TOWN OF LANSING PLANNING BOARD
Date : 14 April 1986

I . Buck Minor Subdivision - Mr . Bertran Buck
Mr . Buck was directed to submit 4 copies of his survey map along
with the fee to the Town Clerk .
II . Bolyard Minor Subdivision - Public Hearing
MOTION : L . Hirvonen moved that in the absense of any public input ,
the Bolyard minor subdivision located on Luce Rd . , be
approved as submitted . Seconded by L . Sharpsteen
carried unanimously .
III . Roy Moore Jr . Minor Subdivision
411 A . Mr . Moore is proposing to subdivide his property located at
1870 E . Shore Dr . , bounded by a creek on the south and
situated south of Colonial Cleaners on Route 34 .
B . The sketch plan shows 3 lots approximately 1 . 3 acres , 4 acres ,
and 13 . 4 acres respectively , with a 60 ' right - of - way between
the two smaller lots leading to the larger lot in the back .
C . Mr . Moore has submitted his sketch plans and paid his fee to
the Town Clerk .
D . If Mr . Moore is able to bring in a survey map the Planning
Board will schedule a public hearing for him on May 12 , 1986
at the Town Hall .
E . MOTION : L . Sharpsteen moved to accept Mr . Moore ' s sketch plan
. 3 for a minor subdivision located at 1870 E . Shore Dr . as
submitted . Seconded by F . Ramin and carried unanimously .
IV . Gerald Wells Minor Subdivision
A . Mr . Wells has submitted a sketch plan for a 3 lot minor

subdivision located off Lakeview Dr . in the development known
as Fiddlers ' Green .
..
B . Mr . Wells was represented by his attorney , Laura Holmberg .
• After researching material at the Lansing Town Hall and the
Tompkins County Court House which does not have a Final Plat
on file for the Fiddlers ' Green major subdivision , and because
there are no restrictions in Mr . Wells ' deed ( interpreted ) ,
Mrs . Holmberg feels there are no legal restrictions to the
development of Mr . Wells ' lot .
C . Many residents of the Fiddlers ' Green development , as well
as neighbors of the area , were present .
1 . Mr . Jim Swayze , neighbor - questioned drainage .
2 . Mr . Danial Baugh _ presented 2 petitions , one signed by
every member of the Fiddlers ' Green development and one
signed by immediate neighbors , stating their concern that
the character of the area will be adversely affected by
this type of development as well as their concern that
the physical aspects of the terrain will not support
further development without causing environmental damage .
• 3 . Mr . Roger Sovocool , attorney for Fiddlers ' Green land owners
said that he had checked with the Planning Board on behalf
o f his client when he was buying the land and was told that
n o more subdividing would allowed . He also voiced concern
✓ egarding the private lane proposed by Mr . Wells , the
precedent it would set , and the problems to the Town it
would cause such as snow removal , busing and fire protection .
4 . All residents felt their deeds restricted further subdividing .
Mr . Wells did not interpret his deed in that way .
D . Further Discussion
1 . Mrs . Miller ( PB ) felt the entire Fiddlers ' Green subdivision
should be reviewed in response to the resident ' s concern .
2 . Mr . John Hartman ( resident ) felt the Fiddlers ' Green
subdivision to be in violation of a Town ordinance , there -
fore approval of Mr . Well ' s subdivision would confirm an
illegal act .
j . Road
• The Fiddlers ' Green Rd . has been deeded to the Town and
e xtends to the south part of Wells ' property . The road
has not been developed that far , there is a temporary
turn - around and the Town has approved only that portion
that has been completed .

4 . Mr . Wells stated that he "fished his proposal to be treated
• as any other proposal would be treated and not judged for
$ anyone elsets sins ( Mr . Finkledey ) . He also said that
he had never wanted to be placed in an adversarial position .
L .. Sharpsteen ( PB ) said that since Planning Board meetings
are open to the public , everyone is welcome to attend .
5 . MOTION : H . Beckwith moved to table further discussion ,
seconded by V . Miller , carried unanimously .
V . Thaler Subdivision - Richard Thaler
A . Located on the north side of Hillcrest Rd . across from the
Skyacres subdivision .
B . Mr . Thaler wishes to have the development designated as a
minor subdivision because it has only four lots .
C . A final map for the subdivision was submitted as well as a
drainage map .
D . Water
C . Kammen ( PB ) questioned the availability of water . Mr . Thaler
and his engineer , L . Fabroni , felt that if' such a problem exists
there are acceptable ways of dealing with it . Mr . Thaler feels
that his property is critical to the development of public
water in that area . For - this-- -reason --he—want-o- -to-- develop his
land in phases . Any plan he might submit now mightnot make
the best use of the land if/when public water becomes available .
E . Road
G . Wood , Building Inspector , said that State law prohibits him
from issuing a building permit to any structure not on a public
road .
Mr . Thaler will need a statement from the Town Board accepting
his road or a recommendation for acceptance from the Town
Highway Superintendent .
F . Drainage
Mr . Thaler will specify in all deeds that field drainage is
required .
G . Public Hearing on Prelimina y Plat
- will be held April 28 , 1986 at the Town Hall .

V I . Lucent e _PDA - Larry Fabroni , engineer .
• Mr . Fabroni inquired as to the status of the PDA . A letter ,
received today from the NY Depart . of Environmental Conservation
and dated April 3 , 1986 was read aloud . It designated the Lansing
Town Board as the lead agency in the Environmental Impact study .
Mr . Fabroni suggested that it would help the Town Board to be
informed of prior discussions and areas of concern . L . Sharpsteen
will forward copies of minutes and correspondence pertaining
to the Lucente PDA to the Town Board .
VII . Wells Minor Subdivision - further discussion
A . Road ( Fiddlers ' Green ) - The Town has never been responsible
for the development of a road . It must be determined who
will complete the road .
B . The Planning Board would like more information about the
following :
• 1 . wording of deeds - - establish intent
2 . water
3 . sewage disposal
4 . road ( private lane )
5 . environment
C . L . Hirvonen suggested that :
1 . however much we sympathize with the Fiddlers ' Green
residents it might not be possible to bring the subdivision
into compliance .
2 . we look at the current deed restrictions .
3 . we evaluate Mr . Wells ' subdivision as a separate entity .
