Sharpsteen , Chairman White , Town Board Liaison , Lou Emmick Chairman White called the meeting to order at 7 : 31 P . M . PUBLIC HEARING ON TIDD MINOR SUBDIVISION Chairman White read the Public Hearing Notice on Tidd Minor Subdivision , and opened the Public Hearing . Mr . Tidd reported that his land is being subdivided according to the sketch plan . There are . four lots of various sizes . Lot # 2 is the smallest and it is 100 x 200 feet . Lot # 3 has doublewide trailer on it which is now being rented . At present , no decision h as been made on what is to be done with the trailer . Chairman White invited questions from the audience . Two questions were raised from the floor . 1 ) Any specification price of homes to be built on these lots ? 2 ) Are you proposing to put trailers on them ? Mr . Tidd replied that modular homes may possibly be built and the answer to the second question was no • trailers will be put on lots . Jim Moravec . His concern is about seepage from septic systems . " Has anyone made a soil survey on these lots ? " Chairman White responded that the Health Department will have to approve any septic systems put on these lots . These lots are on public water and rules for area required are not as stringent as for non water lots . L . Sharasteen . The Health Department would take your question into account . The Health Department will specify the type of septic system to be built . We do not have say . A question was raised from the floor concerning the map which appeared to be out - of -date . One name , Katherina Hercinger , listed on the map as owner of a parcel of land is now deceased and has been for some years . However , it was discovered that her name still appears on the tax rolls . J o Ann Vliet . Expressed concern about sewage drainage in that area and noted that a creek runs behind . property . L . Hirvonen asked how sewage drainage problems had manifested themselves . The reply was water appeared in one basement . H owever , that earlier sewage problem was traced back to house already on middle lot and has been solved . 4. -r • Ann Moraved . reported that she gets water in her basement now but Edi the water is clear . However , she wants to be sure that the Health D .epartment knows of her concern about sewage problems in ._T the area tt L . Hirvanen . In order to allay Ann Moravec ' s fears , she reminded ii ] her that only one building will be built on Lot # 1 and one al building on Lot # 3 . ai Chairman White . On January 7 , 1986 the Health Department es approved septic . A new sand filter . septic system was installed h at the present dwelling an . the middle lot . If you are having ai problems now , we would recommend that you contact the Health • s = Department . ai O ther concern voiced . Is there a guarantee that a trailer will m , , not be built on Lot # 2 ? al L . Hirvanen . The Planning Board deals only with subdivision of p property . Questions of use are out of the Beard ' s jurisdiction . id Our responsibility is division of land . J o Ann Vliet questioned building use of Mr . Tidd ' s property and presented pictures of other properties owned by Mr . Tidd , stating that the properties were in disrepair ; therefore , they caused = 1 other property values in the area to fall . Mr . Tidd responded . He stated that property shown in pictures did belong to him but was now in process of selling it to his son who is remodeling it . He never had complaints about septic n systems from neighbors . He did put in a new septic system for a the house located on middle lot , including a new sand filter , and he has had no problems since . He stated that sewage would not be a problem since the Health Department mandates kind of system to be installed . Size of lots far exceed those lots on Route 34 . Chairman White entertained a motion for Public Hearing to be closed . C . Kammen moved that Public Hearing be closed . Seconded i by L . Hirvanen . Carried unanimously . L . Hirvonen expressed the hope that all visitors at the meeting would consider zoning because it is one way of retaining the value of property and of being in control of what will be built . Both Chairman White and V . Mullane thanked members of audience for their input . 111 t P ♦ c7 • 3 BULLOCK MINOR SUBDIVISION ON SEARLES ROAD Fran Duell presented a sketch plan of his property . He was concerned about the title of a house on 1 . 1 acres of land , which is unclear . This land was transferred to his in - laws on August 7 , 1987 without subdivision approval . Now , his in - laws want to sell the house and move to Florida . Mr . Duell has already sold 6 . 75 acres of land , which is outside subdivision regulations . ,rC . Kammen moved that we accept this one lot subdivision and waive the Public Hearing . L . Sharpsteen seconded . Carried unanimously . • MAJOR SUBDIVISION OF EUVRARD PROPERTY Mr . George Schlecht presented a sketch plan for Mr . Alan E uvrard , owner of five lots on the Southwest side of Hillcrest Road . Euvrard also owns a parcel of land that is not being d eveloped at present time on the other side of the road . The five lot subdivision will contain lots of approximately 1 . 5 acres each with as much of the woods to be retained as possible . The q uestion of sewage drainage was raised . In the past there have been drainage problems an other properties in this area . • This property is in Airport Hazard Zone and the maps will carry this warning . This property will require a long SEOR form . Mr . Euvrard stated that this property is in water district , and he is assuming the lots will have public water . Chairman White recommended to Mr . Schlecht that when he appears before the Planning Board again , the Board would like to see a drainage map . MAJOR SUBDIVISION BECKWITH PROPERTY Mr . Douglas Harris presented a sketch plan for proposed Meadow Ridge , a subdivision located off Route 34B on Ridge Road . There are nine lots . Power- lines run along East edge of property along one lot . These lines plus fifty feet of land belong to NYSEG . Concern was expressed about driveways running into Route 34B . Mr . Harris replied that only four driveways will run into t he road . Planning Board requested of Mr . Harris : 1 ) That a common • driveway could accommodate two lots . 2 ) Show proper size of lots on sketch plan . 3 ) Get in writing from NYSEG a copy of easement , if have one . And , 4 ) Long SEOR farm is needed . a •411 4 • MAJOR SUBDIVISION ON CHERRY ROAD The Planning Board arranged by mutual consent for a regular meeting on November 28 . This will be for Public Hearing for Major Subdivision on Cherry Fuad , which has been agreed to by • Ernie Bayles , representing B . Freedman and the Planning Board . NEW YORK PLANNING FEDERATION MEETINGS :r L . Hirvonen canvassed Board Members regarding attendance at these meetings to be held November 30 , December 1 , 7 & 8 at SLINY , Cortland from 6 : 30 to 9 : 30 P . M . each evening . REPORT FROM BOARD MEMBER1 V . MULLANE Re Count �L Planning Board : The County Planning Board feels the need to review roads . There is need to think about where roads could come into . Ithaca , haw roads could go around Forest H ome , and she would like Planning Board members to present thoughts about roads so this information can be transferred to the County Planning Board . The new distinguished Chairman of County Planning Board is V . Mullane . Subdivision regulations : There is a need for a moratorium 110 on subdivisions . This should be for a short period of time . P lanning Board members should be prepared to discuss this at next meeting . Any work on changes in subdivision regulations should be dealt with as quickly and carefully as possible. Suggestions were made that 1 ) Professional Planner , Tom N iederharn work for Planning Board and 2 ) Planning Board go into committees and have a Town Board member present . Suggestion that November 28 meeting be for Public Hearing and for Planning Meeting . Suggestion that December to March 1 be designated as working time for Planning Board . December .12 will be regular meeting , January 9 regular meeting and January 23 will be planning meeting with Tom Niederharn . OCTOBER 24 MINUTES On page 2 , paragraph 2 , Tidds misspelled . On page 4 , paragraph 4 , passible changed to available . C . Kammen moved the minutes be accepted with corrections . S econded by L . Sharpsteen . Carried unanimously . TIDDS MINOR SUBDIVISION C . Kammen moved that Planning Board approve Mr . Tidds Minor Subdivision with the condition that this Planning Board will not approve further subdivision of Lot # 1 as we are concerned about septic and drainage . Seconded by L . Sharpsteen . Thaler : Professor Jay O ' Rear and Virginia Watts O ' Rear have recently retained this firm to represent them in matters pertaining to their planned subdivision • on Sun Path in the Town of Lansing . It has come to our attention that the Town Board is contemplating a condemnation proceeding to obtain a right of way across property now owned by W . David Banfield , 25 Sun Path . Please be advised that Mr . Banfield and Professor O ' Rear have agreed to negotiate the matter of the right of way privately . We will be drawing up an agreement for the Banfields and the O ' Rears to sign that will set forth the terms under which they will negotiate issues relating to the subdivision and the right of way . As soon as that document is signed by all parties , we will forward a copy to your office . As the involved parties have agreed to work together to resolve this matter , it should not be necessary for the Town of Lansing to continence a condemnation proceeding at this tine . Accordingly , we ask that the Town Board refrain from taking any further action at this time , so that the O ' Rears and Banfields , with the help of the Planning Board , can resolve this matter directly .
