This information re - lates only to the requirements and procedures for MINOR Sub- divisions . For any subdivisions which cannot be classified as MINOR , PART 2 of the Town ' s Subdivision Rules and Regula - tions shall be applicable . ARTICLE I : TITLE Land Subdivision Rules and Regulations of the Town of Lansing , New York . ( ARTICLE II : PURPOSE • The purpose herein is to provide rules , regulations and stan- dards to promote the safe , sanitary and efficient subdivision of land within the Town ; to regulate such subdivision of land in a manner which will result in orderly growth and development , adequate provision of municipal services and the safe movement of vehicular and pedestrian traffic ; and to establish minimum standards and requirements by which land in the Town of Lansing is to be subdivided . ARTICLE III : DEFINITIONS 1 . Subdivision , GENERAL The division of any lot , tract or parcel of land into two or more parcels , lots , plots , tracts , sites or other divi- sion of land for the purpose , whether immediate or future , of transfer of ownership , whether or not new building or development is to occur . For the purposes of these rules and regulations , however , any parcel which is divided so as to create four or less parcels , each with an area of three acres or more and frontage of 300 feet or more , to be used for residential purposes and involving no new public or private roads , and no extension of public water or sewer service , shall not be considered a subdivision . Subdivision shall • include resubdivision in whole or in part of any plot , filed / or unfiled , which is entirely or partially undeveloped . 1 • ARTICLE III : DEFINITIONS ( Cont . ) la . Subdivision , MINOR : The subdivision of land into not more than four lots ( initial lot plus three new lots ) when any one of said lots would have an area of less than three acres or a frontage of less than 300 feet , and when each of said lots fronts on an exist - ing public street and does not require a new or ex- t ended street or road or the extension of public water o r sewer service . lb . Subdivision , MAJOR : Any subdivision of land not classified by the Planning Board as a MINOR subdivision . 2 . Lot Any parcel , plot , site or tract of land separated from o ther parcels , plots , sites or tracts by description as on a subdivision map , or record of survey map , or by metes and bounds , for the purpose of sale , lease , or sep - arate use . 3 . Sketch Plan (• Any drawing ( s ) of the proposed subdivision made with suf - ficient accuracy and detail to be submitted to the Planning Board for the purpose of discussion and classification in accordance with the provisions of these Rules and Regula- tions . • ARTICLE IV : PROCEDURE Sec . 400 . The Sketch Plan • A . The subdivider , prior to subdividing or resubdividing land shall submit four copies of a Sketch Plan of such proposed subdivision and supplementary material along with a written ✓ equest for approval , to the Town Clerk for transmittal to the Planning Board . Such Sketch Plan and written request ' shall be submitted to the Clerk at least five ( 5 ) days prior t o the Planning Board meeting at which it is to be con- sidered . All Sketch Plan submissions shall be accompanied by a fee of five dollars ( $ 5 . 00 ) . B . The Planning Board will classify each subdivision and will discuss with the subdivider suchaspects as existing de- • velopment , facilities and services , as well as those pro- posed by the community plan or otherwise contemplated . Z • • ARTICLE IV : PROCEDURE ( cont . ) Special community or site problems of which the Planning Board has knowledge should be discussed . Possible changes in the plan shall be discussed if it does not meet the objectives or standards of these regulations . Action on sketch plans shall be taken at a regular or special meeting and the Planning Board shall notify the subdivider of the action taken within ten days from such meeting . Reasons for failure to approve any Sketch Plan shall be attached to each copy of the Sketch Plan . C . The Planning Board may , before acting on any Sketch Plan , require the subdivider to submit any additional data deemed necessary . • D . If the Sketch Plan has been classified as a MINOR sub- division and has received Board of Health approval for any sewage disposal system proposed , if applicable , the Plan- ning Board shall waive the requirement for a Preliminary and Final Plat . When such waiver is granted the Planning • Board shall hold a public hearing on such Sketch Plan except as otherwise provided for in Section 400 . E . Within (• 45 days from the date of such hearing , the Planning Board shall approve with or without modification , or disapprove the Sketch Plan . An approved , Sketch Plan shall be endorsed and filed by the subdivider in accordance with Section 401 . E . If a MINOR subdivision contains no more than two lots ( initial lot plus one new lot ) the Planning Board may waive the requirement for a public hearing and approve the Sketch Plan immediately . If such waiver is granted the approved Sketch Plan shall be endorsed and filed by the • subdivider in accordance with Section 401 . F . After a subdivider has submitted four contiguous MINOR subdivisions to the Planning Board , any subsequent sub - division on the same street or on an intersecting street , submitted by said subdivider or his agent , may be classified • by the Planning Board as a MAJOR subdivision . If so clas - sified such subdivision shall require Preliminary Plat and Final Plat approval and submission of all data required • for such approval . ( See Part 2 : MAJOR SUBDIVISIONS ). Sec . 401 . Filing of Approved and Endorsed Plat A . After the Planning Board . has approved andendorseda Sketch Plan of a MINOR subdivision one copy of said endorsed Sketch Plan must be filed by the subdivider with the County Clerk . 3> f • ARTICLE IV : PROCEDURE ( cont . ) B . Any MINOR subdivision not so filed within 60 days from the date of endorsement shall be null and void . C . The subdivider shall also file one copy of the endorsed MINOR subdivision with the Assessor and one with the Planning Board . ARTICLE V : DESIGN STANDARDS Sec . 500 . Lots A . Each lot must have satisfactory access to a public street . Such access must consist of at least 100 feet of frontage at the right-of-way line of said public street unless zoning requirements are less restrictive . B . Minimum lot dimensions and areas shall be determined by the zoning ordinance for zoned areas and by the Tompkins County Board of Health requirements for all unzoned areas . C . In approving subdivisions in unzoned areas the Planning Board shall be satisfied that lot sizes of nonresidential lots are adequate to accommodate off - street parking and servicing required by the type of use contemplated . D . Insofar as practical , side lot lines shall be perpendicular or radial to street lines . E . Double frontage lots and extreme lot depth ( 3 times width ) shall be avoided if possible . F . Corner lots shall have extra width to permit front yard setbacks from both streets . Sec . 501 . Easements When a MINOR subdivision contains a drainage right -of -way the P lanning Board may require that a storm easement be provided with adequate width to permit access for cleaning and repair . 411 • ARTICLE VI : VARIANCES When the Planning Board finds that extraordinary and unreasonable hardship may result from strict compliance with these Rules and Regulations it may vary the regulations so that substantial • justice may be done . ARTICLE VII : MISCELLA.NEOUS Sec . 700 . Amendments • These Rules and Regulations may be amended after public hearing and approval by the Town Board as set forth by Section 272 of the Town Law and Section 130 of the Town Law . Sec . 701 . Violations and Penalties Please refer to PART 2 : MAJOR SUBDIVISIONS . Sec . 702 . Effective Date These Rules and Regulations shall take effect 10 days after being published and posted . • ( C • • • • • • • • ; C' • • •
