I . Minutes
22 January 1979 - T . Kick moved to accept the minutes as read
seconded by PeWells , carried unanimously .
12 February 1979 - Article V , item G corrected to read "County
Departments " and Mr . Wells name was added to the Present list .
T . Kick moved to accept the minutes as corrected , seconded
by H . Cogan , carried unanimously .
II . County Planning Board - T . Kick - no report
III . Board of Zoning Appeals - Mr . John Barney , Chairman
A . Planning Board policy statement - Mr . Hardie
B . Presentation of case - Mr . Barney
Dr . and Mrs . Pierce recently purchased a home in the Kulakosky
subdivision off Farrell Rd . They have options on the 2 lots
west of their lot , which would give them a total of 2 + acres ,
• and wish to put 29 possibly 3 , horses on this land . They intend
to feed the horses year round and would not use the land for
grazing . Under the Town of Lansing Zoning Ordinance , their
area is zoned low- density residential and requires a resident
to own 2 acres of land per horse . The Pierce ' s , through
their attorney , have requested a variance from the Board of
Zoning Appeals to allow up to 3 horses on 2 + acres . According
to Section 1802 of the Zoning Ordinance , the BZA may refer the
issue to the Planning Board " for review as to the conformance
with the objectives of the Master Plan . " Prior to presentation ,
the BZA held a public hearing and some objections were
raised by neighbors .
C . Discussion
H . Cogan It appears that :
1 , the Pierces ' were led to believe they could keep horses .
2 , it is a good place to keep horses .
3 . it ' s separated from other residences fairly well .
4 • the acquisition of additional land would be ideal if it
didn ' t pose a hardship .
5 . grazing area is not the question if the horses are fed
'rear ' round .
B . Bement_ Would prefer not to present an inhospitable view of our
community to newcomers and feels it would be proper to send a
letter to the realtor involved suggesting the possibility of
misrepresentation on his part .
410T . Kick Feels that when someone buys a residential lot it ' s wrong to
put a rural activity into that area .

BZA - continued
D . Hardie - The other people in the subdivision bought their lots with
the understanding it would remain residential .
•10Monj _Prospective buyers as well as residents should be aware of the
restrictions of the area .
J . Barney - The Pierces were aware .
D . Hardie - There are options open to the Pierces . The land on either side
is zoned rural .
J . Barney - Would a variance change the concept of the Master Plan ?
Would it be contrary to what you ' envision the Master Plan as
representing ?
L . Montague -The hardship plea is hard to accept .
B . Bement - To allow the situation goes against everything that ' s been set
up by the Master Plan . It wouldn ' t be acceptable in the
development of the Town .
P . Wells - If the Zoning Ordinance specifically disallows this situation ,
then it should be upheld .
N . Stanton - The Master Plan is too general to apply specifically to this
area . If the Planning Board is guided solely by the Master
Plan then it can have little input .
B . Bement - The Ordinance doesn ' t exclude horses it just sets land
limitations . The horses could still be there if they could
purchase enough land .
R . Kulakosky-The Health Depart . won ' t allow building on the land around
ithe Pierces .
IV . Old Business - Mr . Arno Finkeldey - Proposed Sperry Lane Subdivision
A . Mr . Finkeldey presented 5 copies of a revised map and a map of
the road showing elevation and other details .
B . County Planning Depart . - Mr . Finkeldey met with Mr . Missirian ( CPD )
on 3 - 12 - 79 . Mr . Missirian said his recommendations would be
forthcoming within the week .
C . County Health Depart . - A letter from Mr . John Anderson of the
CHD was presented .
D . Road
1 . The map shows a cul - de - sac at the end of the road .
2 . A review by Lloyd Sharpsteen , Highway Superintendent , was
felt to be advisable .
3 . Mr . Finkeldey asked that the CPD not be made the final
authority .
4 . At the end of the first section of road , Mr . Finkeldey felt
that cars , school buses and snowplows would need the full
circle , as shown on the maps , to make the turn .
E . Drainage
Just south of the midline of the first section of road , a
natural drainage situation occurs , which allows run - off to go
on both sides of the property . From that point , run - off goes
south to the Sperry Lane culvert and down , and north to the
circle where it meets a natural ditch and runs along the edge of
the property .

F . Road Discussion
410P . Wells - Suggested Mr . Finkeldey visit the County Highway Commission
for input .
Finkeldei- Would prefer to get Mr . Missirian ' s recommendations first .
G . Flow Chart
1 . The revised sketch plan with additional information has
been presented as requested .
2 . If approval of the road as presented is given by the various
professionals and agencies to be consulted , then the
Planning Board will approve Step III .
. 3 . Step IV ( Health Depart . ) has been completed .
H . Further Dircussion
Finkeldey- presented a situation which he suggested would prove to be a
hardship for him if he did not have PB approval of his road
within the next 2 days : a bank financing committment for a
client would be withdrawn .
H . Co an - Suggested the PB write a letter to the bank outlining the
steps that must be completed before final approval of the
road can be given , with no commitment made .
B . Bement - Brought to Mr , Finkeldey ' s attention that his subdivision
south of Myers Rd . was developed without regard to Subdivision
Rules & Regs . and that any further development must be handled
in the manner of the subdivision now under discussion .
•Finkeldey- Replied that he would comply with that .
Mr . Finkeldey was told that he would be notified should the PB decide
to write to the bank , and was excused .
I . Continued Discussion
B . Bement - Pointed out that the letter from the Health Depart . says
nothing about the suitability of the land for sewage .
H . Cogan - According to the letter from the HD he . ' s in full compliance
with the letter of the law .
P . Wells - Suggested that Mr . Finkeldey doesn ' t handle his business on
a timely basis .
D . Hardie - Felt it wou d be wise to meet with Harry Missirian and get the
engineers recommendations as to the sui .t • 'ility of the road .
H . Cogen - Pointed out that along with the engineers recommendations ,
Town Highway specifications must be met .
B . Bement - Recommended that a letter be written to Mr . Sharpsteen ( HS )
accompanied by a map , requesting him to check it for town
specs regarding grade and drainrge , and report back to the
PB in 2 weeks .
✓ . Ordinance Officer ' s Retort - B . Bement
• A party on N . Triphammer Rd . , who for the past 2 years has been
dumping soil etc . on bis land , was notified thet This action must stop
Mr . Bement would like to know the rationale behind this action aid
suggested a letter be written to Mr . Stanton requesting this info .

✓ I . Unfinished Business
A . Finkeldey - Should the PB write a letter to the bank in question ?
p . Wells - This is a business problem , not a municiple problem .
As the board concurred , no action will be taken .
B . BZA
MOTION : The Town of Lansing Planning Board after discussion
and study , unanimously approved by all present , the following
motion :
The Town of Lansing Planning Board moved to uphold the
restrictions as entered in the Low Density section of the
Town of Lansing Zoning Ordinance as the Master Plan was the
guide used in formulating the Zoning Ordinance and we see
this as being in conflict with the intent of the Master Plan .
So moved by B . Bement , seconded by P . Wells , carried unanimously .
The BZA will be notified of the Planning Board ' s action .
C . NYSEG fill plan
A letter will be sent to the Town Board indicating that the
Planning Board finds no objection to NYSEG ! s plan to fill the
area excavated for the proposed Bell Station .
✓ II . New Business
At the request of the Town Supervisor , the Planning Board examined
the possibility of a tavern opening on the site of the old Howland ' s
Red & White . As the area is not zoned and the Master Plan
• recommends the area to commercial use , and since there appears to
be an adequate parking area , the Planning B. pard could raise no
o bjections other than the personal feeling that another drinking
e stablishment in that location would be undesirable .
MOTION : B . Bement moved that a letter be sent to the Town Board
to this effect with a copy to be sent to Mr . Cushing Murray of
the ABC . Seconded by L . Montague , carried unanimously .

✓ III . Comprehensive Plan Report
Mr . Wells has asked members for input and Mr . Kick highlighted
the report he had compiled for Mr . Wells .
IX . Finkeldey_ subdivision south of Myers Rd .
Mr . Hardie reported that after much ado , the Town Attorney had
decided the SRR are legal . As to how this will effect Mr .
Finkeldey ' s illegal' subdivision is yet to be determined . Mr Hardie
will discuss the matter with the Town Supervisors Mr . Munson .
X . Mr . Hardie showed n slide of an aerial view of South Lansing proper
taken summer 1978 and noted how small this commercial area looks
compared to the open agricultural area on every side .
