REVIEW OF PLANNING BOARD MINUTES OF AUGUST 13 , 1990 The first order of business was to review the Planning Board Minutes of August 13 , 1990 . P age 4 . James R . Kirby , Jeannine A . Kirby and. Keith Kirby , P roposed 4 Lot Minor Subdivision Request , Forest View Site on Buck Road , Tax. Map No . 29 - 1 - 37 . Chairman Whitepointed out that in paragraph . 3 the word " was! ' should be corrected to " way" regarding Mr . Munson ' s statement concerning the use of the land in the Kirby subdivision . P age 7 . Cayuga Realty Association , Proposed . Major. Subdivision. Located on Salmon Creek Road ( Near Holden Road. ) , Tax Map Nos . 4 . - 1 - 22 and 4 . - 1 - 22 . Chairman White requested that the caption and paragraph 1 regarding Cayuga Realty Association be . amended to show that the proposed. ® major subdivision is located on Salmon Creek Road ( Near French Hill Road ) , not Salmon Creek. Road. ( Near Holden Road ) . Viola Mullane moved that the Planning Board minutes of August 13 , 1990 be accepted , as amended ; Roger Hagin seconded the motion . Chairman White informed the Planning Board Members that no action w as taken after the Public Hearing at the August 13 , 1990 Planning Board meeting regarding approval of the Kirby minor subdivision. ✓ equest . L inda Hirvonen moved that final plat approval be given for the Kirby proposed 4 lot minor subdivision located at Forest View Site on Buck Road as presented ; Carol Kammen secondedthe motion. . VOTE :. ALL IN FAVOR MOTION CARRIED UNANIMOUSLY ® * * * * * BARNEY TERMINA , 6 LOT SUBDIVISION LOCATED ON ARMSTRONG. ROAD. ( Near Franklin Drive ) , TAX . MAP NO ... 38 - 1 -1 . 2 . General. Discussion. . Chairman White statedthat. the Tompkins County Health Department h ad sent a letter to Jeannine Kirby and. to Chairman Whiteregarding the Termina subdivision . Chairman Whitestated that. the Health Department statedthey had not beennotified of the, approval of the Termina subdivision and had not been sent a copy of the SEQR . The Health Department statedthat under their jurisdiction , the . subdivision falls in the major subdivision classification .. Chairman White stated that he had spoken with Jeannine Kirby regardingthis and. she stated. that the. Town Boardhadcompleted . the . S EQR but that it hadnot been forwarded to the Health Department . Chairman White stated that the Health Department claims that two o f the lots do not meet the acreage requirements for public water . George Totman mentioned that Mr . Termina had changed the configuration of the two lots to meet. the Town ' s requirements for the turnaround . Town Engineer Herrick stated that the . Health Department might mean that the dimensions of the lots , rather than the acreage of the lots , do not meet the acreage requirements for ® public water . 2 a . ® Linda Hirvonen stated that she was bothered by the fact that the Planning Board grants final subdivision approval and then find out that the Health Department claims that the all of the lots are not suitable for construction . Viola Mullane stated that Tom Niederkorn felt that a paragraph should be added to the new subdivision rulesandregulations which stated that applicants would be required to return to the Planning Board after approval by the Health Department for approval by the Planning Board. . Larry Sharpsteen statedthat the Planning Board approves: large developments that are acceptable. to the Health Department for construction andthat the rest of them would not by any means acceptable until a public sewer was in place . Viola Mullane. stated that the new subdivision rules andregulations should include a statement that the. Planning Boardonly approves the design of subdivisa:.ons but that the individual lots within the subdivision. • will be subject to final approval by the Health Department . Town Engineer Herrick suggested adding a clause to the regulations that . required the developer to bring back their final submission for reconsideration if the Health Department determines that the number of lots that the Planning Board has approved can be built upon .. Carol Kammen stated that the. Planning Board must be informed of any changes that occur after they grant subdivision approval . Town Engineer Herrick recommended that the Planning Board require that water , sewers and roads: should be approved by the Town Board prior ® to the Planning Board granting preliminary approval . Larry Sharpsteen stated the resolution to the Termina situation would be to adjust the. boundary lines sixfeet to theeast and for Lots 1 , 3 and 5 , eight feet to the south. . Larry Sharpsteen stated that Lot 3 would suffer in acreagebut wouldnot suffer inany other way and that this could be adjusted .. • ALAN EUVRARD , PROPOSED 4 LOT MINOR SUBDIVISION ( Located_ on the Northeast Side of Hillcrest Road.) , TAX. MAP NO . 41 . - 2 - 12 . Mr . George Schlecht and. Mr . Alan Euvrard appeared before the Planning Board regarding the proposed Euvrard 4 lot minor subdivision . Mr . Schlecht presented a revised subdivision plan for Mr . Euvrard on the north side of Hillcrest Road andfelt it would be worthwhile to indicate a littlebit of history of the project becausehe was confused and suspected that others wouldbe as well . Mr . Schlecht stated that they hadpreviously submittedanother plan showing six. lots and a small cul - de - sac and had received preliminary plat approval conditioned: on. receiving Health Departmentapproval and favorable review of the SEQR by the Town Board. . Mr . Schlecht. stated that sometime after that meeting , the.. Town Board hada revised. 3 ® policy with the Planning Board as far as SEQR review . Mr . Schlecht stated that sometime later , Mr . Euvrard had been informed that. the P lanning Board was requiring an environmental impact statement due . t o concerns regarding septic andwith the current problems in the Whispering Pines subdivision . Mr . Schlecht stated. thatthe plans were revised for these reasons prior to their being informed of the requirement for the environmental impact statement . Mr . Schlecht explained that therevised plan showsthree large lots upon which sand filters would be put in , that they were two acre lots and have a 250 foot circle which is a Health. Department requirement . Mr . Schlecht stated that there is a fourth lot which ( Lot 1 ) is 3 / 4 of an acre on which they would be required to put in a raised bed system if it were to be built upon . Mr . Schlecht stated that the point of doing the plan thisway is that Mr . Euvrard intends to build on Lots 2 , 3 and 4 initially and. that Lot 1 , even though totally suitable to be built upon , will be put in. ✓ eserve . Linda Hirvonen questioned if you needed two acres for the installation of a sand filter . Mr . Schlecht stated thatwas correct . L inda. Hirvonen moved that the Planning Board retract the ✓ equirement for an environmental impact study for the proposed Euvrard subdivision_ on the changein design and: reduction of the number of lots in the subdivision ; Roger Hagin seconded the motion . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY Chairman White questioned if Mr . Schlecht was looking for final approval of the proposed Euvrard subdivision . Mr . Schlecht stated that was correct . Chairman Whitestated thathedid not think they could grant final approval . Larry Sharpsteen stated. that due to the reduction in the number of lots in. the revised plans. , that the subdivision would now be considered. a minor subdivision_ under the. present subdivision regulations .. L inda Hirvonen stated that theway thecurrent subdivision ✓ egulations read , that the Planning Board is required to hold a Public Hearing in responseto a. prior hearing . Larry Sharpsteen stated that the redesign of the plans wasdueto comments received. at the May 7 , 1990 Public Hearing for the. Euvrard major subdivision and that dueto the redesignand reclassification to a minor subdivision. , a Public Hearing should be held .. Viola Mullane moved that the Planning Board granted preliminary plat approval for the proposed Euvrard 4 lot minor subdivision and that a Public Hearing be scheduled for. September. 2.4 , 1990 at. 7 : 30 p . m . ; Larry Sharpsteen secondedthe. motion . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY: 4 ® Mr . Schl.echt stated that he would like to discuss the. environmental review process with the Planning Board . Mr . Schlecht stated that he is concerned with the requirements of draft environmental impact statements for smaller projects andfelt there were several alternatives that would better serve the Planning Board andthe public . This discussion session was tentatively scheduled for September 24 , 1990 after the Public Hearing . George Totman stated he could contact Mr . Schl.echt to confirm the discussion session. . * * * * * CAYUGA REALTY ASSOCIATION ,. PROPOSED. 3 LOT MAJOR . SUBDIVISION LOCATED. ON. SALMON CREEK: ROAD ( Near. French. Hill. Road ).. , TAX MAP NOS . 4 . - 1.- 22 & 4 . - 1 - 23 . George Totman reported that he hasnot heard anything from either. Attorney Reizes or . Cayuga Realty Association regarding the requirement for resubmission of the long formenvironmental. impact . statement .. * * * FRED AND BETTY CAMPBELL . and BRENDA HAMMOND , ONE LOT SUBDIVISION LOCATED AT 374 ASBURY" ROAD., TAX MAP. NO .. 38 .. - 1 - 34 . 2 . 410 Mr . and Mrs . Fred Campbell and Ms . Brenda_ Hammond appeared before.. the Planning Board seeking approval of a one lot subdivision located at 374 Asbury Road , Tax Map No . 38 . - 1 - 34 . 2 . Chairman White questioned whether Mr . and Mrs_ . Campbellhad. previously stated that the Health. Department saw no problems with. the proposed one lot subdivision . Mrs . . Campbell stated that she had called the Health Department regardingseptic requirements and_. did. not get an answer , however , they have submitted a variance request to the Health Department . Chairman. White stated. that the Health Department is requiring a 150 foot radius. onboth parcels andthat. this leaves no access from. the front to the back of the landwhen you are dealing with a 150 foot required strip . Chairman. White stated that thelot. is 150 feet on. Asbury Road andgoes. back. 640 feet . Mrs . Campbellstatedtheirintention was to split the lot with their daughter , Brenda Hammond . L arry Sharpsteen statedthat nothing couldbe done until the P lanning Board receives notification of approval of the variance from the Health. Department . Chairman. White stated thatthe: necessary acreage is there . Mrs . Campbell stated_ that the depth of each lot is. 32.0 feet back and questioned therequired- radius of the circle for the septic . 5 0 411 Larry Sharpsteen questioned if. the Planning Boardwould have any problems withthe proposed plan if the Health Department comes through . Mrs . Campbell stated that the Health Department ' s next meeting is scheduled for October 9 , 1990 . Chairman White stated that he had previously talked to Mr . and. Mrs. . Campbelland stated that if they could workout anarrangement with the Health Department , then the. Planning. Board wouldexpedite the. review of the proposed one lot subdivision . Linda Hirvonen stated that shesaw no problem with granting preliminary approval of the proposed one lot subdivision but: that the approval should be contingent upon the Planning Board receiving somethingin writing approving issuance of the variance from . the. Health Department prior to the November 12 , 1990 Planning Board. meeting but that if the variance approval wasreceived prior to the November 12. , 1990 Planning . Boardmeeting , that preliminary approval was granted . Chairman White stated that the Planning Board vote and approval would be based on the Health Department ' s issuance of the variance .. SEQR Review . The Planning Board members reviewed the short form SEQR submitted by Mr . and Mrs . Campbell and Ms. . . Hammond noting normal domestic use for two households and issued negative ® declaration in character with the area . Larry Sharpsteen agreed with Linda Hirvonen and moved that the Planning Board grant preliminary approval of the proposedonelot subdivision contingent upon the Planning Board receiving something. in writing approving issuance of the variance from the Health Department prior to the November 12. , 1990 Planning Board meeting , however , if the variance approval from the. Health. Department was received prior to the. November 12 , 1990 Planning Board meeting , that preliminary approval was granted .; Carol Kammen secondedthe. motion . VOTE : ALL IN FAVOR MOTION CARRIED WITH 1 ABSTENTION Mrs . Campbell asked that if the Health Department goes alongwith the 15 foot rather than 25 feet for the driveway , wouldthismake a difference to the. Planning Board. . Larry Sharpsteen stated that . it would be considered an adjustment . * * * * • 6 GENERAL DISCUSSION . - Proposed Changes - Subdivision Rules an& Regulations . Viola Mullane stated that she felt that the Planning Board is not reacting to the planning needs of the Town of Lansing . Viola Mullane stated that the minutes from the August 13 , 1990 Planning Board meeting stated that a Public Hearing was to be scheduled regarding the changes in the subdivision rules and regulations , however , this did not come to f,rui.tion . Viola Mullane stated that she had met with Mr . Niederkorn to review the proposed changes in the subdivision rules and regulations and. that Mr . Niederkorn found no substantive changes in the regulations and that most of the noted changes were for clarification .. The proposed changes inthe subdivision rules and regulations were reviewed by the Planning. Board . Viola Mullane stated that she would deliver the changes to Mr . Niederkorn for finalization .. - Site Planning The Planning Board membersdiscussed prior action on thesite planning draft and- the need for finalization of the. process .. Viola Mullane stated that the Planning Board members need to review the 410 site planning process for submittal to the Town of Lansing .. Larry Tvaroha stated that the Town would be responsive to aiding the Planning Board in the process of mapping . It was decided that Linda Hirvonen wouldheadup thisprocessand would allocate. specific tasks to the members of the Planning Board . It was further decided that the review and mapping of lands forming the corridor of Burdick Road , Asbury Road , Triphammer Road. and. East Shore Drive be completed and submitted to the Town Board by January 1 , 1991 . * * * * * There being no further business , the Planning Board meeting was adjourned at 10 : 05 p . m .
