Re : O ' Rear Subdivision
Dear. Mr . Thaler :
Professor Jay O ' Rear and Virginia Watts O ' Rear have recently retained
this firm to represent them in matters pertaining to their planned subdivision
• on Sun Path in the Town of Lansing . It has come to our attention that the
Town Board is contemplating a condemnation proceeding to obtain a right of way
across property now owned by W . David Banfield , 25 Sun Path . Please be
advised that Mr . Banfield and Professor O ' Rear have agreed to negotiate the
matter of the right of way privately . We will be drawing up an agreement for
the Banfields and the O ' Rears to sign that will set forth the terms under
which they will negotiate issues relating to the subdivision and the right of
way . As soon as that document is signed by all parties , we will forward a
copy to your office .
As the involved parties have agreed to work together to resolve this
matter , it should not be necessary for the Town of Lansing to continence a
condemnation proceeding at this tine . Accordingly , we ask that the Town Board
refrain from taking any further action at this time , so that the O ' Rears and
Banfields , with the help of the Planning Board , can resolve this matter
directly .
Very truly yours ,
ADAMS & THEISEN
