Minutes - 11 April 1977 - J , Burke moved to accept the minutes as read , seconded by V , Miller , carried unanimously , II . Correspondence A . Division of Legal Services 1 . stated that a Master Plan may be adapted by a resolution , not necessarily by a public hearing 2 . stated that all ordinances are part of a Master Plan B . Newsvane 1 . Chapt . 272 , Laws of 1976 , amends General City Law , Town Law & Village Law , giving Planning Boards the power to issue site plan approval or special permits . 2 . It was moved by D . Hardie to bring this to the atten - tion of the Town Board by including it on the agenda. for the joint meeting with the TB . Seconded by B . Bement , carried unanimously . C . Appalachian Regional Commission - Workshop 1 . Tues . , May 17 , 1977 , 1 : 00 P . M . 410 2 . Binghamton , N . Y . III . Subdivision - Mr . Marshall Volbrecht A . Location - Drake Rd . and Rte . 34 B . Background 1 . Mr . Volbrecht had a sketch done in 1974 2 . Mr . Volbrecht said the Planning Board had seen said sketch in May of 1975 and he was under the impres - sion that approval had been given at that time . 3 . Planning Board records show that Mr . Volbrecht approached the PB on 8 March 1976 . At that time Mr . Volbrecht was told that his proposed subdivision was a major ; discussion of roads etc . followed , and no approval was given . C . New Information 1 . Tompkins Cty . Health Depart . would not issue a permit because subdivision not on file with the County Clerk . 2 , Tompkins Cty . Health Depart . preparing new Sanita- tion Code for approval 1 June 1977 . a ) Mr . Volbrecht was told no new permits would be issued by Health Depart . until after new code adopted . b ) Mr . Volbrecht ' s attorney advised him to get PB approval before 1 June 1977 . c ) Mr . Volbrecht objects to the fact that the Health Depart . can make you wait on rules that haven ' t 411 as yet been passed . d ) Mr . Volbrecht ' s attorney , upon questioning the Health Depart . , found that some permits had been 410 given . e ) If preliminary sketch had had PB approval , and had been filed with the County Clerk the Health Depart . might have felt differently . � PB comment ) f ) Planning Board must have a copy of Health Depart . approval before they can give final approval for a subdivision . g ) Planning Board did not receive its ' copy of the proposed Sanitiation Code until recently due to a postal problem . h ) New code will grant approval for sand filter systems , unlike the old one . i ) Discussion followed on Article 6 , Sewage Disposal , Section 3 , paragraph D , of proposed code . 3 . Two more lots have been added to the proposal , total - ing 8 lots in the proposed subdivision . D . Hardie enquired if this is different from what we saw last year ; Mr . Volbrecht replied , " yes " . 4 , Access roads are being proposed . 5 . 138 . 6 ' frontage for proposed lots not in accordance with Health Depart code . D . Discussion 1 . There is no record of a request for a preliminary plat with the PB , Zoning Officer , or County Clerk . 2 . Mr . Volbrecht felt that 4 minor subdivisions became a major subdivision . 3 . Mr . Volbrecht was asked if he would like to have the PB consider his proposal as a major subdivision . His answer was "yes " . 4 . Therefore , tonight ' s discussion may be considered "informal discussion " in compliance with Step I . 5 . Presently , on his approved lots , Mr . Volbrecht has 2 sand filters and 1 fill system . 6 . The map seen tonight cannot be construed as a sketch plan . E . Need to have : 1 . Road layout a ) exit on Rte . 34 b ) exit on Drake Rd . c ) egress from Drake Rd . to back area 2 . Drainage information a ) what there will be b ) what direction will flow c ) culverts d ) position of future sewers ? e ) will there be drainage into 'creek? 3 . Woods a ) location now b ) how expect to be left 2 - IV , Ordinance Officer - N . Stanton A . Sign 1 . location - Asbury Church 2 . size - 3 ' x 5 ' suspended between 2 posts 3 . lighting - spotlight 4 . back 35 ' from center of road 5 . ordinance doesn ' t include churchs , but sign is in keeping with requirements for similar structures . 6 . Motion - B . Bement moved to approve the recommenda- tion of the Ordinance Officer . Seconded by F . Edmondson , carried unanimously . B . Flood Plain Zone 1 . The Ordinance Officer is recommending to the TB that the 1st floor or lowest level of any new structure in the Flood Plain Zone be built at 390 ' 2 . Motion ® It was moved to accept the recommendation of the Ordinance Officer by D . Hardie , seconded by B . Bement , carried unanimously . C . Letter from National Flood Insurance Program 1 . plan to amend existing ordinance by 1 June 1977 2 . areas effected : a ) Section A , paragraph 1 ( resolution by TB ) b ) paragraph 7 ( subdivisions within Flood area ) c ) " 10 ( new ) ( all mobile homes in Flood area ) D . Thanks were extended to the Ordinance Officer , by the PB , for bringing the information . E . Building permit within Flood Plain Zone 10 application made by Mr . Worzell 411 2 . 1st floor at a.pprox , level of 394 ' V . Proposed revisions to the Tompkins Ctx . Sanitation Code A . Under discussion for 21- years . B , DEC requirements studied to prevent conflicts . Co Temporary residences - more coverage 1 . maintenance 2 . annual renewable permits D . Mobile Home Parks - more coverage 10 supervision of E . Individual residence requirements 1 . 200 ' road frontage 2 . 1 acre lot ✓ I . Planning Board secretary will request a copy of the Ordinance O fficer ' s monthly report from the TB , re : building permits . ✓ II .
