . Frances Raminquestioned
whether the Town agreed. on the site plan review process . . Larry
Tvaroha said they would absolutely agree .
Linda Hirvonen stated that Mr . Niederkorn wouldbe at the October
8 , 1990 Planning Board meeting .

subdivision .
Roger Hagin statedthat he. was completely satisfied. with thelatest
plan . Chairman White stated that he preferred. the revised plan ..
Frances Ramin statedfor the record that she: approves of the plan
as submitted., however , she. would. like to see no further development
to the_ area surrounding the subdivision .. Carol Karnrnen. stated. that
on behalf of Larry Sharpsteen andfor herself , that they agreed .
with the plan as presented . Linda. Hirvonen stated. that she felt Mr .
Euvrard and. Mr . Schl.echt have met all the requirements and moved
that the proposed subdivision be . accepted .. Roger. Hagin noted that.
the septic problems from the area are coming from. Whispering Pines . .
Viola Mullane agreed that the subdivision. shouldbe approved and
again statedthe largelots do not_ help with future septic or sewer
lines .
Frances Ramin asked. Town Engineer Herrick.. if he had any problem
with the development . Mr . Herrick statedthat he did not ..
Frances Raminmoved that the Planning Board. approve the proposed:
Euvrard minor 4 lot subdivision . on Hillcrest Road. , noting that it
is now smaller thanoriginally plannedand, thereforeis a minor
subdivision , not a major subdivision as statedin the. Ithaca.
Journal. ; Carol Kammen seconded the motion .
VOTE : ALL IN FAVOR
MOTION CARRIED UNANIMOUSLY:
Linda Hirvonen requested that Mr . Schl.echtcheck theeasements and:
411 deedrestrictions , and if any , give to Mr . Totman for filing ..

adjourned at 8 : 58 p . m .
