REVIEW OF PLANNING. ' BOARD MINUTES OF JULY 9 , 1990 The first order of business was to review the Planning Board • • Minutes of July 9 , 1990 . Page 1 . Chairman White noted that Larry Sharpsteen did attend the July 9 , 1990 Planning Board Meeting and that the correction should be noted for the Minutes . Page 1 . Chairman Whitestated that there was a motion made and seconded for accepting theminutes of: June 1.8 , 1990 , however , there was no evidence of a vote being taken . Chairman White stated that the minutes shouldbe amended to reflect thefact that a. vote. was taken , all were in favor and the motion was carried. unanimously . Page 4 . Leon Swayze , Proposed 1 Lot Minor Subdivision Located. at 121 Ludlowville Road , Tax Map No . 27 . - 1 - 30 . 2 . Chairman White referred the Planning Board members. to Paragraph 4 and requested that Larry Tvaroha ' s statement. that " . . . the Ludlowville Road areahas a lot of topo with a large slope: . . . " be corrected to read " . . . the topography of thearea shows a large • ® slope . . . " Page 5 . Kirby , 4 • Lot Minor Subdivision Request , Forest View . Chairman White requested that the caption on Page 5 regarding the Kirby minor subdivision request be amended as. follows. : KIRBY , 4 LOT MINOR SUBDIVISION REQUEST , FOREST VIEW SITE ON BUCK ROAD . Page 6 . Cayuga Realty Association , Proposed Major Subdivision Located on Salmon. Creek. Road ( Near Holden. Road ) , Tax. Map Nos . 4 . - 1 - 22 and 4 . - 1 - 22 . Chairman White referred. the Planning Board members to P aragraph 1 and requested that Larry Sharpsteen ' s statement that " . . . Lot 6 will never meet. the 4 % grade . . . " - be corrected to read " . . Lot 6 will never meet the 12% grade . . . " Carol Kammen moved that the Planning Board minutes of July 9 , 1990 be accepted , as corrected ; Roger Hagin seconded. the. motion . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY . * GENERAL DISCUSSION Proposed Changes / Subdivision Rules and. Regulations . Chairman White stated that sincethe. last Planning Board meeting that he had met with Jeannine Kirby and reviewed . the recommended changes. by the Town Board for the. Town of Lansing Subdivision Rules and Regulations. . Chairman White stated that the next step is to get the changes to Mr . Niederkorn for review so that a Public Hearing could be scheduled_. Chairman White statedthat. then were a lot of changes but that most of the changes were wording changes. and omission of sentences . ✓ iola Mullane.. moved that the Planning Board accept the recommendations made by the Town of . Lansing Town Board for changes. . in the Subdivision Rules. and. Regulations , that this_ information. be g iven to Mr . Niederkorn. for. review and return to the. Planning. Board prior to the September 10 , 1990 meeting andthat a Public. Hearing be scheduled for the September' 10 , 1990 Planning Board meeting; Carol. Kammen seconded the motion . VOTE : ALL. IN FAVOR. MOTION CARRIED. UNANIMOUSLY ACTION : Carol Kammen will deliver the proposed changes. to Mr . Niederkorn . 2 I • • SEQR Review . Chairman White stated thathealso reviewed the SEQR procedure that has been followed in thepast with Jeannine Kirby . Chairman White stated that after review and approval of the. SEQR applications: by the Planning Board , that he would write a cover letter to the applicant with copies to the Planning Office , Town of Lansing Town Board ., Town of Lansing Town Clerk and. Tompkins.. County Health Department . General Discussion/ Procedural Questions. , Application of Philip Munson , Sr . Chairman White stated thattherewasa procedural question which needed to be addr. es.sedby the. Planning Board . Chairman White stated that Mr . Philip Munson. had made two applications for a 4 lot subdivision and that 1 lot is not contiguous with the other three . Chairman White questioned if this could. be considered.. as a second subdivision.. Viola. Mullane questioned . i£ the lot was across the road . Carol Kammen pointed out that the lot was in the same tax parcel number. but that it was one -half mile away . Viola Mullane stated thatit wasnot the same subdivision and that it should be considered as a 2 lot subdivision and that it is divided 41/ by a road . Roger Hagin stated that. this is how the Department of Environmental Conservation looks at it too . Chairman. White agreed with Viola Mullane and stated that two SEQR applications had been completed and submitted. by Mr. . Munson . * * * * * THEODORE W . KEY , PROPOSED 3 LOT MINOR. SUBDIVISION LOCATED ON BACON ROAD , TAX MAP NO . 19 . - 1 -15 . SEQR REVIEW : The Planning Board members reviewed the short form S EQR submitted by Mr . Theodore W . Keeney for the proposed 3 lot. minor subdivision. . After review of the short form SEQR , the P lanning Board. issued. negative declaration on the basis.. of being characteristic with the area having no adverse environmental. impact . * * * * * JAMES R . KIRBY , JEANNINE. A . KIRBY AND KEITH KIRBY , PROPOSED. 4 LOT MINOR SUBDIVISION REQUEST. , FOREST. VIEW SITE" ON BUCK ROAD. , TAX MAP NO . 29 - 1 - 37 . Chairman White read. the Notice of Public. Hearing aspublishedin the Ithaca Journal August. 1 , 1990 . The purpose of the hearing was to receive public commentsprior to the consideration of the final 3 410 plat for a minor subdivision which has been submitted by Keith Kirby and located on Buck Road , Tax Map No . 29 - 1 - 37 . Chairman White then called the Public. Hearing to order at 8 : 00 p . m . Mary Decker appeared on behalf. of Keith Kirby to receive andanswer any questions. . Philip Munson , Sr . stated that he felt the proposedplan was a wonderful was to use the land rather than reserving it as an agricultural district and stated that he feltquality homeswere being built . Chairman White questioned if the Public Hearing had to remain open since there was. no Public attendance Viola Mullane stated that there was nothing in the regulations whichstated you had to keep a Public Hearing open . Chairman Whitenoted that ifanyone showed up for the Kirby Public Hearing , that the hearing would be reopened . Viola Mullane moved that the Public Hearing be closed ; Carol Kammen seconded the motion . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY 410 Chairman White closed the Public Hearing at 8 : 06 p . m . Chairman White statedthat action would be taken by the Planning Board and that Ms . Decker should check with George Totman later in the week regarding action taken . * * * PHILIP MUNSON , SR . , PROPOSED SUBDIVISION" REQUEST: - ( SUBDIVISION # 1 , ONE LOT MINOR SUBDIVISION LOCATED- OM LUCK: ROAD , TAX MAP NO . 20 -1.- 8 . 2 ) ( SUBDIVISION # 2 , PROPOSED. TER. LOT SUBDIVISION GOODMAN ROAD., TAX MAP NOS .. 20 - 1 - 1 . 1 AND 20 - 1 - 1 . 2 ) Chairman. White informed. Mr . Munson that the Planning Board feels that. since the. lots arenot contiguous._ and have a different. address , that the. Planning: Board mustconsider them as two separate subdivision requests . Mr . Munson stated that.. he hadapplied for. 2 separate subdivisions .. Subdivision # 1 ONE LOT MINOR SUBDIVISION ON LUCE ROAD. , TAX MAP NO . 20 . - 1 - 8 . 2 . SEQR REVIEW : The Planning Board reviewed the SEQR submitted by Mr . Munson for a. proposedone lot subdivision located on Luce. Road and after review of the SEQR , the Planning Board issued. negative 4 111 declaration with no adverse environmental impact noting that the proposed subdivision is in an agricultural district . * * Mr . Munson appeared before the Planning Board seeking sketch plan approval of a 1 lot minor subdivision located on Luce. Road. , Tax Map No . 20 . - 1 - 8 . 2 . Chairman White stated that the proposedone lot subdivision is 60 feet from the property line on the south side and is away fromthe wet hole . Mr . Munson stated that the creek runs to the north of the property . Mr . Munson stated that the County requires enough ✓ oom to putone septicsystem in for a five bedroom house . Mr . Munson asked the Planning Board if a survey would be required . Chairman White stated that a survey is not required . for. sketch plan approval . Mr . Munson stated that he has not yet sold a lot that has not increased in sizeand that he does notwant to go to the expense of having a survey completed when it will have to be ✓ evised . Linda Hirvonenstated thatthe regulations stated that. once a subdivision is approved , if there are any changes , the applicant must reappear before the Planning Boardfor approval of the changes . Mr . Munson stated thathisrecollection ofthe ✓ egulation was that a survey is not required but usually required at the time of sale. . Viola Mullane stated that the. Planning Board had no problem with enlarging or adding to lots and would be considered as boundary changes . Linda Hirvonen stated that for 1 lot minor subdivisions , the Planning Board can accept grant approval without a survey but thatnormally they do not . Carol Kammen movedthat. the Planning Board grant sketch plan approval for the Munson. proposed 1 lot minor subdivision on Luce Road and waived the requirement for a Public. Hearing ; Linda. Hirvonen seconded the motion . VOTE : ALL. IN FAVOR MOTION CARRIED UNANIMOUSLY * * * * Subdivision # 2 SUBDIVISION # 2 , PROPOSED` 3 LOT SUBDIVISION LOCATED ON GOODMAN ROAD , TAX MAP NOS . 20 - 1 - 1 . 1 AND 20 - 1 - 1 . 2 SEQR REVIEW : The Planning Board reviewed the SEQR submitted_ by Mr .. Munson for a proposed three lot subdivisionlocated on. Goodman. Road. and after review of the SEQR , the Planning Board issued .. negative declaration with no adverse environmental impact noting that the. Illproposed subdivision isinan agriculturaldistrict , that the. Lield 5 drainage be noted on the survey map and protected with deed ✓ estrictions and covenants . * * Mr . Munson appeared before the Planning Board seeking sketch plan approval of a proposed 3 lot subdivisionlocated on Goodman Road , Tax Map Nos . 20 - 1 - 1 . 1 and 20 - 1 - 1 . 2 . Chairman White stated that Mr . Munson had run a field drain through this property and that it started somewhere. behind the first lot o r far right on the sketch plan . Mr . Munson stated that it actually started in the southeast corner . Chairman White stated that if someone were to build a. house on this lot , that most likely the field drain would bedug up . Mr . Munson stated that it is 7 feet deep in some places with the most depth in the ditch . Chairman White stated that he was concerned about the drainage . Viola Mullane stated thatit was her understanding that you could. not interfere with existing natural drainage . Chairman White stated that the drainage runsvirtually the entire length of the lot and that if the drainage field breaks. , therewould be problems with the foundation and footers of anything built on the lot . Linda Hirvonen questioned if Mr . Munson should have protective deed ✓ estrictions and covenants to cover the potentialdrainage situation .. The Planning Board members agreed that there should be deedrestrictions and. covenants . Linda Hirvonen moved that the Planning Board grant sketch plan • approval for the Munson proposed 3 lot minor subdivision located on Goodman Road and that a Public. Hearing be scheduled as soon as a survey map and final plat plan and deed restrictions and covenants are made available to the. Planning Board , noting that the SEQR has been completed and thata. negative declaration has been declared . VOTE : ALL IN FAVOR MOTION CARRIED- UNANIMOUSLY * * * * THEODORE W . KEENEY , 3 LOT MINOR. SUBDIVISION LOCATED ON - BACON ROAD , TAX MAP NO .. 19 . - 1 - 15 . Mr . Theodore Keeney appeared before. the Planning Boardseeking sketch plan approval of a proposed 3 lot minor subdivision located.. on Bacon Road , Tax Map No . 19 . - 1 - 15 . Mr . Keeney stated that there isa total of 4 acreswith. an. existing 1 acre parcel with a house and trailer at 49 Bacon . Road and. that. he wants to cut the existing 1 acre parcel off and divide the remaining land to endup with 3 lots . Chairman White questioned 6 ca if Mr . Keeney was intending to make a 3 lot subdivision . Mr . Keeney stated that this was his intention . Viola Mullane questioned the drainage . Mr . Keeney stated that the drainage is on the west and that the creek crosses the corner of the road . where the house is . Mr . Keeney stated that there would be a well for e ach lot . Linda Hirvonen asked Mr . Keeney if he was going to have any deed ✓ estrictions and covenants . Mr . Keeney stated that he was not . Carol Kammen moved that since the Planning Board had reviewed the SEQR submitted by Mr . Keeney and found negative declaration , that the Planning Board grant preliminary sketch plan approval for the proposed Keeney 3 lot minor subdivision located on Bacon Road and. that a. Public Hearing can bescheduledupon_ receipt of a survey from Mr . Keeney ; Roger Hagin seconded the motion . VOTE : ALL IN FAVOR MOTION CARRIED . UNANIMOUSLY- * * * * * CAYUGA REALTY ASSOCIATION, PROPOSED - 3 LOT MAJOR SUBDIVISION LOCATED. ON SALMON CREEK. ROAD ( NEAR HOLDEN ROAD , TAX MAP NOS . 4 . -1 -22 4 . - 1 - 23 . Attorney Leslie Reizes appeared before the Planning Board on behalf o f Cayuga Realty Association seeking preliminary plat approval for a proposed major subdivision located on Salmon Creek Road ( near Holden Road ) . Attorney Reizes. stated. that he had previously appearedbefore the Planning Board on. June 4 , 1990 and stated. that. Al Fulkerson of T . G . Miller , P . C . had senta letter to Chairman White which addressed questions which wereraised regarding ( 1 ) septic system . and input from the Health Department ; ( 2 ) drainage. ; and ( 3 ) size and shape. o f Lots 1 - 3 . Attorney Reizes stated that. the Health Departmentdid notconsider this a subdivision. under the Public . Health. Law andthat they- would have to wait until individual lots were applied for to grant approval for a septic. system . Attorney Reizes presenteda. proposedsketch plan alternative for the division of Lots 1 - 3 where the 3 lots as previously submitted on June 4 , 1990 wouldbe divided into 6 lots whichwould involved construction of a road with a cul - de - sac to be dedicatedto the Town . Linda Hirvonen stated thatthe argumentfor theother configuration is strong but that the Town would argue for the ® proposed 3 lot plan verses proposed 6 lot with a cul - de - sac due. to 7 C. the drainage on each side of the cul- de - sac . Larry Tvaroha agreed with Linda Hirvonen regarding the drainage on eachside. of the cul - de - sac . Chairman. White. stated that the long form. SEQR previously submitted. was inadequate . Attorney. Reize.s stated. that this. was the. first. that he had heard of this and that he had not been notified . Chairman Whitestated that Attorney Reizes . was to have been notified , however , this had not been done andapologized for this . oversight .. Chairman Whiterecommended . that the long form SEQR be returned to the engineers for adequate completion.. Carol Karmen. stated that under the planpreviously submitted for the 3 lot minor subdivision , if a. road were to be put. in it would have to be 600 feet . Larry Tvaroha stated. thatthere would be less. drainage problems with 3 lots than. with 6 lots because you. would have a road ditch with. 6 lots and. that 6 lots would bepublic drainage . Carol Karen moved that the Planning Board grant preliminary plat. approval for the proposed: 3 lot major subdivision located on Salmon Creek . Road ( near Holden. Road. ) noting that after thorough consideration of both plans as. submitted. . to the Planning Board , that the 3 lot major subdivision as opposed to the 6 lot major subdivision. seemed to be the best plan for drainage. reasons out of several alternative proposals , and that approval was. contingent on adequatecompletion and resubmission of the. long form SEQR for acceptance by the Planning Board ; Linda Hirvonen seconded the motion . VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY- RODERICR" S . AND DONA NENO , PROPOSED 1 LOT MINOR SUBDIVISION, LOCATED ON MUNSON ' ROAD ,,. TAX. MAP NO . 19 . - 1 -26 . • Mr Roderick. Neno appeared: before the. Planning Board _ seeking preliminary plat plan approval of a 1. lot minor , subdivision. located. on Munson Road , Tax Map No . 19 . - i - 2.6 . Mr . Neno explained that he: was intending to give: his. sona building lot at the northend, of the lot and. that it would. be. approximately 2 acres . Mr . Neno stated that the land: has: not been. tilled in. about 3 years but that it was located in anagricultural district . Chairman White stated that Mr . Neno ' s: son wanted. to building, his house onthe rounded. knoll on. the land. , however ,. the financing. company only want. a 1 acre lot so that. it cannot be subdivided . . Chairman White stated that Mr . Neno ' s son. was going to set the house back 100 feet to resolve this. problem .. 8 41, SEQR REVIEW : The Planning Board members reviewed the short. form SEQR submitted by Mr . Neno for the proposed 1 lot minor subdivision and after review , issued negative declaration on thebasis of. a single family residence in character with the area having no adverse environmental impactand noted that the land was in an agricultural district . Carol. Kammen. moved that. the Planning Board grant preliminary plat plan approval for the Neno proposed 1 lot minor subdivision located on Munson. Road andwaived the requirement for a Public Hearing ; Viola Mullane seconded the motion . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY ACTION : Chairman White informed Mr . Neno that he will need to - provide a mylar copy of the survey map for the 1 lot minor subdivision for affixationof the. Planning Boardseal and signature by Chairman White and also that the Health.
