L . Montague told the members present that he had been contacted by Mr . William Straub who was very concerned about a building that was being erected on the Arno, Finkledey Subdivision . Mr . Straub lives on Sperry Lene -and feels that when the structure is completed it would obstruct his view of Cayuga Leke . L . L . Montague went by and checked the height of the building; end it measured r . ' 32 ' . He pulled out the minutes of May 1I+ , 1979 in which there is specified a deed restriction that Mr . Finkledey or two neighbors would have to approve of any _ plans in the subdivision . Mr . Armstrong and . Mr . Nagel , both neigh- bors had approved Mr . Paul Byrne ' s plans . Mr . Straub told the members that his main concern was the obstruction et his • view . He recalled that at the Planning Board meeting two to three years ago , Mr . Finkledey , surd that his plans called for one or two story structures . He felt - that that may have influenced the Board ' s decision . V . Miller informed him that that was not the case . She told him that as a subdivision the Board had nothing to say , without zoning , about the types of homes to be ' built . The Board could only decide on the land itself , the sub - dividing . of it , roads , public utilities , : safety and that type of thing . She added that the Board always asks about the style of buildings and sometimes makes comments on them but without zoning there is nothing that they cannot permit . L . Hirvonen recalled the meeting with Mr . Finkledey and his satin;; that he wanted all of the people in his subdivision to have the view . Mr . Straub said that Mr . Finkledey did not seem pleased with the structure ' . going up . Mr . Straub felt that there should be something in zoning to pre- : - :,• • • vent hideous structures from going up . He felt that two could play the "5 game and he was thinking strongly about that . ' V . Miller commented that beauty was in the eye of the beholder and what might ?• uA , please one person might not please another . She did not think that the Town Board could ever rule on what types of homes people could erect . Mr . Straub said that he and his wife had hired en attorney who felt that , : they had a. strong case against Mr . Byrne . He is not personally optimistic r . about the outcome but was hoping that it might serve as e test case for v - 1- . . ---_______________________ __..__ _ _.__.__.._. 71P Mr . & Mrs . William Straub - continued . the future in Lansing . Mr . Straub said that a Mr . Abbott came to him and described his building - 0 plans . Both Mr . Abbott and Mr . Wells are battling over the same lot . It is located in the Finkledey subdivision , directly below his home . He then asked if there were any restrictions about putting mobile homes . on lots in Lansing . V . Miller told him no , not if there weren ' t any restrictions in the deed . T . Kick told him briefly of the controversy over e modular /mobile home on Maple and Armstrong Roads . There wads e deed restriction there but the people concerned waited too long before coming to the Board . He also told Mr . Straub that the Planning Board has been working on zoning for the Town of Lansing and has submitted it to the Town Board . L . Hirvonen told Mr . Straub that it would be very nice if he would work as a neighborhood leader for zoning when the time comes . H . Ley felt that it all came down to money with Mr . Finkledey and his desire to sell off his lots . Mr . Straub wanted to know when the next Town Board meeting was . V . Miller told him the following evening . He considered attending it end expressing his views . Mr . & Mrs . Straub then left the meeting . IV . T . Kick reported that there have been no water meetings in about a year . L .
