GUEST : Gary Evans , County Planning Depar6CPD )
The meeting was conducted as an open meeting with Mr . Evans .
Io Finkeldey subdivision - off Myers Rd. .
A . The Town Board has indicated they do not wish to pursue
the matter ( the illegality ) .
B . Section 602 , Design Standards , of SRR sets out the require -
ments for a road .
C . Mr . Evans suggested that Section 280A of N . Y . S . Town Law ,
Open Development Area , be followed in regard to the road .
This is a right - of -way agreement , signed by the property
owners , in which they agree that the road access for
emergency vehicles is satisfae: oryo This action would
protect the properte9 owners from the possibility of clouded
deeds and satisfy the Town ' s question of responsibility .
D . Suggestions made by Mr . Evans .
1 . Ascertain the existence of a resolution delegating
responsibility for SRR from Town. Board to Planning Board .
• 2 . Establish working communication with County Clerk .
II . Finkeldey subdivision - off Sperry Lane
A . If Design Standards of SRR are followed , this subdivision
cannot be allowed due to :
1 . cul - de - sac - 600 ' frontage is required
2 . 150 ' radius of turn around
B . When questioned re : 600 ' frontage , the State Depart . of
Community Affairs could see no reason for this renuirement
in e rural area . This indicates that a reinterpretation of
an existing standard might be made .
C . Mr . Evens suggested that Mr . Finkeldey consider a new plan
with 10 lots and one length of road . The grade problem
could be erradicated and all lots would become more
acsessible for building . Economically , the 2nd half of the
proposed road would be more expensive and this could be
eliminated . Fewer trees would be cut in a potentially
high erosion area .
D . Mr . Bement felt the Planning Board could suggest to Mr .
Evans thrt he stress the advantages of the above plan to
Mr . Finkeldey ®
III , Conclusions
A . Pursue Section 280A of NYS Town Law as a method of dealing
with the Myers Rd . subdivison road problem .
B . Ask the Town Attorney to send a directive to tie Tomp . Cty .
Clerk , stating that no subdivided land can be recorded
without approval of the PB .

D . MOTION : In order to create a Subdivision Ordinance as per
the request of the Town Board , the Planning Board moves to
delete sections 4 & 5 of the present Subdivision Rules &
Regs and add a section 15 on administration . So moved by
B . Bement , seconded by T . Kick , carried unanimously .
VI . New Development
A . The County Planning Board has had advance notice of a
proposed multipiedwelling building project by Rocco Lucente
in the vicinity of Farrell & Warren Rds .
B . If such a project is completed , the question of where to
place future water & sewage lines in the Town , would in
. effect be already dictated . It becomes a basic , long- range
development question .
C . Identity problem
1 . If water/sewer lines are placed on Warren Rd . , that area
of the Town would effectively become a finger of the
Ithaca urban area .
2 . How does this effect the identity of the small rural
hamlets of South Lansing , Ludlowville and Myers ?
3 . It is within the scope of the Planning Board to
effectively stop suburban type development with its
consideration of this problem .
VII . Review of Ordinance Officer ' s proposed changes in the Lans Use
Ordinance .
The Board found the changes acceptable , suggesting that the
term General Plar be changed to Comprehensive Plan .

The public hearing was called to order- by Chairman . •
B arney on the application of Raymond F . and He
i _ nD .
Kulak:. os .Lmy for a variance to keep and maintain up to three
horses on premises at Belvedere Drive , being Lots 20 , 22
and 24 in a low density residential area . The premises
in question exceed two acres jn area but are less than the -
acreage required to Reep more than one horse .
Laura Holmberg , attorney for Erwin and Yolanda Pearson ,
appeared for the said Pearsons and explained the reason for
the request . The premises are being sold to M .. and. Mrs .
P earson who are also purchasing property adjoining the above
lots for their residence ( known as 21 Belvedere Road ) . The
property to be owned by the Pearsons is bordered on two sides
( north ar east ) by the area in the Town of. Lansing zoned as
" Rural Residential " , on which theae are no restrictions for
maintaining horses . The Pearsons have contracted to purchase
these lots solely to provide space for maintaining their •
horses and believe that the space is sufficient forth_reehors 'es ,
that the maintenance of horses is contemplated in the
O rdinance and are maintained without restriction on adjoining
lands and rigid enforcement of the acreage requirement would
impose undue hardship and expense . sale of these lots cannot
be consummated unless the variance cs. n be secured .
Mrs . Holmberg went on to stake that the Pearsons planned
t o place a rind on the premises and eventually stalls , but
that there would be no pasturing . Mr . and Mrs . Pearson
are now boarding their three horses in Groton and to leave
theth those for any length of time would create a hardship
for the .-n .
Chairman Barney then invited those in opposition to
t he request to speak .
Jack Ettinger of 1207, Warren Road , Lansing , New York
stated that the drainage area for the site that the Pearsons
411 were talking about is a swamp now . He requested • that there •
• be a good engineering study Of surface run - off done affecting
the low areas . He felt that the animal waste from the horses
would create more of a problem in an area already a problem .
The water is polluted now and he will not have drinking water
until Jobb His property is 1 - 3 on tax map 39 . .

`" Mrs . Annette Blakely , another owner of an adjoining property
spoi� e . She tel that the area should remain a osidential area
for private homes and that horses do not belong hong in the development .
She is concerned about odors , etc . She feels now that the development
already is in need of improvement and that the addition of horses
would definitely be more harmful . She was also . concerned that many
beautiful t 'f Pes would have to be cut down .. Mrs . Pearson maintained
that there are already horses in the back of the development and
people are already riding them all over the development sr, the
add tion of three more horses would be no more harmful than the

Mr . G . W . Montelc ona spoke briefly . He owns property 150 feet
from the land in question He is cones •; reed • about the aroma and
the presence of more horses in a residential area . He also questioned
whether the granting of this variance would later on require approval
of the presence of other large animals later on .
Mrs . Batty Grant spoke next . She explained that at present Mr . .
arid Mrs . Gallup , owners of property in the development , already have
horses behind hex property . She is bothered in the summertime by
. numerous flies in the house and in their swimming pool . She does not feel
it would be fair to allow rno :r_ e horses as she would then be surrounded
• by them .
Mrs . Holmberg at this point pointed. but that the zoning requirements
already would allow one horse and possibly two ' in the specified area .
Mrs . Mcnt leona then identified herself and restated the arguments
of her husband who spoke previously . Their p .- operty is at 15 Brook -
.
haven Drive in Lansing , and is tax parcel 39 -- 1 -- 20 . 14 .
The public hearing was then closed at 9 : 00 p . m .
Chairman Barney moved to adjourn the meeting and stated that he
would like to go out and examine the property in question and invited
• other Board members and anyone else who would like to do the same to
accompany him, . He also suggested that the matter should be referred
to the Planning Board for consideration of whether the allowance of
the variance would be inconsistent with the Master Plan for development
of the Town .
It was unanimously agreed that the Board members would meet at
the subject property at 5J5 .p . m .. on March 15 , 1979 to examine the

pursuant to Section 547 of the Public Housing Law , added by the laws of
