MOBILE HOME PARK ORDINANCE REVISIONS - B . Bement A . Explanation and discussion of proposed changes 1 . Article 8 . 3 - Soil and Ground Requirements The board felt the following correction should be made : a . Delete ° of no less than 2 " caliper . b . Add : Each lot shall be suitable landscaped to meet the needs of the community and environment . 2 . Article 11 . 2 - Electrical - The board felt the following addition should be made : Power lines in any park of more than 15 mobile home stands . . . . . in accordance with Fire Underwriters Specifications . 3 . The board felt an additional article should be added to provide for Planned Development Areas : Article 17 - Planned Development Area ( PDA ) The purpose of this Article is to introduce a flex- ibility in conventional land use and design regula- tions by employing performance criteria established to encourage development in an imaginative and in - n ovative manner while , through the process of review , discussion , insuring efficient investment in public improvements , a more suitable environment and pro - tection of community interest . This section recognizes that a rigid set of space ✓ equirements along with bulk and use specifications w ould frustrate the application of the Planned Development concept . Therefore , where this concept is deemed appropriate by the Town Board , the set o f conventional land use activities and area specifi - cations set forth elsewhere in this ordinance are hereby replaced by an approval process in which the Planning Board may consider innovative approaches to plans on parks of over 15 mobile home stands . B . MOTION : The motion to accept the revisions as discussed and to authorize B . Bement to present them to the Town Board for perusal and approval was made by L . Winter , seconded by L . Roscoe and carried by the board . III . RETIREMENT APARTMENT COMPLEX - V . Miller A . FHA funding will be sought 1 . preliminary study being made for FHA 2 . rural setting required by FHA 3 . 5% of units must be equipped for handicapped B . Size e 30 - 40 units IV . NY PLANNING FEDERATION • The board felt membership at this time was not the solution to the problems facing them and could be reconsidered at another time . V . COUNTY PLANNING BOARD A . Members felt it would be helpful to have a member of the CPB attend our meetings to provide professional expertise . 1 . Mrs . Miller will call Mr . Liguori and enquire B . MOTION : It was moved to approach the County Planning Board for some professional help in planning . Moved by D . Hardie , seconded by L . Roscoe , carried by the board . C . It was suggested that copies of the minutes of CPB might prove helpful to our members if they can be obtained . D . It was generally agreed that a staff person of some kind would be beneficial . 1 . L . Roscoe offered to see if a graduate student in planning would consider the position . • VI . DRAFT MINOR SUBDIVISION REGULATIONS - Mr . Neiderkorn A . MOTION : Mr . M . • • 41 SUBDIVISION RULES AND REGULATIONS TOWN OF LANSING PART 1 : MINOR SUBDIVISIONS NOTE : The following material is part of the Subdivision Rules and Regulations for the Town of Lansing . -This information re - lates only to the requirements and procedures for MINOR Sub- divisions . For any subdivisions which cannot be classified as MINOR , PART 2 of the Town ' s Subdivision Rules and Regula - tions shall be applicable . ARTICLE I : TITLE Land Subdivision Rules and Regulations of the Town of Lansing , New York . • ARTICLE II : PURPOSE The purpose herein is to provide rules , regulations and stan- dards to promote the safe , sanitary and efficient subdivision of land within the Town ; to regulate such subdivision of land in a manner which will result in orderly growth and development , adequate provision of municipal services and the safe movement of vehicular and pedestrian traffic ; and to establish minimum standards and requirements by which land in the Town of Lansing is to be subdivided . ARTICLE III : DEFINITIONS 1 . Subdivision , GENERAL The division of any lot , tract or parcel of land into two or more parcels , lots , plots , tracts , sites or other divi- sion of land for the purpose , whether immediate or future , of transfer of ownership , whether or not new building or development is to occur . For the purposes of these rules and regulations , however , any parcel which is divided so as to create four or less parcels , each with an area of three acres or more and frontage of 300 feet or more , to be used for residential purposes and involving no new public or private roads , and no extension of public water or sewer service , . shall not be considered a subdivision . Subdivision shall include resubdivision in whole or in part of any plot , filed or unfiled , which is entirely or partially undeveloped . • INN V t • h � r d • a 3 • ARTICLE III : DEFINITIONS ( Cont . ) la . Subdiv:ision , . MINOR : The subdivision of land into not more than four lots ( initial lot plus three new lots ) when any one of said lots would have an area of less than three acres or a frontage of less than 300 feet , and when each of said lots fronts on an exist - ing public street and does not require a new or ex- tended street or road or the extension of public water or sewer service . lb . Subdivision , MAJOR : Any subdivision of land not classified by the Planning Board as a MINOR subdivision . 2 . , Lot Any parcel , plot , site or tract of land separated from other , iparcels , plots , sites or . tracts by description as on a subdivision map , or record of survey map , or by metes and bounds , for the purpose of sale , lease , or sep - arate use . 3 . .. Sketch Plan • Any drawing ( s ) of the proposed subdivision made with suf - ficient accuracy and detail to be submitted to the Planning • Board for the purpose of discussion and classification in accordance with the provisions of these Rules and Regula- tions . ARTICLE IV : PROCEDURE Sec . 400 . The Sketch Plan • A . The subdivider , prior to subdividing or resubdividing land shall submit four copies of a Sketch Plan of such proposed subdivision and supplementary material along with a written request for approval , to the Town Clerk for transmittal to the Planning Board . Such Sketch Plan ' and written request ' shall be submitted to the Clerk at least five ( 5 ) days prior to the Planning Board meeting at which it is to be con- sidered . All Sketch Plan submissions shall be accompanied by a fee of five dollars ( $ 5 . 00 ) . B . The Planning Board will classify each. subdivision and will discuss with the subdivider such aspects as existing de- • velopment , facilities and services , as well as those pro - posed by the community • plan or otherwise contemplated . • • ARTICLE IV : PROCEDURE ( cont . ) Special community or site problems of which the Planning Board has knowledge should be discussed , Possible changes in the plan shall be discussed if it does not meet the objectives or standards of . these regulations . Action on sketch plans shall be takenat a regular or special meeting and the Planning Board shall notify the subdivider of the action taken within ten days from such meeting . Reasons for failure to approve any Sketch Plan shall be attached to each copy . of the Sketch Plan . C . The Planning Board may , before acting on any Sketch Plan , require the subdivider to submit any additional data deemed necessary . D . If the Sketch Plan has been classified as a MINOR sub - division and has received Board of Health ' approval for any sewage disposal system proposed , if applicable , • the Plan- ning Board shall waive the requirement for a Preliminary and Final Plat . When such waiver is granted the Planning Board shall hold a public hearing on such Sketch Plan except as otherwise provided for in Section 400 . E . Within • 45 days from the date of such hearing , the Planning Board shall approve' with or without modification , or disapprove the Sketch Plan . An approved Sketch Plan' shall be endorsed and filed by the subdivider in accordance with Section 401 . E . If a MINOR subdivision contains no more than two lots ( initial. lot plus one new lot ) the Planning Board may waive the requirement for a public hearing and approve the . , . Sketch Plan immediately . If such waiver is granted the approved Sketch Plan shall be endorsed and filed by the subdivider in accordance with Section, 401 . F . , After a subdivider has submitted four contiguous MINOR subdivisions 'to the Planning Board , any subsequent sub - . division on the same street or on an intersecting street , submitted by said subdivider or his agent , may be classified • by the ' Planning Board as a MAJOR subdivision . If so clas - • sified such subdivision shall require Preliminary Plat and Final Plat approval and submission of all data required for such approval . ( See Part 2 : MAJOR SUBDIVISIONS ). • See . 401 : Filing of Approved and Endorsed Plat • A . Any MINOR subdivision not so filed within 60 days from the date of endorsement shall be null and void . C . The subdivider shall also file one copy of the endorsed MINOR subdivision with the ' Assessor and one with the Planning Board . ARTICLE V : DESIGN STANDARDS Sec . 500 . Lots A : Each lot must have satisfactory access to a public street . Such access must consist of at least 100 feet of frontage at the right-of-way line of said public street unless zoning requirements are less restrictive . B . Minimum lot dimensions and areas shall be determined by the zoning ordinance for zoned areas and by . the Tompkins County Board. of Health requirements for all unzoned areas . C . In approving subdivisions in unzoned areas the Planning • Board shall be satisfied that lot sizes of nonresidential lots are adequate to accommodate off - street parking and servicing required by the type of use contemplated . D . Insofar as practical , side lot lines shall be perpendicular or radial to street lines . E . Double frontage lots and extreme lot depth . (3 times width ) shall be avoided if possible . F . Corner lots shall have extra width to permit front yard setbacks from both streets . Sec . 501 . Easements When a MINOR subdivision contains a drainage right -of -way the P lanning Board may require that a storm easement be provided with adequate width to permit access for cleaning and repair . Sec . 502 . Recreation Facilities Each subdivider shall be required to contribute to the Town ' s recreation facilities . For each lot in a MINOR subdivision the subdivider shall contribute $ 150 to the Town of Lansing to i • ARTICLE V : DESIGN STANDARDS ( cont . ) be held in a special fund for acquisition and development of recreation land . Money in this fund is to be used only for : 1 . The purchase of land that is suitable for new or enlarged parks , , playgrounds or open spaces and located so as to serve the inhabitants of the Town ' s residential neighbor- hoods ; 2 . The improvement of existing park , playground and open space lands which serve the Town ' s residential neighbor - hoods . ARTICLE VI : VARIANCES When the Planning Board finds that extraordinary and unreasonable hardship may result from strict compliance with these Rules and Regulations •4it may vary the regulations so that substantial justice may be done . ARTICLE VII : MISCELLANEOUS Sec . 700 . Amendments • • I . These Rules and Regulations may be amended after public hearing and approval by the Town Board as set forth by Section 272 of the Tot Law and Section . 130 of the Town Law . Sec . 701 . -Violations and Penalties Please refer to PART 2 : MAJOR SUBDIVISIONS . Sec . 702 . Effective Date ; These Rules and . Mobile Home Stand - no change Permanent Residence - no change Stand Area - no change ARTICLE 4 LICENSE AND TEMPORARY PERMITS 401 - no change 4 . 2 - no change 403 - Established Mobile Home Parks , as determined 411 by the Ordinance Officer , shall be issued , on adoption of this ordinance , a 60 day temp - orary permit by the Town Clerk . This permit may be renewed once by action of the Lansing Town Board . Before the expiration of the 60 day permit the park owners or manager , upon presentation of the Fire Underwriters Inspect - ion Certification of the electrical compliance and the Board of Health certification for sew - age disposal and water supply , will be issued a one year temporary Mobile Home Park license by the Ordinance Officer , This License may be extended 90 days by action of the Lansing Town Board , As early in this temporary license period as possible the Ordinance Officer shall inspect the park and report his findings , in relation to the ordinance , to the park owner or manager . In the event that the park owner or manager feels he is unable to correct deficiencies to comply with the ordinance he will confer with the planning board in these areas . The planning board will make recommendations as to what would be necessary to meet the intent of the or - dinance to the park owner or manager and furnish this information to the town board . A permanent Mobile Home Park License will be required upon expiration of the temporary Mobile Home Park license . The town board shall require the Ordinance Officer to re - view with the park owner or manager the re - commendations of the planning board and re - port on them to the town board before the expiration of the Temporary Mobile Home Park license . With this report the town board will then determine whether or not to cause a permanent license to be issued to the park by the Ordinance Officer . Failure by a park owner or manager to comply with these terms shall constitute a violation of the ordinance and subject the offender to the penalties as outlined in Article 17 . ARTICLE 5 APPLICATION FOR LICENSE OF NEN MOBILE HOME PARK • OR ADDITIONS TO EXISTING MOBILE HOME PARKS AND LICENSE RENEWAL FOR ALL PARKS 5 . 1 -- no change 5 . 2 -- The application and all accompanying plans and specifications shall be filed in dup - licate . The Ordinance Inspector , who shall be appointed by the Town Board , shall re - view the application and the proposed plans and specifications and shall forward a copy to the Planning Board for its re - view and recommendations with special em - phasis as to compliance with the object - ives of the General Plan . Within 45 days from the time of submission to the Board , the Planning Board shall hold a Public Hearing on the proposed park . Such recom- mendation shall be in writing and shall be completed within 30 days from the time of the Public Hearing . If the existing or proposed mobile home park will when con - structed or altered in accordance with such plans and specifications , be in compliance with all provisions of this ordinance , and all other applicable ordinances and statutes , the Ordinance Inspector shall approve the Temporary Permit .
