'.; ' ; fI; Ithaca, New York 14850 , OFFICE OF THE PRINCIPAL PHONE : 274-2145 August 21 , 1979 Tompkins County Health Department 1287 Trumansburg Road Ithaca , New York 14850 D ear Sir or Madam : I am writing to express my concern and the concerns of my neighbors about the health conditions surrounding a number of trailers on S outh VanOstrand Road , Lansing , New York . I am concerned for two reasons : • 1 . I do not believe that the trailer installations meet standards for water , sewer , condition of facilities or access . This is o f particular concern because most of the trailers are rented to people receiving social services aide . Such people normally have little influence on the conditions of their lives and are o ften taken advantage of by enterprising individuals . 2 . The land on which the trailers are set has been plowed by local farmers over many years . These farmers say there is little topsoil on the property and have run into contact with bedrock on plowing . This land would be unlikely to provide proper sewerage without a great deal of work . I feel this work has not been done . I believe that proper sewerage is not provided and wonder if human waste is filtering into a nearby stream . 3 . Finally , Health Department water samples have been inadequate for testing . Yet the trailers are installed on income property . I don ' t mean to be completely condemning of this project , developed by Mr . The Planning Board recognizes it - self as a tool of government created by the authority of the Town Board to dream a lot , to devise and create pland sor an ideal life in Lansing . To be more explicit it has been directed to create a General Dian acceptable to Lansing for the future development of Lansing , to kkkp the Plan updated , to be aware of community needs , to create means by which the Town Board can adopt specific ordinan- cea ( in which for the most part the Planning Board has no further obligation ) ; to administer Sub - division Rules and Regulations ; and in such other matters as are specifically delegated to it by the Town Board . However , long and patient planning is a waste of talent , time , effort , and money unless it finds direction and carries with it implementation and enforcement by the Town Board . It taklse education , cooperation and understanding . It takes frankness and honesty on the part of all members of both boards plus a willingness on the part of each to understand the other . Surely all are working • essentially for the same thing - - - whatever is best for Lansing as each sees it - - in his own way ! The Planning Board appreciates the desire of the Town Board to set the records straight , and most especially to create an atmosphere for accomplishment of its goals . It does not understand the reasoning for wanting to throw out the Subdivision Rules and Regulations and start over ! Those Regs are the product of years of work and expense - - by both boards , past and present ! And , more important , they work . The Planning Board wonders if the Town Board is aware that the present ordinance officer never found them accept - able at least to a point of acting as the inspection officer even when so directed . ( 4/13 / 76 ) . Your memo would seem to suggest that our Boards are a 1 long wadi apart in our thinking , which is most disturbing ! It is hard of believe that the present Towb Board would take the time and trouble to decide that the Planning Board had not been given the ' Power of Subdivision Control ' in April 1967 . Frankly , it seems to be a matter of semantics . Perhaps you would like an account and explanation of exactly how it cameabout . Tht.t is possible . The Planning Board regrets the long delay inanswering this memo , which you will recall was some five months in reaching its destination . However , the delay was a help in the the Pl . Bd . has had its first experience in administering a major subdivision . It is not an experience to be completely proud of or satisfied with , but at least everyone will know better how to proceed the next time . SWe also found out that the Regs . as written are just fide . But more about subduvmsions under a point by point discussion of your memo , a copy of which is enclosed . 2 1 . It is only fair to the residents and taxpayers of Lansing that all paople should be treated alike , - - and that none should encounter unnecessary hardship at the hands of any Town Board . ( Some family members can be most unscrupulous . ) 2 . By the adoption of ordinances the Town is trying always to make Lansing an even better place to live and work . Both Minor and Major Subdivision Regs are needed to keep abreast of possible development activity within the Town and to carry out Planning as the General Plan suggests . As major subdivisions , such as the County now describes , are rare in Lansing , it is necessary to have ( and try to enforce ) minor S . Regs to know where developing is occuring or may be about to occur . Also , minor subdivisions often have a way of becoming major - - and then the pot boild over ! In general Lansi4.g rules do comply witk County - - always where recess ary . Obviously they are at present somewhat more restrictive , and we think that is what Lansing wants and needs . The Planning Board has fpund in the past that in no way does Lansing want to copy or be dictated to by the County . Besides it is a bit hard to know just where the County will jump next ! Unfortunately experience with the County in these matters does not lead to confidence in their deal - ings . Lansing needs its own regulations - - and this the Health Dept . has been asking for for years ! Incidentally , we have found the Dept . to be most cooperative in carrying out our specifications . 3 . The Planning Board agrees that a short version of the Su . Regs should be available to the public . Minor Sub Regs can le • explained gmickly and easily ; major would be more diffiu t . How- ever , it should be assumed that anyone wishing to debelop a major subdivision in Lansing would ( 1 ) have the experiencerecessary to understand and accept the rules as stated or that ( 2 ) he would have available to him the necessary counsel to advise him as to the procedures stated . In dealing with some segments of the public it is necessary to have and use legal and detailed regulatoons . It is necessary , too , to have an inspection officer who can advise as to the rules when necessary and to check to see that plans are being carried out correctly . FOR YEARS THA PLANNING BOARD HAS BEEN ASKING FOR THIS . Laws without enforcement is like a gun without ppwder . Both are . useless ! Once Lansing comes to grips with this issue , the people will soon learn and accept. With short version sub division regs . and perhaps other minor changes , remembering that it is always something of an ordeal to change ordinances , it should be apparent to anyone that the so - called restrictions are tolerable ; the procedures sensible and easy ! . Perhaps we all need to become better acquainted with them . L . The Zoning Ordinance ( preferably referred to as the Land Use Ordinance ) and Sub - division Regulations are hardly related - - at best in - laws . State statutes provide for Zoning to be under the control of the Town Board and the Zoning Board of Appeals with possible recommendations for site app ± oval by the Planning Board . ( The legislature has enacted new laws allowing T . B . s to delegate IIIsite approval to the Planning Bds . ) Sub division control is proper ly given to the Planning Board as it is more a part of planning procedures and allows for greater leniency . There seems to be no statutory authority or judicial approval for the enactment of subdivision regulations as a part of a zoning ordinance . It follows 3 reasonably that it hardly seems necessary for the language to be 1110 the same . Certaily public hearings will be called by either Board as needed . The Planning Board is obliged by its very nature to try to keep up with changes in Lansing , to change plans to meet these changes . This it has been trying to do in its recent re - view of the General Plan . At present it sees no major change except for the loss of Cayuga Staation . It is a bit too soon to know what the 100% evaluation will do throughout the Town . The Planning Board is concerned that there seems to be a lack of communication between the Boards . It was easier when someone from the Pl . Bd . sat through entire meetings of the Town B oard , but that hardly seems expedient or necessary . Unfortunately , on- the - spot information is better than minutes which usually fail to tell the story of all that is going on ! However , your memo does indicate a concern that is understandable , and resolvable . The Planning Board has had much change of personnel and a change in officers , whichis difficult when continuity is so important . At the same tmme new personnel on the Town. Board needs answers which so many take for granted . The Planning Board should have been ready with the answers , but was involved in other matters which demanded attention and time . But , by the same token , the members of the Planning Board need assurance from the Town Board that plans for the town will get positive consideration . Each has an entity of its own , does its own work , and tries to do a good . job . In so far as they go , the present ordinances seem to be good ones - - workable and enforceable . It really does not do much f or morale to be told that something worked on for years , costly in time and mmney needs all kindsof revision and change . No member of the Planning Boardnow , or in the past , wants or is will - ing to accept unnecessary or unreasonable restrictions for Lansing residents as a whole . However , by the same token , individuals ( many of whom are not Lansing people ) should not be able to do as they wish to the detriment of many . The questions you pose for consideration are ones that have concerned the Pl . Bd . greatly especially in the past few months as it has turned its attention to a review of the General Plan . It is concerned that the greater areas of the Town are in a way , through Agricultural Districting , already zoned . With the South end strictly zoned , it hardly seems Lair to the other areas that they receive no such consideration . Part - town zoning does not work out to be the answer to a town •, ' s needs . To Quickly finish the questions on your memo as this seems to be getting too cumbersome and explanation too lengthy , here are the answers as the Pl . Bd . sees them . 1 - Probably not ; as much as any other town . '020 Simple Zoning . ( 3 ) Returns to previous zoned d istrict . ( 4 ) Yes ( 5 ) No - the person building israrely the 111 one selling the lot ( 6 ) Has been turned down in the past . ( 7 ) Does not seem probhble or advisable .
