Sharpsteen , A . White Absent : L . Hirvonen , V . Miller Zoning Officer : G . Wood Guests : David Drier , Matthew Shulman , Charlie Potterny A . White brought the Planning Board up - to - date on the two following items : TI Jim Reeves sold his house and 1 . 7 acres of land on Auburn Drive . Mr . Reeves is retaining 70 acres for himself . The Board approved this at its last meeting . 2 ) Future correspondence with Jerry Wells will now be handled by the Town of Lansing attorney , Mr . Williamson , per Mr . Williamson ' s request . I . Drier Family Estate - - East Shore Circle David Drier of Buffalo , New York , was in attendance at the meeting , representing the Drier Family Estate . As background information , Mr . Drier told the Board that in December of 1984 his mother deeded her property on East Shore Circle to her four children . Before this land was deeded , his mother promised she would sell Wayne Lucas a 30 ' parcel of land and Marlene ( Kordas ) Avery another parcel of the property . Mr . Drier wanted to know if the sale of these two pieces of land were considered minor lot subdivisions , and if so , how many minor subdivisions he is allowed before a major subdivision is required . As pointed out by A . White and J . Homa , the selling of the 30 ' parcel of land to Wayne Lucas was not considered a minor subdivision . The Board acted upon that decision as noted in the June 9th minutes ( Article VI ) . However , the property being sold to Mrs . Avery does constitute a minor subdivision . G . Wood read from the regulations that four minor subdivisions are allowed before a major subdivision is constituted . Hence , Mr . Drier has used one of the four minor subdivisions permitted , leaving him with three . L . Sharpsteen consented to send Mr . Drier a letter stating the above . J . Homa suggested to Mr . Drier that he plan the entrance to the property on Route 34 rather than East Shore Drive . Mr . Drier agreed but stated that he has no plans for developing the property at this time . J . Homa indicated that the Board will not take action on the request for a minor subdivision on the Avery land until the Board hears from Mrs . Avery . A letter from the Department of Health has yet to be received on the Avery property . II . Charlie Potterny Property Mr . Potterny intends to sell three or four parcels of his land to several parties . Matthew Shulman is purchasing a piece of this land - - 7 . 03 acres , 1500 - 1600 ' frontage , 230 ' deep , off of Wilson Road . Mr . Shulman contacted the Zoning Office ( Burr Phelps ) and was told that since his piece of land was over three acres , it was not necessary to bring it to . ' the Planning Board for subdivision approval . Hence , on that information , Mr . Shulman engaged a builder and obtained a loan . There was some discussion as to the validity of the information Mr . Shulman received . The Board took a 15 minute recess to discuss the ordinance and how it pertains to the Potterny /Shulman property . Upon returning , J . Homa stated the following three points : 1 . The Planning Board has worked with Mr . Potterny in the past wherein his subdivisions through 1984 were brought into compliance with the Town ordinances . 2 . The Board interprets the subdivision ordinance to mean that any parcel of land over three acres with no new roads , utilities , etc . does not constitute a subdivision ; hence , the seven acres which Mr . Potterny desires to sell to Mr . Shulman does not constitute a subdivision and need not come before the Planning Board for approval . 3 . However , the other lots that Mr . Potterny desires to sell do fall under the ordinances of a major subdivision since he has already , in past years , made more than four minor subdivisions of his land . He must comply with the ordinances of a major subdivision . C . Kammen indicated that Mr . Potterny would need to make a formal subdivision submittal with an updated map of the entire area . • L . Sharpsteen suggested to Mr . Potterny that while he is having this map drawn up , it would be a good idea to have additional subdivision lines drawn where Mr . Potterny might want to sell his property in the future . L . Sharpsteen reminded the Board that this same suggestion was given to Mr . Potterny last time he made a formal submittal for subdivisions and unfortunately was not done . Mr . Potterny agreed with the three points made by J . Homa and with L . Sharpsteen ' s suggestion . L . Sharpsteen will send letters regarding the Potterny land to the following : Mr . Shulman , Mr . Potterny , Mr . Potterny ' s daughter , and Roger Sovoceol ( Mr . Potterny ' s attorney ) . III . Miscellaneous L . Sharpsteen mentioned that the one year review of The Horizons subdivision of Alex Cima is due in September . L . Sharpsteen will send Mr . Cima a letter asking him to bring the Board up - to - date . L . Sharpsteen also wanted to bring to the attention of the Board that the Walnut Grove Trailer Park does not have a trailer license and that the owner , Tom Frank , passed away .
