Beckwith , A . White , L . Sharpsteen ABSENT : F . Ramin GUESTS : G . Wood , Ordinance Officer , Cal Swayze , Bruce Wilson , attorney , Jeff Sweazye , Steve Carroll , Mr / Mrs . B . Buck I . PUBLIC HEARING - 7 : 30 PM Calvin Swayze proposed minor subdivision . Four lots located between Ludlow and Lansing Station Rds . , officially known as 48 Ludlow Rd . Access to the lots is by a right - of - way across land owned by Jeff Sweayze . L . Hirvonen asked Jeff Sweayze if the dimension of the right - of - way as seen on the Final Plat submitted by Mr . Swayze was the same on his deed . He answered yes . • L . Hirvonen asked who will provide maintenance for that part of the right - of - way shared by all four lots . Mr . Wilson replied that all deeds will state that each owner will be financially responsible , on a pro - rata basis , for maintenance of that portion shared by all . In addition , New York State law doesn ' t allow land to be landlocked . The law requires that an easement be provided either through a written document or by constant use . Mr . Swayze indicated that in the past he has provided general maintenance and he will continue to do so . The restriction on further subdivision found on the Final Plat will be expanded to include " without approval of the Planning Board . " . Stephen Carroll , landowner adjacent to Lot I , has expressed an interest in pur - chasing a portion of Lot 1 . Will he be allowed to do that if no further sub - division is allowed ? It was the general consensus that since there would be the same number of lots and the same number of owners that it would be allowed . • Mr . Swayze has requested hardshipstatus and special action . bit Let the record show that there were no objections to the proposed subdivision from the public . • C . Kammen moved that the board adjourn foraprivate session . Seconded byH . Beck - with , ck with , carried unanimously . The meeting was reopened by Chairman Homa . MOTION : Since all documents seem to be in order and there have been no objections from the public , it was moved by C . Kammen to provisionally approve Mr . Swayze ' s minor subdivision at 48 Ludlow Rd . , with formal adoption to take place at the regular meeting on Oct . 13 , 1986 . Seconded by H . Beckwith , carried unanimously , II . Mr . & Mrs . Bertrand Buck - subdivision , Buck Rd . See minutes 3 - 24 - 86 . Mr . Buck was granted 6 months in which to provide a complete survey map of the subdivision . Let the minutes show that Mr . Buck was present at the prescribed time interval , but because his survey map is still not ready and this is not a regular meeting • for the Planning Board , the Bucks have been asked to return at the next regularly scheduled meeting , Oct . 13 , 1986 . Mr . Buck questioned the proper procedure if an adjoining land owner wishes to buy a portion of the adjacent lot which has a Town drainage ditch and isn ' t suitable for building . Again , it would be the realignment of lot lines and the Board didn ' t feel it would necessitate subdivision action . III . Fiddlers Green - Gerald Wells - update Letters have been exchanged between L . Holmberg , attorney for Mr . Wells and the Town Attorney , Robt . Williamson . IV . Cima - New Horizons Review - rescheduled for Oct . 13 , 1986 V . Planning Board Budget Chairman Homa and Ordinance Officer Wood discussed the need for a full - time planning , zoning , code = enforcement person . Mr . Wood is currently a part - time employee . Board members agreed that there is a definite need and the Town Board should be consulted . ') - L -
