PLANNING BOARD * Denotes Present * Al White * Larry Sharpsteen * Carol Kammen * Roger Hagin * Linda Hirvonen Viola Mullane * Frances Ramin * Larry Tvaroha , Town Councilman * George Totman , Planning , Zoning and Code Administration Office * David Herrick , Town Engineer * Richard Thaler , Town Attorney PUBLIC PRESENT Dale Flinn Herb Beckwith John Dietershagen Mary Sherman James Tucker John Howell Al White , Chairman , called the Planning Board Meeting to order at 7 : 35 p . m . REVIEW OF PLANNING BOARD MINUTES OF APRIL 2 , 1990 The first order of business was to review the Planning Board Minutes of April 2 , 1990 . Carol Kammen moved to accept the minutes of April 2 , 1990 . Frances Ramin referred the Planning Board members to Page 6 of the minutesregarding the proposed. Flinn Subdivision Request and questioned whether David Flinn actually appeared before the Planning Board . It was clarified by Larry Sharpsteen that Dale Flinn had appeared before the. Planning Board . Chairman White stated that the minutes should be amended to show this correction and moved that the April 2 , 1990 minutes be approved as amended ; Larry Sharpsteen seconded the motion . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY * * * * * ® AUTUMN RIDGE SUBDIVISION Chairman White then read a letter that that he had received which was sent to Jeannine Kirby by Town Attorney Thaler from David Dubow , Esq . regarding a revised agreement for Autumn Ridge . Chairman White requested that the Minutes only reference the receipt of the letter by Chairman White and that he shared it with the Planning Board members . * * * ALAN EUVARD , PROPOSED 9 LOT MAJOR SUBDIVISION ( LOCATED ON THE NORTHEAST SIDE OF HILLCREST ROAD. ) . Chairman White read the Notice. of Public Hearing on May 7 , 1990 at 8 : 00 p . m . as published in the. Ithaca Journal April 27 , 1990 . The purpose of the hearing was to receive public comments prior to the consideration of the final plat for a major subdivision which has been submitted. by Alan Euvard and which is to be located on the northeast side of Hillcrest Road , Tax Map No . 41 - 1 - 12 . Mr . James Tucker of 3 Whispering Pines appeared before the Planning Board seeking any information available to the public regarding this proposed subdivision . Mr . Tucker stated that he was already experiencing a tremendous drainage problem on his property and was concerned that the proposed Euvard Subdivision would only make his current drainage problem worse . Chairman White stated that Mr . Euvard couldn ' t put any water on to Mr . Tucker ' s land . Carol Kammen empathized with Mr . Tucker ' s and stated that the Planning Board was aware of the drainage problem in the Whispering Pines Subdivision . Chairman White also stated that in addition to the concerns regarding the drainage problem , that the Planning Board was also very concerned about further building closer to the airport hazard area and the potential for additional noise. complaints . Roger Hagin stated that the Health Department had approved the system that is leaking out in the Whispering Pines Subdivision . Mr . Tucker stated that the solution should be not to overpopulate areas where they know extreme problems exist and in areas which have a low depth of soil to rock . Frances Ramin asked Mr . Herrick to explain the drainage situation in the proposed Euvard Subdivision . Mr . Herrick stated that it is a low flat area and has presented some problemsfor adjacent land owners and that the septic system will be an issue with the Health Department . Mr . Herrick has received the drainage study from George Schlecht ' s office and statedthat they have found 2 ® something in the study that they felt needed to be corrected but that they have not yet heard back from George Schlecht . George Totman stated that the Health Department had approved the water and septic lines but that Mr . Herrick had not given his final approval on the proposed plan . L inda Hirvonen asked Mr . Herrick whether there was something in the drainage study that would alleviate any possible drainage from the Euvard Subdivision to Whispering Pines . Mr . Herrick stated that Whispering Pines water flows across to the. Euvard proposed Subdivision , not the other way around . Chairman White stated that there is now raw sewage being emitted from one of the houses in the Whispering Pines Subdivision and that the concern is that the additional housing density of the proposed Euvard Subdivision will resultin more fills . Mr . Herrick stated that he was aware of the raw sewage problem but that they could not. determine whether the problem has been caused by bad design or bad construction . L inda Hirvonen moved that the Public Hearing regarding the proposed Euvard Subdivision be closed ; Larry Sharpsteen seconded the motion . VOTE : ALL IN FAVOR MOTION CARRIED UNANIMOUSLY The Public Hearing was closed at 8 : 20 p . m . and Chairman White thanked Mr . Tucker for attending the Public Hearing . * * * * * DAVID G . AND MARY FLINN , PROPOSED SUBDIVISION REQUEST , LOCATED OFF ROSS ROAD , TAX MAP NOS . 25 - 1 - 1 AND 25 - 1 - 3 . 1 J ohn Dietershagen and Dale. Flinn appeared before the Planning Board to further discusstheir plans for a proposed Subdivision located off of Ross Road . Mr . Dietershagen stated that he had sent a memo to George Totman which detailed the project and that it may help to answer any questions concerning the proposed Subdivision . Frances Ramin referred the Planning Board members to the Minutes of April 2 , 1990 regarding Carol Karnmen ' s. statement of what was required by the Planning Board in order to review and understand this project . Mr . Dietershagen questioned why the Town Engineer would be required to look at the proposed driveway off Ross Road . Mr . Dietershagen stated that they had looked at the possibility of making the first road approximately 800 feet and stated that the road would ultimately have to be acceptable to the Town and would 3 ® come off Ross Road and possibly service a future home . Mr . Dietershagen stated their road builder has spoken with Peter Larsen a number of times and is working on final pricing for them . Chairman White stated that that portion of the road would have to be built to Town specifications . Mr . Beckwith stated that he had asked Mr . Dietershagen to build the road as a Town road and that they may work out a deal ✓ egarding the financing of this road due to Mr . Beckwith ' s plans on building a home at this site in the future . Chairman White stated that the major concern is that the Town is still responsible for fire and ambulance service if something would happen in the future and that there has to be access to this property . Carol Kammen asked Mr . Dietershagen to explain the three parcels . Mr . Dietershagen stated that there was 3200 feet of private road with one parcel of four acres to be sold ( Parcel C ) and that the rest would be used for seasonal homes to be retained by a partnership between. Mr . Dietershagen and Mr . David Flinn and his family . Chairman White stated that there really isn ' t any action ✓ equired by the Planning Board because there is only one parcel , does not have access on to a public road and is a land locked lot . George Totman stated that he would not be able to issue any ® building permits due to the fact that there was no access on to a public road . Mr . Thaler clarified that Mr . Dietershagen and Mr . Flinn were intending to change the ownership of the 60 foot right - of -way to an entity that does not own the adjoining lands . Mr . Thaler further stated that what was actually happening was that they were subdividing the 60 foot right - of -way . Mr . Dietershagen stated that two parcels would be going to the partnership . Larry Sharpsteen stated that they were actually changing ownership andpointed out that the Subdivision Regulations do not recognize the fact that one o f the members of a partnership was the original owner of the land . Mr . Thaler stated that when he had originally read the proposed plan for this Subdivision , he questioned how was it guaranteed that the people who owned Parcel C and Parcel B have access to the right - of -way . Mr . Dietershagen stated that he believed this would bea deeded right - of -way from the partnership . Mr . Thaler questioned who continues in the ownership of the right o f way when one of the partners dies . Mr . Dietershagen stated that their attorney has drafted an agreement and that the agreement has been delivered to all of the parties involved . Chairman White stated that according to Planning Board ✓ egulations , the Planning Board does not have jurisdiction over this matter and that this proposed Subdivision is a Town Board • function and closed the discussion . 4 * BARNEY TERMINA , PROPOSED 6 LOT SUBDIVISION LOCATED ON ARMSTRONG ROAD ( Near Franklin Drive ) , TAX MAP NO . 38 - 1 - 1 . 2 This proposed 6 lot Subdivision was originally scheduled to be a Public Hearing for May 7 , 1990 , however , the Town Board cancelled the Public Hearing due to changes in the regulations . * * * * * Carol Kammen stated that the Planning Board was going in to Executive Session .
